INTRODUCTION

The enactment into law of Republic Act No. 7160,otherwise known as the New Local Government Code of1991, paved the way for the mandatory creation of adistinct and separate Municipal Civil Registry Office, BeforeCivil Registry functions were performed by the MunicipalTreasury Office, then later by the Municipal Planning andDevelopment Office, both in concurrent capacity. Article IX,Section 479 of RA No. 7160 enumerates the qualifications,powers and duties of the Municipal Civil Registrar. Corollarythereto, the Municipal Civil Registry Office is mandated toimplement applicable provisions of RA No. 3753 or the CivilRegistry Law.

-Republic Act of No. 7160 Article IX Section 47

The Civil RegistrarQualifications, Powers and Duties.

• (1) No person shall be appointed civil registrar unless he isa citizen of the Philippines, a resident of the localgovernment unit concerned, of good moral character, aholder of a college degree from a recognized college oruniversity, and a first grade civil service eligible or itsequivalent. He must have acquired experience in civilregistry work for at least five (5) years in the case of thecity civil registrar and three (3) years in the case of themunicipal civil registrar.

• The appointment of a civil registrar shall be mandatory forcity and municipal governments.

• (2) The civil registrar shall be responsible for the civil registration program in the local government unit concerned, pursuant to the Civil Registry Law, the Civil Code, and other pertinent laws, rules and regulations issued to implement them.

• (3) The Civil Registrar shall take charge of the office of the civilregistry and shall:– (a) Develop plans and strategies and upon approval thereof by the

governor or mayor, as the case may be, implement the same,particularly those which have to do with civil registry programs andprojects which the mayor is empowered to implement and which theSanggunian is empowered to provide for under this Code;

– (b) In addition to the foregoing duties and functions, the civil registrarshall:• (i) Accept all registrable documents and judicial decrees affecting the civil

status of persons;• (ii) File, keep and preserve in a secure place the books required by law;• (iii) Transcribe and enter immediately upon receipt all registrable documents

and judicial decrees affecting the civil status of persons in the appropriate civilregistry books;

• (iv) Transmit to the Office of the Civil Registrar-General, within the prescribed period, duplicate copies of registered documents required by law;

• (v) Issue certified transcripts or copies of any certificate or registered documents upon payment of the prescribed fees to the treasurer;

• (vi) Receive applications for the issuance of a marriage license and, after determining that the requirement and supporting certificates and publication thereof for the prescribed period have been complied with, issue the license upon payment of the authorized fee to the treasurer;

• (vii) Coordinate with the National Statistics Office in conducting educational campaigns for vital registration and assist in the preparation of demographic and other statistics for the local government unit concerned; and

– (c) Exercise such other powers and perform such other duties and functions as may be prescribed by law or ordinance.

This report focused on the accomplishment of the MCRO from July 2010 to February 29 2012 in the implementation of the following:

• Registration of Vital Events

• Issuance of Certifications

• Issuance of Marriage License

• Implementation of RA No. 9048

• Implementation of RA No. 9255

• Capability – building of MCRO Personnel

1. Registration of Vital Events

BIRTH

• The birth of the child, being a vital event of a person, shall be registered within (30) days from the time of the birth in the Office of the Municipal Registrar where the birth occurred.

BIRTHREQUIREMENTS:• Four (4) copies of Certificate of Live Birth duly

accomplished correctly, completely and signed byproper parties. (Data supplied in the certificatesmust be typewritten on line and must have noerasures.

• For illegitimate but acknowledged child, anAFFIDAVIT of Acknowledgement/Admission ofPaternity is needed.

• For delayed Registration of Birth• For persons less than eighteen (18) years old.

BIRTH• a. Affidavit of Delayed Registration (at the back of the Certificate of

Live Birth) signed by the father, mother, or guardian, or the child himself, if he is of understanding capacity;

• b. Any two (2) of the following documentary evidence which may show the name of the child, date and place of birth and the name of the parents:– Certificate of NO RECORD of Birth from the National Statistics Office

(NSO)– Baptismal Certificate– School Record– Medical Records– Marriage Certificate– Voter’s Record/Registration– Others

might have witnessed or have known about the birth of the child; and

• d. A sworn statement of the present whereabouts of the mother , if the person seeking delayed or late registration of an illegitimate child is not the mother.– For persons whose parents are not married at the time of

BIRTHNUMBER OF REGISTERED BIRTHS FROM JULY 2010 TO FEBRUARY 29, 2012

From July 2010 to Feb 29, 2012, there were 889 registered births. Out of this total, 276 were registered from July 1 to December 31,2010 ,511 were registered from January to December of 2011 and 102 from January to Feb 29, 2012 . However, the above data did not include the vital events involving residents of San Simon that took place outside the municipality.

For births that were registered on time, a registration fee of Php 30.00 was collected and Php 100.00 for births that were registered beyond the 30 day reglementary period.

MARRIAGEUpon application and submission of requirements for a

marriage license, the required period of time is 10 days.

REQUIREMENTS:– Four (4) copies of Marriage Certificate Forms duly accomplished

correctly, completely and signed by proper parties. (Data supplied in the certificates must be typewritten on line and must have no erasures.);

– Birth/Baptismal Certificates of Applicants;– Certificate of No Marriage (CENOMAR) from National Statistics Office

(NSO);– Certificate of SEMINAR conducted by Population Commission

(POPCOM); and,– Parent’s Consent (For 18-21 years old); or– Parents Advise (22-25 years old)

MARRIAGENUMBER OF REGISTERED MARRIAGE FROM JULY 2010 TO FEBRUARY 29, 2012

• For marriage, the office recorded a total of 494 events. Out of this number, 149were recorded on July to December 2010 , 296 were registered on January to December 31, 2011 and 49 were registered on January to February 29, 2012.

• A fee of Php 422.00 was collected for the ceremony officiated by the Municipal Mayor and Php 222.00 if officiated by heads of various religious sects.

DEATHNUMBER OF REGISTERED DEATHS FROM JULY 2010 TO FEBRUARY 29, 2012

For death, 303 events were recorded. Out of these data, 80 were registered on July toDecember 31, 2010, 195 from January to December 31, 2011 and a total number of 28 wereregistered on January to February 29, 2012. Excluded from this report were those deathsinvolving residents of San Simon that occurred outside the jurisdiction of the municipality.

A fee of Php 100.00 was collected as Burial Permit in Roman Catholic cemetery or Php600.00 in Municipal Cemetery.

3. Acceptance of Application for Marriage License and its Issuance

NUMBER OF FILED AND ACCEPTED MARRIAGE APPLICATIONS

A total of 538 accepted marriage applications were filed in theoffice. From July to December 31, 2010, there were 156 applicationsacceptance by the MCRO. 312 applications from January to December 312011 and 70 applications from January to February 29, 2012.

An amount of Php 150.00 per application was charged as anapplication fee. On the other hand, a fee of P2.00 was collected permarriage license issued..

4. Implementation of Republic Act No. 9048Republic Act No. 9048 authorized the correction of entry in the

Civil Register without need of judicial decree order in cases oftypographical errors in the Certificate of Live Birth, Death and Marriage.However, in the case of births, the change in gender and the date of birth(day, month, year) still needs approval by the courts.

From July 2010 to February 29, 2012, the MCRO accepted andprocessed 16 Petitions for Correction of Clerical Error. Out of this, 1 was aMigrant Petition. On the other hand, 3 Petitions for Change of FirstName were accepted and processed by the Office.For every petition for the Correction of Clerical Error, a filing fee of Php1,000.00 was collected while for petition for Change of First Name, a feeof Php 3,000.00 were collected.

5. Implementation of Republic Act No. 9255Republic Act No. 9255 or the Law for Children Needing for Special Protection (CNSP) provides for a way in which illegitimate children can use the surname of their father.

6. Capability-Building of MCRO PersonnelOn March 30 to April 1, 2011, Jean Paul C. Malonzo , MCR

(SanSimon) and Emma I. Canlas , Adm. Aide I attended the “ Refresher Course on the Revised Civil Registry Forms, IRR of RA 9858 and Training on PHILCRIS Software Window – Based Version” at Hotel Stotsenberg , Clark Freeport Zone Angeles City. On Feb 29, 2012 , the same personnel participated on 2012 Lecture Series on Civil Registration and joined the 1st MCR’s staff quiz, wherein San Simon ( Emma Canlas) awarded as 2nd

place.

PLANS• Aside from the usual processing of the Birth, Marriage, and Death

Certificates, the office is planning to update its system throughcomputerization using PhilCRIS, it is a software in Windows of theCivil Registry Information System. This software enables encodingof relevant information from civil registry documents, storage ofvital data, query and retrieval of encoded records, printing andissuance of certified copies of encoded civil registry documents,generation of transmittal files, data management and maintenanceof the local civil registry data base.

• The use of PhilCRIS will enable the Local Government Unit(LGU)/Institution to print preview and print directly to the new civilregistry forms.

• Another is to conduct a MOBILE REGISTRATION prioritizing thefarthest barangays in the Municipality.
