1198655-OSA A-310922F7004 CORE COMMUNICATIONS, INC.

- On 7/10/14, an Opinion and Order was entered addressing, inter alia, Exceptions in response to the Recommended Decision issued by ALJ Salapa. On 8/1/14, Core filed a Petition for Reconsideration and Clarification and Windstream PA filed a Petition for Reconsideration of the 7/10/14 Order. Since the 30-day period within which the Commission must act in order to preserve jurisdiction on the Petitions ended on 8/11/14, consistent with Pa. R.A.P. Rule 1701(b)(3), on 8/7/14, an Order was adopted and entered by notational vote to grant the two Petitions pending review of and consideration on the merits.

RECOMMENDATION:

That, consistent with 4 Pa. Code § 1.43(c), this action be recorded and entered in the minutes of this public meeting.

- Application filed on 4/12/12, seeking Commission approval to alter six crossings on Conrail's track in the City of Chester. An initial Secretarial Letter was issued on 6/29/12 and an Amended Secretarial Letter was issued on 9/20/12 which approved the Application. The following documents were filed in reference to the 9/20/12 Secretarial Letter: (1) T.I.B.C. Depot Partners filed a Petition for Issuance of a Declaratory Order on 3/31/14; (2) Conrail filed a Petition for Extension of Time on 4/11/14; and (3) Conrail filed a Petition to Amend Order on 4/29/14. That the Commission adopt the proposed Opinion and Order that, inter alia: (1) grants Conrail's Petition for Time Extension, nunc pro tunc; (2) grants Conrail's Petition to Amend Order; (3) deems Depot Partners' Petition for Declaratory Order to be moot.

MICHAEL PRENDERGAST VS PHILADELPHIA GAS WORKS

- Formal Complaint filed on 7/16/12, alleging that there were incorrect charges on his gas bill. On 8/9/13, ALJ Vero issued an Initial Decision which dismissed the Complaint, in part, and sustained it, in part. On 8/27/13, the Complainant filed Exceptions and on 9/9/13, PGW filed Replies to Exceptions. The Commission entered an Order on 2/27/14, which denied the Exceptions and modified the Initial Decision. PGW filed a Petition for Reconsideration (Petition) on 3/14/14. On 3/26/14, the Complainant filed an Answer to the Petition.

RECOMMENDATION:

That the Commission adopt the proposed Opinion and Order, which denies the Petition, in part, grants it, in part, and remands the matter for further hearings as deemed necessary.

By way of relief, the Complainant requested that the Commission order Frontier to fix his telephone lines and to issue an unspecified credit for substandard service. On 12/3/13, the Commission issued ALJ Barnes' Initial Decision that sustained the Complaint and ordered Frontier to pay a civil penalty of $1,000 for various violations. On 1/22/14 Frontier filed Exceptions. No Replies to Exceptions were filed.

RECOMMENDATION:

That the Commission adopt the proposed Opinion and Order that grants Frontier's Exceptions, reverses the ALJ's Initial Decision and dismisses the Complaint.

- Application filed on 6/27/13, to alter the pertinent crossing by the installation of a new aerial fiber optic cable. PPL agreed to perform the installation and no other party objected. The Commission issued a Secretarial Letter on 8/1/13 which approved the Application and set a deadline of 8/31/14 for the completion of the pertinent work. On 7/21/14, PPL filed a Letter-Petition for Extension of Time with reference to the 8/1/13 Secretarial Letter. No response to the Petition has been received.

That the Commission adopt the proposed Opinion and Order that: (1) grants PPL's Petition for Time Extension; and (2) modifies the 8/1/13 Secretarial Letter.

PPL ELECTRIC UTILITIES CORPORATION

- Petition filed on 8/23/13, for approval of a new Pilot Time-of-Use Program. An evidentiary hearing was held on 2/26/14. Main Briefs were filed on 3/21/14, and Reply Briefs were filed on 4/11/14. Also on 4/11/14, a Joint Petition for Partial Settlement was filed by PPL, the OSBA, the OCA, the Coalition for Affordable Utility Services and Energy Efficiency in Pennsylvania, the Sustainable Energy Fund, and Direct Energy Services, LLC. The Partial Settlement was actively opposed by the Dauphin County Industrial Development Authority. In a Recommended Decision issued 5/9/14, ALJs Colwell and Cheskis approved the Partial Settlement and rejected the position of DCIDA. Exceptions were filed by DCIDA on 5/29/14, and Replies to Exceptions were filed by PPL, OSBA, and FirstEnergy Solutions Corp. on 6/9/14.

RECOMMENDATION:

That the Commission adopt the proposed Opinion and Order, which approves the Partial Settlement, denies the Exceptions and adopts the Recommended Decision.

By Order of 7/28/14, the Application was denied on the basis that the Applicant failed to comply with the Commission's request for documentation. 2397029-OSA C-2013-2397029 LEONA OLIPHANT VS PHILADELPHIA GAS WORKS

- Formal Complaint filed on 12/11/13, wherein she requested that PGW be directed to restore her gas service and have the outstanding balance of her account paid through a payment agreement. PGW filed an Answer on 1/6/14 alleging, inter alia, that the Complainant is not eligible for a payment agreement. A telephonic hearing was held on 3/20/14 before ALJ Cheskis. ALJ Cheskis issued an Initial Decision on 6/4/14 in which he recommended that PGW be directed to reconnect the Complainant's service subject to certain conditions. PGW filed Exceptions to the Initial Decision on 6/24/14. No Reply Exceptions were filed.

RECOMMENDATION:

That the Commission adopt the proposed Opinion and Order which modifies the Initial Decision and finds PGW's Exceptions moot.

- Application filed on 1/14/14, for authority as a common carrier of household goods in use. Notice of the Application was published in the Pa. Bulletin of 3/29/14. Several entities filed a timely Joint Protest and the matter was assigned to ALJ Vero. The ALJ advised the Applicant to have an attorney file a notice of appearance on its behalf by 6/11/14. In her Initial Decision, issued on 6/17/14, the ALJ noted that Applicant had not timely complied with her directive on attorney representation and, as such, the ALJ recommended that the Application be dismissed. The Applicant filed the following documents on 7/7/14: (1) Exceptions to the Initial Decision; (2) a Petition to Reopen the Proceeding; (3) a Notice of Appearance by counsel for the Applicant.

RECOMMENDATION:

That the Commission adopt the proposed Opinion and Order that (1) grants the Applicant's Exceptions; (2) deems the Petition to Reopen the Proceeding to be moot; (3) reverses the Initial Decision; and (4) assigns the matter to OALJ for further proceedings.

- Per Letter of 5/2/14, the Commission's Bureau of Technical Utility Services (TUS) stated that it had reviewed the information submitted by the Petitioner relative to the Petitioner's request for a waiver from the requirement that vehicles used in limousine service be no more than eight model years old. 52 Pa. Code § 29.333(e). The 5/2/14 Letter denied the Petitioner's request because the application was untimely filed. On 5/21/14, the Petitioner filed a Letter-Petition for Reconsideration of Staff Action, with reference to the 5/2/14 Letter. No response to the Petition has been received.

RECOMMENDATION:

That the Commission adopt the proposed Opinion and Order which denies the Petition.
