BLZ153677 153677 36x5x185 BCM Koori Mail PUBLIC NOTICE WAKKA WAKKA PEOPLE #3 AND WAKKA WAKKA PEOPLE #4 NATIVE TITLE AUTHORISATION MEETINGS The Wakka Wakka People have made two claimant applications to the Federal Court of Australia seeking recognition of their native title rights and interests under the Native Title Act 1993 (Cth). The claims are Wakka Wakka People #3 (QUD621/2011) and Wakka Wakka People #4 (QUD91/2012) (‘the Native Title Claims’). The claim areas are depicted in the Map below. The Wakka Wakka People #3 and the Wakka Wakka People #4 native title claim groups (‘The Wakka Wakka People’) are currently described as the Aboriginal people whose members identify as Wakka Wakka People, who are descended from the following ancestors: a) Jenny and David Carlo (parents of Princess Carlo); b) Minnie Bly (mother of Thomas Simpson), Ethel and Bill Button; c) Maggie Hart (mother of Crabbie Chapman and Henry Hart); d) Mother of Willie Boy Pickering; e) King Billy and Maria of Boondooma (parents of Tommy Dodd of Taabinga); f) Maggie West; g) Kitty of Boonara; h) MiMi; i) Kitty (mother of Jack Bulong); j) John Bond; k) Kitty (mother of Jenny Lind), Jenny Lind and Mick Buck; l) Boubijan Cobbo; m) Stockman Bligh and Aggie Bligh; n) Tommy (aka Boondoon) and Maggie (parents of Willie Bone), Billy McKenzie (father of Chlorine McKenzie), Chlorine McKenzie; o) Kate/Katie/Kitty Law; p) Emily of Degilbo, mother of Annie. AUTHORISATION MEETING #1 This notice invites all members of the Wakka Wakka People as described above to attend a native title authorisation meeting at the time, date and location below: Date: Saturday, 1 December 2018 Venue: Gayndah Shire Hall, 32/34 Capper Street, Gayndah Time: 9:30am (registration commencing at 9:00am) The purpose of Authorisation Meeting #1 is to: 1. CONSIDER anthropological materials and legal advice relating to an individual described as ‘Taabinga Harry’ and his descendants; 2. CONSIDER legal advice regarding the format of the claim group descriptions for the Native Title Claims; 3. Subject to #1 and/or #2 above, AUTHORISE the amendment of the claim group description for the Native Title Claims to: a) include the descendants of Taabinga Harry; and/or b) reformat the list of apical ancestors so that each Wakka Wakka apical ancestor is listed individually and in alphabetical order by first name. If the proposed amendments to the current claim group descriptions for the Native Title Claims are authorised, then the amended description of the Wakka Wakka People for each of the Native Title Claims will be: The Wakka Wakka People are those people who identify as Wakka Wakka People and are descended from the following ancestors: a) Aggie Bligh; b) Billy McKenzie (Father of Chlorine McKenzie); c) Boubijan Cobbo; d) David Carlo; e) Emily of Degilbo (Mother of Annie); f) Jenny Carlo; g) John Bond; h) Kate/Katie/Kitty Law; i) King Billy of Boondooma; j) Kitty (Mother of Jack Bulong); k) Kitty (Mother of Jenny Lind); l) Kitty of Boonara; m) Maggie (Mother of Willie Bone); n) Maggie Hart; o) Maggie West; p) Maria (Mother of Tommy Dodd of Taabinga and Alick Little); q) Mick Buck; r) MiMi; s) Minnie Bly; t) Mother of Willie Boy Pickering; u) Stockman Bligh; v) Taabinga Harry; w) Tommy (aka Boondoon). If the proposed amendment to the Native Title Claims to include Taabinga Harry as an apical ancestor in the claim group description for the Native Title Claims are made at Authorisation Meeting #1, then Authorisation Meeting #2 will be open to the Wakka Wakka people as newly described above. If the proposed amendment to include Taabinga Harry as an apical ancestor is not authorised, then Meeting #2 will be cancelled, and Meeting #3 will commence. AUTHORISATION MEETING #2 Date: Saturday, 1 December 2018 Venue: Gayndah Shire Hall, 32/34 Capper Street, Gayndah Time: To commence immediately after the conclusion of Authorisation Meeting #1. The purpose of Authorisation Meeting #2 is to: 1. AUTHORISE persons to be (or continue to be) the Applicant for the Native Title Claims to make the applications and to deal with matters arising in relation to the Native Title Claims; and 2. Subject to #1 above, AUTHORISE the newly comprised Applicant to make interlocutory applications under section 66B of the Native Title Act 1993 (Cth) for orders to replace the current Applicant. AUTHORISATION MEETING #3 Date: Saturday, 1 December 2018 Venue: Gayndah Shire Hall, 32/34 Capper Street, Gayndah Time: To commence immediately after the conclusion of Authorisation Meetings #1 and/or #2. The purpose of Authorisation Meeting #3 is to: 1. CONSIDER legal advice in relation to the proposed consent determination orders to be made in Wakka Wakka People #3 and Part A of Wakka Wakka People #4; 2. CONSIDER legal advice relating to the outcome of the Alternative Dispute Resolution process involving Part B of Wakka Wakka People #4; 3. AUTHORISE the Applicant to agree to settlement of Wakka Wakka People #3 and Part A of Wakka Wakka People #4 on the terms of a proposed consent determination tabled at Meeting #3; and 4. AUTHORISE the Applicant to make any amendments to the Native Title Claims as may be necessary in order to: a) Bring the Native Title Claims into alignment with the terms of the proposed consent determination orders, including to reduce the area of the land and waters claimed and amend the list of native title rights and interests claimed; and b) Comply with the outcome of the Alternative Dispute Resolution process involving Part B of Wakka Wakka People #4, including (if necessary) to reduce the area of the land and waters claimed in Part B of the Wakka Wakka People #4 claim area. INFORMATION SESSION An Information Session will be held the day prior to the Authorisation Meetings to assist the Wakka Wakka People prepare for, and make informed decisions at, the Authorisation Meetings. QSNTS is unable to assist individuals with accommodation or transport to/from the Information Session or Authorisation Meetings. However, a bus will be available for Cherbourg residents to attend the Information Session and the Authorisation Meetings. The bus will depart from the Cherbourg Aboriginal Council building, 22 Barambah Avenue Cherbourg at 7:15am each morning (on 30 November and 1 December 2018) and will depart Gayndah at a time to be advised following the closure of the information session and Authorisation Meetings, on each day. Morning tea, lunch and afternoon tea will also be provided on each day.
