Security guards will not be required since alcohol sales from the premises will typically bedelivered directly to the customer's residence or business. Alcohol sales from the premiseswill require a prearranged appointment and a $15 minimum purchase. The premises willbe monitored by a video surveillance system during all hours, and will be secured by amonitored alarm system when the business is closed. Conditions have been reviewed andapproved by the Los Angeles Police Oepartment.

D. PUBLIC CONVENIENCE AND NECESSITY EVALUATION
The City of Los Angeles is very concerned if a new request to sell alcohol is subject to one of the followingconditions noted on page 5 of this application. There is a strong likelihood that the City will deny your "publicconvenience or necessity" application if one of the above listed conditions apply to your site. It is stronglysuggested that you contact your Council Office and discuss your project. If the Council Office does notoppose your project, you should then check with your local area police vice unit as well as the PlanningDepartment Public Counter at (213) 482-7077 for the determination of whether the proposed site is within aSpecific Plan area, and the Community Redevelopment Agency (CRA) project staff at (213) 977-1682 or977 -1665, to determine if your site is in a CRA Project Area. If any of the five conditions listed below apply toyour site, you should carefully consider if you want to file for a Public Convenience or Necessity finding.
1. The proposed site is in an area with a long-term level of undue concentration of alcoholic beverageoutlets.
2. The geographic area is the target of special law enforcement activity, e.g., police task force isworking on reducing vice in the area, or eliminating juvenile crime (such as cruising or Graffiti) organg activity.
3. The proposed site is in close proximity to sensitive uses, including schools, parks, churches, youthactivities, homeless shelters, mental health or alcohol or drug treatment centers.
4. The geographic area has elevated levels of alcohol-related crimes, including but not limited to: publicintoxication, driving under the influence, assault, vandalism, prostitution, drug violations, loitering.

D. PUBLIC CONVENIENCE AND NECESSITY EVALUATION
The City of Los Angeles is very concerned if a new request to sell alcohol is subject to one of thefollowing conditions noted on page 5 of this application. There is a strong likelihood that the City will denyyour "public convenience or necessity" application if one of the above listed conditions apply to your site.It is strongly suggested that you contact your Council Office and discuss your project. If the Council Officedoes not oppose your project, you should then check with your local area police vice unit as well as thePlann ing Department Public Counter at (213) 482-7077 for the determination of whether the proposedsite is within a Specific Plan area, and the Community Redevelopment Agency (CRA) project staff at(213) 977-1682 or 977-1665, to determine if your site is in a CRA Project Area. If any of the fiveconditions listed below apply to your site, you should carefully consider if you want to file for a PublicConvenience or Necessity finding.
1. The proposed site is in an area with a long-term level of undue concentration of alcoholicbeverage outlets.
According to the State of California Department of Alcoholic Beverage Control licensing criteria,five off-sale licenses are allocated to subject Census Tract No. 1919.00. In Census Tract No.1919.00, there are presently seven existing off-site licenses, four of which are for a full line ofalcoholic beverages and three of which are restricted to beer and wine only. Although the additionof a new establishment would exceed the number of licenses allocated, this disparity is due to anumber of factors, and does not translate into an undue concentration. Alcoholic beveragelicenses are allocated by population with census tracts, and there are large commercial andindustrial areas located within this census tract. This has the effect of lowering the number oflicenses allocated to a large geographical area. Further, while the data indicates that the existinglicense count exceeds the allocation threshold, none of the other establishments are locatedwithin the immediate vicinity; they are dispersed throughout the Census Tract and are separatedfrom the proposed site by approximately 800 feet to over 3,000 feet.
Moreover, the proposed use is currently operating within the immediate area, approximately1,700 feet from the site. It is being forced to relocate because the existing site where it is locatedis being developed into a more dense mixed use project. Therefore, the relocation of thebusiness to the subject property does not represent a new licensee within this area. Further, thisbusiness provides a critical service to the community by delivering fresh food and groceries.
Additionally, the proposed use is unlike a conventional off-site alcohol sales outlet as theproposed use is primarily a warehouse use with delivery service. Several conditions have beenproposed to address concerns about undue concentration of establishments. These conditionsare listed in Attachment 1 and have been approved by the Hollywood Vice Unit of the LosAngeles Police Department and the Central Hollywood Neighborhood Council, whichunanimously voted to support the project. Therefore, the proposal would not result in an undueconcentration of such establishments.

The project site is not within a close proximity to any sensitive uses such as schools, parks,churches, youth activities, homeless shelters, mental health or alcohol or drug treatment centers.
The proposed use has been approved by the Hollywood Vice Unit of the Los Angeles PoliceDepartment. No concerns have been raised concerning the proposed use, subject to it operatingin compliance with the conditions listed in Attachment 1.
3. The proposed site is in close proximity to sensitive uses, including schools, parks, churches,youth activities, homeless shelters, mental health or alcohol or drug treatment centers.
The proposed use is supported by the Hollywood Vice Unit of the Los Angeles PoliceDepartment. No concerns related to elevated levels of alcohol-related crimes, including but notlimited to: public intoxication, driving under the influence, assault, vandalism, prostitution, drugviolations, or loitering have been raised in relation to the proposed grocery delivery servicewarehouse. Some supporters have indicated that the service decreases the incidence of drunkdriving.
4. The geographic area has elevated levels of alcohol-related crimes, including but not limited to:public intoxication, driving under the influence, assault, vandalism, prostitution, drug violations,loitering.
The subject property is not located within a Specific Plan or Community Redevelopment AgencyProject area.
5. The proposed site is located in a Specific Plan or Community Redevelopment Agency Projectarea which specifically includes a policy to control future alcoholic beverage sales.
E. IF THE PROJECT SITE IS NOT SUBJECT TO ONE OF THE ABOVE CRITERIA, YOUR PROJECT WILLBE EVALUATED BY THE CITY COUNCIL WITH CONSIDERATION GIVEN TO THE FOLLOWINGPOSSIBLE BENEFITS AND DETRIMENTS TO THE COMMUNITY:
1. Possible Benefits

a. Employ local residents (how many)
Yummy Foods will provide a benefit to the community by employing local residents. YummyFoods heavily recruits within the local community. The proposed store is anticipated toemploy at least 20 local residents.
b. Generate taxes (provide estimate)
Yummy Foods presently operates a similar business approximately 1,700 feet away in theCity of West Hollywood. Because of a proposed redevelopment of that site, YummyFoods must relocate its business. Yummy Foods anticipates $6 million in annual salesfor this location. The relocation of Yummy Foods to the subject property will result innew tax and other business-related revenues generated for the City of Los Angeles,including sales tax and the City's gross receipts tax.
c. Provide unique goods and services (which ones)
Yummy Foods delivers groceries to residents who do not have a car, are homebound,elderly, sick or too busy to go to the supermarket themselves. Yummy Foods delivers afull assortment of groceries, including fresh produce, fresh meat, fresh prepared foods,packaged and organic groceries. Like other grocery stores, customers can alsopurchase beer, wine and liquor. Yummy has serviced this community since 2002 andthere are no other similar businesses serving the community. More than 2,500residents have expressed their support for the proposed request, along with the CentralHollywood Neighborhood Council, and the Hollywood Vice Unit of the Los AngelesPolice Department.
d. Result in an aesthetic upgrade to the neighborhood (in what exact way)
The proposed use would ensure that the building remains viable and does not remainvacant for a prolonged period of time. Occupancy of the building by a viable commercial usewill act as a deterrent against crime and graffiti.
e. Contribute to the long term economic development (how)
Yummy Foods will provide a long-term economic benefit to the community by relocating asuccessful operation from the City of West Hollywood to the City of Los Angeles. YummyFoods will also contribute to the long-term economic development of the neighborhood byproviding it with a stable, successful business that provides a valuable service with itsdeliveries of fresh produce, food and groceries.
f. Provide a beneficial cultural/entertainment outlet (specify)
The proposed use will provide numerous benefits to the surrounding community, although itdoes not include a cultural or entertainment component.
2. Possible Detrimental Impacts
The proposed project would not be detrimental to the character of development in the immediateneighborhood. The proposed use will be located within an existing warehouse building and ispermitted by right in the M1 Zone. The proposed availability of alcoholic beverages in the marketwould not be for consumption upon the premises. Further, alcohol sales are an incidentalcomponent of the operation, comprising no more than five percent of the total floor area of theproposed business. The proposed use would be located within an existing building on acommercial street in an industrial zone. Adjoining and surrounding uses include warehouse andoffice uses to the north, parking uses to the south and residential uses to the west. The proposeduse would be located within a fully enclosed building with no openings facing the properties in themultiple family residential zone to the west. The space is currently occupied by awarehouse/distribution use and the proposed use would be no more intensive than the existinguse's activities. Moreover, the proposed use already exists within this geographic area and isbeing relocated from a nearby site. The availability of alcoholic beverages would not result in anylocalized impacts. The business would not have a storefront located on a public street and wouldnot have any signage indicating the availability of alcoholic beverages. Most sales would be inthe form of preordered products delivered directly to the customer.
The Hollywood Vice Unit of the Los Angeles Police Department supports the application and hasraised no concerns related to excessive calls to the Police Department, excessive strain on policeresources, high rates of alcoholism or homelessness in the area, or any concerns of a large"youth" population in the area of the project site, as these relate to the operation of the proposedgrocery warehouse.

The primary business is the delivery of groceries, such as fresh food and householdproducts. The sale of alcoholic beverages is an incidental component of the business,yet necessary in order to remain a viable grocery solution for its customers. No sales ofalcoholic beverages will be made after 12:00 a.m. The majority of employees will be atleast 21 years of age.
c. Would the business duplicate a nearby business already in existence?
There are no other similar businesses serving the surrounding community. YummyFoods would serve as a convenient alternative for community members who requireor prefer the personal benefits of a grocery delivery service.
c. Other non-alcohol sales business options available so alcohol does not have to be sold,e.g., more specialty products, broader range of items like fresh meats or fruits andvegetables, etc.
Like other grocery stores, alcohol sales are an incidental component of the proposedstore. The store will offer a wide selection of fresh meats, dairy products, fruit andvegetables, and typical grocery products. However, the store must also offer alcoholicbeverages in order to meet customer demand and to remain a viable grocery solution.
ATTACHMENT 1

1. Retail hours of the facility shall be between the hours of 08:00 a.m. to 12:00 a.m. seven days a week.
2. No pay phone will be maintained on the exterior of the premise.
3. There shall be no coln-operated games or video machines maintained upon the premises.
5. The Petitioner(s} shall be responsible for maintaining free of litter, the area and adjacent to the premises over which theyhave control.
4. Any graffiti painted or marked upon the premises or on any adjacent area under the control of the Petitioner(s) shall beremoved or painted over within 24 hours of being applied.
6. Electronic age verifications device(s) which can be used to determine the age of any individual attempting to purchasealcoholic beverages or tobacco products shall be installed on the premise at each point-of-sale location. This device(s)shall be maintained in an operational condition and all employees shall be instructed in their use prior to the sale of anyalcoholic beverage or tobacco product.
7. The Petitioner(s) shall install and maintain security cameras and a one-month video library that covers all common areasof the business, high-risk areas and entrances or exits. The videotapes shall be made available to police upon request.
8. Any future operator or owner for this use must file a new Plan Approval Application or an equivalent to allow the City ofLos Angeles to review the "mode and character" of the usage.
9. Any music, sound or noise emitted that is under the control of the petitioner(s) shall not violate Section 116.1 of the LosAngeles Municipal Code.
10. If at any time during the period of the grant, should documented evidence be submitted showing continued violation(s) ofany condition(s) of the grant, resulting in a disruption or interference with the peaceful enjoyment of the adjoining andneighboring properties, the Zoning Administrator will have the right to require The Petitioner(s) to file for a plan approvalapplication together with the associated fees, to hold a public hearing to review The Petitioner(s) compliance with and theeffectiveness of the conditions of the grant. The Petitioner(s) shall submit a summary and supporting documentation ofhow compliance with each condition of the grant has been attained.
11. Any carry-out purchase of alcoholic beverages shall be for a minimum of $15.00.
12. All alcoholic beverages shall be handled by employees only until the time of purchase.
13. All alcohol sales conducted within the premises shall be by appointment only.
14. There shall be no exterior advertising of any kind or type promoting or indicating the availability of alcoholic beverages.This shall not preclude the inclusion of alcoholic beverages in any catalog that lists products available for sale.
15. Alcoholic beverages in containers of 12 ounces or less shall only be sold in prepackaged multi packs.

Pursuant to Los Angeles Municipal Code Section 12.24-W, 1, I hereby APPROVE:
upon the following additional terms and conditions:
1. All other use, height and area regulations of the Municipal Code and all otherapplicable government/regulatory agencies shall be strictly complied with in thedevelopment and use of the property, except as such regulations are hereinspecifically varied or required.
2. The use and development of the property shall be in substantial conformance withthe plot plan submitted with the application and marked Exhibit "A", except as may berevised as a result of this action.
3. The authorized use shall be conducted at all times with due regard for the characterof the surrounding district, and the right is reserved to the Zoning Administrator toimpose additional corrective Conditions, if, in the Administrator's opinion, suchConditions are proven necessary for the protection of persons in the neighborhood oroccupants of adjacent property.

4. All graffiti on the site shall be removed or painted over to match the color of thesurface to which it is applied within 24 hours of its occurrence.
5. A copy ofthe first page of this grant and all Conditions and/or any subsequent appealof this grant and its resultant Conditions and/or letters of clarification shall be printedon the building plans submitted to the Zoning Administrator and the Department ofBuilding and Safety for purposes of having a building permit issued.
6. Indemnification. The applicant shall defend, indemnify and hold harmless the City, itsagents, officers, or employees from any claim, action, or proceeding against the Cityor its agents, officers, or employees to attack, set aside, void or annul this approvalwhich action is brought within the applicable limitation period. The City shall promptlynotify the applicant of any claim, action, or proceeding and the City shall cooperatefully in the defense. If the City fails to promptly notify the applicant of any claim actionor proceeding, or if the City fails to cooperate fully in the defense, the applicant shallnot thereafter be responsible to defend, indemnify, or hold harmless the City.
7. The grant made herein shall have a life of five years after which the grant entitlementshall be null and void and the applicant shall file for and win approval of a new grantfrom the Office of Zoning Administration in order to continue the sale of a full line ofalcoholic beverages for on-site consumption.
8. Store operation shall be permitted only between the hours of 8:00 a.m. and midnight,seven days a week.
9. Approved herein is the sale of a full line of alcoholic beverages for off-siteconsumption, in conjunction with a 7,380 square-foot grocery warehouse.
10. Any future operator or owner for this site must file a new Plan Approval Application oran equivalent to allow the City of Los Angeles to review the "mode and character" ofthe usage.
11. No pay phone will be maintained on the exterior of the premise.
12. There shall be no coin-operated games or video machines maintained upon thepremises.
13. Electronic age verifications device(s) which can be used to determine the age of anyindividual attempting to purchase alcoholic beverages or tobacco products shall beinstalled on the premise at each point-of-sale location. This device(s) shall bemaintained in an operational condition and all employees shall be instructed in theiruse prior to the sale of any alcoholic beverage or tobacco product.
14. The Petitioner(s) shall install and maintain security cameras and a one-month videolibrary that covers all common areas of the business, high-risk areas and entrances orexits. The videotapes shall be made available to police upon request.
15. Any music, sound or noise emitted that is under the control of the petitioner(s) shall

not violate Section 116.1 of the Los Angeles Municipal Code.
16. If at any time during the period of the grant, should documented evidence besubmitted showing continued violation(s) of any condition(s) of the grant, resulting in adisruption or interference with the peaceful enjoyment of the adjoining andneighboring properties, the Zoning Administrator will have the right to require ThePetitioner(s) to file for a plan approval application together with the associated fees, tohold a public hearing to review The Petitioner(s) compliance with and theeffectiveness ofthe conditions of the grant. The Petitioner(s) shall submit a summaryand supporting documentation of how compliance with each condition of the granthas been attained.
17. Any carry-out purchase of alcoholic beverages shall be for a minimum of $15.00.(Applicant-volunteered)
18. All alcoholic beverages shall be handled by employees only until the time ofpurchase. (Applicant-volunteered)
19. All alcohol sales conducted within the premises shall be by appointment only.(Applicant-volunteered)
20. There shall be no exterior advertising of any kind or type promoting or indicating theavailability of alcoholic beverages. This shall not preclude the inclusion of alcoholicbeverages in any catalog that lists products available for sale. (Applicant-volunteered)
21. Alcoholic beverages in containers of 12 ounces or less shall be only be sold inprepackaged multipacks. (Applicant-volunteered)
22. Fire: The following recommendations of the Fire Department relative to fire safetyshall be incorporated into the building plans, which includes the submittal of a plotplan for approval by the Fire Department either prior to the recordation of a final mapor the approval of a building permit. The plot plan shall include the following minimumdesign features: fire lanes, where required, shall be a minimum of 20 feet in width; allstructures must be within 300 feet of an approved fire hydrant, and entrances to anydwelling unit or guest room shall not be more than 150 feet in distance in horizontaltravel from the edge of the roadway of an improved street or approved fire lane.
• High-efficiency toilets (maximum 1.28 gpf), including dual-flush water closets, andhigh-efficiency urinals (maximum 0.5 gpf), including no-flush or waterless urinals,in all restrooms as appropriate. Rebates may be offered through the Los AngelesDepartment of Water and Power to offset portions of the costs of theseinstallations.
23. Utilities: Unless otherwise required, and to the satisfaction of the Department ofBuilding and Safety, the applicant shall install:

• Restroom faucets with a maximum flow rate of 1.5 gallons per minute.
Single-pass cooling equipment shall be strictly prohibited from use. Prohibition ofsuch equipment shall be indicated on the building plans and incorporated into tenantlease agreements. (Single-pass cooling refers to the use of potable water to extractheat from process equipment, e.g. vacuum pump, ice machines, by passing the waterthrough equipment and discharging the heated water to the sanitary wastewatersystem.)
24. Prior to issuance of any permits relative to this matter, a covenant acknowledging andagreeing to comply with all the terms and conditions established herein shall berecorded in the County Recorder's Office. The agreement (standard master covenantand agreement for CP-6770) shall run with the land and shall be binding on anysubsequent owners, heirs or assigns. This agreement with the conditions attachedmust be submitted to the Department of City Planning for approval before beingrecorded. After recordation, a certified copy bearing the Recorder's number and dateshall be provided to the Department of City Planning for attachment to the subjectcase file.
25. Prior to the clearance of any conditions, the applicant shall show proof that all feeshave been paid to the Department of City Planning, Expedited Processing Section.
OBSERVANCE OF CONDITIONS - TIME LIMIT - LAPSE OF PRIVILEGES - TIMEEXTENSION
All terms and Conditions of the approval shall be fulfilled before the use may beestablished. The instant authorization is further conditional upon the privileges beingutilized within two years after the effective date of approval and, if such privileges are notutilized or substantial physical construction work is not begun within said time and carriedon diligently to completion, the authorization shall terminate and become void. A ZoningAdministrator may extend the termination date for one additional period not to exceed oneyear, if a written request on appropriate forms, accompanied by the applicable fee is filedtherefore with a public Office of the Department of City Planning setting forth the reasonsfor said request and a Zoning Administrator determines that good and reasonable causeexists therefore.
TRANSFERABI L1TY
This authorization runs with the land. In the event the property is to be sold, leased, rentedor occupied by any person or corporation other than yourself, it is incumbent that youadvise them regarding the conditions of this grant.
VIOLATIONS OF THESE CONDITIONS, A MISDEMEANOR
Section 12.29 of the Los Angeles Municipal Code provides:
"A variance, conditional use, adjustment, public benefit or other quasi-judicialapproval, or any conditional approval granted by the Director, pursuant to the

authority of this chapter shall become effective upon utilization of any portion of theprivilege, and the owner and applicant shall immediately comply with its Conditions.The violation of any valid Condition imposed by the Director, Zoning Administrator,Area Planning Commission, City Planning Commission or City Council in connectionwith the granting of any action taken pursuant to the authority of this chapter shallconstitute a violation of this chapter and shall be subject to the same penalties as anyother violation of this Code."
Every violation of this determination is punishable as a misdemeanor and shall bepunishable by a fine of not more than $1,000 or by imprisonment in the county jail for aperiod of not more than six months, or by both such fine and imprisonment.
APPEAL PERIOD - EFFECTIVE DATE
The applicant's attention is called to the fact that this grant is not a permit or license andthat any permits and licenses required by law must be obtained from the proper publicagency. Furthermore, if any Condition of this grant is violated or if the same be notcomplied with, then the applicant or his successor in interest may be prosecuted forviolating these Conditions the same as for any violation of the requirements contained inthe Municipal Code. The Zoning Administrator's determination in this matter will becomeeffective after September 11, 2009, unless an appeal there from is filed with the CityPlanning Department. It is strongly advised that appeals be filed early during the appealperiod and in person so that imperfections/incompleteness may be corrected before theappeal period expires. Any appeal must be filed on the prescribed forms, accompanied bythe required fee, a copy ofthe Zoning Administrator's action, and received and receipted ata public office of the Department of City Planning on or before the above date or theappeal will not be accepted. FINDINGS OF FACT
After thorough consideration of the statements contained in the application, the planssubmitted therewith, the report by the Department of City Planning Staff thereon, and thestatements made at the public hearing on August 12, 2009, all of which are by referencemade a part hereof, as well as knowledge of the property and surrounding district, I findthat the requirements for authorizing a conditional use permit for the sale of a full-line ofalcoholic beverages for off-site consumption under the provisions of Section 12.24-W havebeen established by the following facts:
BACKGROUNDThe subject site is located in the Hollywood Community Plan and has a LimitedManufacturing land use designation. The lot is generally flat, rectangular shaped withapproximately 407 linear feet of frontage along Mansfield Avenue and a lot depth ofapproximately 147 feet. The site is currently improved with three buildings occu pied byoffice and warehouse uses with 76 parking spaces, including three handicap spaces.
The applicant is requesting to permit the sale of a full line of alcoholic beverages for off-siteconsumption, in conjunction with a grocery warehouse delivery service, selling a full line offresh produce, fresh meat, and packaged groceries. The proposed grocery warehousespace will be located within an existing 29,184 square-foot warehouse and office building.The proposed use would be located within a fully enclosed building. The business wouldnot have a storefront located on a public street and would not have any signage indicatingthe availability of alcoholic beverages. The applicant presently operates a similar businessapproximately 1,700 feet away in the City of West Hollywood. The operation is proposedto be relocated at the project site, since the existing business site will be redeveloped. Thebusiness provides an alternative to the community who prefers the benefits of a grocerydelivery service.
Surrounding uses consist of warehouse and office uses to the north in the M1-1VL Zone,multi-family uses further north across Lexington Avenue in the RD1.5-1XL Zone,warehouse and office uses to the south in the M1-1VL and C2-1 D Zone, single and multi-family uses to the west in the R3-1XL Zone, and a parking lot across Mansfield Avenue inthe M1-1VL Zone.
Previous Cases. Affidavits. Permits. and Orders on the Applicant's Property:
There are no similar or relevant ZA or CPC cases.
Previous Cases, Affidavits, Permits. and Orders on Surrounding Properties:
Case No. ZA 2003-9172(CUB)(ZV): On March 30, 2004, the Associate ZoningAdministrator approved a Conditional Use Permitforthe continued sale and dispensing ofa full line of alcoholic beverages for on-site consumption, in conjunction with a restaurant inthe M1-1VL Zone, and a Variance to permit the required parking on another lot beyond a

750-foot distance by lease agreement in lieu of a covenant and agreement, located at 1155North Highland Avenue.
Case No. ZA 2002-3406(CUB): On December 18, 2002, the Associate ZoningAdministrator approved a request for a Conditional Use Permit, to permit the sale anddispensing of a full line of alcoholic beverages for on-site consumption, located at 1155North Highland Avenue.
The Hollywood Plan Map designates the property for Limited Manufacturing land use withthe corresponding Zone of M1. The property is not currently within the area of any specificplans or interim control ordinances. The site is located in the Hollywood RedevelopmentProject Area.
Mansfield Avenue is a Local Street with a 60-foot width at project's street frontage.
Public Hearing
The public hearing was held on August 12, 2009 in City Hall. The hearing was attended bythe applicant, his representative, a member of the public, and Officer Ritchie from LAPDVice. Barnaby Montgomery described the need for the new conditional use permit for thesale of a full line of alcoholic beverages for off-site consumption in conjunction with agrocery delivery service. He stated that he is losing his current warehouse location a fewblocks away and needs a new location by the beginning of next year. Yummy Foodsoperates three warehouses, two in Los Angeles and one in Santa Monica. His groceryservice has been operating for seven years and alcohol sales are incidental to grocerysales, but crucial to the success of his operation. His representative stated that therewould be no signage and that the warehouse was permitted by-right in the zone. GloriaJohnson, a customer of Yummy Foods who is disabled explained how she relies on theirdelivery service to quickly bring her food and other items. She said it is a wonderfuloperation with helpful staff and she does not know what she would do without them.Officer Ritchie stated that he has no problem with the operation and submittedrecommended conditions of approval.
BASIS FOR CONDITIONAL USE PERMITS
A particular type of development is subject to the conditional use process because it hasbeen determined that such use of property should not be permitted by right in a particularzone. All uses requiring a conditional use permit from the Zoning Administrator are locatedwithin Section 12.24 of the Los Angeles Municipal Code. In order for the sale of a full lineof alcoholic beverages for off-site consumption to be authorized, certain designatedfindings have to be made. In these cases, there are additional findings in lieu of the fourstandard findings for most other conditional use categories.
CONDITIONAL USE FINDINGS
Following (highlighted) is a delineation of the findings and the application of the relevantfacts to same:

1. The proposed location will be desirable to the public convenience or welfare.
The subject site is located in the Hollywood Community Plan and has a LimitedManufacturing land use designation. The lot is generally flat, rectangular shapedwith approximately 407 linear feet of frontage along Mansfield Avenue and a lotdepth of approximately 147 feet. The site is currently improved with three buildingsoccupied by office and warehouse uses with 76 parking spaces, including threehandicap spaces.
The applicant is requesting to permit the sale of a full line of alcoholic beverages foroff-site consumption, in conjunction with a grocery warehouse delivery service,selling a full line of fresh produce, fresh meat, and packaged groceries. Therefore, the proposed use will bedesirable to the public convenience and welfare as it provides a service that willserve public convenience and welfare.
2. The location is proper in relation to adjacent uses or the development of thecommunity.
Surrounding uses consist of warehouse and office uses to the north in the M1-1VLZone, multi-family uses further north across Lexington Avenue in the RD1.5-1 XLZone, warehouse and office uses to the south in the M1-1VL and C2-1 D Zone,single and multi-family uses to the west in the R3-1XL Zone, and a parking lotacross Mansfield Avenue in the M1-1VL Zone. The Mansfield Avenue location isan appropriate spot for alcohol sales for off-site consumption in conjunction with agrocery warehouse. The proposed use would be located within a fully enclosedbuilding. The business would not have a storefront located on a public street andwould not have any signage indicating the availability of alcoholic beverages. Thelocation is proper in relation to adjacent uses and development of the communitybecause it follows an established pattern of orienting alcohol sales in an existingwarehouse building, in a manufacturing area. The location is appropriate in termsof the surrounding uses and the character of development.
3. The use will not be materially detrimental to the character of the developmentin the immediate neighborhood.
The proposed sale of alcohol for off-site consumption at a grocery warehouse willnot be materially detrimental because the area is primarily characterized by studiouses, warehouses, offices, and multi-family uses. The location along Mansfield

Avenue, a block north of Santa Monica Boulevard is an appropriate location foralcohol sales in a warehouse building. The Neighborhood Council and LAPD ViceUnit volunteered numerous conditions of approval which will reduce the impact ofthe operation of the store.
4. The proposed location will be in harmony with the various elements andobjectives of the General Plan.
There are eleven elements of the General Plan. Each of these elements establishespolicies that provide for the regulatory environment in managing the City and foraddressing environmental concerns and problems. The majority of the policiesderived from these Elements are in the form of Code Requirements of Los AngelesMunicipal Code. Except for those entitlements described herein, the project doesnot propose to deviate from any of the requirements of the Los Angeles MunicipalCode. The Land Use Element of the City's General Plan divides the city into 35Community Plans.
The project site is located within the Hollywood Community Plan Area. The plandesignates the subject site for Limited Manufacturing land uses with thecorresponding M1-1VL Zone. The location of a grocery warehouse in an areadesignated for limited industrial uses is consistent with the many goals theHollywood Community Plan. The Hollywood Community Plan text is silent withregards to alcohol sales. In such cases, the Zoning Administrator must interpret theintent of the Plan. Given the numerous conditions of approval, the proposed usecan be deemed to be in harmony with the General Plan.
5. The proposed use will not adversely affect the welfare of the pertinentcommunity
The approval of the conditional use request will not adversely affect the welfare ofthe Hollywood community. The subject property is zoned for limited manufacturinguses and will be utilized as such with the proposed grocery warehouse.Surrounding properties include studio uses, warehouses, offices, and multi-familyuses. The zoning of this parcel and adjacent properties represents an example oftransitional zoning within the City, which attempts to promote a gradual progressionof uses. The project will provide much needed economic revitalization of thecommunity.
6. The granting of the application will not result in an undue concentration ofpremises for the sale or dispensing for consideration of alcoholic beverages,including beer and wine, in the area ofthe City involved, giving considerationto applicable State laws and to the California Department of AlcoholicBeverage Control's guidelines for undue concentration; and also givingconsideration to the number and proximity of these establishments within aone thousand foot radius of the site, the crime rate in the area (especiallythose crimes involving public drunkenness, the illegal sale or use ofnarcotics, drugs or alcohol, disturbing the peace and disorderly conduct), and

whether revocation or nuisance proceedings have been initiated for any use inthe area.
According to the State Department of Alcoholic Beverage Control (ABC), there are 5off-site licenses and 6 on-site licenses allocated to Census Tract No. 1919 whilethere are 7 off-site licenses and 25 on-site licenses existing. The applicant isproposing to add one off-site license to this census tract. The tract is therefore overconcentrated. Over-concentration can be undue when the addition of a license willnegatively impact a neighborhood. Over-concentration is not undue when theapproval of a license does not negatively impact an area, but rather such licensebenefits the public welfare and convenience. Although the census tract isnumerically over-concentrated, the project will not adversely affect communitywelfare because the wine and spirits store is a desirable use in an area designatedfor such.
Statistics from the Los Angeles Police Department reveal that in subject CrimeReporting District No. 665, which has jurisdiction over the subject property, a total of500 crimes were reported in 2008, compared to the citywide average of 235 crimesand 282 crimes in the high crime reporting district for the same period. The LosAngeles Police Department, Hollywood Vice Unit, and the Central HollywoodNeighborhood Council has volunteered numerous conditions related to the serviceof alcohol that will further reduce any potential crime issues.
7. The proposed use will not detrimentally affect nearby residentially zonedcommunities in the area of the City involved, after giving consideration to thedistance of the proposed use from residential buildings, churches, schools,hospitals, public playgrounds and other similar uses, and otherestablishments dispensing, for sale or other consideration, alcoholicbeverages, including beer and wine.

The following sensitive uses are located within a 1,OOO-footradius of the project site:
The area is a mixture of manufacturing/office uses and multi-family to the west ofthe project site. The applicant worked with LAPD Vice Unit and the NeighborhoodCouncil to mitigate their concerns about the operation of the proposed project. Thesurrounding neighborhood has been and continues to be a mixed-useneighborhood. The applicant understands the character ofthe neighborhood and iscommitted to help preserve such character th rough responsible service of alcohol inthe store. The store is self-contained use that will not interfere with sensitive uses inthe area. The zoning of this parcel and adjacent properties represents an exampleof transitional zoning within the City, which attempts to promote a gradualprogression of uses.

ADDITIONAL MANDATORY FINDINGS
8. The National Flood Insurance Program rate maps, which are a part of the FloodHazard Management Specific Plan adopted by the City Council by Ordinance No.172,081, have been reviewed and it has been determined that this project is locatedin Zone C, areas of minimal flooding.
9. On July 22, 2009, the Department of City Planning issued Mitigated NegativeDeclaration No. ENV-2009-1517-MND. This Mitigated Negative Declaration reflectsthe independent judgment of the lead agency and determined that this project wouldnot have a significant effect upon the environment provided the potential impactsare mitigated to a less than significant level. I hereby adopt that action. Thecustodian of the documents or other material which constitute the record ofproceedings upon which the decision is based are located with the City of LosAngeles, Planning Department located at 200 North Spring Street, Room 750, LosAngeles, California 90012.

1. Retail hours of the facility shall be between the hours of 08:00 a.m. to 12:00 a.m. sevendays a week.
2. No pay phone will be maintained on the exterior of the premise.
3. There shall be no coin-operated games or video machines maintained upon the premises.
4. Any graffiti painted or marked upon the premises or on any adjacent area under thecontrol of the Petitioner(s) shall be removed or painted over within 24 hours of beingapplied.
5. The Petitioner(s) shall be responsible for maintaining free of litter, the area and adjacentto the premises over which they have control.
6. Electronic age verifications device(s) which can be used to determine the age of anyindividual attempting to purchase alcoholic beverages or tobacco products shall beinstalled on the premise at each point-of-sale location. This device(s) shall be maintainedin an operational condition and all employees shall be instructed in their use prior to thesale of any alcoholic beverage or tobacco product.
7. The Petitioner(s) shall install and maintain security cameras and a one-month videolibrary that covers all common areas of the business, high-risk areas and entrances orexits. The videotapes shall be made available to police upon request.
8. Any future operator or owner for this use must file a new Plan Approval Application oran equivalent to allow the City of Los Angeles to review the "mode and character" of theusage.
9. Any music, sound or noise emitted that is underthe control of the petitioner(s) shall notviolate Section 116.1 of the Los Angeles Municipal Code.
10. If at any time during the period of the grant, should documented evidence be submitted.showing continued violation(s) of any condition(s) of the grant, resulting in a disruptionor interference with the peaceful enjoyment of the adjoining and neighboring properties,the Zoning Administrator will have the right to require The Petitioner(s) to file for a planapproval application together with the associated fees, to hold a public hearing to reviewThe Petitioner(s) compliance with and the effectiveness of the conditions of the grant.The Petitioner(s) shall submit a summary and supporting documentation of howcompliance with each condition of the grant has been attained.

As the certified Neighborhood Council for this area, Central Hollywood Neighborhood Council wishes to expressour support for Yummy Foods, LLC'sapplication for a type 21 off-sale alcohol license. The Committee and Boardbelieve that Yummy Foods, which is presently operating in the area from a nearby location. will continue toprovide a positive and needed service to the community.
The Planning and land Use Management Committee and Board of the Central Hollywood Neighborhood Councilmet on April 13 and April 27, 2009, respectively, to consider Yummy Foods, LLC'sapplication in connection with itsproposed grocery delivery sennte warehouse at 1135 N.
