G.R. No. 200898 June 15, 2015
BROWN MADONNA PRESS INC., THADDEUS ANTHON A. CABANGON,
!ORTUNE "I!E INSURANCE COMPAN,, Petitioners,
vs.
MARIA ROSARIO M. CASAS, Respondent.
OPINION#
Summary dismissal of an employee violates his right to security of tenure, a right
aorded with protection by the constitution. When an employee is summarily
dismissed, like what the employer in this case did to Casas when they had a
company meeting and told her not to report for work anymore right there and then,
the employer violated not only Casas personal right but also the Constitution itself.!reat is the protection of the Constitution when it comes to labor as the e"istence of
employers social advantage over the employee is a principle in labor laws. #t is the
States duty to promote social $ustice, hence the Constitutions protection to labor is
so immense that dismissing an employee does not depend on the employers
whims only. %here should be $ust or authori&ed cause for the termination and the
employer has to comply with the due process re'uired by law ( the twin
re'uirements of notice and hearing. %hese were not shown in the present case.
%herefore, the student respectfully submits her concurrence with the Supreme
Courts decision in awarding Casas the backwages and damages that she has
prayed for.
