Lee Kirk Burgess, 48, of Mount Ulla, and Anthony Jasper Osmond Tolliver, 31, of York, South Carolina, each were sen- tenced by Superior Court Judge Mark E. Powell to 70 months to 93 months in the North Carolina Department of Adult Corrections, according to anews release from District Attorney Ashley Welch. Each defendant was also assessed a $50,000 fine. The street value of meth seized in the case was around $5,000, Welch said. The two were traveling on Interstate 40 with a third person, Levi Esh, on Jan. 24,2014, when they were pulled over for a minor traffic violation, according to Assistant District Attorney Jeff Jones said. After a trooper smelled marijuana, a consent search revealed methamphet- amine in various pieces of luggage, along with numerous glass pipes, digital scales, and misdemeanor amounts of marijuana, Jones said. Esh, 35, of Statesville, pleaded guilty prior to trial. Burgess and Esh admitted to their share of the meth, but Tolliver did not, Jones said. Keys in one bag belonging to Tolliver fit a lock on a green metal box in a second bag, which tied Tolliver to its con- tents, including a crystal-like substance. Testimony from Special Agent Mi- chael Piwowar, a forensic chemist with the State Crime Lab, established the crys- talline substance contained in that green metal box was about 2 ounces of metham- phetamine, Jones said. More than 3.5 ounces of meth were found overall. Man charged with aiding motel killing LEAH BULETTI [email protected] ASHEVILLE A second Asheville man has been charged in the 2013 Nakon Motel killing, which had been consid- ered a cold case until Saturday. Aaron Daniel Jones, 34, of the 200 block of Richmond Hill Drive, was charged with two felony counts of accessory after the fact in connection with the November 2013 killing of William Pernas- Baraqui, according to warrants at the Bun- combe County magis- trate's office. Pernas-Baraqui, 41, of Florida, was found dead Nov. 6,2013, at Nakon Mo- tel, 1233 Smokey Park Highway. Warrants state Jones, knowing that Mauricus Santel Fleming had com- mitted first-degree mur- der, assisted Fleming in attempting to es- cape and in escaping detection, arrest and punishment, as well as in disposing of evidence. Warrants further state Jones assisted Mauricus Santel Fleming Aaron Daniel Jones Fleming in attempting to escape detec- tion by taking proceeds from the felony. On Saturday, Fleming, 29, of the 100 block of Pisgah View Road, was charged with first-degree murder and robbery with a dangerous weapon, both felonies, according to warrants. Fleming assaulted Pernas-Baraqui with a handgun and stole money and nar- cotics valued at $7,000 from him, war- rants state. One day earlier, Fleming was charged with two felony counts of trafficking in opium or heroin, with the date of offense listed as Sept. 19. Warrants state Fleming possessed and transported more than 28 grams of heroin. Fleming on Tliesday was also charged with possession of a firearmby a felon, ac- cording to warrants. He possessed a .38- caliber revolver on Sept. 24, after being convicted of felony attempted common law robbery in 2007 in Buncombe County Superior Court, warrants state. He was sentenced to eight months in that case. The Buncombe County Sheriff's Of- fice and the Buncombe County Anti- Crime Task Force are investigating the slaying case. Jones was being held at the Bun- combe County Detention Facility on a $130,000 secured bond. Fleming is not eligible for bond. The United States Environmental Protection Agency J Announces a Public Meeting and Public Comment for I I the CTS of Asheville, Inc., Superfund Site located in Asheville, North Carolina The United States Environmental Protection Agency (EPA) has issued an Interim Proposed Plan for the CTS of Asheville, Inc., Superfund Site located in Asheville, Buncombe County, North Carolina. A public meeting to present the details of the Interim Proposed Plan will be held on Tuesday, October 13, 2015, from 6:00p.m. to 8:00p.m. at the T.C. Roberson High School auditorium located at 250 Overlook Road in Asheville. EPA is conducting a 30-day public comment period from October 1, 2015 to October 30, 2015, to seek public input on the Interim Proposed Plan. During the comment period, the public is encouraged to review and offer comments on all site- related documents. You can find these documents on line at http://semspub.epa.gov/src/collection/04/AR63944. CTS manufactured electronic components used in auto parts and hearing aids from 1959 to April 1986 when plant operations ceased. Small electronic components were electroplated with tin, nickel, zinc and silver as one step in the process. Solvents, including TCE were used to clean, or degrease, the parts before electroplating. Disposal and/or recycling activities at the facility prior to 1959 are unknown. From 1959 to 1980, metal-bearing rinse waters and alkaline cleaners that could not be reclaimed from the electroplating process were reportedly disposed of through the municipal sewer system, while concentrated metals and solvent wastes were placed in drums for off-site disposal/recycling. After 1980, wastes were accumulated in drums on-site prior to off-site disposal/recycling. Numerous environmental investigations have been conducted at the CTS site since the late 1980s. The Site was proposed to the National Priorities List (NFL) in March 2011, and became Final on the NFL in March 2012. EFA's has selected Electrical Resistance Heating (ERH), as the preferred alternative to address the NAPL/TCE source area. ERH was the most aggressive and effective source control remedy evaluated in the Focused Feasibility Study (FFS). ERH provides the highest level of certainty to meet the RAO, as the technology has demonstrated greater than 95% TCE removal efficiencies. ERH can be implemented in the least amount of time, and provides the greatest long-term permanence. Although ERH has a slightly higher total cost, it is a one-time source control and treatment event with no longer term operation and maintenance costs. WAYNESVILLE — A Haywood Coun­ty jury has found two people guilty of methamphetamine trafficking.
