SOFTENED/ERODED, ~STRONGLY RECOMMEND THAT EARTHWORK CONSTRUCnON BE COMPLETED IN THE DRY SEASON (TYPICALLY APRIL 1 - OCTOBER 31). WHILE ~T SEASON CONSTRUCnON IS TECHNICALLY FEASIBLE, INCREASED COSTS ASSOC/A TED WITH UNSUITABLE SOIL REMOVAL, ADDlnONAL GROUND WATER AND SURFACE WATER CONTROL, AND EROSION CONTROL SHOULD BE EXPECTED.

Project Success & ComplianceCriteria for SuccessUpon completion of the proposed mitigation project, an inspection by a qualified wetland professional will be made to determine plan compliance. A compliance report will be supplied to the City of Kirkland within 30 days after the completion of planting. A qualified wetland professional will perform condition monitoring of the plantings annually in the fall. A written report describing the monitoring results will be submitted to the City after each site inspection of each monitored year.

Definition of SuccessThe planting areas shall meet the following performance standards:

a) End of Year 1: 100 percent survival of newly planted species,b) End of Year 3: at least 90 percent survival of installed plant species,c) End of Year 5: at least 80 percent survival of installed plant species and at least 80 percent aerial coverage by the installed species, native volunteers, and ground cover.d) There shall be less than 15 percent cover of invasive plant species for all five years post-installation.e) Existing installed plants downslope of the new outfall will have at least 90 percent survival for all five years after project completion.

MaintenanceThe mitigation area will require periodic maintenance to remove undesirable species and replace vegetation mortality. Maintenance shall occur in accordance with the approved plans. Maintenance may include, but will not be limited to: removal of competing grasses (by hand if necessary), irrigation, fertilization (if necessary), replacement of plant mortality, and the replacement of mulch for each maintenance period. Chemical control, only if approved by City staff, shall be applied by a licensed applicator following all label instructions.

Duration and ExtentIn order to achieve performance standards, the contractor shall be responsible for maintaining the mitigation area during the first monitoring year. The City of Kirkland shall be responsible for maintaining the mitigation area for the remainder of the five-year monitoring period (years 2 through 5). Maintenance will include: watering, weeding around the base of installed plants, pruning, replacement, re-staking, removal of all classes of noxious weeds (see Washington State Noxious Weeds List, WAC 16-750-005) as well as Himalayan blackberry and reed canary grass, and any other measures needed to ensure plant survival.

SurvivalAt the end of the first growing season (year 1), any plant mortality will be replaced under the contractor's guarantee. The City of Kirkland will be responsible for replacing dead plants as needed for years 2-5. A growing season for these purposes is defined as occurring from spring to spring (March 15 to March 15 of the following year). For fall installation, the growing season will begin the following spring.

Installation Timing for Replacement PlantsReplacement plants shall be installed between October 15 and March 15, unless otherwise determined.

Standards for Replacement PlantsReplacement plants shall meet the same standards for size and type as those specified for the original installation, unless otherwise directed by a qualified professional.

ReplantingPlants that have settled in their planting pits too deep, too shallow, loose, or crooked shall be replanted.

Herbicides / PesticidesUnless deemed absolutely necessary by the consulting biologist and/or the City, chemical controls shall not be used in the mitigation area, critical areas, or their buffers. Any chemical controls used shall be applied by a licensed applicator following all label instructions.

Irrigation / WateringWater should be provided during the dry season (July 1 through October 15) for the first two years after installation to ensure plant survival and establishment. A temporary above ground irrigation system, sprinklers and hoses, and/or water truck should provide water. Water should be applied at a rate of 1” of water twice per week for year one and 1” per week during year two.

Contingency PlanIf 20 percent of the plants in the enhancement area or the additional monitoring area downslope of the new outfall are severely stressed during any of the inspections, or it appears 20 percent may not survive, additional plantings of the same species may be added to the planting area. Elements of a contingency plan may include, but will not be limited to: more aggressive weed control, pest control, mulching, replanting with larger plant material, species substitution, fertilization, soil amendments, and/or irrigation.

PROJECT DESCRIPTIONThis project represents phase 1 (“CIP 1”) of a three-phase project with the goal of improving stormwater drainage facilities in the Goat Hill area of Kirkland. Stormwater drainage is problematic in the Goat Hill area. Water velocity during times of high rainfall contributes to flooding and erosion in multiple areas on the hillside. Improved drainage and updated infrastructure is needed to protect property and for public health and safety. The proposed plan retains all existing open stream channels and will reduce channel erosion that occurs during high rainfall events.

Areas that are disturbed during construction will be restored to their original pre-construction condition. Most of these impacts involve existing paved areas, which will be re-paved following construction. Because the City of Kirkland was not able to secure an easement to upgrade an undersized culvert that outflows to Stream F, a new outfall and associated storm drainpipe will be constructed in the buffer of Wetland E to accommodate excess flows. The proposed location of the additional outfall is approximately 280 feet east of the existing outfall at Stream F. The alignment of the storm drainpipe associated with the new outfall has been designed to minimize disturbance to buffer vegetation by locating it beneath an existing paved walking trail. Native plants tolerant of moderately wet conditions will be planted around the new outfall structure to facilitate infiltration of water and to provide screening. Surrounding buffer vegetation that is disturbed during construction will be re-planted with appropriate native species. Wetland E and its buffer were part of a recent restoration project and are being monitored under a current USACE Section 404 permit. An area downslope of the new outfall will be monitored as part of the current project and if any mortality occurs as a result of a change in hydrology, it will be replanted with appropriate native species.

BUFFER MITIGATION SUMMARYThe applicant is proposing 13 square feet of wetland buffer enhancement as mitigation for permanent buffer impacts associated with the proposed stormwater outfall. Additionally, 368 square feet of temporarily impacted wetland buffer will be restored following construction. These mitigation measures result in a 1:1 mitigation ratio for permanent and temporary buffer impacts. Restoration will take place in the buffer of Wetland E and will be planted with the species listed below. Willow whips will be planted downslope of the new bubble up outfall structure. The other species will be planted upslope of the outfall structure and at the western edge of the trail. Narrow areas directly adjacent to the trail that are temporarily disturbed will be re-mulched. If any existing plantings on either side of the trail are disturbed during construction they will be replaced with the same species.

PROJECT MONITORING PROGRAMPursuant to KZC 90.55(4), the following monitoring program has been designed to ensure success of the proposed mitigation measures.

Requirements for monitoring project:1. Initial compliance/as-built report2. Semi-annual site inspections (twice per year in the spring and fall) for five years3. Annual reports (one report submitted in the fall of each monitored year)

Purpose for MonitoringThe purpose for monitoring this mitigation project shall be to evaluate its success. Success will be determined if monitoring shows at the end of five years that the definitions of success stated below are met.

MonitoringMonitoring shall be conducted semi-annually by a qualified professional for five years in accordance with the approved mitigation plan. The monitoring period will begin once the City receives written notification confirming the mitigation plan has been implemented and City staff inspects the site and issues approval of the installation.

Vegetation MonitoringSampling points will be established for vegetation monitoring and photo points will be established from which photos will be taken throughout the monitoring period. Permanent sampling points must be identified on the mitigation site plans in the first monitoring report (they may be drawn on approved plans by hand). Each sampling point shall detail herbaceous, shrub, and tree coverage. Monitoring of vegetation sampling points shall occur annually between May 15 and September 30 (prior to leaf drop), unless otherwise specified.

Photo pointsAt least one permanent photo point will be established within the mitigation area. Photographs will be taken from this point to visually record condition of the enhancement area. Photos shall be taken annually between May 15 and September 30 (prior to leaf drop), unless otherwise specified.

Monitoring Report ContentsMonitoring reports shall be submitted by October 31 of each year during the monitoring period. As applicable, monitoring reports must include descriptions / data for:1. Site plan and vicinity map2. Historic description of project, including date of installation, current year of monitoring, restatement of mitigation / restoration goals, and performance standards3. Plant survival, vigor, and areal coverage for every plant community (sampling point data), and explanation of monitoring methodology in the context of assessing performance standards4. Observed wildlife, including amphibians, avians, and others5. Assessment of nuisance / exotic biota and recommendations for management6. Color photographs taken from permanent photo-points that shall be depicted on the monitoring report map
