Many DetailsMany Details

To develop a good lease and see that both parties are covered there are many items that should be included and considered.

The old practice of agreeing over a cup of coffee and a handshake is not sufficient in today’s business world and this method has gotten ranchers and livestock owners in trouble.

Extreme Environmental Changes

Extreme Environmental Changes

What if severe drought, wildfires, insects, floods, etc. change the picture? Use the review and amendment process

outlined in previous slides Do a reassessment of how much pasture

usage has been lost Take into account amount of grass needed for

rejuvenation, reseeding needed, etc. Talk to an Extension range specialist or other range

personnel to determine how many AUMs can still be used without damage to the property and how it should be timed.

If tenant is going to continue on the pasture discussion between landlord and tenant is necessary to evaluate how much the capacity has decreased, plus how much each is willing to put into restoration. The tenant will be able to increase

numbers with restoration The landlord will gain increased

Legal AdviceLegal Advice

Any and all contracts should be reviewed by a contract attorney

Discussing and reaching agreement on the items we have suggested will greatly decrease the time and expense of an attorney However, that does not mean you shouldn’t

have every contract checked for proper language and applicable state laws

After agreeing on terms have an attorney draw up the final document – the money will be well spent and provide peace of mind
