    National Hispanic Leader Alleges Discrimination, Persecution by Government Agency

    Oakland, CA (July 20, 2005) A national Hispanic community leader is appealing to the public and U.S. LaborDepartment to stop another government agency from discriminating and retaliating against him. Dr. AlbertoRocha says that the Pacific Region Office of the Office of Federal Contract Compliance Programs (OFCCP) isattacking his reputation and career. He also says OFCCP Pacific Region managers have breached personnelregulations of the Labor Department and created an intimidating and hostile work environment at the Oakland

    District Office. This environment has caused fear, lowered employee morale and adversely affected the missionof the office.

    The situation is a sheer travesty in which a national Hispanic leader and good public servants of the OaklandDistrict Office are being terrorized and harassed by the Pacific Region management, according to Rocha,assistant district director of the Oakland office. Rocha is also the former National Chairman and Chief ExecutiveOfficer of National Image, which is proactive with employment, education, civil rights and other issues thatimpact the Hispanic community.

    They are currently attempting to fire me for my involvement in protected activities like taking a leadership role ina national non-profit community based organization, Rocha explains. With the community and severalcongressional offices concerned about the illegal treatment of us, the Department of Labor management inWashington D.C. should intervene and correct the problemor be made to correct the problem through thecourt of public opinion.

    Interestingly, the OFCCP is part of the U.S. Department of Labor's Employment Standards Administration. TheOFCCP is charged with ensuring that employers doing business with the federal government comply with theequal employment opportunity (EEO) and affirmative action provisions of their contracts.

    As the office responsible for contractor compliance with federal nondiscrimination laws and regulations, theOFCCP has a responsibility to be a workplace model for the private-sector contractors it oversees, Rocha said.

    With the appropriate attention, OFCCP can be made to function effectively.

    Rochas allegations of employee discrimination and harassment stem from incidents that began in 2002. Aftersuccessfully competing for the position of Assistant District Directorof the Oakland District Office, Rocha wasasked to relinquish his position as chairman of National Image by director, Woody Gilliland, director of thePacific Regional Department of Labor OFCCP Office, due to conflict of interest. Rocha refused, maintaining therequest violated his protected personnel practice.

    According to Rocha, Gilliland proceeded to harass himeven over trivial matters such as whether he couldinclude Ph.D. on his business signature and cards.
