SCOPE AND CONTENT NOTEThis Supplement to Part 23 of Papers of the NAACP reproduces the working
case files of the NAACP's general counsel and the legal department staff for theperiod 1960-1972, focusing on the years 1965-1972. The case files in Supplement
to Part 23 pertain to demonstrations and boycotts, employment discrimination, schooldesegregation, discrimination in the criminal justice system, and voting rights. The
files consist of correspondence discussing strategic decisions in the litigationprocess, exhibits, briefs, lawyers' notes, depositions, and transcripts of courtproceedings.
Due to the massive size of the NAACP Legal Department Case Files, UPA hasorganized this Supplement to Part 23 into several series based on geographiclocation. Series A covers southern states and is further divided into three sections.Section I covers Alabama, Arkansas, and Florida. Section II covers Georgia,Maryland, North Carolina, South Carolina, and Virginia. Section III covers Kentucky,Louisiana, Mississippi, Tennessee, and Texas. Series B covers northeastern states,while Series C and D cover the Midwest and West, respectively. This guide providesa reel index as well as an alphabetical index of correspondents and subjects for thecases in Series A, Section II.
Series A, Section II includes files from several cases relating to demonstrationsand protests. The Georgia case NAACP v. Over street had a significant impact onNAACP protest strategies and the financial health of the organization. NAACP v.Overstreet arose out of an incident on May 30, 1962, in a Savannah grocery store.
On that day, Robert Bolton, a fourteen-year-old African American male, reported tothe Savannah police that Haldred Overstreet, the owner and operator of the grocerystore, had physically assaulted him. Bolton's mother contacted the SavannahNAACP branch, and the branch quickly decided to stage a boycott of Overstreet'sstore. The boycott continued until June 22, when Overstreet won a temporaryrestraining order against further picketing. Shortly thereafter, a jury awarded
Overstreet damages in the amount of $85,793.05. After the supreme court of Georgiaaffirmed the judgment of the trial court, the NAACP filed a petition for a writ ofcertiorari with the U.S. Supreme Court. In December 1965, the Court initially agreedto consider one of the questions in the case but dismissed the writ of certiorari inApril 1966; therefore, the ruling of the Georgia Supreme Court held.
The significant impact of NAACP v. Overstreet on the organization's operationsis illustrated in part by a July 7, 1966, memorandum from NAACP General CounselRobert L. Carter to all NAACP branches and NAACP personnel (Reel 9, Frame0033). In the memorandum, Carter discussed how the decision would affect NAACP

participation in boycotts and other protests against private persons or businesses.Carter stressed the need for the NAACP to be very cautious in its conduct. He alsomentioned that when local branches undertook such protests, it was essential thatthey did so as units distinct from the NAACP national corporation. Carter noted thatthis strategy was necessary in order to prevent people like Overstreet from comingto New York to collect money from the NAACP.
Several other cases in this edition concern the rights of the NAACP and othercivil rights organizations to engage in public protests against racial discrimination.The case of Kelly v. Page arose from civil rights demonstrations in Albany, Georgia,in the early 1960s. Asa D. Kelly, the mayor of Albany, sued the local AlbanyMovement and the Southern Christian Leadership Conference, Student NonviolentCoordinating Committee, Congress of Racial Equality, and NAACP in an attempt tostop the demonstrations in the city. In North Carolina, Sellars v. NAACP involved theboycott of a Winston-Salem grocery store. The owners of the store, Howard E.Sellars and Jesse E. Sizemore, charged that the national NAACP, the Winston-Salem NAACP branch, and the Kimberly Park Neighborhood Association conspired
to prevent consumers from entering their store. In their defense, the threeorganizations argued that Sellars treated his African American customers in aderogatory manner, sold beer and wine to minors, and once threatened to summonthe Ku Klux Klan. The other boycott case in this edition is Hornstein v. NAACP. In
this case, Stanley Hornstein, the owner of a Victoria, Virginia, grocery store, refusedto display a sign condemning the Ku Klux Klan. The Lunenberg County NAACP
branch and the Virginia Students' Civil Rights Committee coordinated a boycottagainst Hornstein's store.
Employment opportunities for African Americans had been an important part ofthe NAACP's agenda since the 1930s. After passage of the Civil Rights Act of 1964,with its Title VII provision against discrimination by employers, labor unions, andemployment agencies, the NAACP filed many employment discrimination cases.
This edition contains employment discrimination cases from Georgia, Maryland,North Carolina, and Virginia. The most well-documented employment discriminationcase in this edition is Banks v. Lockheed-Georgia Co. This case involved Ralph
Banks and other African American employees of the Lockheed-Georgia Company,the Marietta, Georgia, branch of the Lockheed Aircraft Corporation. Banks and hisfellow plaintiffs claimed that African American employees were denied promotions,that the company administered tests for promotions that had a discriminatory effect,that African Americans were excluded from supervisory positions, and that anatmosphere of racial intimidation pervaded the workplace. The files for this caseinclude correspondence, lawyers' notes, and twenty-nine volumes of transcripts ofthe court proceedings. These proceedings include testimony from many Lockheed-Georgia employees describing working conditions at the plant. Among the files is acopy of the settlement of the case as well as correspondence related to thesettlement (Reel 1, Frame 0472).

Other employment discrimination cases from Georgia are Jones v. J. P.Stevens Co., Jones v. Montag, Inc., and Luster v. Local 709, InternationalAssociation of Machinists and Aerospace Workers, AFL-CIO. The Marylandemployment discrimination case is Morton v. Charles County Board of Education, in
which faculty members in the Charles County school system charged that AfricanAmerican employees had been refused employment or promotion, or had beendemoted or discharged, because of their race. In another part of this case, two of theplaintiffs were school children who argued that Charles County continued to maintain"racially identifiable schools." The North Carolina employment discrimination case isGriggs v. Duke Power Co. Virginia cases on employment discrimination are Quarlesv. Phillip Morris, Inc., United States v. Chesapeake and Ohio Railway Co., andUnited States v. Virginia Electric and Power Co.
School desegregation remained an important area of litigation for the NAACPduring the period covered by this edition. The most significant and well-documentedschool desegregation case in this section is Bradley v. School Board of the City ofRichmond. Parents of African American students originally brought this case in 1961,and it reached the U.S. Supreme Court in both 1965 and 1973. This case addressedmany issues central to school desegregation controversies throughout the 1960sand 1970s, including "freedom of choice" plans, faculty desegregation, busing, andmultidistrict desegregation remedies. In 1972, federal district court judge Robert R.Merhige Jr. ordered the merger of the Richmond schools with those in thesurrounding Chesterfield and Henrico Counties. A federal appeals court overturnedMerhige's order, and, in 1974, the U.S. Supreme Court upheld the appeals courtruling. Judge Merhige's order and the 1974 Supreme Court decision are reproducedin this edition.
Other cases in this edition concern interracial marriage, rights of criminaldefendants, libel and slander, and voting rights. Loving v. Virginia involved achallenge to Virginia's law prohibiting interracial marriages. Richard Perry Loving andMildred Jester married in Washington, D.C., in June 1958. After the marriage, theyreturned to Virginia and took up residence in Caroline County but were arrested inJuly for violating Virginia's ban on interracial marriages. In January 1959, the Lovingspleaded guilty; the court sentenced them to one year in jail and then suspended thesentence, provided that the Lovings left the state of Virginia for twenty-five years.The Lovings moved back to Washington, D.C., but decided in 1963 to challenge theVirginia law regarding interracial marriages. In 1967, the U.S. Supreme Court foundthat the Virginia law violated the Fourteenth Amendment. The NAACP's amicuscuriae brief supporting the Lovings is reproduced in this edition. In State of NorthCarolina v. Mallory, the case that arose from a kidnapping incident in Monroe, NorthCarolina, the defendants claimed that they had been denied their right to counsel.Libel and slander cases include Fields v. Law, Naimaster v. NAACP, and four casesinvolving the Barlington, South Carolina, NAACP branch. Voting rights cases includeBacote v. Carter, in which the then-governor of Georgia, Jimmy Carter, was one of

the defendants, and two cases from South Carolina: South Carolina NAACP StateConference of Branches v. West and Stevenson v. West.
