NATURAL AND CULTURAL HERITAGE INVENTORY The reason for the inclusion of the following lists is to draw the attention of owners, occupiers and the general public, to the significant buildings, trees, structures and sites in the District. Map references to the Planning Maps are given for easy identification. New Zealand Historic Places Trust (NZHPT) classifications are given where applicable. Every effort has been taken to accurately identify and locate the items listed in the Inventory. However, due to inaccuracies in the source data and the large scale of the Planning Maps it is not always possible to show precise locations. Listings are to be taken as indicative of potential heritage value pending comprehensive review.

1.17 The Historic Places Trust has identified the Government Gardens Conservation Area as an historic area, in terms of Section 22 of the Historic Places Act 1993. This will help to safeguard the future of significant buildings contributing to the character of this conservation area. The conservation area also includes the gardens, open spaces, planted areas, small lakes, carvings and gateways within the area.

A conservation area is defined as an area with two or more buildings which relate closely to each other, but which are not necessarily in close proximity to each other. Thus, any new construction on other sites within the Government Gardens conservation area should be compatible with the special nature of this area, Map 26.

a1.5 NOTABLE TREES Three categories of notable trees have been identified as worthy of recognition and

protection:

(a) Cultural Value

(i) any tree or trees associated with or commemorating an historic event; (ii) any tree or trees associated with or planted by an historic or notable

figure; (iii) of spiritual or cultural value.

(b) Ecological Value

(i) any naturally occurring remnant tree of a species rare in the region or New Zealand;

(ii) any tree or group of trees of ecological significance providing an important habitat for wildlife;

(iii) any tree particularly outstanding for its species in relation to its form, large diameter, height, age or canopy spread.

(c) Amenity Value

(i) any tree or trees that have significant landmark value due to their location;

(ii) any tree or trees which make a significant contribution to the visual amenity of the immediate neighbourhood;

(iii) any tree or trees which have outstanding value because of screening or beautification functions;

(iv) any tree or trees that are important in the avoidance of natural hazards.

In determining whether trees qualify as Notable Trees (by way of a Plan Change) the following evaluation criteria will be used:

(a) Cultural (Historic, Social, Spiritual)

The tree may be associated with an historic building, site or event, or the tree may have been planted by or have strong associations with a person(s) of historic importance to the District, or to New Zealand, or the tree may be known to be of spiritual importance.

(b) Botanical

This factor is assessed according to the numbers of the species found in the local area. Particular recognition is given to New Zealand’s unique indigenous trees, especially those trees that only occur locally or regionally.

(c) Size The height, girth and canopy spread of the tree

(d) Form and Condition

This factor assesses whether the tree is well shaped with a balanced branch system, and how well the trunk contributes to its visual appearance and takes

into consideration any factors which may limit the tree’s life span such as its state of health, or its position in relation to existing development.

(e) Age

An estimate of the tree’s age at the time of evaluation recognising a range from recent plantings to the oldest on record in New Zealand.

(f) Functional Value

The role of the tree in such areas as soil stabilisation, noise amelioration and screening of unsightly views.

(g) Importance of Position in Landscape

Includes the influences of visibility (eg a tree visible from many vantage points would receive a higher rating for this factor than one visible only from its own site and a neighbouring site), viewing audience (how many people would notice the loss of the tree?), accessibility to the public and the visual role or contribution of the tree in the wider landscape.

(h) Suitability in Relation to Setting

Assesses the appropriateness of the tree to its setting within the site (eg causing damage to heritage buildings), its physiological suitability for the health of the tree, the contribution of the tree to a visual grouping.

Council will endeavour to inform all affected parties of the existence of Notable Trees.

5.1.1 Dacrydium cupressinum (Rimu), Boys High School, Rotorua. Largest of three trees planted in 1934 by Taiporutu Mitchell. Map 25.

5.1.2 Podocarpus dacrydioides (Kahikatea), Lake Rotoiti, just North of Moose Lodge. Planted by Sir Frank and Lady Mappin. Map 63.

5.1.3 Podocarpus spicatus (Matai), Hongi's Track Rotoiti-Rotoehu the "Wishing Tree". The track was founded by Chieftainess Hinehopu, who planted the Matai beside the track. Map 69

5.1.4 Podocarpus totara (Weeping Totara), Boys High School, Rotorua. Planted by Mrs Peter Fraser, the wife of the Prime Minister on 12 September 1944 in honour of Taiporutu Mitchell. Map 25.

b1 DESIGNATIONS b1.1 INFORMATION TO BE SUPPLIED

The information to accompany a notice of requirement is set out in Section 168 of the Resource Management Act 1991. This information includes details of the public work, project or work, alternatives considered, results of consultation and resource consents to be obtained. Information required by this Plan must also be included and is set out below. Each notice of requirement shall also be accompanied by the prescribed administrative charge. (a) Sufficient drawings to adequately illustrate the proposal. (b) Whether the proposed work is a public work in terms of the Resource

Management Act 1991, or if the requirement is for a proposed project or work by a network utility operator. Details of the Order in Council which empowers the applicant as a requiring authority, including any specified terms and conditions is also required.

(c) A statement of the objectives of the requiring authority that the requirement is

necessary to achieve. (d) The degree to which the work complies with Part II of the Resource

Management Act 1991. (e) How the work impacts on any relevant provisions of national, coastal and

regional policy statements and regional plans. (f) The degree to which the work meets the Objectives, Policies and Rules of this

Plan. (g) Details of the current ownership of the subject land. Where the subject land

is not owned by the requiring authority, details are required of the consultation undertaken with the landowner(s) and the proposed land acquisition programme.

(h) The proposed sequence and timing of implementation of the work or project

clearly identifying any part of the work which may not be commenced for 5 years or more.

(i) Proposals for the use and maintenance of those parts of the land which will

not be developed for 5 years or more, in particular, identification of those

buildings and structures which could continue to be used and maintained in the meantime. (j) Details of the effects the work or project will have on the environment. The

forecasting methods used to assess the longer term and cumulative effects on the environment shall also be provided.

(k) Where hazardous substances may be used in the construction or operation of

the work or project, the degree of risk to public health and safety arising from the storage, use, disposal or transportation of such substances shall be evaluated.

(l) If the site is already designated or subject to a heritage protection order, what

that designation or order is for. Also, whether the previous designation has been fully put into effect, and the generated effects of the existing designation.

b1.2 CONDITIONS

Conditions appropriate to the circumstances may be recommended on all requirements to address the following matters: (a) the remedying or mitigation of any likely adverse effect of the proposed

public work, project or work and structures on the environment; (b) the period within which the designation will be given effect; (c) the operation or design of the proposed public work, project or work

having regard to achieving the purpose of the required public work, project or work;

(d) the maintenance of the land affected by the designation; (e) any resource consent procedure that may be required to enable the

establishment and operation of the proposed public work, project or work; (f) other conditions may also be recommended according to the particular

proposal, its nature, site and location, and the relevant provisions of the Plan and the Resource Management Act 1991.

b1.3 DRAWINGS REQUIRED

(a) Outline drawings of works to be constructed by or on behalf of a requiring authority on designated land shall be submitted to Council for its consideration before construction is commenced, unless they have been otherwise approved under this Plan. The outline drawings shall show the height, shape and bulk of the work, its location on the site, the likely finished contour of the site, vehicular access and circulation, and landscaping provisions, and shall be consistent with the drawing requirements of Appendix V.

(b) The provisions of this clause shall not apply in respect of:

(i) any work which the body or person responsible for its construction

considers is immediately necessary:

- to safeguard life or property; or - to maintain or restore communication or transport links.

(ii) dams and bridges; iii) any public utility provided for in Part 15; and iv) such other works in respect of which Council considers it to be

impractical or unnecessary to prepare outline drawings.

(c) Any temporary work which the body or person responsible for its construction considers is immediately necessary to meet an emergency situation may be constructed without first advising Council, if outline drawings of the work are submitted to Council as soon as practicable after work has been commenced.

(d) Outline drawings of a work need not be submitted to Council under this

clause if a requiring authority made a requirement in respect of the work under Section 168 of the Resource Management Act 1991.

(e) Council, after considering the proposals included in the outline drawings

may, within 20 working days after receipt of the drawings, request the requiring authority to make changes to all or any of the proposals contained in the drawings so that the proposals comply more fully with the conditions imposed.

b1.10 TRANSIT NEW ZEALAND b1.10.1 STATE HIGHWAYS

All existing State Highways within the Rotorua District are to be designated "Roads", including those portions of State Highway notated as "limited access road" on the Planning Maps. The use of roads under the control of Transit New Zealand includes the planning, design, supervision, construction and maintenance of roads in accordance with the Transit New Zealand Act 1989. Underlying Zoning for all State Highways shall be Road Zone.

b1.10.2 PROPOSED EASTERN ARTERIAL ROUTE

Designation Proposed Rotorua Eastern Arterial Motorway (including planning, design, supervision, construction and maintenance in accordance with the Transit New Zealand Act 1989), comprising the existing designation with modifications as notified by Transit New Zealand on 29 October 1993 in terms of Section 168 of the Resource Management Act 1991. Location Between Central Business District and Rotorua Airport on Planning Maps 21, 22, 27, 28, 32 and 33. Underlying Zoning The Zoning of the adjacent land to the middle of the designation. Duration - 10 years.

b1.10.2.1 General Conditions (a) That Transit New Zealand and its contractors shall take all reasonable steps

to prevent or mitigate any nuisance to adjacent properties during construction, including any dust nuisance.

(b) That reasonable access shall be maintained to those properties which are

affected by construction. (c) That in order to enable a noise barrier to be installed, if required by b1.10.2.2

below, on each side of the arterial and to provide adequate provision for screen or landscape amenity planting, the designation shall have a nominal width of 40 metres except where a greater width is shown on the requirement plan.

b.1.10.2.2 Noise Mitigation Measures

(a) That the Transit New Zealand Guidelines for the Management of Traffic Noise: State Highway Improvements, November 1994 shall be used as the basis for noise mitigation measures.

(b) Construction Noise That all works shall comply with the requirements of NZS 6803P:1984. The Measurement and Assessment of Noise from Construction, Maintenance and Demolition Work.

b1.10.2.3 Visual Impact Mitigation

(a) That Transit New Zealand shall construct the Eastern Arterial so as to comply with a landscape plan prepared in consultation with Council by a practising landscape architect. The plan will include methods for:

(i) rehabilitation of construction areas, including grassing, surface

treatments and amenity planting; (ii) integration of the new road with existing landscape features and

character; (iii) screening of undesirable views from the Eastern Arterial; (iv) visual enhancement of the new arterial route; and (v) the on-going maintenance of the landscape plantings.

(b) That within six months of the opening of the Eastern Arterial the works

provided in the landscape plan shall be completed. b1.10.2.4 Sanatorium Reserve, Waste Water Treatment Plant And Te Papa O Ruamoa

That Transit New Zealand shall prepare and implement a design plan in consultation with Council which shall avoid, remedy or mitigate, any adverse effects on the Wastewater Treatment Plant and significant vegetation and geothermal areas on Sanatorium Reserve, the Puarenga Stream mouth and Te Papa o Ruamoa. All construction work shall be undertaken in accordance with this plan.

b1.10.2.5 Robinsons Avenue Pedestrian Bridge

That pedestrian access shall be provided over the arterial road to connect the severed ends of Robinson Avenue.

b1.10.2.6 Access Between Ngapuna Village And Te Papa O Ruamoa

That if required by the owners of Te Papa o Ruamoa, Transit New Zealand shall provide pedestrian access between Ngapuna Village and Te Papa o Ruamoa. The owners’ requirements in this matter are to be determined during the land purchase negotiations.

b1.10.2.7 Access Between Ngapuna Village And Sanatorium Reserve/Sulphur Flats

That at the time of construction, Transit New Zealand shall provide a pedestrian bridge across Puarenga Stream to provide access between Ngapuna Village and Sanatorium Reserve or Sulphur Flats, unless such pedestrian access has already been provided.

b1.10.2.9 Alternative Access Roads That Transit New Zealand shall form and seal, in accordance with Rotorua District Council’s standards, the alternative access roads to be constructed as part of the project.

b1.12.1A.3 Description of the Activity:

The designation of the urban road network is for the purpose of ‘Road’, in accordance with the definition in Section 2 of the Resource Management Act 1991 and includes ‘roads’ within the meaning of Section 43 of the Transit New Zealand Act 1989. Works are restricted general powers and various roading and associated activities as outlined in Part 21 of the Local Government Act 1974. The underlying zone shall be ‘Road Zone’.

b1.12.1B MALFROY ROAD DESIGNATION

The following set of conditions shall apply:

b1.12.1B.1 As part of the programme of road improvement, the Council shall link the traffic signals on Amohau Street (Fenton to Ranolf) when the Ti Street deviation and roundabout on Fenton Street is installed.

b1.12.1B.2 The new road section between Ti Street and Te Ngae Road and the enlarged

roundabout at the Malfroy Road/Ranolf Street intersection (see b1.12.1C) shall be finished with asphaltic concrete or a small chip seal equivalent.

b1.12.1B.3 Malfroy Road, between Fenton and Ranolf Street, shall be finished with asphaltic

concrete or equivalent on completion of the Ti Street deviation works. b1.12.1B.4 The Council will seek to purchase the following properties, subject to the

agreement of the affected landowners, but if partial purchase only occurs in any instance, the balance retained in private ownership shall be provided with 1.8 metre high acoustic timber walls erected along such balance property’s road frontage, the cost of the said fencing to be a charge against the improvement project. • 58A/B Malfroy Road • 60 Malfroy Road • 61 Malfroy Road • 96 Ranolf Street

b1.12.1B.5 Mitigation measures shall be discussed and negotiated with owners of those

properties who experience a traffic noise increase greater than or equal to 3 dBA expressed as a 24 hours Leq in ambient background as a result of the Ti Street deviation. A comprehensive noise/vibration survey of the properties in the area affected or likely to be affected shall be undertaken prior to the opening of the Ti Street deviation and then subsequently within 12 months of its opening and again after 24 months. For the purpose of monitoring noise, measurement shall be taken at a point one metre in front of the façade of the principal occupied building on any site.

b1.12.1B.6 The costs of the agreed noise/vibration mitigation measures are to be a charge

against the improvement project. b1.12.1B.7 A full heavy traffic survey is to be undertaken prior to the opening of the Ti Street

deviation and subsequently within 12 months of its opening. The Council shall promulgate a heavy vehicle operations bylaw prohibiting the use of Malfroy Road from Fenton Street to Old Taupo Road (and vice versa) by such vehicles between 2200 and 0700 hours inclusive if the level of heavy traffic increases by more than 15 percent beyond that which existed prior to the Ti Street deviation works, or the level of vibration experienced increases by more than ten percent beyond that which existed prior to the Ti Street deviation.

b1.12.1B.8 Prior to the Ti Street deviation and the roundabout on Fenton Street being installed,

adequate pedestrian crossings, including recognised streetscape design techniques, shall be provided in accordance with the relevant national standards to cater for the increased traffic volumes. The location and design of such crossings is to be determined after consultation with the Board of the Rotorua Intermediate School.

b1.12.1B.9 The Council shall enter into negotiations with affected landowners and occupiers as

necessary immediately the designation becomes operative under the District Plan. The scale and scope of rehabilitation works described in Section 4.2 of the Assessment of Environmental Effects (AEE) shall be confirmed with those affected.

b1.12.1B.10 A landscape screening and planting plan for the street berms shall be prepared and

implemented immediately following completion of the new road section from Fenton Street to Te Ngae Road.

b1.12.1B.11 A landscape screening and planting plan for the street berms on Malfroy Road from

Fenton Street to Old Taupo Road shall be implemented in accordance with Council’s street planning policy.

b1.12.1B.12 Amenity planting shall be undertaken on appropriate parts of the land subject to the

designation at the time that designation works are carried out. b1.12.1B.13 The Council shall prepare a comprehensive plan change to its District Plan

incorporating the district road network, short term and long term, inclusive of Malfroy Road as an urban arterial.

b1.12.1B.14 The designation on the site of the Gateway Motel shall be amended to include a

length of only 12 metres on the Malfroy Road frontage and 9 metres on the Fenton Street frontage. The entranceways serving the Gateway Motel shall be incorporated at the Council’s cost in conjunction with the relevant intersection improvements. If the motel sign fronting Fenton Street needs to be moved in order to ensure proper traffic safety and efficiency in relation to the Malfroy Road/Fenton Street intersection, when the roundabout is installed, it shall be moved to such alternative location on the motel site as the motel owners may choose (without impinging on such safety and efficiency and subject to any District Plan requirement affecting placement of signs) at the Council’s expense.

b1.12.1B.15 The Council shall, prior to the opening of the proposed Ti Street deviation,

promulgate a Heavy Traffic Bylaw prohibiting entry of heavy traffic from the Ti Street deviation into the redesigned Ti Street at its western end via Fenton Street. The portion of the Ti Street deviation between Te Ngae Road and State Highway 30A will be available to serve the industrial area of Ti Street and its vicinity.

b1.12.1B.16 The speed regime of Malfroy Road shall be monitored with sufficient thoroughness

and frequency for the Council to be kept suitably informed and in a position to introduce such further traffic management steps as regards Malfroy Road and/or the Ti Street deviation in the future as may be necessary for maintaining the safety of motorists and pedestrians.

b1.12.1C MALFROY ROAD/RANOLF STREET INTERSECTION IMPROVEMENTS

b1.12.1C.1 The site to which the alteration to designation applies is:

Malfroy Road / Ranolf Street intersection, Rotorua, on land legally described as Gazette Notices 2004/2186, 2004/2713, 2004/2716 and 2004/4209 (formally legally described as Sec’s 1, 2, 3 & 4 SO 314558).

b1.12.1C.2 Description of activity:

The alteration is required to designate land for the purpose of improving efficiency and safety of the roading network, in particular the works will upgrade the existing single lane roundabout at the Malfroy Road / Ranolf Street intersection to a double lane roundabout with two lane approaches and exits on each leg to accommodate current and future traffic. The area of the proposed designation consists of 2913m² in area. The requiring authority owns all the land subject to this designation and part of the area is already subject to an existing designation for the same purpose. A small amount of earthworks will be required and the widening of the road.

b1.12.1C.3 Conditions:

The following set of conditions shall apply: 1. That the road construction be undertaken generally in accordance with the

report by Opus Consultants Limited (reference 267881.00 dated November 2005) and plan by Opus Consultants Limited titled “Rotorua District Council intersection improvements Malfroy Road/Ranolf Street Intersection – Alteration to Designation and Notice of Requirement for Designation for Roundabout improvements”, feature identifier 2/216/27, Code 3204, Sheet 01, Revision R0, unless amended by the following conditions.

2. That prior to construction being undertaken a Construction Noise

Management Plan shall be prepared and subsequently implemented. Such plan shall have regard to the noise standards contained in the Rotorua District Plan.

3. That construction activities shall be carried out so as to comply with the noise

limits recommended in Tables 2 and 3 of NZS 6803:1999 (Acoustic Construction Noise) and shall be measured and assessed in accordance with NZS6801:1999 (The Measurement of Environmental Sound).

4. That the preparation of a Dust Management Plan to minimise the potential for

dust nuisance during construction or adverse effects on adjacent properties shall be undertaken by the contractor and submitted to Council for approval prior to construction.

5. That the preparation and implementation of a Sediment Management Plan to

avoid, remedy or mitigate potentially significant and adverse effects associated with any sedimentation from the proposal shall be undertaken by the contractor and submitted to Council for approval prior to construction.

6. That the designation shall lapse after 10 years from the 18th September 2006,

unless an application is made pursuant to Section 184 of the Resource Management Act 1991 to extend the period for the designation.

b1.12.1D.1 The site to which the designation applies is as follows:

Malfroy Road / Old Taupo Road intersection, Rotorua, on land legally described as: • Lots 20, 21 and 22 DP 2992, • Lots 1 and 2 DPS 24570, • Lots 2 and 3 DP 33739. The above-mentioned land parcels were excluded from the Urban Roads designation that became operative on 18 September 2006 (refer to b1.12.1A).

b1.12.1D.2 Description of activity:

Construction and operation of road widening work for intersection upgrade. The proposed works will upgrade the existing intersection of Malfroy Road and Old Taupo Road to provide two eastbound lanes (one additional lane in total) on Malfroy Road west that merge into a single through lane on the eastern side of Malfroy Road. A small amount of earthworks will be required and also the widening of the road. Approximately 530 square metres of land is required for the designation (Figure b1.12.1D).

b1.12.1D.3 Conditions:

The following set of conditions shall apply: (a) That the road construction be undertaken generally in accordance with the

report (reference 267881.00 dated November 2005) and plan titled “SH5 Region 4 RS 50 Four Lane Reconstruction” by Opus Consultants Limited.

(b) That a Traffic Management Plan be provided and submitted to Council and

approved by Council prior to construction commencing. (c) That prior to construction being undertaken a Construction Noise

Management Plan shall be prepared and subsequently implemented. The plan shall have regard to the noise standards contained in the Rotorua District Plan.

(d) That construction activities shall be carried out so as to comply with the

noise limits recommended in Tables 2 and 3 of NZS 6803:1999 (Acoustic Construction Noise) and shall be measured and assessed in accordance with NZS6801:1999 (The Measurement of Environmental Sound).

b1.12.1E LAKE ROAD FOUR LANE WIDENING DESIGNATION b1.12.1E.1 Designation of Lake Road b1.12.1E.1.1 The site to which the designation applies is as follows:

Land between the Lake Road and Fairy Springs Road/Old Taupo Road intersection and the Lake Road / Ranolf Street intersection (refer Figure b1.12.1E).

b1.12.1E.1.2 Description of activity: To designate land for the purpose of improving the efficiency and safety of Lake Road. The proposed works will upgrade Lake Road to four lanes and includes associated upgrades to railway and stream crossings. A small amount of earthworks will be required.

b1.12.1E.1.3 Conditions:

The following set of conditions shall apply:

(a) Construction That a Construction Environmental Management Plan (CEMP) shall be submitted to the Director of Environmental Services and approved prior to construction commencing. The CEMP shall detail: (i) All reasonable steps that will be taken to prevent any nuisance

and damage during construction to properties that are adjacent to the works.

(ii) Noise Management strategies that shall have regard to: • the noise standards contained in the Rotorua District Plan; • the noise limits recommended inTables 2 and 3 of NZS

6803:1999 (Acoustic Construction Noise); • the measurement and assessment criteria in

NZS6801:1999 (The Measurement of Environmental Sound); and

• the consultants report ‘Proposed Widening of Lake Road, Rotorua, Assessment of Noise Effects’ prepared by Hegley Acoustic Consultants and dated November 2005.

(iii) Dust management to minimise the potential for dust nuisance during construction.

(iv) Sediment and erosion control to avoid remedy or mitigate potentially significant and adverse effects associated with any sedimentation from the proposal.

(v) Vibration management to limit the duration of vibration effects during construction as detailed in the Central Laboratories Report 07-3-37535.1 Task 7CL, dated May 2007.

(vi) The measures to mitigate any potential adverse effects on private geothermal resources.

(vii) The protocols to be followed in the event that any

archaeological sites, remains, artifacts, Taonga or koiwi are unearthed, dislodged, uncovered or otherwise found or discovered during earthworks.

(b) The Requiring Authority shall ensure that any property damaged

during construction shall be reinstated, or the owner compensated. (c) Within 6 months of the commencement of the designation, the

Requiring Authority shall advise the owners of those properties located on the route ("Owners") for which noise mitigation in the form of a noise barrier ("the Noise Works") is proposed in terms of Condition 2(a)(ii), of the intention to construct the Noise Works. If any of the Owners advise the Requiring Authority, within one month of receiving that advice, that they do not want the Noise Works constructed in respect of their property, the Requiring Authority shall not be required to comply with Condition 2(a)(ii) insofar as it relates to that Owners' property.

(d) That the Requiring Authority shall provide suitable turning facilities

in close vicinity to the Railway/Dinsdale/Lake Roads intersection to allow for all vehicles, including large vehicles and trailers, to change their direction from heading southeast along Lake Road to northwest towards Fairy Springs Road.

(e) That a right-turn bay and break in the median barrier on Lake Road

shall be provided to allow for Lake Road right-turning traffic to access 159 Lake Road (legally described as Te Koutu 3G1A).

(f) That an Outline Plan is required to be obtained prior to construction

works commencing. An outline plan shall be submitted in terms of Section 176A of the Resource Management Act 1991 and will detail the engineering design and confirm necessary mitigation and/or provision for: (i) The safe, efficient and viable access to every property fronting

Lake Road between Fairy Springs Road and Ranolf Street. (ii) The construction design of the Utuhina Stream bridge. (iii) The construction design of the Rotorua Branch railway

crossing. (iv) Cycle infrastructure (v) Pedestrian infrastructure (vi) Structural engineering assessment of the potential effects of the

road construction on the building at 163-167 Lake Road, Rotorua.

(vii) Stormwater disposal. (g) Prior to the finalisation of the Outline Plan the Requiring Authority

shall investigate and consider the potential to have a break in the proposed raised median strip or having a flush median to provide the ability to increase access opportunities for properties located between 169 and 177 Lake Road. The outcomes of this further analysis shall be reflected in the Outline Plan submitted for approval.

b1.12.2.4 Conditions Applying to all Utility Sites: b1.12.2.4.1 Engineering Works That all engineering works undertaken to satisfy the conditions outlined below,

shall be carried out in accordance with the Rotorua Civil Engineering Industry Standard and the District Plan to the satisfaction of the District Engineer.

b1.12.2.4.2 Project Management and Liaison A project manager is appointed to maintain liaison with the community regarding

the physical works programme. The project manager be responsible for advising neighbours of the annual programme of physical works, the nature of those works including construction materials and finished colours, and a general timeframe for those works to be completed.

Physical works refers to reservoirs and structures like, or similar to a stand-by

generator structure and does not include maintenance, repair and replacement or minor extensions to pipes or the placement of small container heads on the designated site.

This responsibility also extends to those sites for which an Outline Plan will be

required, as set out below. b1.12.2.4.3 Landscape Plan

(a) On all sites situated on reserve land, as classified under the Reserves Act 1977 and or zoned as such under the District Plan, a landscape plan shall be prepared by a suitably qualified person to screen these structures from neighbouring land uses.

(b) The Landscape Plan shall include a:

(i) description of the existing planting and proposed planting; (ii) general schedule of species to be planted, suggested planting density, and

the mature height of these species in relation to the structures(s) to be screened; and

(iii) maintenance programme.

(c) The Landscape Plan shall be to the satisfaction of the Director, Environmental

Services, and shall be approved prior to the completion of the physical works on each site.

b1.12.2.4.4 Construction Noise All noise from construction, maintenance and demolition work shall be managed in

accordance with NZS6803P: 1984 “The Measurement and Assessment of Noise from Construction, Maintenance, and Demolition Work.”

b1.12.2.4.5 Noise

(a) Other than occasional noise emissions from stand-by generators when used in an emergency, activities shall be managed so that noise generated shall not exceed the maximum levels for the underlying zones as specified in Appendix K – Noise Standards, in the District Plan.

(b) No activities are to exceed a night-time level of 75dBA Lmax. b1.12.2.5 Additional Site Specific Conditions – Outline Plan Applications

b1.12.2.5.1 In accordance with section 176(A) of the Resource Management Act 1991, an

application for an Outline Plan is necessary when physical works are to be constructed on the following designated sites:

Site 7: Neil Road Sanitary Sewer pump station (adjacent to 32 Neil Road); Site 35: Willow Avenue Sanitary Sewer pump station (adjacent to 25 Willow

Ave); Site 41: Brookdale Drive Sanitary sewer pump station; Site 67: Tarawera Top Reservoir and pump station; Site 68: Tarawera Bottom Reservoir, Tarawera Road; Site 69: Ngongotaha Reservoir, Henderson Road; Site 80: Tihi-o-tonga Reservoir No.1 and No.2 Balwyn Avenue.

b1.12.2.5.2 Physical works refers to reservoirs and structures like, or similar to a stand-by

b1.12.2.5.3 Additional Site Specific Condition Site 50: Waikuta Road Sanitary Pump Station. Any additional above ground structures shall be located against the fence on the

property boundary at 20 Waikuta Road and any trimming or removal of vegetation will be minimised

b1.12.2.5.4 Additional Site Specific Condition Site 67: Tarawera Road Top Reservoir.

Any additional reservoir structure shall be located on the existing cleared and grassed bench to the south of the existing reservoir.

b1.12.2.5.5 Additional Site Specific Condition Site 68: Tarawera Bottom Reservoir;

(a) Should any additional reservoir be constructed, both the existing and additional reservoir structures shall contain guttering and spouting to connect all stormwater flow to the reticulation system.

(b) In the first planting season following the date of the decision on the notice of

requirement (11 June 2002), plant evergreen landscaping in a position that would not be affected by future construction works for a second reservoir. This planting shall be to a depth of 3 metres adjacent to and for the full length of the property boundaries with 6G and 6H Forest Place, Rotorua.

(c) Details of such planting shall be discussed with the above listed Forest Place

residents prior to planting. (d) The planting is intended to provide screening over a 10-year period, of a

second reservoir, if constructed on the site, for adjoining property owners, as illustrated in the photos of Diagram 1.

b1.12.2.5.6 Additional Site Specific Condition – Site 80: Tihi-o-tonga Reservoir No.1 and No.2

Balwyn Avenue. Should any additional reservoir be constructed, the existing and additional reservoir structures shall contain guttering and spouting to connect all stormwater flow to the reticulation system, where this exists.

b1.12.2.5.7 Additional Site Specific Condition – Site 97: Reporoa Recorder Shed.

For the purpose of Section 184(1)(c) of the Resource Management Act 1991, the designation be confirmed for a period of one year commencing from July 15, 2002. By that time the Recorder Shed shall be removed from its present site.

b1.12.3 ROTORUA AIRPORT b1.12.3.1 The site to which the designation applies is as follows:

The designation applies to the whole of Rotorua Regional Airport and contains 103.43 hectares of land. The Airport has frontage to SH30 (Te Ngae Road) on its eastern side, Lake Rotorua on its western side, rural land to the north and residential land to the south.

The extent of the Rotorua Airport designation is shown on the accompanying Figure titled – Rotorua Airport Land to be designated for Airport Purposes. It comprises the same area of land that is the subject of Part A of the Airport Operation And Airport Approach And Take-Off Obstacle Limitation Surfaces Designation, held by Rotorua Regional Airport Limited. The land is legally described as Part Lot 1 DPS 49938, Parts Owhata 4A1B, 4A1A, Part Lots 40 and 41 DP 33114, Lots 7, 8, 26 – 31, and 102 DP 36536. (See Figure 1.)

b1.12.3.2 Description of activity is:

The designation applies across the whole of the Airport in a manner allowing the continued operation and future development of the Airport and all activities associated with its operation as an important physical infrastructure resource to the Rotorua community and the wider regional and national community.

Existing and future Airport development includes existing and future runway extensions, and provision of all infrastructure associated with the Airport including buildings, drainage navigational aids and lighting, within the areas shown in the Figure titled - Rotorua Airport –Plan of Development. (See Figure 2.)

Ancillary aviation related uses of the buildings are for recreation, conference and function purposes. Erosion, silting and flood management systems are provided for within the designation.

b1.12.3.3 Designation on Part Lot 1 DPS 49938, Parts Owhata 4A1B, 4A1A, Part Lots 40

and 41 DP 33114, Lots 7, 8, 26 – 31, and 102 DP 36536. The following conditions shall apply to Rotorua District Council’s designation on Part Lot 1 DPS 49938, Parts Owhata 4A1B, 4A1A, Part Lots 40 and 41 DP 33114, Lots 7, 8, 26 – 31, and 102 DP 36536. (See Figure 1.)

b1.12.3.3.1 That the layout of new buildings, structure and facilities, including managed

pedestrian access along the lakefront and protection of the Karamuramu Baths and Pikirangi Puna (Springs), shall be generally in accordance with “Rotorua Airport Plan of Development”. (See Figure 2.)

b1.12.3.3.2 Any land taken or held for the Airport Development Works shall be maintained to a

reasonable standard until physical works commence. b1.12.3.3.3 That the designation be subject to all of the noise controls and noise mitigation

requirements set out in Section 12.2 of the District Plan.

b1.12.3.3.4 That an archaeologist shall be present on site during the excavation part of the

construction programme for the proposed runway extension and if any construction work uncovers any archaeological remains, the Requiring Authority shall immediately advise local iwi and the New Zealand Historic Places Trust (NZHPT) and cease working in the affected area until any necessary authority required by the NZHPT is obtained.

b1.12.3.3.5 Within 12 months of the designation taking effect, the Requiring Authority shall

commission a suitably qualified and experienced professional to prepare to the satisfaction of the Council’s Director of Environmental Services (upon advice from an independent professional), a Wetlands Mitigation Proposal. This proposal will identify area(s) of additional rehabilitation for existing (degraded) wetlands and/or additional new wetlands to be established, of an area at least equal in size to the wetlands that will be reclaimed as a result of the proposed runway extension. The programme will include a detailed Planting Plan(s) for the existing wetland(s) to be rehabilitated and/or the new wetland(s) to be established, including the following:

(i) Details of how the local hydrology will be managed to maintain the wetlands;

(ii) Location of the proposed vegetation zones; (iii) Species to be used in each of the vegetation zones; (iv) Source of the plant material; (v) Size of the plants; (vi) Density of plantings; (vii) Details of plant maintenance (including replacement of mortalities); (viii) A maintenance schedule. The Planting Plan shall be implemented within 12 months of the completion of construction of the proposed runway extension works.

b1.12.3.3.6 Construction noise shall comply with the provisions of NZS 6803:1999 “Acoustics

– Construction Noise” with the following exemptions:

For reasons of safety and to avoid disruption to scheduled passenger services it will be necessary to carry out “tying in” and “overlay” works on the existing runway during night time hours. These works shall comply with the following: For a maximum of 15 nights per annum, noise from construction activities shall not exceed the following limits received 1 metre from the façade of dwellings: 8.00pm –midnight 60dBA Leq midnight – 6.30am 55dBA Leq 8.00pm-6.30am 85 dBA Lmax

In addition construction works may be carried out at each end of the runway in exceedence of the limits in NZS6803:1999 up to a maximum of 10 nights per annum for the northern end and 10 nights per annum for the southern end . This is provided that no works take place at any one end of the runway for more than two consecutive nights at a time, unless all affected persons agree. At least 48 hours prior to these night time works commencing, residents of dwellings which are predicted to receive noise levels greater than the limits of NZS 6803:1999 shall be notified.

All construction works shall be carried out in accordance with Construction Noise Management Plans to be prepared in accordance with NZS6803:1999 “Acoustics – Construction Noise”, to the satisfaction of the Council. For the purpose of this condition construction noise levels shall be measured and assessed in accordance with the provisions of NZS 6803:1999.

b1.12.3.3.7 All contract documentation for the construction of Airport development works,

shall include reference to these Designation conditions, any resource consents (including any conditions on any consents), and any approved mitigation, management plan(s) or outline plan(s) approved for the Airport.

b1.12.3.3.8 That the site of the Karamuramu Baths and Pikirangi Puna (Springs) on the

lakeshore be demarcated in consultation with tangata whenua and that managed pedestrian access along the lakeshore to the Springs and Puna be provided where this is consistent with Airport safety and security within 12 months of the designation taking effect. The proposed demarcated area and lakefront access is indicated on Figure 2.

b1.12.3.3.9 Within 18 months of this designation taking effect Rotorua District Council shall

make offers to the owners of numbers 53 Lee Road, 2, 4 and 8 Williton Road to purchase those properties.

b1.12.3.3.10 Forthwith upon the designation taking effect, Rotorua District Council shall make

offers to purchase: (i) all those houses on the eastern side of Williton Road, being numbers 1, 3, 5,

7, 9 and 11 that are covered by the designations; and (ii) 51 Lee Road; and (iii) all those properties within or partly within the 2033 Ldn 70dBA contour (if

any) which are to be identified, forthwith b1.12.3.3.11 Where the annual noise contour plan forwarded to the Council in accordance with

rule 12.5.5.2(d) and rule 12.2.5.3(a) of the District Plan indicates that properties will fall within, or partly within, the annual Ldn 65dBA contour, the Rotorua District Council shall offer to purchase the properties, within 18 months, but not earlier than 12 months, of receiving the report from the airport company.

b1.12.3.3.12 Rotorua District Council will provide acoustic treatment to the following

buildings as if such buildings qualified for treatment under clause 12.2.5.3 of Change 32 (and in the manner and to the standards applying to a relevant qualifying building under that clause) as follows: (i) The Ruamata Marae buildings and Pikirangi Marae, when Change 32

becomes operative, and (ii) The Ruamata Kura Kaupapa buildings, within six months after this

designation has been given effect to, and (iii) The Rotokawa School, within two years of this designation having been

given effect to.

b1.13.1 DESIGNATION ON PART ROTOMAHANA PAREKARANGI 3A3B5A BLK

The following conditions shall apply to Broadcasting Communications Limited’s designation on Part Rotomahana Parekarangi 3A3B5A Blk V Paeroa SD.

b1.13.1.1 There shall be only one lattice tower on the designated land, with a maximum

height of 40 metres above existing ground level, at any one time with the exception of temporary structures for construction and/or maintenance purposes. Any temporary structures shall be removed at the end of such work.

b1.13.1.2 The emission of electrical or electromagnetic radiation shall comply with the New

Zealand Standards NZS2772.1 (1999). Radio frequency Fields: Part 1 Maximum Exposure Levels – 3kHz – 300GHz.

b1.13.1.3 The placement or erection of the following equipment on the lattice tower and

existing structures on the site shall be permitted without the provision of any Outline Plan of Works pursuant to Section 176A(1) of the Resource Management Act 1991:

i) Up to a total of twelve dish antennas, each with a maximum diameter greater than 2 metres but less than 4 metres.

ii) Broadcasting, telecommunication and radio communication antennas including whip, grid, yagi, dipoles and panels or similar ancillary equipment, but no single antenna dish or panel shall have a solid frontal surface area of greater than 4m2 or 2 metres in diameter in the case of dish antenna, unless otherwise specified above.

b1.13.1.4 No new structures other than those specified in 1(c) of the Notice of Requirement

shall be erected on the site without the submission of an Outline Plan of works pursuant to Section 176A of the Resource Management Act 1991.

b1.13.1.5 Any new antenna or structures above 10 metres in height shall be constructed from

materials which minimise the reflection of light (subject to civil aviation requirements).

b1.13.1.6 i) That during the construction phase of the complex, the requiring authority

shall ensure that the builders operate their plant and equipment in compliance with NZS 6803P Measurement and Assessment of Noise from Construction, Maintenance and Demolition Work.

ii) During normal operation, the requiring authority shall ensure that the noise emissions from the site, when measured at the notional boundary of any affected residence shall not exceed the following noise levels, as specified in Appendix K of the Proposed Rotorua District Plan:

The following conditions shall apply to Broadcasting Communications Limited’s designation on Part Ngati Whakaue Amalgamated ML 20323 (Pukepoto Hill).

b1.13.2.1 The following equipment shall be permitted to be attached to or erected on the

existing towers and structures or elsewhere on the site, on a permanent basis without the provision of any outline plan of works pursuant to section 176A of the Resource Management Act 1991:

a) Up to two dish antennas with a maximum diameter greater than 2.5 metres but less than 5.0 metres.

b) Broadcasting, telecommunication and radio communication antennas including whip, grid, yagi, dipoles and panels or similar ancillary equipment, but no single antenna dish or panel shall have a solid frontal surface area of greater than 5.0 m2 or 2.5 metres in diameter in the case of dish antennas, unless otherwise specified in (a) above.

b1.13.2.2 No new structures shall be erected on the site without submission of an outline plan

of works pursuant to section 176A of the Resource Management Act 1991 other than those set out in condition 1 above or structures which are either intended to replace the structures existing on the site or any temporary structures erected for the purposes of allowing maintenance or repair of existing structures (provided that such temporary structures will be removed once any such maintenance or repair has ceased).

b1.13.2.3. Radio frequency radiation emissions from the site shall comply with standard NZS

2772.1:1999 Radio Frequency Fields (Maximum Exposure Levels – 3kHz to 300GHz).

b1.13.2.4. For any alterations or additions to the facility requiring earthworks the applicant

shall detail consultation with tangata whenua in the submission of an outline plan of works pursuant to section 176A of the Resource Management Act 1991.

b1.13.2.5. The height of any mast and attached antenna shall be capped at a maximum height

of 50m.

b1.14 ROTORUA REGIONAL AIRPORT LIMITED b1.14.1 AIRPORT OPERATION

b1.14.1.1 The site to which the designation applies is as follows:

The designation applies to the whole of Rotorua Regional Airport and contains 103.43 hectares of land. The Airport has frontage to SH30 (Te Ngae Road) on its eastern side, Lake Rotorua on its western side, rural land to the north and residential land to the south.

The extent of the Rotorua Airport designation is shown on the accompanying Figure titled – Rotorua Airport Land to be designated for Airport Purposes . It comprises the same area of land that is the subject of Part A of the Airport Operation And Airport Approach And Take-Off Obstacle Limitation Surfaces Designation, held by Rotorua Regional Airport Limited. The land is legally described as Part Lot 1 DPS 49938, Parts Owhata 4A1B, 4A1A, Part Lots 40 and 41 DP 33114, Lots 7, 8, 26 – 31, and 102 DP 36536. (See Figure 1.)

b1.14.1.2 Description of activity is:

The designation applies across the whole of the Airport in a manner allowing the continued operation and future development of the Airport and all activities associated with its operation as an important physical infrastructure resource to the Rotorua community and the wider regional and national community.

Existing and future Airport development includes existing and future runway extensions, and provision of all infrastructure associated with the Airport including buildings, drainage navigational aids and lighting, within the areas shown in the Figure titled - Rotorua Airport –Plan of Development. (See Figure 2.)

Ancillary aviation related uses of the buildings are for recreation, conference and function purposes. Erosion, silting and flood management systems are provided for within the designation.

b1.14.2 AIRPORT APPROACH AND TAKE-OFF OBSTACLE LIMITATION

SURFACES DESIGNATION b1.14.2.1 The site to which the requirement applies is as follows:

Airspace above Rotorua Airport and part of the surrounding Rotorua District (as more particularly detailed in Figures 3 and 4).

The height restrictions used in this notice are based on Civil Aviation Authority (“CAA”) Rule Part 139.51 and the associated Advisory Circular AC 139-06A “Aerodrome Design – Aeroplanes above 5,700kg” specifications for OLS applicable to code 4C aircraft operating from an instrument non-precision runway. All elevations are provided in metres above mean sea level (“AMSL”) unless otherwise stated.

NOTE: The CAA uses a coding system that defines the airport operational requirements for

aircraft based on their size and takeoff performance. Under this system the Boeing 737 and Airbus A320 are defined as code 4C aircraft

It is proposed to extend the existing sealed runway (1622m long x 30m wide) by a total of 487m to the south, including a 122m starter extension to be used only for takeoff to the north and 145m of sealed runway to be used only for landing from the north and take-off. In addition it is proposed to extend the existing sealed runway by a total of 150m to the north, including a 130m starter extension to be used only for takeoff to the south and 20m of sealed runway to be used only for landing from the south and take-off.

For the purpose of determining the scope and extent of the airspace controls an overall runway length of 2259m including starter extensions has been adopted. The runway identification is 18/36, runway 18 being for takeoffs to the south and landings from the north, and runway 36 the opposite. A grass runway running parallel to the main runway and 833m x 50m has the same identification.

b1.14.2.2 Description of the activity is:

The designation shall be for all operational aspects of the Rotorua Regional Airport (“Airport”) including operations on the expanded Airport area authorised by the Rotorua District Council Designation 1; and airspace protection in the vicinity of the Airport, by defining essential obstacle limitation surfaces (“OLS”) for the protection of aircraft flight paths. (Figures 3 and 4 show these surfaces in plan view).

The operations authorised by this designation are operations on the existing runway and future runway extensions, and provision of all infrastructure associated with the Airport including buildings, drainage navigational aids and lighting, within the areas shown on the Figure titled - Rotorua Airport Plan of Development. Ancillary aviation related uses of the buildings are for recreation, conference and function purposes but excludes visitor accommodation.

CAA rule Part 139.51 requires an airport operator to provide OLS around the airport to ensure the safe operation of aircraft approaching and departing the airport. This is done by means of height controls based on a series of geometric surfaces projecting up from the edges of the strip which surrounds the sealed runway, the intention being to prevent structures and trees from penetrating these surfaces in areas critical to operational safety and efficiency.

CAA Advisory Circular AC 139-06A provides details on the extent of the OLS. The surfaces adopted for Rotorua Regional Airport are for an instrument non-precision runway able to accommodate aircraft up to Code 4C in size.

Figures 3 and 4 and the following description are a part of this Notice of Requirement. This requirement protects Rotorua Airport from possible intrusion of over-height obstacles into the necessary approach and take-off areas required for the safe operation of the airport by all types of aircraft in use, or expected to be in use, at the airport in recognition of its role as an integral part of the national aviation infrastructure.

A ‘user-friendly’ explanatory guide as to how these height controls work in practice is attached at the end of this designation.

b1.14.2.3 Height Restrictions

Height restrictions will apply to objects including buildings, structures, masts, poles and trees under the OLS as described below.

b1.14.2.4 Runway, strip and OLS inner edges

The main runway is to be extended to the north by a total of 150m, which includes a 130m starter extension and 20m of sealed runway that is only available for takeoff on runway 18, landing on runway 36 and take-off.

The main runway is also to be extended to the south by a total of 487m, which includes a 122m starter extension and 365m of sealed runway that is only available for takeoff on runway 36, landing on runway 18 and take-off.

The runway will be contained within a rectangular strip with edges 75m either side of and parallel to the runway centreline. For the purpose of this NOR, the strip ends are co-incident with the OLS inner edge locations at each end of the runway.

The take-off and approach OLS commence from an “inner edge” that crosses the runway centreline at right angles at the following survey locations:

Both takeoff OLS commence at the north end inner edge location. The surface edges commence at each end of the inner edge, located 90m either side to the runway centreline and rise at a gradient of 2.0% (1:50) over a horizontal distance of 15,000m.

(i) Turning Take-off (refer to figure 3 path 7a)

The surface edges diverge from each end of the inner edge at a rate of 12.5% (1:8) to a final width of 1800m (900m either side of the surface centreline).

The surface centreline follows the extended runway centreline north to a point 1,716m from the inner edge. At this point the surface steps down 4.6m in height and its centreline commences a left turn of radius 1,620m through an arc of 80 degrees. The surface centreline then steps up 4.6m and continues straight for a further 11,022m to a total distance of 15,000m from the inner edge measured along the surface centreline.

(ii) Straight-ahead Take-off (refer to figure 3 path 8a)

The surface edges diverge from each end of the inner edge at a rate of 12.5% (1:8) to a final width of 1200m (600m either side of the surface centreline). The surface centreline follows the extended runway centreline over its full 15,000m length.

Both approach OLS commence at the north end inner edge location. The surface edges commence at each end of the inner edge, located 75m either side of the runway centreline.

(i) Straight-in Approach (refer to figure 3 path 10a)

The straight-in approach surface from the north commences at the inner edge and rises at a gradient of 2.0% (1:50) over a horizontal distance of 15,000m.

The surface edges diverge from each end of the inner edge at a rate of 15.0% (1:6.6) to a final width of 4650m (2325m either side of centreline).

The surface centreline follows the extended runway centreline over its full 15,000m length.

(ii) Curved Approach (refer to figure 3 path 9a)

The curved approach surface from the north commences at the inner edge and rises at a gradient of 2.5% (1:40) over a horizontal distance of 3,243m, extending to the edge of the lakeshore. The surface edges diverge from each end of the inner edge at a rate of 10% (1:10) to a final width of 799m. The surface centreline follows the extended runway centreline to a point 1,716m from the inner edge. At this point the surface centreline commences a left turn of radius 1,067m through an arc of 82 degrees at which point the surface ends.

b1.14.2.7 Southern Take-off OLS (refer to figure 3 path 2b)

The southern take-off OLS commences at the south end inner edge and rises at a gradient of 2.0% (1:50) over a horizontal distance of 15,000m. The surface edges commence at each end of the inner edge, located 90m either side of the runway centreline.

The surface edges diverge from each end of the inner edge at a rate of 12.5% (1:8) to a final width of 1800m (900m either side of the surface centreline). The surface centreline follows the extended runway centreline south to a point 946m from the inner edge. At this point the surface steps down 4.6m in height and its centreline commences a right turn of radius 2,480m through an arc of 185 degrees. The surface centreline then steps up 4.6m and continues straight for a further 6046m to a total distance of 15,000m from the inner edge measured along the surface centreline.

b1.14.2.8 Southern Approach OLS

There are two southern approach paths and two corresponding approach OLS. Both approach OLS commence at the south end inner edge. The surface edges commence at each end of the inner edge, located 75m either side to the runway centreline.

The straight-in approach surface from the south commences at the inner edge and rises at a gradient of 2.0% (1:50) over a horizontal distance of 15,000m. The surface edges diverge from each end of the inner edge at a rate of 15.0% (1:6.6) to a final width of 4650m (2325m either side of centreline).

The surface centreline follows the runway extended centreline to a point 1,318m from the inner edge. At this point the surface skews 14°59’ to the west of the extended runway centreline (effectively a clockwise rotation of 14°59’) and continues straight for a further 13,682m.

(ii) Curved Approach (refer to figure 3 path 6b) The curved approach surface from the south commences at the inner edge and rises at a gradient of 2.5% (1:40) over a horizontal distance of 9,109m, extending to the edge of the lake shore. The surface edges diverge from each end of the inner edge at a rate of 10% (1:10) to a final width of 1,972m. The surface centreline follows the extended runway centreline to a point 1,318m from the inner edge. At this point the surface centreline commences a right turn of radius 2,480m through an arc of 180 degrees.

b1.14.2.9 Transitional Side Surface (refer to figure 4) The transitional side surface extends from the side of the strip upwards and outwards at a gradient of 1:7 until it reaches the inner horizontal surface. North of the inner edge location, the transitional side surface extends to meet the outer edge of the straight-in approach path 10a OLS such that the outer edge of the side surface meets the outer edge of path 10a OLS 2,250m from the inner edge, measured along the centreline of path 10a.

b1.14.2.10 Inner Horizontal Surface (refer to figure 3)

The inner horizontal plane is located at a height of 330m above mean sea level (45m above the runway reference height) and extends out to a distance of 4000m measured from the periphery of the runway strip.

b1.14.2.11 Conical Surface (refer to figure 3)

The conical surface slopes upward and outward from the periphery of the inner horizontal surface rising at a gradient of 5.0% (1:20) to a height of 435m AMSL (150m above the runway reference height).

Note The inner horizontal and conical surfaces are penetrated by terrain and

existing trees and structures predominantly to the south and east of the runway. RRAL, at its discretion, may permit further penetration of the surfaces by trees and structures in this area.

requirements set out in Section 12.2 of the District Plan. b1.14.3.2 That the Requiring Authority shall consult with the appropriate road controlling

authority regarding any necessary traffic management or other measures to be implemented on Lee Road to prevent the infringement of the Obstacle Limitation Surface if the proposed Rotorua Eastern Arterial intersection is constructed in grade separated form.

b1.14.3.3 The Requiring Authority shall meet the costs of the initial removal of obstacles

(including trimming of trees) carried out in accordance with the purpose of this designation. Subsequent trimming of trees or removal of obstacles shall be the responsibility of the owner of the affected land or obstacle.

b1.14.3.4 Where the removal of obstacles in accordance with the purpose of this designation

requires the removal of trees or in the opinion of an arborist the tree will die as a result of the proposed pruning, the Requiring Authority shall offer the affected landowner replacement trees of an appropriate species (or other equivalent means of mitigation, at the discretion of the Requiring Authority).

b1.14.3.5 Noise Management Plan Within 12 months of this designation taking effect, and without in any way limiting

its obligations to fully comply with the conditions attaching to the designation, the Requiring Authority shall prepare and implement a Noise Management Plan (NMP) to assist all interested parties in complying with the objectives and rules in the District Plan and the requirements of this designation. The NMP shall include:

(i) A statement of noise management objectives and policies;

(ii) Procedures for the ongoing maintenance and operation of the ANMC;

(iii) Procedures for monitoring and ongoing review of the NMP;

(iv) Procedures for the preparation of the Annual Aircraft Noise Contours;

(v) The procedure for the recording, responding and reporting of complaints

received in respect of noise from aircraft operations, engine testing activities and any other activities generating noise at the Airport;

(vi) Dispute resolution procedures to resolve disputes between RRAL and the

ANMC about the contents and implementation of the NMP; (vii) Consideration of land use measures which may mitigate adverse effects of

aircraft noise through changes to controls;

(viii) Details of methods and processes for monitoring and reporting to the ANMC compliance with the District Plan rules and designation conditions, including but not necessarily limited to: • Limitations on aircraft noise provided in the rules; • Engine testing; • Limitations on night flights;

(ix) Protocols for the use of the Airport apron for engine testing; (x) Noise abatement procedures, including but not necessarily limited to:

• Where practicable, requests to Rotorua Air Traffic Control to request aircraft pilots to avoid overflight of the Ruamata Marae when the Marae advises that a tangi or hui is being held at the Marae;

• Where practicable, requests to Rotorua Air Traffic Control to request aircraft pilots to use “best practice” noise abatement procedures for the aircraft type with the objective of minimising noise over residential areas and the Ruamata Marae and Kura;

• Where practicable, requests to Rotorua Air Traffic Control to request aircraft pilots to maintain required circling or holding patterns out over the Lake away from the residential areas;

• Improvements to airport layout to reduce ground noise; • Aircraft operating procedures in the air and on the ground, including

flight tracks.

Within six months of this designation taking effect, RRAL shall prepare a draft of the NMP for presentation to the ANMC and shall invite the ANMC to comment on the draft before completing the NMP.

b1.14.3.6 Airport Noise Management Committee

Within 6 months of this designation taking effect, RRAL shall establish and maintain at its cost an Airport Noise Management Committee (ANMC) to consider, and where appropriate make recommendations to RRAL, on aircraft noise issues and concerns that arise from the operation and activities at Rotorua Airport.

An independent person appointed by RRAL shall chair the ANMC. RRAL shall have two members of the ANMC, and shall invite each of the following organisations to nominate a member of the ANMC:

(i) Ruamata Marae Committee; (ii) Ruamata Kura Kaupapa Board of Trustees; (iii) Rotokawa School Board of Trustees;

(iv) Holdens and Hannah’s Bay Residents and Ratepayers Association;

(v) Airport Operators Group (General Aviation); (vi) Board of Airline Representatives of New Zealand;

(vii) Airways New Zealand.

The ANMC shall meet once every two months for the purpose of carrying out the following activities:

(i) Identify community concerns regarding aircraft noise; (ii) Assist RRAL to formulate and propose procedures to minimise noise impact

on the surrounding community; (iii) Assist and advise RRAL in the dissemination of relevant information to the

community;

(iv) Review noise complaints and resolution mechanisms used by RRAL;

(v) To consider the reports on incidents of engine testing and the ramifications of those incidents;

(vi) To assist RRAL to prepare the NMP;

(vii) To encourage parties to work together co-operatively, sharing information

and making recommendations by consensus and agreement.

b1.14.3.7 The designation shall lapse within 7 years unless it has been given effect to within that period.

b1.14.3.8 The Requiring Authority shall consult with the Chair of the Ngati Uenukukopako

iwi Trust (or their delegate) on an appropriate name for the internal arrivals terminal planned as part of the Rotorua Airport upgrade. The terminal shall be given a name which has been agreed between the Chair of the Ngati Uenukukopako Iwi Trust (or their delegate) and the Requiring Authority.

b1.14.3.9 Within 6 months of this designation taking effect, RRAL shall invite the Chair of

Ngati Uenukukopako Iwi Trust (or their delegate) to meet to discuss Airport activities and their impacts on tangata whenua (excluding noise complaints). Such meeting shall be held every 6 months from the date of the first meeting (unless RRAL, and the Chiar of the Trust agree that meetings shall be held more or less regularly).

b1.14.3.10 Notes b1.14.3.10.1 No object, including a building, structure, mast, pole or tree, shall penetrate any of

the airspace height restrictions illustrated in Figures 3 and 4 attached to the designation, except with the express prior written consent of the Requiring Authority. The Requiring Authority may remove any obstacle that penetrated the airspace height restrictions when the requirement for this Designation was notified on 17 December 2005.

b1.15 MINISTRY OF SOCIAL DEVELOPMENT

b1.15.1 DESIGNATION ON PT PAREKARANGI A9 b1.15.1.1 The site to which the designation applies is as follows:

The designation applies to four specific areas of land adjacent to State Highway 30 approximately 4km south of Rotorua. The physical address is 538 State Highway 30.

The land is legally described as Pt Parekarangi A9 and is owned by Parekarangi Trust Limited. The Crown has negotiated a lease agreement with Parekarangi Trust for the four pieces of land that are the subject of the designation. The designated land accommodates the access road, buildings and facilities required for the Ministry of Social Development Youth Justice Residential Centre – Central (hereinafter “the residence”). On 28 August 2008, Rotorua District Council processed an alteration to the designation and this was approved 22 September 2008. The alteration allowed for the designation of the access road and minor adjustments to the building platform for the residence and stormwater management systems following detailed design considerations. The designated areas are shown on Figure 15.1 and Planning Map 108.

b1.15.1.2 Description of activity is:

The residence will be established, operated and maintained in terms of Section 364 of the Children, Young Persons and their Families Act 1989. The designation encompasses the access road, the residence and ancillary educational, recreational, therapeutic, administrative, cultural facilities, and associated earthworks.

b1.15.2 CONDITIONS

The following conditions shall apply to the residence on Pt Parekarangi A9. b1.15.2.1 Buildings and Site Layout

The siting, layout and appearance of the residence shall be in general accordance with the plans prepared by Beca Carter Hollings and Ferner Limited and Chow Hill Architects Limited as attached in Appendix B and Appendix C respectively of the Notice of Requirement and the further information provided dated 9 August 2007 and 30 August 2007 where this is relevant, correspondence from Crown Law to Environment Bay of Plenty dated 11 December 2007 and from Child, Youth and Family to Transit NZ dated 3 November 2007.

b1.15.2.2 Occupancy

The residence shall provide for up to forty (40) children and young persons at any one time.

b1.15.2.3 Community Liaison Committee

A Community Liaison Committee shall be established to provide opportunities for management at the residence and the community to be informed and contribute ideas to improve the operation of the residence and maintain safety and security for the community. In accordance with Regulation 34 of the Children, Young Persons and Their Families (Residential Care) Regulations 1996, the Committee shall comprise: • Two persons residing in and representative of the community in which the

residence is situated; • Two persons appointed by the local authority having jurisdiction over the area

in which the residence is situated; • Two persons representing the Tangata Whenua of the area in which the

residence is situated; • A member of the Police; • The Manager of the residence or a senior member of staff of the residence to

attend meetings of the Committee in the absence of the Manager; • A representative of the members of staff of the residence; • A representative of the children and young persons in the residence; and • Such other person or persons as the Committee invites to be members of the

Committee. Reports shall be kept of the minutes, outcomes and actions arising from the meetings of the Community Liaison Committee and these shall be provided to the Rotorua District Council on an annual basis.

b1.15.2.4 Security Management Plan

A Security Management Plan for the residence shall be formulated and implemented in consultation with the Community Liaison Committee and relevant emergency services.

b1.15.2.5 Access

The new intersection onto State Highway 30 shall be located 77 metres south of the existing crossing place (Tureporepo Road).

The existing crossing place (Tureporepo Road) shall be physically and legally closed and the existing roadway be redirected to connect with the new access serving the residence. In order to reduce headlight glare from the side road, low growing shrubs shall be planted from the frontage of State Highway 30 to where Tureporepo Road meets the new access road. The final detailed design of the new intersection shall be to the satisfaction of the Regional Manager, Transit New Zealand, Hamilton; and shall include the following:

• Illustration of the proposed distance from Tureporepo Road (its connection

with the access road) to the intersection with State Highway 30 (the access roads intersection with State Highway 30).

• Appropriate highway lighting at the new intersection. The Requiring Authority shall clear the vegetation on the left hand side of State Highway 30 and inside the adjacent property boundary south of the proposed new crossing place to maximise sight distances. The Requiring Authority shall adopt travel demand initiatives as part of the Notice of Requirement. Such initiatives could include, but are not limited to, the following: • A bus service to take employees to and from work. • A bus service available on occasions to take visitors to and from the site.

Any sign to be erected on site that is visible from State Highway 30 shall comply with the Rotorua District Plan and the following requirements: • The message on the sign should be clear, concise and easy to read. • The minimum lettering height of all words shall be no less than 160mm

because the speed environment is greater than 70km/h. • There shall be no more than six words and/or symbols, with a maximum of 40

characters. • Colour combinations, legends and symbols, shall not be similar to those used

for traffic signs as defined in the Traffic Regulations 1979. • There shall be no use of reflectorised materials. • The sign shall not be illuminated or moving.

b1.15.2.6 Noise b1.15.2.6.1 Construction Noise Noise from construction shall comply with the limits in, and shall be measured and

assessed in accordance with, the requirements of NZS6803P:1984 Construction Noise. (Note: alternatively NZS6803:1999 could be specified which superseded the older 1984 Standard specified in Appendix K of the Rotorua District Plan).

Prior to commencement of construction activities on the site (including

earthmoving activities during preparation of the building platform and access road) a Construction Noise Management Plan shall be prepared by a suitably qualified and experienced acoustic consultant and submitted for Council approval.

b1.15.2.6.2 Operational Noise Noise generated by all activities on the site shall not exceed the following noise

limits at the notional boundary of any rural dwelling in the Rural A zone:

b1.15.2.7 Landscaping The site shall be landscaped in general accordance with the Landscape Concept

Plan prepared by Opus International Consultants contained in Appendix D to the Notice of Requirement.

Landscape treatment shall be provided on the site to assist to partially screen the

building profile of the residence and to limit headlight sweep and light spill on neighbouring residential properties existing at December 2007.

Where possible and practicable, planting and/or hydroseeding shall be undertaken

to screen cuttings created to establish the buildings and the road. Landscape treatment and all planting shall be completed within the first planting season of the commencement of the operation of the residence and be maintained including replacement planting for the life of the residence. The revegetation shall generally comprise locally sourced native species such as, but not limited to, karamu, rewarewa, kanuka, mahoe and kohuhu. Consideration should be given to planting of other parts of the site with native species, in the vicinity of the storm water retention pond, the access road, and associated with the soil conservation reserve adjacent to State Highway 30.

b1.15.2.8 Lighting and Headlight Glare

All lighting for secure outdoor recreational areas on the site shall be designed and operated to meet the requirements of AS/NZS 4282 Control of Obtrusive Effects of Outdoor Lighting.

A detailed design and lighting philosophy shall be provided to the Council that provides detail of compliance with the performance specifications for exterior lighting covering:

• Circulation road lighting; • Inner courtyard lighting; • Secure recreational lighting; • Car park lighting; • Access road lighting; and • Building lighting.

Commentary shall be provided on how light spill and glare is proposed to be monitored to minimise adverse effects on the locality.

The potential for headlight glare from vehicles using the access road to impact upon neighbouring properties will be considered in the design of the access road and will be mitigated through the provision of appropriate landscaping, earthworks or fencing where necessary.

b1.15.2.9 Cultural

Should there be accidental discovery during construction of koiwi tangata (human remains), parekai (midden), or taonga (artefacts): • The work in the vicinity shall stop immediately; • The area in which the discovery is made will be secured off and left

undisturbed; • Local iwi will be advised as soon as possible after seeking advice from the

Director, Kaupapa Maori at the Rotorua District Council; • Notification shall be sent to New Zealand Historic Places Trust; • Notification shall be sent to the Community Liaison Committee; and • Work on the site will not be recommenced until direction and consent has

been provided by local iwi.

b1.16 RADIO NEW ZEALAND LIMITED DESIGNATION b1.16.1 DESCRIPTION OF ACTIVITY: Designation for the purpose of radio communication and telecommunication

(including broadcasting) and ancillary purposes and land uses. b1.16.2 THE SITE TO WHICH THE DESIGNATION APPLIES IS AS FOLLOWS:

An approximately 4.04 hectare area of land identified in Ngati Whakaue Amalgamated Block, as set out in Partition order PR/254/144, registered under the Maori Affairs Act 1953 (refer Figure 16.1 and Planning Map 41).

b1.16.3 CONDITIONS: b1.16.3.1 There shall be only one lattice tower on the designated land, with a maximum

height of 120 metres above existing ground level, at any one time with the exception of temporary structures for construction and/or maintenance purposes. Any temporary structures shall be removed at the end of such work.

b1.16.3.2 The emission of electrical or electromagnetic radiation shall comply with the New

Zealand Standard NZS2772.1 (1999): Radio frequency Fields: Part 1 Maximum Exposure Levels – 3kHz – 300GHz.

b1.16.3.3 The placement or erection of the following equipment on the lattice tower and

existing structures on the site shall be permitted without the provision of any Outline Plan of Works pursuant to Section 176A(1) of the Resource Management Act 1991: (a) Broadcasting, telecommunication and radio communication antennas

including whip, grid, yagi, dipoles and panels or similar ancillary equipment, but no single antenna dish or panel shall have a solid frontal surface area of greater than 4m2 or 2 metres in diameter in the case of dish antenna, unless otherwise specified above.

b1.16.3.4 No new structures other than those permitted under the District Plan or as specified in Condition b1.16.3.3(a) above shall be erected on the site without the submission of an Outline Plan of works pursuant to Section 176A of the Resource Management Act 1991.

b1.16.3.5 Any new antenna or structures above 10 metres in height shall be constructed from materials which minimise the reflection of light (subject to civil aviation requirements).

b1.16.3.6 All activities shall be conducted and buildings located, designed and used to ensure that noise levels at or within the notional boundary of the nearest building do not exceed the following limits:

Noise shall be measured and addressed in accordance with New Zealand Standards: NZS 6801:1991 – Measurement of Sound NZS 6902: 1991 – Assessment of Environmental Sound Note: Notional Boundary as referred to in this condition means a line 20 metres

from the façade of any rural dwelling. Except that where a rural dwelling is not situated on the same title as Radio New Zealand Limited’s facilities, the notional boundary means: • a line 20 metres from the façade of that rural dwelling; or • the legal boundary of the title on which that rural dwelling is situated,

whichever is the closer to the rural dwelling.

That during any construction work carried out at the site, the requiring authority shall ensure that the builders operate their plant and equipment in compliance with NZS 6803P Measurement and Assessment of Noise from Construction, Maintenance and Demolition Work.

b1.16.3.7 The above conditions do not restrict the continued use of infrastructure currently on the designated land, subject to compliance with the noise limits stated in condition 16.3.6 and emission levels specified in condition 16.3.2 including those specified in item 3.1 of the Notice of Requirement. This infrastructure includes (but is not limited to):

i. An aerial mast approximately 110m high, with synthetic support guys, which currently operates 3 AM signals, and FM antennas which currently operate 4 FM signals;

ii. An Aerial Coupling Unit (ACU) Hut; iii. An FM Transmitter Hut; iv. A radial earth mat which forms part of the aerial system; v. Aerial security fencing approximately 2 metres in height; vi. A concrete block AM transmissions building approximately 4 x 8 metres in

dimension; vii. A diesel generator building of concrete block construction;
