    (3) The Organization/Executive Committee shall make its recommendations to

    the full Board of Directors based upon the following criteria:

    a. Determination that the request for reimbursement relief is based upon

    genuine economic hardship and inability to afford the CBDs annual costs;and

    WHEREAS the Downtown Oakland Association seeks to improve the Downtown

    Oakland area with the special benefits funded from the new CBD, however,

    does not seek to create hardship for disabled, senior or other individuals, non-

    profit/tax-exempt organizations or those property owners who currently lack the

    means to pay into the Downtown Oakland Community Benefit District

    Reason for request for Hardship reimbursement from the Downtown Oakland

    Association:

    1. The assessment makes our tax payment over 432% of what it would be without the Business

    District assessment.

    2. The current membership is 20 and, as a result, monthly net income versus expenses is negative.

    Our annual deficit is in the thousands. The financial challenge, as a small membership working

    to maintain a large historic building, is extreme.

    3. Because the church sits on a corner lot, the linear footage calculation/cost is based on footage on

    both 17thStreet and Franklin.

    4. The building is used about six hours per week for church services only four hours of which are

    on weekdays.

    5. In recent years in order to comply with local ordinances, we have incurred major expenses to

    have the building retrofitted for earthquake safety.

    Staff RecommendationTo: Joint Organization Committee

    Re: Proposed amendment to the Disbursement Agreements with the City of Oakland

    Staff is recommending the below amendment to Section 5.2 of the Disbursement Agreements

    between the City of Oakland and the Downtown Oakland Association and the Lake Merritt

    Uptown/District Association. This amendment will alleviate the undue burden of the requirement to

    go out to bid every three years on all contracts exceeding $5,000 per year.

    Once the proposed amendment is approved by the boards of directors, staff will submit the

    amendment to the City Attorneys Officefor approval. Upon approval from the City Attorneys Office,

    the amendment is final.

    Current Disbursement Agreement:

    5. Recipient Responsibilities

    5.2. Competitive Bidding. Recipient shall competitively bid all contracts over $5,000 and shall keep

    and provide copies of all bids submitted for review to any affected property owners or to the City

    upon request. The lowest qualified bidder shall receive any service contract that is bid. Recipient

    shall present its written bidding policy and procedures to the City for review and approval. Once the

    contract has been publicly bid and the lowest qualified applicant has been selected, that selected

    contract may remain for up to three years from the commencement of the contract, but may not

    extend beyond the term of this agreement without the express written consent of the City and is

    subject to provisions outlined in Section 5.8.3 below.

    Staff recommends adopting the following language pending approval from the City of Oakland:

    5. Recipient Responsibilities

    use CBD funds received by Recipient pursuant to this Agreement (each, a "Bid Contract"). Recipient

    shall keep copies of all bids submitted for review for a Bid Contract for five (5) years and provide

    copies thereof to any affected property owner or to the City upon request. The lowest qualified

    bidder on a Bid Contract shall receive any service contract that is bid. Recipient shall present its

    written bidding policy and procedures to the City for review and approval. A Bid Contract may not

    extend beyond the term of this agreement without the express written consent of the City and issubject to the provisions outlined in Section 5.8.3 below.

    Upon approval of the amendment from the City Attorneys Office, staff will pursue amending the

    districts Bidding Policies and Procedures, as required by the Disbursement Agreements.

    The Fox Theater Oakland Proposal 2014

    Proposed Scope of Service

    ServicesSafety & Hospitality

    Ambassadors assigned to the safety and hospitality function will perform the following services:

    Hospitality

    Services

    When analyzing the tasks which consume the time of Ambassadors

    they spend the majority of their day patrolling the service district onthe lookout for unwanted activity and deterring criminal behavior.

    These patrols provide a tremendous opportunity to interact with

    pedestrians in order to be friendly, good will representatives of the

    service district, share information and make recommendations.

    o Offer a friendly greeting and assistance

    o Provide directions

    o Provide recommendations on things to see and do

    o Answer any questions the public might have

    o Identify customer service opportunities, such as carrying

    packages or holding a door

    Deter & Report

    o Continually circulate through their assigned zone and through

    the specified parking facilities within the district to provide high

    visibility to deter unwanted behaviors

    o Report unwanted activities, crimes or disturbances

    o Assist police by being witness complainants in cases involving

    Ambassadors

    o Ambassadors will be responsible for interacting with persons

    creating quality of life issues, to advise them of local ordinancesand requesting compliance. All Ambassadors are trained in

    situational protocol to appropriately handle situations in a firm,

    yet courteous, manner.

    Public Safety

    Escorts

    This service would allow district workers and guests to request this

    service by calling the on-duty Team Leader on the publicized cellular

    phone number to have an Ambassador meet them at their place of

    business or residence and walk them to their destination.

    Special Events

    We will provide two supplemental Safety and Hospitality

    Ambassadors in the Lake Merritt Uptown District and the areas

    around the intersection of 19th

    and Telegraph including BART

    stations, bus stops and surrounding parking lots. Exact hours to be

    determined based on budget and need.

    Information

    Sharing

    Working with the local Police Department the Ambassadors will be

    utilized to share information to educate stakeholders on

    safety/security related issues. For instance, if the police departmenthas crime prevention brochures, the Ambassadors can be utilized to

    distribute this information.

    Social Service

    Outreach

    Ambassadors will have a working understanding through their

    training of local service providers that can assist the homeless.

    During the course of their duties Ambassadors will engage homeless

    persons to conduct welfare checks and encourage those persons to

    engage with service providers. Also, the Ambassadors will work to

    identify those persons deemed to be most in-need or most

    engaged. Working with providers a custom strategy will be

    suggested to assist those persons.

    Reporting

    Ambassadors will be responsible for completing Daily Activity

    Reports and submitting them to the CUSTOMER as specified. The

    daily statistics will be compiled weekly and provided to the

    customer. The Ambassadors will gather information on any incidents

    or criminal activity that is considered to be out of the ordinary and

    forward such information in the form of an Incident Report. Criminalactivity includes Quality of Life crimes, such as public intoxication,

    open container, loitering, trespassing, public urination and

    aggressive panhandling.

    Safety Ambassadors are recommended to continue using the following patrol mechanisms,

    which will provide the above services using the most practical, efficient methods possible.

    PATROL METHODS

    Foot Patrol

    Walking Patrols - Ambassadors will be deployed to their assignedzones to patrol the area as a deterrent for unwanted activity, we

    well as to interact with businesses, residents and visitors.

    Ambassadors on walking patrol will be responsible for making Public

    Relations (PR) checks at various businesses each day to make a

    personal contact and to gather and share safety related information.

    Bicycle Patrol

    Based on the deployment plan some Ambassadors will be assigned

    to patrol their area on bicycle. Bicycle patrols will allow

    Ambassadors to be cover more ground and provide extra visibility,without losing the ability to interact with the public or be

    disconnected from the environment. Ambassadors will use bicycles

    to patrol sidewalks, alleys and the many surface parking lots of the

    service district to deter unwanted activity and offer assistance.

    Services - Cleaning

    Ambassadors assigned to the maintenance and hospitality function will perform the following

    services:

    Litter

    Removal of litter, trash, and debris, and extending a distance of 18

    inches beyond the curb into the street or alley, by mechanical or

    manual means, including: all types of paper, cigarette packages and

    butts, leaves, gravel or rocks, cans, cardboard, boxes, plastic refuse,

    bottles, broken glass, beverage spills, urine, feces, vomit, and any

    dead animals.

    Weeds

    Killing and removal of weeds and grass. Contractor shall spray weedsas needed with chemicals meeting all Federal, State and Municipal

    laws and regulations. Contractor shall meet all licensing

    requirements imposed by Federal, State, or local authorities.

    Graffiti

    Remove or cover graffiti from the first floor of buildings facing or

    visible from public rights of way, and from utility poles, mail boxes,

    courier boxes, newspaper or magazine boxes and kiosks, public

    telephones, parking meters and other fixtures, within 24 hours after

    the graffiti appears (subject to any delay necessary to obtainconsent of the owner of any private property), using the least

    intrusive means available and approved by the property owner.

    Contractor will not perform graffiti removal on private property until

    the consent of the owner has been obtained. The District will aid

    Contractor in securing any necessary consent from the owner of any

    private property affected.

    Power Washing

    A power washing schedule will be developed within the first 60 days

    of operations and forwarded to CUSTOMER. Thereafter, and if

    necessary, the Power Washing schedule will be updated quarterly

    and forwarded to CUSTOMER for review and approval.

    Special ProjectsCarry out a wide variety of special projects mutually agreed upon by

    Cleaning Ambassadors will be deployed in a variety of methods, depending on the equipment in

    which they are assigned:

    DEPLOYMENT METHODS

    Manual

    Cleaning Ambassadors are assigned to a rolling garbage can, which carries

    the CUSTOMER and PSC. Such special projects include painting of

    fixtures (benches, light posts, etc.), or any other project not

    requiring technical expertise that can be carried out within

    reasonable methods or means by existing Clean Streets Staff

    members.

    o Thorough cleaning of tree wells

    o Power washing and repair of waste cans

    o Thorough scrubbing and cleaning of street fixtures

    o Any other task as specified

    Hospitality

    Services

    Clean Team members will also be trained and expected to recognize

    hospitality needs in order to:

    o

    Provide a friendly greeting and an offer of assistanceo Give directions

    o Provide recommendations on things to see and do

    o Answer any questions the public might have

    Potholes

    PSC shall survey, identify, photograph and keep records of all

    potholes on the streets within the Service Area. On behalf of the

    CUSTOMER, PSC shall submit to the City of Oakland requests for the

    repair of the potholes.

    Mechanical

    Cleaning

    Using the Districts mechanical cleaning devices to clean sidewalks

    and remove debris and litter from public pedestrian rights of way

    (including sidewalks, pedestrian skywalks and alleys) and tree wells.

    Specific Clean Team members shall be hired and trained by

    Contractor to be the primary operators of the mechanical cleaning

    devices. Only in the event of an extreme emergency should other

    members of the Clean Team be permitted to operate the machines.

    Patrol the appropriate tools to handle the majority of any needs they

    identify on their patrols. They will be equipped to address litter,

    isolated weeds, graffiti, and public fixtures in need of damp

    wiping and straightening.

    Mechanical

    Cleaning

    Patrols

    Ambassadors may be assigned to operate small, more nimble

    litter vacuums. Operating these earlier in the day will allow them

    to be more efficient in removing litter than broom and dustpan

    alone in advance of more detailed work throughout the day.

    Special

    Projects

    Ambassadors assigned to unique projects will be predominantly

    focused on utilizing their specialized equipment to complete

    their assigned task.

    Staff Position Overview

    Ambassadors

    Ambassadors will comprise the front line staff of the program, and will provide a high level

    of visibility and public engagement as they circulate through their assigned zone.

    Ambassadors whose core functions are providing Safety Services will have the primary

    responsibilities of:

    o Patrolling on foot and bicycle

    o Providing a high level of pedestrian engagement to greet the public, offer assistance,

    and promote a reassuring presence to reinforce positive perceptions

    o Deter crime and proactively address low level quality of life crimes, while

    summoning the help of the local police for more significant issues

    o Carefully document activities and accomplishments using the guard tour system or

    through established reporting mechanisms

    o Take ownership in the entire district by picking up isolated pieces of litter, and

    reporting public infrastructure in disrepair

    Ambassadors whose core functions are to provide cleaning services will:

    o Provide Manual Cleaning Patrol Services by circulating through their assigned zone

    with a rolling can and all necessary tools to remove litter, cigarette butts, weeds and

    graffiti tags, at the same time damp wiping and straightening public fixtures.

    o Remove litter by mechanical means using an assigned litter vacuums

    o Carry out an assortment of projects to improve the long term appearance of the

    district to include tasks such as power washing, painting, mulching, or cleaning out

    tree wells

    o Document any issue within the public right of way that needs to be completed by

    someone else, for example the power washing team or the public works department

    Take ownership in the entire district by providing directions, information andassistance, or reporting unwanted behaviors
