I, Juan dela Cruz, a Filipino and a resident of Malolos, Bulacan, hereby aver the following facts: That I am employed at the Barangay Hall, Malolos, Bulacanas Barangay Councilman; That on January 8, 2006, Metropolitan Trial Court Sheriff issued a writ of demolition to the land belonging to the plaintiff located at Sitio Bagumbuhay in Bulacan; That pursuant to said purported writ, Metropolitan Trial Court Malolos Sheriff sent notice to the residents to vacate the said area by virtue of writ of demolition; That said Metropolitan Trial Court Malolos Sheriff disregarded the complaint letter sent by the residents of Sitio Bagumbuhay; That said Metropolitan Trial Court Malolos Sheriff armed with M16, accompanied with thirty armed men went to the said area and began dragging the residents out of their houses; That no complaint letter was received in response to the said writ, That I am charging Metropolitan Trial Court Malolos Sheriff for the commission of the crime of Expulsion under Article 127 of the Revised Penal Code.
