Fully Updated to Reflect Changes Introduced by the America Invents Act (AIA)The first-inventor-to-file regimen, introduced by the AIA effective March16, 2013, has dramatically changed thecriteria for determining patentability ofinventions over the prior art through arevision of 35 U.S.C. §102. Yet, for many years to come pre-AIA §102 willcontinue to be applicable in determiningpatentability vel non of claims in manyU.S. patent applications filed both beforeand after March 16, 2013, and the validity of claims in issued U.S. patents.Accordingly, all patent attorneys andagents must be intimately familiar withboth pre-AIA and AIA §102 and knowwhich applies to any claim undergoingscrutiny.
PRG’s Winning Patents Workshop hasbeen updated to incorporate the changes,nuances, and ambiguities introduced by AIA §102 and the rules promulgatedby the USPTO for implementing the newlaw. Among the crucial considerationsthat will be thoroughly explored and ex-plained in the course are the following:
� How to determine whether pre-AIA or AIA §102 criteria are applicable inevaluating patentability of any claimedinvention over the prior art.
� The nuances and ambiguities stemming from the “otherwise availableto the public” provision added by AIA in new §102(a)(1).
� The five categories of exceptions inAIA §102(b)(1) and (2) that disqualify§102(a)(1) and (2) events from beingprior art to a given claimed invention,and the requirements for establishingsuch exceptions during prosecution ofapplications before the USPTO.
� The important, subtle differences between the “effective filing dates” ofclaims undergoing examination and priorart in the form of published U.S. and PCTapplications and U.S. patents.
� Consequences to evaluate in determin-ing whether to file an RCE, CIP, or multiple applications when modificationshave been made to an invention after thefiling of an application.

� Develop an understanding of recent Federal Circuit case law, which resulted in claims being either unduly narrowly interpreted, and therefore held to be not infringed, or held to be invalid for lack ofwritten description or enablement support,due to improvidently prepared and prose-cuted applications.
� Appreciate what ought to be said – and not said – in the specifications,claims, and responses to Office actions,and why.
� Compose and prosecute a patent application based on a disclosure, priorart, and Office actions carefully createdby PRG.
