INTRODUCTION This introduction is not part of tlie licence aiid does not purport to be a legal interpretation of the licence.

Rilta Eiivironniental Limited operate a hazardous waste treatment faciliry at Greenogus Business Park. Rathmole. County Dublin. The quantity of waste to be accepted at tlie facility is liiiiited to I 11.000 tonnes per aiuiuni consisting of hazardous waste. commercial waste. construction and demolition waste, industrial sludges and industrial waste.

The facility coinprises two niain buildings which house tluee distinct operations:

(1) Drum Recoverv Centre

Reconditioning or recycling of empty industrial packaging such as steel drunis. plastic drunis and intermediate hulk containers (IBCsI. There are 3 emission points to atmosphere from the Drum Recovery Centre.

( i i ) Hydrocarbon Waste Treatment Centre

Treatment, recovery of Iiydrocarhon-contaniiiiated waste from sources such as bilge tanks of ships. petrol stations aiid oil spills. Trade effluent arising from the waste treatment is discharged to sewer under the coii~ent of the Water Senices Authority (South Dublin County Council).

(iii) Hazardous Waste Transfer Station

Bulking up and transfer of liarardous waste (including asbestos and contaminated soil) for disposal recovery.

The licence revieu. was required to facilitate the setting o f a standard for processed fuel oil produced at this facility for use only i n the asphalt quarry sector as a substitute for hemy fuel oil. There is a requirement to assess the location of the infrastructure on-site to provide for the sezrezation of wastes.

This facility falls within tlie scope of h m e x I of Council Directive 96,61 EC concerning Integrated Pollurioti Prevenrioii and Control as tlie following actibity is carried on at tlie facility:

The Environniental Protection 4%e11cy is satistied. on the basis of the inforniation available. that subject to compliance with the conditions of this licence. any emissions from the activity will comply with and will not contravene any of the requirements of the Section 40(4 of the Waste Management Acts 1996 to 2010.

Condition 1. Scope

This licence has been granted in substitution for the licence granted to the licensee on 29th May 2008 (Register No WO192-02). The previous IPPC licence (Reg No. WO192-02) is superseded by this revised liceiice.

2. I. I The licensee shall eiiiploy a suitable qualified and experienced facility manager who shall be designated as the person in charge. The facility manaser or a nominated. suitably qualified and experienced deputy shall be present on the facility at all times during its operation or as othemise required by the Agency.

I .2 The liceitsee shall ensure that persounel perfomiing specifically assigned tasks shall be qualified on the basis of appropriate education. training and experience as required and shall be aware of the requirements of this licence. In addition. tlie facility manager aud his, her deputy shall successfully complete a FAS waste nianagement training programme or equivalent agreed by the Agency.

2.2 Environmental Management System (EMS)

2.2.1 The licerises shall maintain an Environmental Management System (EMS). EMS shall be updated on an annual basis.

The licensee shall maintain a Schedule of Enviroiimental Objectives and Targets. The schedule shall. as a minimum. provide for a rwiew of all operations and processes. including an evaluation of practicable options. for energy and resource efficiency. the use of cleaner technology. cleaner production. and the prevention. reduction and minimisation of waste and shall include waste reduction targets. The schedule shall include time frames for the achievement of set tarsets and shall address a tive-year period as a niiniuiuui. The schedule shall be rwiewed annually and amendments thereto notified to tlie Agency for agreement as part of the Annual Environniental Report (AER).

2.2.2.3 Eiivironmental Management Programme (EMP)

The licensee shall maintain an EMP. including a time schedule, for achieving the Environmental Objectives and Targets prepared under Condition 2.2.2.2. Once agreed the EblP shall he maintained by the licensee. I t shall include:

The EMP shall be reviewed annually and ammdments thereto notified to the Agcncy for agreement as part of the Annual Environmental Report iAER).

A report on the programme. including the success in nieeting agreed targets. shall he prepared and suhiiiitted to the Agency as part of the AER. Such reports shall he retained on-site for a period of not less than seten years and shall be available for inspection hy authorised persons of tlie Agency.

2.2.2.4 Documentation

( i ) The licensee shall maintain an eiiviroiiiiieiital management documentation system w4iicli shall be to the satisfaction of the Agency.

( i i ) The licensee shall issue a copy o f this liceiice to all relevant personnel whose duties relate to any conditio11 of this licence.

2.2.2.5 Corrective Action

The licensee shall establish procedures to ensure that correctiw action is taken should the specified requirements of this licence not be fulfilled. The responsibility and authority for persons initiating further investigation and corrective action in the event of a reported non-conformity with this licence shall be defined.

The licensee shall clearly allocate responsibility for the platining. niaiiazenient and execution of all aspects of this programme to appropriate personnel (see Condition 2. I abo\-e).

The licensee shall maintain a programme to ensure there is adequate control of processes under all modes of operation. The licensee shall provide and maintain an impern~eable concrete surface in all areas of the facility. The surfaces shall be concreted and constructed to British Standard 9 I IO or an alternative as ayreed by the Agency.

Traffic layout at the facility shall be such that emergency sewiices' vehicles shall I i ax access to a11 parts of the facility at a11 times.

Surface water run-off from areas other than the weighbridge and vehicle wash area shall be discharged to surface water drainage system.

3.8. I Tlie licensee shall provide and maintain a weighbridge and a vehicle wash area at the facility.

The vehicle wash area shall be used by all vehicles leaving the facility as required. to ensure that no wastewater or waste is carried off-site. All water from the weighbridge and vehicle wash areas (including surface water run-off) shall be directed to the wastewater drainage system.

The vehicle wash shall be inspected on a daily basis aud drained as required. Silt. stones and other accumulated material shall be removed as required kom the vehicle wash aiid disposed appropriately.

Tlie quantity of waste accepted at the facility on a daily basis shall not exceed the duty capacity of the equipnient at the facility.

3.9.3

3.10 The licensee shall provide a dedicated area in the Hydrocarbon Treatment Centre for tlie treatmeiit aiid storage of waste oils which shall include a waste inspection area. a waste quarantine area and dedicated waste oil aiid final product storage tanks. A drawing outliniiig the location of these facilities shall be agreed with the Agency prior to the shipment of reprocessed waste oil from tlie facility i n accordaiice with Condition 3.2 of this licence.

The licensee shall provide aiid use adequate lighting during the operation ofthe facility

The licensee shall install on all eniissioii points such saniplinx points or equipment. iiicludiiig any data-losging or other electrouic commuuication equipment, as niay be required by the Agency. A11 such equipment shall be consistent with the safe operation of all sanipling and monitoring systems.

3.13 In the case ofconiposite sampling of aqueous emissions from the operation of the facility. a separate coniposite sample or homogeneous sub-saniple (of sufficient volume as advised) shall be refiigerated imniediately after collection and retained as required for EPA use.

The licensee shall clearly label and provide safe and permanent access to all on-site sampling and monitoring points and to off-site points as required by the Agency. The requirement with regard to off-site points is subject to the prior agreement of the landowner(sl concerned.

Hazardous Waste Storage Areas. Tank, Sump. Container and Drum Storage Areas

Silt Traps and Oil Separators

The licensee shall install and maintain silt traps aiid oil separators at the facility to ensure that all storm water discharyes. aiid wastewater (excluding toilet aiid canteen wastewater) discharyes from the facility pass tluough a silt trap and oil separator in advance of discharge. For discharges to surface water. the separator shall be a Class I full retention separator which shall be fitted with a manual shut-off valve. For discharges to sewer, the interceptor shall be Class I1 till1 retention interceptor. The silt traps and separator shall be in accordance with I.S. EN-858-2: 2003 (separator systsnis for light liquids).

3.18.1 In the event of a tire or a spillage to storm water. the site storm water shall be diverted to the firewater retention tank.

The provision of a catchment system to collect any leaks tiom flanges and valves of all over- ground pipes used to transport material other than water shall be examined. The licensee shall at no time discharge or perniit to be discharged into the sewer any liquid matter or thing that is or may be liable to set or congeal at average sewer temperature or is capable of giving off any inflanunable or explosive gas or auy acid, alkali or other substance in sufficient concentration to cause corrosion to sewer pipes. penstock and sewer fittings or the general integrity of the sewer.

Materials classifiable as “Hazardous Wastes” nuder the Waste Managenient Acts 1996 to 2010. shall not be discharged to sewer.

Trade eftluent shall be screened prior to discharge to remove gross solids and avoid blockages i n the sewer.

The licensee shall ensure that the discharge shall 1101 contain dissolved methane. petroleum spirits or orgaiiic solvents (including chloriuated organic sohents) at concentrations which xvould give rise to flammable or explosive vapours in the sewer.

Non-trade effluent \vaste\vater (e.g. firewater. accidental spillages) which occurs on site shall not be discharsed to the sewer without the prior authorisation of the Water Senices Authority.

The licensee shall maintain. or have maintained. the effluent treatment system. to coniply with the requirenients of this licence. Records of iiiaintenance and desludging operations shall be kept on site for inspection purposes.

Condition 6. Control and Monitoring

6.1 Test Prograiiinme for the Waste Oil Treatment System

6.1.1 The licensee shall prepare to the satisfaction of the Agency. a test progranme for operation of the Waste Oil Treatment System to the specification required to produce reprocessed waste oil in this licence. This programme shall be submitted to the Agency in advance of inipleiiientatioii.

The programme. follou,ing agreement with the Agency. shall be completed within three months of the coiiinieiiceiiient.

The criteria for the operation of the waste oil treatnient system as determined by the test programme, shall be incorporated into the standard operating procedures.

In the event of ths malfunction of any continuous monitor. the licensee shall contact the .4gency as soon as practicable, and alternative saiiipling and nioniroring facilities shall be put in place. The use of alternative equipnient. other than in emergency situations. shall be as agreed by the Agency.

Monitoring and analysis equipment shall he operated and maintained as necessary so that monitoring accurately reflects the eiiiissiotldiscliarge (or ambient conditions where that is the monitoring oh.jectiue).

The licensee shall ensure that groundwater monitoring well sampling equipment is available installed on-site and is f i t for purpose at all times. The sampling equipment shall be to 4gency specifications.

All treatnient abatement aiid emission control equipment, including waste processing equipment and infrastructure. shall he calibrated (where relevant) and maintained in accordance with the instructions issued by the manufacturer supplier or installer.

The kequency. methods aiid scope of inonitoring. sampling and analyses. as set out in this licence. niay be amended uith the agreement of the Agency following evaluation of test results.

The licensee shall prepare a programme. to the satisfaction of the Agency. for the identification and reduction of fugitive emissions using an appropriate combination of best available techniques. This progranme shall he included in the Environmental Management Progranuiie.

The licensee shall carry out daily visual inspections of all bunded areas to detect any possible spillages. The licensee shall carry out weekly visual inspections to assess all bunds and hardstanding areas for stmctural soundness aiid cracking damage.

The integrity aiid water tightness of all underground pipes. t a k , sumps. building structures and containers aiid their resistance to penetration by water or other materials carried or stored therein shall be tested and demonstrated by the licensee. This testing shall be carried out by the licensee at least once every three years and reported to the Agency on each occasion. This testing shall he carried out in accordance with any guidance published by the Agency. A written record of all integrity tests and any niaintenance or remedial work arising from them shall be maintained by the licensee.

The drainage system (i.e.. gullies. manholes. any visible drainage conduits and such other aspects as may he agreed) and bunds. silt traps and oil separators shall be inspected weekly and desludged as necessary. All sludge and drainage from these operations shall he collected for safe disposal. The drainage system. bunds, silt traps and oil interceptors shall be properly maintained at all times.

All foul sewer gullies, drainage grids and manhole col-ers shall he painted with red squares whilst all surface w‘ater discharge gullies. drainage grids and nianhole covers shall be painted with blue triangles. These colour codes shall be maintained so as to he visible at all times during facility operation. and any identification designated in this licence (e.g. SWI) shall be inscribed on these niaidioles.

There shall be no direct wastswater discharge to sewer from the Drum Recovery Centre. Hydrocarbon Waste Treatnieiit Area and the Hazardous Waste Transfer Centre. without the prior agreenient of the Agency and the WSA. Wastewater from these areas shall he treated as hazardous xvaste unless it can he deliionstrated to be otherwise. Such wastewater shall be disposed of in a safe and appropriate niainier.

Storm Water

6.15. I A visual examination ofthe stonn water discharges shall be carried out daily. A log of such inspections. shall be maintained.

A representati\e sample of effluent shall he screened for the presence of organic compounds and heavy metals within twelve months of date of grant of licence and annually thereafter.

An inspection for leaks on all flanses and valves on over-ground pipes used to transport materials other than water shall be carried out weekly. A log of such inspections shall be maintained.

Noise

The licensee shall carry out a noise sumey of tlie site operations annually. The sumey progranuiie shall be undertaken in accordance with the inethodology specified in tlie ‘En\~ironmental Noise Sun-ey Guidance Document’ as published by the A g i c y .

Hydrocarbon Treatment Centre

6.19.1 The processing of aqueous and sludge waste at the facility shall be carried out as described in Section 2.3.2 Hydrocarbon Waste Treatment Centre of tlie EIS submitted to the Agency on 07th June 2007. unless otherwise agreed in writing by the Agency.

The processing of waste oil at tlie facility sliall be carried out as described in Attachnient D2 of this review application or as otherwise agreed in writing by the .r\geiicy having regard to the requirements of this licence.

The heating of waste oils shall be carried out at tlie appropriate temperature so as to avoid their combustion. A safety cut off temperature detection unit shall be installed on the oil heating talks and calibrated annually.

Treatment of waste in the Hydrocarbon Treatnieiit Centre shall cease in tlie event o f a breakdown of the on-site wastewater treatment system and wastewater shall be stored for reiiioval off-site for disposal at an authorised facility to be agreed with the Agency.

The substance and, or wastes to be included in the PRTR shall be as agreed by the Agency each year by reference to EC Regulations No. 166 2006 concerning the establishment of the European Pollutant Release and Transfer Register and amending Council Directives 91 689 EEC and 96 61 EC. The PRTR shall be prepared in accordance with any relevant guidelines issued by tlie Agency and shall be submitted electronically in specified format and as part ofthe AER.

The licensee shall niaiiitaiii a Data Management System for collation. archiving. assessing and graphically presenting tlie monitoring data gemrated as a result of this licence.

Waste shall be accepted at the facility only from known customers or new customers subject to initial waste profiling and waste characterisation off-site. The writtcn records of this off-site waste profiling aiid characterisation shall be retained by the licensee for all active custoniers and for a two year period following termination of licensee customer agreciiients.

Waste Repackaging

Any leaking or otherwise ruptured druuis or containers shall he overdrummed or the contents transferred to a sound container in a nianner which will not adversely affect the environnient. This operation shall only he carried out in hunded areas such that any spillage arising from tlie activity inay he contained and collected.

All operations involving the transfer of contents referred to in Condition 8.14. I shall take place indoors. protected against spillage. in a designated area to he agreed with the Agency. 8.15.1 Unless approved in writing. in advance. by the Agency tlie licensee is prohibited from mixing a hazardous waste of one category with a hazardous waste of another catspory or with any other non-hazardous waste.

Blending. mixing or hulking up of hazardous solids or liquid waste shall only he carried out inside the Hazardous Waste Trausfer Station.

The compatibility of wastes to he hulked-up shall he established prior to such hullclng up takins place. The procedures to be in place under Condition 8.1 1.2 shall consider any coiiipatihility testing that niay he required. including. as far as is possible. the identitication of any potentially ahnomial or unusual situations.

Only those u'astes assigned Disposal Recobery Code "Treatnient D9" as listed in .4rtachnient H.1 of the application niay he treated at tlie Hydrocarbon Waste Trsntnient Centre. unless otherwise agreed by the Agency. No other waste shall he accepted for treatment at the Hydrocarbon Waste Treatment Centre without the prior written approval ofthe Agency.

Agency Charges

12. I . I The licensee shall pay to the Agency an annual contribution off19.394. or such suni as the Agency from time to time determines, having rezard to variations in the extent of reporting. auditing. inspection. sampling and analysis or other hnctions carried out by the Agency. towards the cost of nionitoriny the activity as the Agency considers necessary for the perfomiance of its hnctions under the Waste Management Acts 1996 to 2010. The first payment shall be a pro-rata amount for the period from the date of grant of this licence to the 3 1" day of December. and shall be paid to the Agency within one month tioni the date of grant of the licence. In subsequent years the licensee shall pay to the Aeency such revised annual contribution as the Ayency shall tkom time to time consider necessary to enable perfomiance by the Agency of its relevant functions under the Waste Management Acts 1996 to 2010. and all such payments shall be made within one month ofthe date upon which demanded by the Agency.

In the event that the tiequency or extent of monitoring or other functions carried out by the .Agency needs to he increased. the licensee shall contribute such sums as deteniiined by the Agency tu defray its costs in regard to itenis not covered by the said annual contribution.

Water Senices Authority Charges

The licensee shall pay to the Water Senices Authority an annual monitoring charse o f € l , l 5 0 and such other suni as may he deteniiined from time to time. ha\,ing regard to the variations in the cost of providing drainass and the variation in effluent reception and treatnient costs. Payment to he made on demand.

Environmental Liabilities

The licensee shall as part of the AER, provide an aiuiual statement as to the measures taken or adopted at the site in relation to the prevention of environmental damage. and the financial provisions in place in relation to the underwriting of costs for remedial actions following anticipated events (including closure) or accidents. incidents. as may be associated with the carrying on of the activity.

12.3.2 The Environniental Liabilities Risk Assessment (ELIL.2) shall be reviewed as necessary to reflect any significant change on site, and in any case every three years following initial agreement. The results of the review shall be notified as part of the AER.

As part of the measures identitied in Condition 12.3.1. the licensee shall, to the satisfaction of the Agency. make financial provision tn cover any liabilities identitied in Condition 12.3.2. The amount of indemnity held shall be reviewed and revised as necessary. but at least annually. Proof of renewal or revision of such financial indemnity shall he included in the annual 'Statement of Measures' report identified in Condition 12.3. I
