2 OBJECTIVES

2.1 Overall Objective This project aims to achieve an efficient land administration system complying with European standards and to update and harmonize land registry and cadastre records for all Municipalities of Croatia. The objective of the intervention is to radically improve the real-estate property market by addressing constraining aspects of the supporting infrastructure related to the real-estate property registration system in the municipal courts and the cadastre offices.

2.2 Project Purpose The PHARE Project on Modernization & capacity building of integrated land administration system in Croatia should support process of detail need assessment for modernization of cadastral and land registry offices including ICT need assessment and deliver harmonized data between cadastre and land registry for especially chosen 324 Municipalities in North Western Croatia (Slavonia) targeting 12 Land Registry Courts and 13 cadastral offices.1 Cadastre and Land Registry data in Slavonia are considered as “good” and applicable to be transferred in to Integrated Land Administration System (ILAS) by the mean of the harmonization procedures (cost effective). The overall purpose of this project is to increase capacity of the institutions responsible for the property (State Geodetic Administration – SGA) and ownership (Ministry of Justice – MoJ) registration and deliver support to other subjects – governmental bodies, performing their tasks in execution of governmental and accession tasks as well as to execute pilot projects which should give solutions for solving specific problems in running both registers. On the national level a CROPOS – Croatian positioning service – based on satellite based positioning and navigation service network of permanent station covering whole Croatia should be established. CROPOS will be used as a reference system for all state survey and cadastre measurements in a new Croatian reference system (conform to EUREF recommendation) A study on agricultural land classification will be used to give answers and procedures how to harmonize national classification of agricultural land with the EU classification for the purpose of future preparation of IACS. A detailed need assessment of equipment and office modernization needs will be carried out for the 218 LR and cadastre offices at national level for the further development of the ICT infrastructure (PHARE 2006). Beside the inventory, results of this work will be also used to the decision making regarding future reorganization (rationalization) of the office network.

2.3 European Partnership and NPAEU priority The cadastre and land registration sector provides essential services within a market economy and play a large part in supporting the four freedoms: movement of goods, services, people and capital. Requirements for candidate countries to become full members of the Union were established at the European Council meeting held in June 1993 in Copenhagen. These criteria are of an economic, political and legal nature. The first economic criterion is the existence of a market economy. The market economy depends on the free operation of markets for production factors, the liberalization of trade and of prices, the absence of important barriers for entry to or exit from the market and the proper functioning of the legislative system including guarantees of ownership rights. The objective of the intervention is fully in compliance with the 2004 priority of EP concerning Economic Criteria i.e. “Accelerated land reform and in particular … through the establishment of a modern and efficient cadastre and land registry to eliminate the current obstacles to the development of land and housing markets”. The wider objective is in compliance with the priorities contained in the "National Program of Preparation for EU Membership" including point:

Accelerating the process of regularisation and updating of land registers, and the reconciliation of land registry and cadastral records with the actual situation; attracting more foreign and domestic investment, and speeding up the privatisation of state-owned agricultural land. 1.2. DEMOCRACY AND THE RULE OF LAW 1.2.1. Judicial Reform According to the National Program of Republic of Croatia for Accession to European Union (NPAEU, MEI 2005) reform of judiciary and especially reform of land registration (and connected cadastre system), chapter 1.2.2, page 40, is major political and economical priority for the Republic of Croatia on its way towards European union.

3 DESCRIPTION

3.1 Background General The Republic of Croatia has had a parcel (plot) based land registration system and an associated cadastral system since the nineteenth century. Cadastral records are held at municipal level cadastral offices (CO), decentralized regional and branch offices of the SGA, in total 112 offices, while the land registry function is held by the 106 Land registry offices (LRO) of the Municipal Courts. Part of the rationale for the project is the need to reconcile the differences in the content of the two registers and to update these registers to reflect the true status on the ground. To create a more integrated system in order to overcome the problems which are currently having a detrimental affect on the development of the land market, and hence the Croatian economy as a whole. The most urgent requirement, in support of the need to enhance the efficiency of the land market, is to provide prospective and existing land and property owners with a more efficient, updated and reliable service. The potential value to the economy is huge. Cadastre The SGA, which reports to the Ministry of Environmental Protection, Urban Planning and Construction, is responsible for the maintenance and development of the cadastre in Croatia. The SGA took present responsibility in 1999, under the new Law of State Survey and Real Estate Cadastre3 (LSSREC). Before this time the maintenance of cadastre was the responsibility of counties. The SGA is administered from its HQ in Zagreb, and has a

network of 20 regional (county) and 92 branch offices. The Zagreb City cadastre office is independent (organizationally) city authority aside of SGA, obliged to obey legal and programmatic instructions from the SGA. Throughout Croatia the majority of cadastral plans in use are still those created in the 19th century and understandably these are often inaccurate, out of date, and physically fragile. As far as the cadastral component is concerned, updating these maps and then improving the linkage with the land register will be the main focus of the intervention. Recently, according to the National Program on State Survey and Real Estate Cadastre for period 2001-20054 (Program), substantial systematic cadastre resurvey activities are executed in Croatia as well as digitalization of data (cadastral maps). In period 2001-2005 (figures for 2005 estimated) through the Program financial resources in height of 67 mil. € have been mobilized from the national budget (SGA) and various co-financiers (regional and local governments, public enterprises, citizens). Land Registry 106 Land Registry Courts are established in Croatia under direct jurisdiction of the Ministry of Justice. Inefficiencies and inaccuracies affect the real property registration system: data in Land Registry are not harmonized with Cadastre data, registration numbers differ, Land Register records need to be updated, replaced and corrected, information is often inaccurate and or incomplete, heavy backlogs affect the efficiency and performances of land registry offices, procedures and management practices are not harmonized and vary in their degree of efficiency, the legal and regulatory framework need to be modernized and upgraded, offices are understaffed and responsibilities need to be redefined. Issues to be addressed include an improved institutional co-operation, a more active role of MoJ in supervision and monitoring LRO all over the Country, and the introduction of a modern electronic data processing for LRO and cadastral offices. In conjunction to SGA’s cadastral activities systematic renewal of the land registry and massive digitalization of the land registry records is executed. Real Property Registration and Cadastre Project Following the above mentioned Program and need to urgently address land administration bottlenecks and to reform the sector a comprehensive feasibility study was carried out in 2002 to assess land registry and cadastre in Croatia and design an intervention aiming to a modernized and efficient land administration system. The Real Property Registration and Cadastre (RPR&C) project was launched in 2003 and closing date is scheduled on September 2008. The total cost of the project is US$39.2 million, including a World Bank investment loan of US$25.7 million, US$6.6 million from the Croatian Government and a US$6.9 million grant from the European Commission (CARDS Program 2002 and 2003). CARDS 2004 support worth €4.5 million is under preparation. · Inter-institutional Operations, and Joint Information Technology · Project Management, Training and Monitoring The RPR&C Project is focused on four mayor activities, systematical renewal of cadastre and land registry for chosen localities (data in very bad condition, expensive procedures), development of joint information system – ILAS, its establishment (HW + SW purchase) and loading with initial data set (from national Program, RPR&C and PHARE activities), data digitalization (cadastral maps, land registry records, digital ortophoto maps production) and training and education activities for staff of both institutions and private sector involved. Last two activities are mainly financed by CARDS Program. The project following a relatively slow start, partly due to difficulties linked to inter-institutional coordination and setting up of the management unit (PIU), seems to have reached its cruising regime. Disbursement so far amounts to about 20% of the budget (mid 2005). A mid-term review is expected in early 2006. Cadastral measurements and GPS network All through Europe land measurement is implemented through National GPS (Global Positioning System) networks, in real time, with a high level of precision and low operational cost. In Croatia the majority of cadastral maps are yet heritage of the Austro-Hungarian period and level of precision tends to be respectively low. The use of terrestrial surveys and topographic triangulation slows down the process of measurement for land reform, increase sensibly its cost 5 and allows a margin of error not acceptable for a modernized cadastre and land registry (up to 3 m per measurement). Level of accuracy within blocks is generally acceptable (up to 30 cm) but tends to decrease sharply between blocks (1 to 5 m). Dishomogeneity within the territory is very high. Trough bilateral cooperation between F.R Germany and the Republic of Croatia, GTZ finalized project “Consultation for the establishment of the cadastral system in Croatia” assisted the SGA to the implementation of a feasibility study for a permanent GNSS network – CROPOS The study proved the implementation of CROPOS to be a cost-effective intervention for the implementation of an integrated land administration system that will speed up the process of land reform. Several secondary benefits are also expected for the numerous public and private applications of CROPOS. It is expected that the system will be compatible and adaptable to the GALILEO European satellite network when this will become operational6. Agricultural policy In order to become a member of the EU, Croatia has to fulfill a large number of obligations related to the Common Agricultural Policy. The harmonization of the data among land registry, the cadastre and the situation in reality presents the precondition for the state-owned agricultural land privatization. The future establishment of LPIS and

IACS system which is under the responsibility of the Ministry of Agriculture, Forestry and Water Management (MAFWM) will be based on the data from cadastre and land registry, without prejudging model which will be used. MAFWM and SGA are already collaborating in preparatory activities for development of LPIS and IACS. The activities related to the harmonization of classification of agriculture land in cadastre according to the EU standards have been prepared and will be done in close collaboration between MAFWM and SGA. Current situation All mentioned activities, national Program, RPR&C Project and proposed PHARE Project are organized to create grand picture of efforts in solving the obstacles in land administration system in Croatia. Together with a substantial process of institutional reform for land administration, results which are achieved till now show that undertaken activities are on the right tracks and they have reached its cruising speed. However additional support is urgently needed. Namely, Program and RPR&C project covers only 5% of national territory7 focusing on areas where only systematical renewal can solve the situation. PHARE intervention for modernization of land administration, especially Harmonization pilot project covers areas where such expensive measures are not necessary but procedures should be developed to enable needed harmonization. So PAHRE targets a region not covered by the WB/EU/Croatian Government sponsored intervention.

ILAS should become operational at the end of year 2007 at which time also Harmonization pilot project should deliver its results, and accordingly all prepared data for loading from national Program, RPR&C Project and PHARE harmonization will be ready. Digitalization of maps and records as well as establishment of ILAS is also necessary precondition for efficient reorganization/rationalization of both systems running the registers. To enable development which will avoid any redundancy in processes in cadastre and land registry and achieve its full automatization, both institutions, MoJ and SGA, are preparing further improvements of present legislation (which has already defined such path). This project addresses specific issues related to the harmonization of the Land Administration with the EU acquis (for instance in relation to the agricultural land classification).

3.4 Activities (including means)

3.4.1 R.1 – Capacity established for future effectiveness and efficiency usage ILAS system

Technical Assistance Services aim to provide an efficient support for the implementation of PHARE project “Modernization of land administration in Croatia” and to timely achieve the expected results. Services to be provided include: strategy advice to the land reform process, technical support to the modernization of land administration, achievement of training targets, coordination and inter-institutional linkages. The TA contractor and its long and short term experts will be ultimately assessed on performances related to achieved results and cost effectiveness. Technical Assistance services will seek sustainability through appropriate linkages with beneficiary institutions and the RPR&C project and a full support to capacity building at Municipality level. TA services contract will support the following activities:

• A detailed need assessment of equipment and office modernization needs will be carried out for the 218 LR and cadastre offices is expected to achieve the following outputs: − Survey of the 20 regional cadastral offices, 92 branch cadastral offices and

106 land registry offices. − Definition of harmonized standards to be achieved for each office typology. − Gap analysis and identification of cost effective solutions. − Specification of equipment to be supplied − Specification of improvement of offices (electrical and communication

wiring, eventual minor works required) − Elaboration of complete tender documents for services and equipment

supply, inclusive of plans, detailed technical specifications and specific requirements.

• Cadastre data concerning land use will be modified in a sample area, as a pilot test

to modify and standardize the agricultural land classification all over Croatia to meet EU requirements. The classification system will set the primary land classification for each of the uniquely identified land parcels within the cadastre. The classification will utilize the existing Croatian Land Classification System as a base, modifying it to meet the EU requirements and for any future use of the cadastre as the reference base for IACS.

• GPS procedures defined, training of staff and information spread to users and to

the broad public

• Training and capacity building of LR and Cadastre staff in the target area The project will have the following outputs:

• Need assessment for modernization of cadastral and land registry offices including

ICT need assessment presented;

• Assessment study of the utility and cost of re-classifying land use attributes for any future use of the cadastre as the reference base for IACS. 5 Municipalities in the pilot area applies the EU classification of agricultural land in cadastre books.

• Technological and operational know-how of GPS system transferred.

• Training and workshop in the target area executed.

3.4.2 R.2 - Land registry and cadastre data harmonized in selected region The impact of this result will be ability of loading harmonized data in to the IALS as well as direct availability of maps and land books in digital form, easier maintenance and transparency of land administration system. Services provided by the contractor for harmonization processes between land registry and cadastre do not include special tooling or equipment and service will be provided by contractor office. TA services contract will support the following activities: • Digitalization of all text data of Land Books (A, B and C) of the 12 Land Registry

offices targeted by the intervention and data will be loaded in “EOP_ZK” software, owned by the Ministry of Justice

• A total number of 6.497 maps will be vectorized. The services include vectorization of pre-scanned cadastral maps. Vectorized maps have to be delivered in defined data model together with comparison of vectorized maps with alphanumerical part of the cadastral data. Standardization of cadastral maps will be carried out in the targeted area and mentioned 3.001 maps should partly be standardized to defined standards since they have been vetorized earlier. The old and new mappings are examined and re-survey will be used for a fragment of the area where the situation on the ground is significantly different from that shown on the cadastral plans as an integral part of vectorization and standardization process. Ground survey will be needed for approximately 5% of the total area, some 400 ha.

• Harmonizing data between cadastre and land register system in selected parts of cadastral municipalities, meaning that unique parcel reference number (UPRN) will be introduced.

This TA contract will absorb some 36% of the total PHARE project resources allocated to land reform sector; the result constitutes a critical step in process of land administration modernization. The project will have the following outputs:

- All text data of land books of 12 land registry offices in the Pilot Area digitalized; - All Cadastral maps are vectorized, standardized, and between digital and existing

maps in the Pilot Area; Final quality improvement and partial re-survey completed in the Pilot Area;

- harmonized data loaded in to cadastre and land registry targeted database enabling full linkage and easy identification between registers (UPRN), also on the user level (e-government)

3.4.3 R.3 – CROPOS network established A GPS national network will be established to improve accuracy and efficiency of topographic measurements. The supply contract will include limited related services including, installation, calibration and training. Cost for the set up of the national GPS network is estimated at € 1.444.635. According to equipment of the 30 Reference Stations, the 5 of them are main stations implemented for auditing the whole system covering the territory of Republic of Croatia.

The list of GPS& ICT equipment and its technical specifications includes:

• Supply GPS&ICT equipment for 30 Reference Stations (Antennas, GPS receivers, antenna protections, USV 420…)

• Software of control station • Calibration and Quality control of the System (internal and external)

implemented.

3.4.4 Other results Beside direct results of the PHARE Project on land administration system in Croatia and synergic effect of all running activities (national Program, RPR&C Project, PHARE) there will be also indirect results of the project which will affect general picture, such as:

• through the general availability of data via internet (e-government) general transparency will be achieved,

• general transparency will reduce possibilities for corruption and enforce public control,

• general availability of the records connected with public awareness campaign, will increase knowledge of the citizens about the system and so further enforce sorting out of situation in registers,

• international networking and participation in EU harmonization efforts will be strengthen.

Implementation Unit which enabled efficient execution of procurement and minimal failure rate (1 tender cancellation on 50 in 2005). Activities are executed transparent and results are presented realistically as they are, even if sometime not everything was executed as foreseen. High level of communication and understanding has been developed between executing institutions what enabled that problems are detected and respectively solved in efficient way. Same openness has been introduced in execution of international projects. The donor co-ordination established in Croatia, based on regular annual donor conferences, distribution of information (Technical assistance matrix) and exchange of informations in preparation phases enabled do develop situation of mutual understanding and confidence. Also, since PHARE has successfully supported the process of land administration reform in other accession Countries. Lessons have been drawn from the case study of PHARE intervention in Hungary and Slovenia.

3.6.1 Hungary land reform: a case study of a similar PHARE intervention Conspicuous similarities can be observed with a comparable intervention carried out in Hungary where a “"Computerization of the Hungarian Land Registration" project was implemented between 1995 and 1997 with the contribution of PHARE resources. The following box sums up major recommendations.

PHARE support to Land Reform, cadastre and land registration in Hungary The intervention The support from the PHARE Program was mainly oriented on computerization and techniques for data acquisition. Many District Offices were equipped with Local Area Networks for the direct computerization of cadastral registers and maps. In most of the countries the registers are converted into computer files and a start is made with the digitizing and vectorization of cadastral maps. The PHARE authorities considered the cadastral program as rather successful. Conclusions and recommendations. • The need to reorganize Land Registry before beginning the computerization process.

• The modernization of land administration is a long and very expensive process. As such it

is recommended a long term commitment of the government to mobilize additional resources to those facilitated by the EU.

• Capacity building and staff training seem to be a key issue for the success and sustainability of the intervention

It should be noticed that in the case of Croatia these recommendations have been consistently applied: 1) the reorganization of Land Registry Offices and of Ministry of Justice is already launched and supported by the RPR&C project, 2) the Country has assigned a high priority and full political commitment to the land administration reform and 3) a substantial capacity building component have been in-built in the design of this

intervention and the RPR&C project is providing additional resources for training land registry and cadastre staff at national level.

3.6.2 National GPS network in Germany CROPOS design (feasibility study) is based on the experiences of the German National GPS network.

Within project Aufbau eines Katastarsystems in Kroatien - Machbarkeitsstudie für das permanente GNSS-Netzt of State Geodetic Administration and Deutsche Gesselschaft für Technische Zusammenarbeit GmbH, a study visit was organized to assist SGA staff in the learning process and to understand demands concerning preparation works, installation and maintenance of the system. During a study visit we had opportunity to see control station of SAPOS network in Bonn but also to see practical demonstration of system using in the field work. German colleagues gave us overview in every day tasks connected with system maintenance and their experiences in system management.

4 INSTITUTIONAL FRAMEWORK

4.1 Sustainability and ownership The project is a large and relatively complex intervention. One of its points of strength - but also a potential risk for a successful implementation - is its promotion of inter-institutional coordination. The institutional architecture of the intervention is designed to promote institutional linkages and avoid organizational barriers. The project objective to harmonize cadastre and land registry office data and operations demands a specific institutional set up where both beneficiary administrations, namely the Ministry of Justice for Land Registry and the State Geodetic Administration for Cadastre offices, will share the ownership of the intervention and jointly will be responsible for activities of management, supervision and steering. The institutional set up is summarized in the chart in the following page. Program Authorizing Officers will be designed for both institutions as detailed in § 6 below. A Management and Coordination Team will be set up to support implementation. This unit will be hierarchically attached to:

• The Geodetic Department of the State Survey Sector of the SGA • Land registry department, Civil law directory,Ministry of Justice.

Both departments will assure institutional responsibility guaranteeing sustainability of the intervention after completion of technical assistance services. SGA and MoJ departments will participate to PHARE activities to include: i) the technical management of the intervention, ii) activity implementation and follow up, iii)

contracts supervision and monitoring, iv) approval of contracts output and v) the evaluation of technical offers to tenders.

A couple of results, CROPOS and the EU classification of agricultural land, will be exclusively attached to the SGA and as such will be linked directly to the Geodetic Department, without co-responsibility of the MoJ. MAFWM will delegate staff which will participate in above project activites considering the EU classification of agricultural land study. Institutional changes A new sub-unit, CROPOS, will be opened within the department of “Fundamental Geodetic Works” FGW of SGA. Four staff will be recruited for the operation of the sub-unit and the maintenance of the system and will be attached to the control station in Zagreb. The sub-unit will be directly supervised by the head of FWG, Mr. Marijan Marjanovic. For the creation of the department internal regulation of SGA will be modified to provide allowances for the 4 new positions. Juridical department of SGA will be responsible for the modification of internal regulations. The procedure manual, to be established as a result of this intervention, will specify the organizational chart and structures, terms of reference for each post and will define the institutional set up for the operation of CROPOS. Close consultation will also be established with the Croatian Geodetic Institute, responsible for the quality control of the system and the testing of system components.

1. All investment sub-projects supported by PHARE must receive co-financing from national public funds. Minimum requirement for co-financing from national public funds is 25% of the combined PHARE and national contributions to the overall investment support.

2. Many Institution building projects will also have a degree of co-financing – this should be quantified and included wherever possible.

3. Expenditure related to equipment (regulatory infrastructure or ESC- related) and to Technical Assistance supporting investment (e.g. pre feasibility study / supervision of works / technical specifications) should be considered as Investment support in the project fiche.

4. All co-financing must be provided on a joint basis. Parallel co-financing will, in a principle, not be accepted. Exceptions to this rule have to be agreed with the Commission in advance.

5. All co-financing should be clearly quantified, also the degree of certainty of such co financing (i.e. for National Public Funds: is it already earmarked in local or national budget, for FIs Loans, private funds: are they already approved/ under appraisal, etc.).

6. Where parallel co financing is accepted and justified per exception to the normal rule it should be provided in monetary form. If this is not possible there should be clear criteria set out for the valuation of any non-monetary contributions (that should be quantified in the table).

7. If twinning is involved, clearly state the expected budget of the twinning covenant.

8. The financial engineering of the project should be closely monitored against actual delivery during implementation and against the objectives that were set in the project fiche so that corrective actions may be taken where required.

6 IMPLEMENTATION ARRANGEMENTS

6.4.1 TA services for a Integrated Land Administration System in Croatia Tender addressed to long and short term technical assistance services to include: − The project team will provide technical and administrative support, monitor and

manage the intervention, on-the-job training and capacity building sessions related to the modernization of land administration, specialized short term expertise.

- Need assessment for the equipment and modernization of cadastral and land registry offices completed

- Cadastre data concerning land use will be modified in a sample area, as a pilot test to modify and standardize the agricultural land classification all over Croatia to meet EU requirements. The classification system will set the primary land classification for each of the uniquely identified land parcels within the cadastre. The classification will utilize the existing Croatian Land Classification System as a base, modifying it to meet the EU requirements and for any future use of the cadastre as the reference base for IACS.

- GPS procedures defined, training of staff and information spread to users and to the broad public.

The tender will be addressed to companies specialized in technical assistance services and capacity building with specific know-how related to reform of land administration. The tender will be launched immediately after project start up.

6.4.2 TA service for harmonization process between land registry and cadastre data in the Pilot Area The project team will be responsible for tendering and follow up (supervision, coordination, linkages with other programs and training support) of the activities related to the pilot project of modernization land administration offices in Slavonia. The tender will be addressed to companies specialized in geodetic services with specific experiences in computerization of land administration data. This contract will cover most technical activities related to the computerization of cadastre (map vectorization) and land registry offices (data digitalization) and data harmonization in 324 Municipalities. Activities for the selected contractor will include

• Digitalization of land registry data • Vectorization of cadastre maps • Standardization • Map Improvement and ground control • Harmonization • Staff training

The tender will be launched within three months following Technical Assistance start up.

6.4.3 Supply - CROPOS network establishment

Measurement and ICT equipment for 30 Reference Stations and software of control station. Testing and quality control will be carried out after the complete installation of GPS and ICT equipment as well as basic training and education to staff which will be in charge of the system as well as documentation over the system provided. The Geodetic institute will carry out the testing of the network and quality control. The tender will be launched within three months following Technical Assistance start up.

8 EQUAL OPPORTUNITY

Based on the fundamental principles of promoting equality and combating discrimination, participation in the project will be guaranteed on the basis of equal access regardless of sex, racial or ethnic origin, religion or belief, disability, age or sexual orientation.

Specifically in relation to the issue of equality between men and women, Croatia’s population (2001 census) constitutes 51.87% women and 48.13% men, with those in active employment (based on Labor Force Survey statistics, conducted in accordance with ILO methodology, for the second half of 2002) divided 45.31% women and 54.69% men.

All contractors shall be requested to provide monitoring data recording the participation of men and women in terms of expert inputs (in days) and of trainees benefiting under the project (in days) as an integral component of all project progress reports.

9 ENVIRONMENT The modernization of the land administration system and the establishment of a national GPS network will not have a negative impact on the environment:

• No new building and or infrastructure will be built • Antennas for CROPOS and their supports are very short in size and will be fixed

on the existing buildings of the reference stations • No polluting substance is emitted as part of implementation or operation of the

network. On the other hand noteworthy environmental beneficial effects are expected as a result of project implementation:

• En efficient land administration system will allow an effective land property control and will limit non-authorized and illegal building thus reducing risks of negative environmental impacts in Croatia.

• The GPS network will be, as it is the case in other European Countries, an

excellent tool for LUP (Land Use Planning) and environmental management.

• Environmental monitoring through GPS measurements will prove to be more cost/effective and precise.

10 RATES OF RETURN Although the calculation of the rate of return is not applicable to this PHARE intervention for modernization of land administration, CBA (Cost benefit Analysis) has been carried out as part of the feasibility study for the RPR&C project. The intervention has a very contained cost / benefit ratio, due to the massive economic benefits that a functional land and real property market will have on Croatian economy. A specific study was also carried out by GTZ to establish the feasibility of a national GPS network, a result which will absorb an investment of about €1,5 M.

Costs of positioning will be reduced from the current 28,7 € to 11,8 € , with a decrease of 56%, thus making the new network a very cost effective investment. To appraise the economic and financial benefit stream should also be noted that a decreased cost of land measurements will ultimately benefit end-users who will have access to better services at lower prices. The implementation of the national GPS network will create new jobs not only in SGA but also in private companies because of investment savings for new equipment and increase of needs for new technologies, including ICT. In the economic impact should also be mentioned that CROPOS will make traditional topographical surveying an obsolete tool for many applications. Several operators will have to reconvert themselves and new investment in GPS equipment is to be expected, especially amongst the private sector.

11 INVESTMENT CRITERIA

11.1 Catalytic effect The Commission preliminary mission to Croatia set an accelerated land reform as one of the priority intervention areas. PHARE support to the modernization and harmonization of cadastre and land registration over 10% of municipalities in Croatia will permit to speed up the implementation of an efficient land administration system, a pre-requisite to carry out land reform and overcome current obstacles to the process. Although modernization of land modernization is likely to happen also without EU support, time of implementation would be stretched over a much longer period, with a significant negative impact on Croatia economy and the overall accession process. It should also be noted that this intervention is laying the basis for the future implementation of CAP and a correct operation of IACS which will need a modernized, efficient and updated structure of land classification and registration.

11.2 Co-financing Amount of co-financing is specified in the budget table, see § 5 above.

11.3 Additionality PHARE grant will not displace other financing. EU funding is complementary to a WB loan and will not displace this or other funds allocated to the land reform sector.

11.4 Project readiness and size Readiness The completion of feasibility studies carried out in preparation of the Real Property registration & Cadastre project (1992) provide a sound basis for the implementation of PHARE intervention. The Project Implementation Unit (PIU) of the RPR&C project has also developed strategies, procedures, training material, consultant terms of references, providing background support and on-the-shelf material for immediate project start-up. Existing elements of readiness:

• The broad and detailed preparation work carried out, • the sound institutional set up already in place, • the competent staff appointed for land administration reform by both the

Geodetic Administration and the Ministry of Justice, • Ongoing Real Property Registration and Cadastre Project ($ 37,5 M) underlines

the strong national and international commitment to land reform and improved land administration system in Croatia.

For the National GPS Network (CROPOS) a feasibility study financed trough bilateral cooperation between F.R Germany and the Republic of Croatia has been recently completed (May 2005). The State Geodetic Administration is currently actively involved in the selection and preparation of the cadastral offices to be selected, out of the existing network of 112 offices, to establish the 30 reference stations.

Size Land Reform program amounts to a total of € 5,526,158, thus making it eligible to EU pre-accession financing support.

11.5 Sustainability

11.4.1 Institutional sustainability The implementation of ICT installation is the main point of the SGA business plan as well as to rationalize the branch offices network providing one part of them in to “customer service point” witch will be digitally connected with land databases and explore files successfully.

11.4.2 Technical sustainability: Modernization of Land Registration and cadastre through data computerization and harmonization is well compatible with existing technologies. In this case technical sustainability is strictly linked with the capacity of the project to upgrade skills and know-how of land registration and cadastre staff at municipal level. A strong capacity building component has been included to provide necessary know-how.

The implementation of a national GPS network deserves also a brief assessment in terms of technical sustainability. GPS is a modern, globally applied and well tested tool. The creation of a national network is a pre-requisite to speed up a modern and efficient land administration system and the land reform process. Technical sustainability is also in this case ensured by the strong capacity building component included in the intervention. CROPOS will be established to comply with EU standards and is expected to be a tool lasting in the long term. After 2010 there will be the option to link the GPS network to the GALILEO satellite network.

11.4.3 Economical and financial sustainability. The land administration system, following project implementation, will become more efficient and cost effective. Recurrent costs attached to each query or operation will be drastically reduced thanks to more efficient practices and computerization. It is not expected that this intervention may lead to added operation expenditures at Municipality level. An exception should be raised for the establishment of the national GPS network of 30 stations, which will represent a significant additional operational cost. However the feasibility study shows how the overall significant reduction of measurement cost and the added revenues generated through the fares for users to access to CROPOS will largely compensate operational expenditure.

11.4.4 Environmental and social sustainability. No negative and social impacts are expected following the modernization of the land administration system. An overview of possible environmental effects related to the intervention are discussed in § 9 above.

11.6 Compliance with State Aid provisions The project is compliant with the state aid regulations in accordance with Articles 92(3)(a) and 92(3)(c) of the EC Treaty.

12 CONDITIONALITY AND SEQUENCING Pre-conditions Pre-conditions for the implementation of project are:

1. Institutional thorough commitment and assignment of full time staff in charge of

follow up activities for launching Phare intervention (assessment, preparation of tendering documents, inter-institutional communication)

2. Joint MoJ and SGA Steering Committee appointed (same as for Steering of the Real Property Registration and Cadastre Project)

RELEVANT LAWS AND REGULATIONS

Legal framework for harmonization and connecting all courts and cadastral offices The Land Registration Act is in force (Official Gazette 91/96), and articles 9-12 of the Law stipulate that the land registry books shall be based on the data obtained by the cadastral survey and that the designations of cadastral plots in the LR must be compatible to the designations in the land cadastre and cadastre maps. Article 10 of the LRA is especially important and prescribes that all changes of cadastral data should be recorded in the land registry books based on the resolution of the LR court which is based on the cadastral application sheet. The above mentioned law was amended in 2001 ((114/01) so the article 224 prescribes that the municipal state attorney's offices are obligated, before 1 January 2007, to initiate procedures for entry of property rights on real estates whose holder is the Republic of Croatia, while other not registered holders of property rights are obligated, before the same deadline, to initiate the procedure of registering their rights. Also, the Land Registry Rules of Procedure (Official Gazette 81/97) is effective, where the articles 94-99 in more details prescribe the manner of procedure with application sheets and all changes of cadastral data. The Law on State Survey and Real Estate Cadastre is also in force (NN128/99), which in articles 5, 64, 65 and 106 prescribes the manner of changing cadastral data and harmonization with LR status in the same way as the LRA. Based on Article 212 LRA and article 85 of LSSREC, MOJ and SGA will arrange structure and operation of LDB/JIS (Land Database or Joint Information System). MOJ passed the Rulebook on Internal Structure and Operation of the Land Database (Official Gazette 90/04), and on 10 May 2004 the Agreement on LDB between MOJ and SGA was signed. Legal framework for categorization of agriculture land Law on Agricultural Land (Official Gazette 66/01) in provisions of articles 23, 32 and 43 stipulates possibility of sale, lease or concession on agricultural land owned by the state, while the article 54 of the same Law determines that the units of local government should pass the program about disposing of agricultural land owned by the state for their area, and this program must contain total surface area of agricultural land owned by the state in that area, areas for restitution of property, for sale, concession and lease, surface areas should be determined according to the cadastral data.
