After being convicted in the Fodder scam the maverick Bihar  politician is poised for some- thing interesting things even in the jail. As they say either God is blind or smiles only on the  powerful. In jail too, he will g et his share of jail lime light. Sentenced to five years of rigor- ous imprisonment, he will have to do some work and earn. Intriguingly, the Jail Superintendent thinks that due to his status, he will not be given heavy work. It is baffling on the  part of the jail head to think he has a status higher than other jail inmates. Ok, he may not be given tough job but to treat him a celebrity in jail is not good. However, who cares for he  brings in his Lalu magic with him in the jail too. He will be given the job of teaching jail inmates political science. Funny yet true, he has addressed Harvard Business School and Indian Institute of Management Ahmadabad. For what is yet a riddle? Political science and he may be a good combination but his social theories stand already rejected by the Bihar people. What he will teach the Jail inmates is a matter of curiosity  but it could be otherwise too. When his students come out how they will behave, a research  project on them is for asking. Lalu teacher and Jailed students. JKENG/2012/41612 Vol. 2 No: 249  ROHIT SINGH RANA With a ban like situation imposed by the army on its operations in Shala Batu area Keran sector it is not clear what actually happened at this sensitive area eleven days back. It is intriguing why the army held back the information of the heavy infiltration and occupation of a ghost village when the Prime Minister was in New York readying to meet  Nawaz Sharif. Perhaps he could have  been given a le ver to tell Pakistan more  bluntly about its misadventure. Did army knew about the incursion is anoth- er r matter. But on a whole the picture that is unfolding is not to the best inter- ests of the nation. It will be unfair to directly implicate the army and hold it responsible. But if truth is not told and analysed thread  bare, it will have even graver implica- tion for the security of the country. Having said so, the questions remain unanswered. Responsibility has to be fixed on some one. If as per r eports, one unit of army was withdrawing and other was taking its place during the process why the bunkers were not manned till the deployment of the other unit was made complete is not clear. Army is not supposed to work like a government office, where employees come at their sweet will have a laid back attitude and work at a leisurely pace. Especially in a such a sensitive and terror prone border area, where from across the LoC hun- dreds of die hard terrorists are waiting to be launched in a war against India, such a laid back attitude is last that could be tolerated. Seems Kargil les- sons are yet to be learnt. Obviously if the national leadership had learnt the lessons of 1962 Chinese treachery, it would have faced today the Chinese from a position of strength. They would not have developed the audacity to intrude at their sweet will that too at the moment of their own choosing. The question is why the army not report the heavy infiltration when it was reported on 24th September. By 29th September the full blown infiltra- tion was already evident. Why the army chief did not share this informa- tion with his defence minister or why the Prime Minister was not informed of the intrusion, when he was in New York. It raises doubts that either the army was not willing to share its responsibility or it was hiding the facts. On both counts it has to do some soul searching. We regard our armed forces in highest esteem but there are times when it has to share its blame and responsibility. Hiding behind a ban or not revealing the truth will have a detrimental effect of our forces. It is also in uncertain whether the Prime Minister would have taken up the issue with Nawaz Sharif. The Indian foreign office was too busy to get the two peo-  ple meet. The result for us was Keran and Dehati Aurat. Remember Kargil, the same sinister settings are repeated. The Chief Minister was inter- vening during the reply of questions by Sheikh Ghulam Rasool, Ravinder Kumar Sharma and supplementaries of other Members during the Question Hour in the Upper House: "There is even no role of the State Government in the monitoring or placing of stu- dents in educational institu- tions outside the State. The scheme is completely run by the Union Government. However, the State Government cannot absolve itself of its responsibility towards the people as such the matter of reported cheat- ing by some NGOs has been vehemently taken up with the Central Government. I have written to Prime Minister in this regard urging upon him to grant one time exception to the students who have sought admission in various institutions through NGOs and do not qualify for the scholarship so that their edu- cational career is not marred. I have also emphasized the need of involving the State Government in the imple- mentation of the scheme so that it is run hassle-free ensuring transparency and no chance for fraudulent ele- ments to sneak in and take advantage of any lacuna in this centrally sponsored scheme", he said adding that the scheme provides for get- ting admission in the educa- tional institutions by the stu- dents on their own and if they obtain first five positions in the Entrance Tests held by these institutions, they are only then entitled for scholar- ship under the SSS. Omar Abdullah said that some NGOs and the educa- tional institutions have admitted students in bulk despite the fact that there is a cap placed in the scheme for grant of scholarship to only first five position holders. They said that for the past over two decades the schools have not  been upgraded in their areas, with the results 8Contd p2 NEW DELHI, OCT 04: As the ongoing Army operation against infiltrators from Pakistan in Keran sector of Jammu and Kashmir's Kupwara district entered eleventh day on Friday, the Army Chief denied that there was Kargil-like situation on the Line of Control. "There is nothing like that. It was an infiltration attempt by about 30 to 40 terrorists; they attempted this infiltration at four or five places. We had information about it. They have been stopped, prevent- ed, neutralized some of them and operations are on to flush them out," said General Bikram Singh, when asked that there are media specula- tions about the present situa- tion in Keran Sector being another Kargil. "No village has been occupied. It's an area where they have come in, we are dominating from all sides and the terrorists are holed up. It's a broken ground, it's very difficult ter- rain; they are stuck in that and we will take them on," he added. Highly-placed sources today said that the counter-offensive was in the final stages. Two intruding guerrillas were killed in the Keran sector of the Line of Control (LoC) where alert troops of the Army spotted a group of infiltrating guer- rillas and challenged them, a defence spokesman said. The Army's operation against the 30-40 infiltra- tors in Keran sector has entered the 8Contd p2 NEW DELHI, OCT 04: Railways has decided to increase passenger fare and freight tariff by about 2 per cent from next week to offset the financial burden arising out of increased input cost. Railways is expected to mop up about Rs 1250 crore from the hike in the last six months of the current fiscal, sources in the ministry said. The sub- urban and non-surban fares would, however, remain untouched. The decision on the fresh round of hike has  been taken under the system of fuel adjustment component (FAC) about which an announcement was made in the 2011-12 rail budget. Railways has taken into account the additional burden of 7.3 per cent increase in diesel price and about 15 per cent in electricity hike. While the fare of AC and sleeper class will be increased by about 2 per cent, the freight rate will go up by 1.7 per cent, as per the decision. Railways has imposed 15 per cent levy as the busy season charge on all commodities from October 1 and the FAC- linked revision is likely to take effect from October 10. According to the budget pro-  posal, the fuel component is segregated from tariff as FAC and the railways is expected to revise the passenger and freight tariff after every six months taking into account the input cost and the prevail- ing market condition. NEW DELHI, OCT 04: As  part of efforts to build up mil- itary infrastructure along the  border with China, the IAF on Friday said it plans to develop a fighter aircraft  base at Nyoma in Ladakh and is upgrading seven airfields for carrying out 24X7 opera- tions in the northeast. The service is also consider- ing extending the runway length and upgrading the Kargil airfield close to the Line of Control with Pakistan, its chief NAK Browne. "Nyoma is an important loca- tion for both the Army and the IAF in the south east of Ladakh where we have good weather all round the year... The cost of developing the air base would be around Rs 2,173 crore and it will take 4- 5 years to develop it," he said, addressing the 81st Air Force Day press conference. Browne said the proposal for developing the Nyoma air field was mooted in 2010 with the landing of an An-32 transport aircraft there. It is right now with the finance ministry and is expected to  be taken up by the Cabinet next month, he said. "All types of aircraft includ- ing fighters, helicopters and transport aircraft would be able capable of being deployed and operated from there," he said. there will now be a button for NOTA optionso that electors who do not want to vote for 

any of the candidates can exercise this option by pressing the button against NOTA.The CEC Sampath said the Commission

would be spreading awareness among thevoters about this new option, through field-level officials to be especially trained for the

 purpose.It may be recalled that a September 27 judg-

ment of the Supreme Court had directed theEC to provide NOTA option on the ballot

 papers and EVMs.

Another recent Supreme Court judgment thatwill be implemented in the upcoming polls isthe requirement of having all columns filled 

in affidavits to be filed by the candidate. ASeptember 13 order of the apex court had made it obligatory for the returning officer "to

check whether the information required isfully furnished at the time of filing of affi-

davit with nomination paper". If a candidateleaves any column blank, the returning offi-cer will issue a notice to him to file the affi-

davit with all columns filled. If the candidatestill fails to fall the columns, the nomination

 paper will be liable to be rejected.

Another first in these state polls is the deploy-ment of central awareness observers, over and above the general observers, expenditureobservers, police observers and micro-observers. They will oversee the efficient and 

effective management of the electoral process...mainly in the field of voter aware-ness and facilitation. "Awareness observerswill be deployed in two phases of seven dayseach and shall observe the interventionsundertaken by the election machinery to

 bridge the gap in people's participation in theelectoral process, particularly in voters'turnout," said a press note issued by the EC.

No Kargil-like ...attempt reportedly involves between 30 and 

40 militants and Pak Special Forces troops,

who entered the Indian Territory on

September 24 and occupied an abandoned 

village along the Line of Control. The inci-

dent is being labeled by many as Pakistan's

attempt to do a second Kargil in the state.Army sources said intermittent firing contin-

ued in Shala Batu village between infiltrators

and 1300 Gurkha Rifles jawans. The fighting

has been going on in a one square kilometre

area.

The Army has been cautiously carrying outthe operation since there are fears the infiltra-

tors may have mined the area.

Till now, five Army soldiers have been

injured in the operation in which 12 infiltra-

tors are reported have been killed. However,

no bodies have been recovered from the area

so far and the Army believes infiltrators could 

have taken them back across the LoC.

The Pakistani Army has refuted the claims

that its special troops were involved in the

infiltration. The Indian Army suspects

Pakistan's Border Action Team could be

involved in the incident.Ironically, the infiltration took place justahead of the crucial meeting between thePrime Ministers of India and Pakistan in New

York on September 29, on the sidelines of theUN General Assembly.Meanwhile, the Army on Friday foiled anoth-

er infiltration bid in Keran sector, killing twomilitants, a defence spokesman said.

 papers.Erasu was among a dozen ministers who had submitted their resignations to the chief min-ister following July 30 decision of Congressworking committee giving the go ahead for splitting the state. His resignation had not

 been accepted."The Congress' decision to bifurcate AP isagainst democracy. The Congress will be

totally wiped out in Seemandhra," Erasu told reporters after meeting the governor.

Friday there was no reason to dispute the gov-ernment's estimate of 5-5.5 per cent econom-ic growth for the current fiscal year.Global currency market sentiment is likely to

 be driven by the US deficit and debt ceilingnegotiations, with markets likely to turn morerisk averse closer to October 17, the date bywhich the US Congress must approve raisingthe country's borrowing limit."The market should not be very complacentseeing the rupee stability. The economy fun-damentally is worse off from a year earlier asthe fiscal deficit is higher and growth islower," said Samir Lodha, managing director at QuantArt Market Solutions."The rupee will remain vulnerable to any dol-lar strength," he said.The partially convertible rupee closed at

61.43/44 per dollar compared with61.735/745 on Thursday, a third day of riseand a fourth week of gains out of five. It roseto 61.25 in the session, its best level sinceAugust 13.Earlier in the session, stop-losses were trig-

gered after the rupee hit 61.64, which marked the highest since the Federal Reserve's sur-

 prise decision to continue its bond stimuluslast month.The currency's gains have come as the dollar continued to struggle near an eight-monthlow as the US government shutdown dragged on. Meanwhile, the euro held firm, boosted 

 by positive euro zone data.In the offshore non-deliverable forwards, theone-month contract was at 61.91, while thethree-month was at 62.94.

In the currency futures market, the most-trad-ed near-month dollar/rupee contracts on the

 National Stock Exchange, the MCX-SX and 

the United Stock Exchange all closed at

around 61.82 with total traded volume of $2.7 billion.

from US. And, they found a significant differ-ence, never noticed before.The left and right hemispheres of AlbertEinstein's brain were unusually well connect-

ed to each other and may have contributed tohis brilliance, according to the new study.Lead author Weiwei Men of East China

 Normal University's Department of Physicsdeveloped a new technique to conduct the

study, which is the first to detail Einstein'scorpus callosum, the brain's largest bundle of fibers that connects the two cerebral hemi-spheres and facilitates interhemispheric com-munication."This study, more than any other to date, real-ly gets at the 'inside' of Einstein's brain," said Dean Falk, evolutionary anthropologist atFlorida State University and a co-author. "It

 provides new information that helps make

sense of what is known about the surface of Einstein's brain.""This technique should be of interest to other researchers who study the brain's all-impor-tant internal connectivity," he added.Einstein's brain was removed by Doctor 

Thomas Harvey at Princeton University a fewhours after his death in 1955. It was largely

 preserved, although Harvey sliced out some pieces for study. In 2010 the remains of the brain were donated to the National Museumof Health & Medicine. 14 unique photo-

graphs were also given to the museum.Current research holds the right hemisphereas involved in processing form, structure, and 

 perhaps, direct links to emotion, while the lefthemisphere handles complex, rapidly chang-

ing stimuli, in which discerning the specificsequential order is critical to perception. The

left hemisphere of the brain contains regionsresponsible for grammar, vocabulary and lit-eral meanings of words. It also contains areas

that do exact mathematical computation. Theright hemisphere processes intonation of lan-

guage and general quantities.Men's technique measures and color-codesthe varying thicknesses of subdivisions of the

corpus callosum along its length, wherenerves cross from one side of the brain to the

other. These thicknesses indicate the number of nerves that cross and therefore how "con-nected" the two sides of the brain are in par-

ticular regions, which facilitate differentfunctions depending on where the fibers cross

along the length. For example, movement of the hands is represented toward the f ront and mental arithmetic along the back.

In particular, this new technique permitted registration and comparison of Einstein'smeasurements with those of two samples -

one of 15 elderly men and one of 52 menEinstein's age in 1905, the 'miracle year'.The research team's findings show that

Einstein had more extensive connections between certain parts of his cerebral hemi-

spheres compared to both younger and older 

control groups. The research of Einstein's

corpus callosum was initiated by Men, whorequested the high-resolution photographs

that Falk and other researchers published in

2012 of the inside surfaces of the two halvesof Einstein's brain.

4ROHIT SINGH RANA: Dr. Sahib youhave fought Parliamentary elections threetimes. Tell us how you could do it especial-ly about your past?

4DR NIRMAL SINGH: I amfrom a poor family. My father was in the army who after retirement took to agriculture. Since my form-ative years I have been associated with agri-culture and there is not a single work rightfromsowing to harvesting or even milkingcows that escaped my hands. My brothers too

 joined me in various aspects of farming.I joined MAM College in 1972. At the sametime I joined RSS where I was a Pracharak,the whole timer. During emergency I wasinterned and booked under Defence of India Rule. Then I joined Akhil BharitiyaVidhathi Parishad (ABVP). In the mean timeI went to Ludhiana and joined a job as lec-turer. I was there till 1989. In that year I was joined Jammu Universi ty. In 1990 I wasgiven the job of coordinating rehabilitationand relief effort of RSS forKashmiri dis-placed people who had come out of Kashmir as a result of terrorism? I wasmade ABVP President and after the deathof Pandit Vaid Vishnu Dutt jee I fought theelections from Jammu Poonch constituency.I was at number two after the results of thepolling. I lost with A narrowmargin attributed towhole scale rigging. After wards I was madestate president BJP and then again I foughtanother MPelecti on in 2004. This time I gotthree lakh two thousand votes, the highestpolled by any BJPcandidate in the state. Withno anti incumbency factor to help me still I lostby a narrowmargin of 17000 votes to the con-gress candidate.Soon after the Sri Amarnath agitation of 2008 Iwas in the thick of things with plunging myself headlong in the agitation which was a water shedmovement for all nationalist and rightminded people of the entire state. When theunfortunate episode of lifting the dead body of martyr Kuldeep Vermaf romParade groundtook place I was present at the scene and

vehemently opposing the police atrocity. In notime I was arrested and sent to aremote bor-der police post cut off f rommy party and peo-ple, for two days nobody knewwhere I actuallywas. Thence after my party asked me to con-test for the Assembly elections. This time itwas a neck to neck contest and again I lost bya very narrowmargin of 2000 votes.

4ROHIT SINGH RANA: Education andpolitics are two different things. How youmaintain a balance and do you think youare doing justice to both?

4DR. NIRMAL SINGH: Emphatically poli-tics and education are two different things.Being a university teacher, it becomes more asacred duty because you are in the portals of higher learning. Interestingly UGCgave aguide line in 1987 that university professorscan join politics in order to bring in academicprecision and learning into the humdrumandrumble tumble of politics. My party and RSS,my nursery of political and social grooming,gaveme a go ahead and thus I joined politics.It was not a spontaneous decision but a cali-brated one that prompted my entry into poli-tics. Besides, I think I amfortunate to haveinherited tough genes which enable me to clickin both fields. In University I forget the NirmalSingh as a politician. I make it a point that Itake classes regularly and ask any of my stu-dents they will echo the same sentiments.Presently eight students are doing research

under me. Interestingly one among themisdoing PhDon Article 370 whether it hasbrought any good to the peopleof the state or not. My students are my real investment andthey are sacred trust with me.

4ROHIT SINGH RANA: It is a fact thatyou lost every election. Were you unable tocapitalize on the political situation or thekind of milage that BJP as a party gives

you?

4DR NIRMAL SINGH: Constant shift-ing took a toll. First I was giv en JammuPoonch Parliamentry constituency, fol-lowed by Gandhi Nagar Assembly seat.Then I was shifted to Doda- Udhampur parlia-mentary constituency. Still if you impartiallyanalyse all these elections which I lost I wasnewto the voters. I got scant time to touch achord with them. Yet I amhighly thankful to theoverwhelming support I received from every

place, I contested. The very narrowmargin, bywhich I lost tells that all. Yet in a democracyvictory is a victory and a defeat is a defeat.This time I see the opportune moment toreverse the tide, if I amasked to join the elec-tion fray. Nowpeople knowme well. Theyhave understood my brand of constructive poli-tics. Hence if given a chance it will be a differ-ent story this time.

4ROHIT SINGH RANA: In Doda-Udhampur there are two factors workingagainst you, one is Panthers Party becauseProf. Bhim Singh has said he will contestfrom Doda- Udhampur, the other is Prof.Chaman Lal Gupta factor . How will younuetralise rather tackle them both

4DR. NIRMAL SINGH: Both these fac-tors will not matter. People see the credibilityand past contributions of the people.Importantly persons do not matter much, whatmatters is ideology and a clean image.Voters are intelligent. They have seen throughthe games of some persons, hence they aretoday at the margins despite their bravado.Today the whole country is watching with avidinterst and hopes the rise of Modi phenomena.Doda -Udhampur is not insular to this happen-ing. Many issues drive voters to vote. Theissue of terrorism, under development, crimi-nalization of politics, and communalization of politics are pressing matters. The matter of refugees, displaced people, Kashmiri Panditsand decline of lawand order are other matterswhich our party has taken up and raised voic-es for the depressed citizens of the state. Our party has raised these issues aggressively andwe are in touch with the people. Since earlymorning to late evening, people ring me, askme to do this or that or come to meet me or Igo to listen to their problems. We in deferenceof their wishes and hopes have always tried tobe with them, whether it is in the remote ham-lets or hilly vill ages. In addition the work andcontact with the people that we are presentlyfocusing on, will result into a thumping victoryfor BJP.

4ROHIT SINGH RANA: During my talkswith people of Kishtwar there is a resent-ment that it was BJP especially Prof. NirmalSingh and Ashok K hajuria who acepetedthe paltry compensation package of Rs 5lakh when the loss on the ground was run-ning into crores.

4DR. NIRMAL SINGH: This is far fromthe truth. We were heading an all party dele-gation to Kishtwar and we managed tobring the minority community on the table todiscuss the matter. One day earlier the Chief Minister on his visit failed to do that. Our efforts were lauded by Taj Mohuddin and thisis on record. Yes when it comes to the dis-cussion in the compensation then KhajuriaJi and other BJP members of the Kishtwar dirstict had stuck to one and only demand of providing the comple loss to thore who were

effected in riots. Yes when it comes to thediscussion of Rs.2 lack or Rs.5 lack this wasa demand of immediate reflief which the gov-ernment said will be provided within twodays. Rs.2 lack for minor loss and Rs.5 lackfor those who had a major loss that too tillthe the time government agencies calculatethe actual loss of the property lost.Previously no government had accepted thecompensation of Rs 5 lakh for the damaged

properties per owner. We were only mediat-ing. The compensation package was notaccepted by BJP.

4ROHIT SINGH RANA: Why did BJPcall off the Jammu Bandh when nothingwas paid to victims?

4DR NIRMAL SINGH: The reality is thatBJPgave a one day call for Jammu Bandh.We were members of all party delegation.Then news appeared in a local daily in whichDIG Doda Kishtwar was referred to have said

that they had arrested the mastermind of theKishtwar riots. We immediately criticized hisstatement and pressed for his suspension or removal because his statement was far from thetruth. BJP had demanded that the HomeMinister should resignwhich he did. Wealsodemanded theinvestigation of the riots by a judi-cial commission, whichwas accepted. Thecom-pensation demand was partially accepted. Insucha situation BJPhad no reason but to calloff thecall for extendedJammuBandh.BJPpressed that at least Rs 2 lakh should begiven within two days but despite promisesby Taj Mohuddin nothing happened. Now thegovernment is back tracking on all matters.The findings of theJudicial Commissionwere to be submitted in a timebound man-ner and that too is not happening.

4ROHIT SINGH RANA: The judicialInquiry is headed by Jus tice RC Gandhiwho was given appointment letter 20 daysafter announcement. Do you think he willdeliver as people of Kishtwar have doubtsabout the commission itself?

4DR. NIRMAL SINGH: The statementsof Chief Minister, and Taj Mohuddin that theKishtwar riots were an international con-spiracy and BJP too believes that it was alarge game plan to target minorities inKishtwar . But the government has failed todeliver on the matter. The judicial commissionis alright but people are not happy with the

investigation which ought to be undertaken byCBI. In fact Taj Mohuddin said that if the judi-cial commission thinks it prudent to get thematter investigated by some other agency itwill be done. Sadly all these promises havenot been made. BJPhence doubts the sinceri-ty of the government.

4ROHIT SINGH RANA: You say it wasan international conspiracy then by thiscan it be construed that Ex-Home Minister Sajjad Kitchloo was also a part of interna-tional conspiracy.

4DR. NIRMAL SINGH: Of-course hisrole has to be inv estigated in these param-eters. It is important to know why such atop government functionary sat still anddid nothing when minorities were hounded,killed and their properties and housedrazed to ground by a JCB machine. Insteadour party funct ionaries are being targetedas the master minds. It is complete non-sense and a cruel joke played on theminorities. A gun shop was looted and 43guns were distributed. These guns wereused to target minorities. In such an atmos-phere of fear and government apathy wedemand the dubious role of NationalConference politician like Sajjad Kitchloowho was sitting just meters away from theplace of incidents. There are credible reportsthat the riots were planned months earlier andpeople sawmasked men entering the entireChenab valley with nefarious designs to create

another Kashmir like situation in Kishtwar. Itwas only BJPwhich first raised the Kishtwar issuein the Parliament and will continue toagitate for the victims of the riots and press for their complete rehabilitation.

4ROHIT SINGH RANA: What is your message to the people of Kishtwar?

4DR NIRMAL SINGH: First of all me andmy party has apprehensions about the credibil-ity of DIG. He is a dubious official who isharassing the minorities and young people for no reason. He must be shifted at once.Secondly, the one man judicial commission willdo nothing because the person who is headingthe commission has no credibility among thepeople. BJP wants a CBI inquiry in t he mat-ter.My message to the people of Kishtwar is to beunited and fight the evil forces with full vigour.Entire nation is rock solid behind them.India will not be cowed down by a bunch of scoundrels, looters and terrorists. Peopleof Kishtw ar are brave. The role of the peo-ple of Kishtwar, Doda & Bhaderwah tofight militancy is historical. We salute their patriotism. BJPwill not allowharassment of any nationalist person whether Hindu or Muslim in any part of the state.

4ROHIT SINGH RANA: How you envis-age yourself as a prospective candidate for the parliamentary elections 2014? In factthere are reports that you are the party can-

didate for Doda -Udhampur parliamentaryconstituency. How will you like to react onit?

4DR NIRMAL SINGH: It is in fact theprerogative of the party high command. I amafoot soldier of the party. But if given the oppor-tunity, this time it will be different and we shallwin taking into view the work that we havedone at the grass root level.

4ROHIT SINGH RANA: There is animpression that you are ignoring Jammuand focusing much on K ashmir. Secondly,is it true that t he lack of leadership hascost you dearly?

4DR NIRMAL SINGH: We are a nation-alist party. But Jammu will never be ignored.Previously BJP was touted as a Hindu partywith only a support base in Jammu. Being anationalist party we have look for Ladakh andKashmir as well but i t does not mean Jammuwill be ignored. For the state unit of BJP,Jammu is like Karam Bhoomi.

4ROHIT SINGH RANA: There is animpression that your party has ignoredDoda, Bhaderwah and Kishtwar. How youfeel about it and what about your presencein other regions?

4DR NIRMAL SINGH: It is a figment of imagination. We have a strong presence inthese important regions, and in the last oneand a half years we are working to strengthenour party base at the grass root level. Tobeprecise, during last two years I havebeen mostof the time intheDoda, Kishtwar , Bhaderwahregions than I have beenin Jammu. So it is anallegation which has no basis at all. Leadershipis slowly coming up in these regions and asyou well know, it is not in days that a credibleleadership is developed. It takes time and thistime the party is optimistic that things areimproving. Our presencein the state hasincreased. In Kargil local body elections our candidates, all Muslims came thirdahead of PDP. I was in chargeof the poll committee inKargil. InLadakh we are first factor inthe politi-cal stakes. Similarly we are having a presencein Kashmir and every day weare increasingand improving our acceptability.

4ROHIT SINGH RANA: Translated intoseats, how many seats will BJP win in thecoming elections? Will not the breakawayBJP group turn spoiler in the electoral cal-culations?

4DR NIRMAL SINGH: As said earlier BJPhas improved its baseandacceptability quo-tient. This is very important. We have come outof the past happenings andwe intend tolook tothe futurewith enthusiasmand vigour. BJPhasenergized 60%of booths. The Modi factor isworking wonders and people are looking toBJP eagerly. In seat terms I amsure that thistime we shall win 2 Lok Sabha seats fromJammu and one from Ladakh. In the valleyour voteshare will improve significantly. Thiswill result into consolidation of votes for 

 Assembly elections scheduled late 2014.In the Assem bly elect ions w e shall w in 15 to 20seats. This way we shall become political driv-ers of the State. To reach this level we areworking hard. All our party men are full of hopebut not leaving anything to chance.

4ROHIT SINGH RANA: What aboutDelimitation and Article 370. If BJP getsmajority will it do away with the article?

4DR NIRMAL SINGH: Delimitation wasa cunning ploy and a trick played on the peo-ple of Jammu and Kashmir. At that time thediscussion was on the ban on the number of seats but it turned out to be otherwise. The NCpassed delimitation instead, which unfortunate-ly will continue till 2026. The Kashmir centricparties spearheaded by NChad a brute major-ity. So the Delimitation Bill was passed withbrute majority in utter disregard to democraticconsensus. So Far as Article 370 is con-

cerned, BJPis opposed to it in letter and spirit.But we have to understand that it is a constitu-tional provision and will go through an act of parliament amending the Constitution. It is notas easy as saying. We have to bepractical. Toachieve we have to educate the masses aswell as the members of Parliament that this

 Article runs counter to the very spirit of IndianConstitution. This Article will have to go someday but the opposition to it and education on

its immense evil effects will go side by side.Even eminent jurists feel that it has not helpedthe people of Jammu and Kashmir. On thecontrary if Article 370 is something of a rev-olutionary Article then it ought to beextended to other states as well. Here theneed is to educate the people of Jammu andKashmir that it is a big stumbling block in their way to progress and development.

4ROHIT SINGH RANA: What will bethe agenda of BJP for the people of Jammuand Kashmir?

4DR NIRMAL SINGH: The people of the state have seen Congress -PDP allianceand now they have tasted the bitter fruits of Congress- NC alliance. Corruption, nondeliverance and opacity in the governanceare now order of the day. Lawand order is inshambles, so are the developmental schemes.Separatismand terrorismhas again taken cen-tre stage. The people are fed up with theseparties. They have an urge to see change. Inthis dismal scenario, it is only the BJPthat is abetter alternative. Development, fair play, nocommunal politics, rather a clean inclusive pol-itics, corruption free systemwill be our agendafor the Assembly elections.

4ROHIT SINGH RANA: Recruitmentpolicy is in sh ambles, despite promises for a central recruitment package nothing hascome. What is your take on it?

4DR NIRMAL SINGH: The governmentis sitting still of the promise of providingone lakh jobs as promised during GhulamNabi Azad's tenure. Nothing has happened.Udaan and other schemes are only on thepapers. The jobs promised for KashmiriPandits, displaced from the valley are onlyon finger tips. Youth are feeling demoral-ized. Jammu this time is in sociological cri-sis. The young people have been forced toseek employment elsewhere. It is a heartbreaking scenario. The refugees of 1947and PoKrefugees are living as second classcitizens. We promise to reverse this trend.Providing jobs will be the top most concern of BJPif it comes to power. Still we have foughtfor youth and shall continue to do so everyminute.

4ROHIT SINGH RANA: Your Politicalmessage to youth

4DR NIRMAL SINGH: I have a mes-sage to the youth. They should join the BJP. Itis a party of nationalism, a party that isagainst any appeasement and strives hard for the rise of youth who are the base if India andits very fabric. Narendra Modi has attractedyouth with his total focus on them. We want tomake a newIndia which is possible only if youth in large numbers join us. We have acomprehensive programme for youth basedpolicies. We have chalked out a st rategywhere by larger number of youth will begiven tickets to fight elections . We intend tobring in fresh ideas and blood in the politics.To me BJPis the best address for youth of this great nation.

SRINAGAR, OCT 04 : The Minister for Planning, Mr. Ajay Sadhotrainformed the House that an amount of Rs. 754.88 crore was provided by theState Planning Department for theimplementation of the CentrallySponsored Schemes in the State duringlast financial year and against which Rs.688.82 crore have been spent by the endof March 2013.Replying to a question by Mr. M. Y.Tarigami in Legislative Assembly hereon Friday, the Minister said that thefunds under Centrally SponsoredSchemes (CSS) do not lapse adding thatun spent balances at the end of the finan-cial year are revalidated by the con-cerned departments in the followingyears for their utilization.The Minister informed that at the end of 2012-13 out of the total availability of Central share of Rs. 4703.31 crore, anamount of Rs. 1150.55 crore hasremained un-utilized under differentCentrally Sponsored Schemes (CSS).He said the same are now being utilized

 by the departments in the curre nt year after its revalidation.Mr. Sadhotra said that the decisionstaken in the District Development Boardmeetings are implemented promptly as

far as possible. He however, said thedecisions involving policy matters andhaving huge financial implications arecritically examined by the concernedadministrative departments and if foundtechnically feasible are implemented ina phased manner subject to availabilityof resources.

The Planning Minister said that thedevelopmental works in the State partic-ularly in respect of CSS have not beenhampered for want of matching stateshare. He said while conveying authori-zation of the annual plans, the depart-ments are advised to earmark the Stateshare out of their allocations for the projects to be taken up under NABARDas per the norms / guidelines of theschemes adding that similarly, matchingstate share as per the funding pattern is being released in respect of various flag-ship programmes / CSS.Supplementaries were also raised by Mr.Harshdev Singh, Ms. Mehbooba MuftiMr. G. M. Saroori, Ch. Zulafkar Ali, andPeer Mansoor.

SRINAGAR, OCT 04 : As many as 21 new water filtrationschemes will be completed in Wachi Constituency in Shopiandistrict during the current financial year.The information was given by the Minister for PHE, Irrigation

and Flood Control, Mr. Sham Lal Sharma while replying to a

question by Mr. Showkat Hussain Ganie.

The Minister further said that in Wachi Constituency 36 water 

supply schemes and 13 filtration plants are presently opera-

tional.

 Baba waterfall as tourism destinationSRINAGAR, OCT 04 :Minister for Tourism, Mr. GhulamAhmad Mir replying to a question by Vijay Bakaya said that

the government has earmarked an amount of Rs. 71 lakhunder Tourism sector for development and promotion of Siyar Baba waterfall near Reasi as a tourist destination.The Minister said that out of total allocated funds an amount

of Rs. 21.50 lakh has been spend so far for developing tourism

related infrastructure and parking facilities for the tourists vis-

iting the spot. Mr. Jugal Kishore also raised the supplemen-

tary to the question.

Minister for Tourism Mr.Ghulam Ahmad Mir replyingto a question by Dr. ShahnazGanai said that restoration of Poonch Fort was taken up inhand in the year 2006-07under Central FinancialAssistance at a cost of Rs.40.55 lakh. The amount wasutilized for conservation andre-use of Darbar Hall build-ing of the Fort.The Minister said that duringthe year 2011-12, another  projec t namely"Conservation andRestoration Plan for PoonchFort" was sanctioned at a

cost of Rs 379.14 lakh.The components mainlycomprise dismantling works,repair/reconstruction worksof the fort Rs 194.99 lakh,re-construction of damagedrampart wall Rs 64.23 lakh, providin g plinth protectionwithin and outside along thefort wall Rs 20.45 lakh and prov iding storm water drainage Rs 23.65 lakh.The shifting of Revenue

SRINAGAR, OCT 04: TheMinister for RuralDevelopment and PanchayatiRaj Mr. Ali Mohammad Sagar on Friday said that there has been increase in incidents andcease fire violation during theyear 2013 along the Line of Control during the year 2013up to September 25, addingthat 105 cases of cease fireviolations have been reportedalong the Line of Control(LOC) in Jammu Provincewhich includes the areas of Poonch and Rajouri.Replying to a CallingAttention Notice of Dr.Shahnaz Ganai in LegislativeCouncil about the situationthat has arisen due to theunprovoked firing alongActual Line of Control inentire Poonch and Rajouri dis-tricts from across the border 

and steps taken by theGovernment for shifting andrehabilitating and providecompensation to the people of these areas.The Minister said that peopleliving in border areas areaffected by cross-border shelling on the area near theLOC particularly in Poonchand Rajouri districts. He said6 civilians living near LOC of Poonch got injured due tothese cease fire violations. Hesaid ex-gratia relief has been paid to the injured persons,adding that no incident of either loss of life or injury has been reported in DistrictRajouri and Jammu. At pres-ent there is no proposal for shifting rehabilitation of the people of border areas under the consideration of Government.

SRINAGAR, OCT 04- TheMinister for Social Welfare,Ms Sakina Itoo on Fridayinformed the House thatagainst 7350 pendening casesin Srinagar district under ISSS, 2500 cases have beensanctioned reducing the fig-ure to 4850 adding that the50% funds for this purposehave already been released.Replying to a question byPeer Afaq Ahmad inLegislative Assembly, SocialWelfare Minister informedthat there are 9300 cases pending as on date under IGNOAPS, ISSS and NFBSin Srinagar district out of which 3200 cases are under IGNOAPS, 4850 cases under ISSS and 1250 cases under  NFBS.The Minister said that regard-ing clearance of pendingcases under IGNOAPS and NFBS the matter has been

taken up with the Centre.In reply to the supplemen-taries by Mrs. Bimla Luthra,Mr. Irfan Ahmad Shah, Mr. Nizam-ud-D in Bhat, Mr.Jugal Kishore and Mr.Yashpal Kundal, the SocialWelfare Minister said thatdue to concerted efforts of the government out of onelakh pendening pension casesunder different schemes 50%cases have been cleared dur-ing last over 4 years in theState and matter for clearanceof remaining cases has beentaken up with the Centre for release of funds. Minister for Law andParliamentary Affairs, Mir Saifullah on behalf of R&BMinister informed the Housethat 26 roads were damageddue to heavy rains in JammuWest for which an amount of Rs. 14.65 lakhs has been pro- posed under State Disaster Relief Fund (SDRF) and outof which Rs. 7.33 lakhs has been released. The restora-tion work is in progress andthe roads shall be restoredfully by way of black topping

in the current year, he said.The Minister was replying toa Calling Attention Notice byProf. Chaman Lal Gupta inthe Legislative Assemblytoday. He said rainfall thisyear has been excessive andincessant, which has resultedin road damages. The roadsare being restored / main-tained continuously and aretrafficable, he said. The rid-ing surface at some places isdamaged and is beingrepaired / premixed, headded.

Revenue, Relief andRehabilitation, Mr. AjazAhmad Khan on Fridayinformed the House that twotehsils have been affecteddue to hailstorm in Kulgamand D.H. Pora and as per thereports 4288 families have been affected involv ing atotal area of 1614 hectares.He said the total lossassessed is to the tune of Rs.86.70 lakhs and the reportsfrom other districts areawaited.

The matter, he said, shall be placed before the State

Executive Committee for sanctioning of the claims sothat the farmers are paidcompensation as per theSDRF norms, he added.The Minister was replying toa Calling Attention Notice byMr. M. Y. SRINAGAR, OCT 04: GovernmentVide SRO-375 dated 23rd August has setup a commission of enquiry headed by aretired Judge of Hon'ble High Court toenquire into the circumstances which ledto the violence and arson and the conse-quent loss of life and p roperty in DistrictKhistwar and to enquire into the admin-istrative lapses, if any, while handling thesituation. The commission will also to fixthe responsibility of the persons,involved in acts of violence, arson andthe loss of life and property.

This was stated by the Minister for RuralDevelopment and Panchayati Raj, Mr.Ali Mohammad Sagar in reply to a call-ing attention notice of Syed NaeemAkhtar Andrabi about the activities of some Villages Defense Committee(VDC) members in Padder Tehsil of Kishtwar district following communalclashes in Kishtwar township on August9th who allegedly opened fire on theunarmed villagers of Kejai in Padder tehsil leaving around 4 persons criticallyinjured and abducted a villager LassaKhanday, whose body was later found in

the nearby forest area. The Minister saidthat on 10th August, 2013, communaltrouble erupted at Paddar Gulabgarh.During the Skirmishes between the twocommunities, 04 persons sustainedinjuries. He said Members of one com-munity again attacked the members of other community when they were evacu-ating injured persons near the helipad butwere rescued by the Police. He said OneLassa Khanday, attendant of one of theinjured persons, went missing during thenight and his dead body was found in the

area on 11-08-2013 which flared up thesituation in the area and stray incidentstook place throughout the day. He saidthe State Administration took all meas-ures to contain the situation, includingimposition of curfew and deployment of Army to assist the Civil Administration,so as to control law and order situationand ensure that no further loss of life anddamage to property is caused. One coy of CRPF was mobilized from Khistwar toPadder area to deal with the rioters whileanother coy of CRPF was air dropped inthe area area to deal with the situation.

One column of Army was also mobi-lized. He said with the timely efforts of the State Administration and the activecooperation of the people, normalcy wasrestored in the area.Mr. Sagar said cases Fir No. 16/2013 u/s307, 336, 147, 148, 427, 34 RPC and FIR  No. 17/2013 u/s302/307/364/336/427/34/147/148 RPCwere registered at Police Station, Atholiand investigation taken up to investigatethe role of the accused persons includingsome VDC members. After competing

all the necessary formalities, chargesheet in case FIR No.16/2013 u/s 307,336, 147. 148, 427, 34 RPC P/S Atholihas been produced in the Court o f law on25-09-2013 against 08 accused persons,out of whom 04 accused persons (includ-ing VDC members) have been arrestedso far and the remaining 04 accused p er-sons are absconding, against whom pro-ceedings u/s 512 CrPC have been initiat-ed. He said the investigation of the caseis in progress and the case will be chal-laned after the arrest of the accused per-sons.

RJD supremo Lalu Prasad is currentlylanguishing in cell no 3312 in BirsaMunda Jail in Ranchi, battling for hisfuture. On Monday, the court found himguilty of corruption and criminal conspir-acy in the Rs 37 crore fodder scam case,which surfaced in 1996. He not only hasto serve a jail sentence but also has toforego his membership of Parliamentafter the recent Supreme Court verdict. Ata time when the RJD was recovering thelost ground in the state, the conviction hascome as a great setback to both the RJDand its leader. Mr Lalu Prasad would havegot away from losing his membership had Mr Rahul Gandhi not put a spoke on theordinance brought by the Government tohelp him.Many wonder whether this is the end of the road for Mr Lalu Prasad who has seenmany ups and downs. The truth is that theRJD’s future hangs on how his core vote-

 bank reacts to the c onviction and whatkind of new political equations emerge inBihar before the 2014 polls.Mr Lalu Prasad’s career graph is very

interesting. He came to power by exploit-ing the anti-Congress sentiments. Heruled Bihar twice — from 1990 to 1995,and returned for a second time from 1995to 1997. When the fodder scam surfaced he had to step down, but he put his wifeRabri Devi as his puppet for eight yearsand virtually ruled the State from jail. He

had also been a Union Minister from2004 to 2009 as a partner in UPA1. He isthe longest serving president of a political

 party today.The immediate problem for the showmanis: Who takes charge of the RJD in hisabsence. Mr Lalu Prasad may get bailafter a month or two while his appeal isheard in the High Court. One option isthat he can continue to be president and 

rule by proxy. If the party is h anded over completely to his family, senior leadersmay rebel while some may opt for theJD(U). On the other hand, if he goes for ‘collective leadership’, with people likeMr Raghuvansh Prasad Singh, therecould be a way out. The RJD chief would still call the shots as far as ticket distribu-

tion, campaign strategy and alliances areconcerned.Secondly his sustenance power alsodepends on the period of his jail sentence.If this is not too long, he can manage tokeep the party afloat. Not contesting the

 polls is not a big problem, as other lead-ers like Bal Thackeray had controlled 

 parties without being an MP or an MLA.After the conviction, it is not clear whichway the Congress would go. While party

 president Sonia Gandhi wants an alliancewith the loyal RJD chief, vice presidentRahul Gandhi would prefer to go with theJD(U). The Congress is not in a hurry todisclose its strategy and will play a wait-and-watch game.Bihar was dominated by the upper castesfor long and all the disadvantaged casteslike the OBC, Muslims and Dalits had feltoppressed from this domination . It wasMr Lalu Prasad who broke the grip of theupper castes by getting power to the

 backward classes. Interestingly, while hedid some good things for social empow-erment, his contribution to governanceand development was minimal. With theaspirations of the people moving towardsdevelopment and good governance, Mr Lalu Prasad will have to work hard towoo voters by things beyond caste.

Mr Lalu Prasad has used his communica-tion skills to remain durable. Going bythe reactions coming from Bihar, whilethe people are happy that justice has atlast caught up with Mr Lalu Prasad, theyare also questioning why only he and notothers. The showman might make use of these sentiments to his advantage to keep

the RJD alive.Finally, it is strange that politicians inIndia do not fade away easily; jail termsand convictions or corruption charges donot shock the cynical public. Look at thereception Mr Jagan Mohan Reddy of YSR Congress received recently when hegot bail after months of suffering in jail.Also, the people who brought Ms JJayalalithaa back to power in 2011, haveignored the allegations of corruptionagainst the Tamil Nadu Chief Minister.This is because either the gullible masses

 believe that their leaders have beenframed or they forgive them.Since Mr Lalu Prasad has a huge task of keeping his vote-bank intact, he mayhave to struggle hard to keep himself and his party afloat. He can do it sitting in jail,

 provided he chalks out his strategy well.The track record so far is that no politi-cian is out until he dies.

Whether we like it or not, we need eachother. Indeed, Homo sapiens, it is agreed,cannot survive in solitude. Yet, dealingwith each other is often a pain unmitigat-ed. That however, has not prevented any-one from experimenting.Sometimes one can wonder as to whyman is taken to be a thinking animal.One wonders what kind of thoughtsmakes one travel over the same path of error over and over again.Consider the act of being in love. Almosteveryone has tried his hand at this emo-tion and almost everyone has gonethrough the same let-downs and the sameheartaches. That has not prevented any-one from going through the next round of experimentation. Love and emotion isonly the more visible and demonstrableset of human sentiments. There are larg-er numbers of other emotions includinganger, envy, jealousy, gluttony — and the list can be endless. The model of action, response and learning remains

remarkably similar in all emotions.This model can be extended beyond thelife span of individuals, societies and generations. Across the millennia people

have said the same things in love, anger,

hate and more. Sometimes, one wonderswhether there is any cumulative humanlearning, and if so, what it totals up to.

One can understand that learning and thevalue-addition procedure is the domainof science and technology and even inmathematics, where the upgradation and the application of principles get increas-ingly enriched and progressively moredependable. Behaviour is another domain al together. Hence the basicquestion remains: Where do we go fromhere?

Each individual is a separate script, eachindividual has his own symbols of expression, each individual has his ownvalues of right and wrong. Each individ-

ual considers himself to be the smartest

of all. There are very few exceptions tothe generalisation.In confirmation of this cliques and fac-

tion are formed and personal strategieslaid down. Some of us are more gifted inreading such behaviour and adapting toit. Some of us are not as adept. The lau-rels are often collected by people whoare able to successfully conceal their realemotions and are able to strike the chord the situation demands.If all individual or group behaviour could be so easily programmed, the path

to behavioural success would be simple.There would be coaching, training and operational universities in this domain.There are such institutions but without

certification of predictive validity. They

are fiddling with wires in the dark.People handle conflict and emotions bytechniques ranging from withdrawal toviolence. Napoleon Bonaparte, thestrategist, is reported to have stated thatsurprise is one of the biggest ingredientsof conflict resolution. When this is laced up with treachery, concealment and rig-orous planning, the ‘goddess’ of successcould smile.Smarter and more ruthless personalitiesare born, and they undo the successful

 people of yesteryears by applying tech-niques and methodology of the preced-ing victors. The chain goes on.The smarter leader of the currently dom-inating generation is more often than not

 betrayed by his own cohorts who want to be leaders. Other fatal e rrors are made.In an emotionally weak movement or outof smugness, the leader lets his defencesdown and is demolished.Most of all, it is soulful to realise thatvictory in the overall scheme of things isof righteousness and of an order which ismoral in character. If this was not so, thehistory of the globe and humanity would have been different.

The will of the larger cosmic order e xistsand that will ultimately decide — notover a year, not for a decade, but in itsown time.

The Government's decision to withdraw a controversialordinance and a Bill, both of which offered protection toconvicted lawmakers, is a resounding victory for the people of the country who were outraged by the

Congress-led UPA Government's brazen attempt toshield the corrupt. It was the people's powerful voice,heard through the regular and social media, which com- pelled the Government to retract. The Congress is busygiving credit to its vice president Rahul Gandhi for thereversal by the Central regime. While it's true that the party and the Union Government swung into damagecontrol mode after Mr Gandhi made his famous remark about the ordinance being a piece of “nonsense” and deserving to be “torn up and thrown away”, theCongress must remember that Mr Gandhi's grandstand-ing came after he realised that the public mood had turned not just against the ordinance but also against the party which had initially cleared the law in its core com-mittee meeting, and which had no problem when theordinance went to the President for his approval. Not just that, the Congress had even piloted a Bill whichwould have replaced the ordinance in due course of time, with provisions similar to that in the ordinance. Mr Gandhi had silently watched these developments. It’sonly when it became clear that even the President had strong reservations about the ordinance and was notinclined to sign it, t hat Mr Gandhi erupted. The partyvice president may have upstaged Prime Minister Manmohan Singh and established, if ever there was anydoubt, that he is the real boss even when it comes tomatters of Government policy. But, while his efforts toderive personal political mileage may have succeeded to

an extent, it has come at the expense of the PrimeMinister's prestige. Mr Singh is now looking more vul-nerable than before. Those who had believed that thePrime Minister would take a tough stand and say‘enough is enough' to the Congress's first family, seemed to have forgotten his past submissive conduct. Mr Singhhas admitted that he does not get upset easily as he hasdeveloped a thick skin. That quality does not deservemerit in the situation at hand.The UPA regime had been completely isolated over theordinance, with the Bharatiya Janata Party and severalnon-UPA parties taking it to task. The BJP even peti-tioned the President against the ordinance, with its sen-ior leaders calling the law “morally, politically and con-stitutionally wrong”. Pushed to the wall, the Congresshas tried in vain to implicate the BJP by claiming thatthe principal Opposition had initially supported the theBill on providing shelter to convicted lawmakers. ButCongress leaders forget that the Bill was referred to a parliamentary panel because the BJP had stronglyobjected to it.Since all is well that ends well, we must hope that our lawmakers will not take any more foolish steps to pro-tect the convicted among them. The Supreme Court had on July 10 struck down as “unconstitutional” Section8(4) of the Representation of the People Act, which pro-vided relief to convicted MPs and MLAs. It had alsodismissed a review plea by the Government seeking thecourt's reconsideration of the earlier verdict. This iswhere matters must now rest.

The US Government shutdown, even if for a brief peri-od, is a failure as much of the conciliatory efforts of theObama Administration as it is of the Republicans whodecided not to rise above politics. President Barack Obama has on several occasions reached out to theRepublican Party, including Speaker John Boehner, butGOP leaders believe that he and his Democrat col-leagues have not done enough to forge bipartisan con-sensus. At the crux of this showdown is the question of how to fund the federal Government.The Republicans, who control the House of Representatives, are determined not to pass any spend-ing measures unless President Obama agrees to defund his flagship healthcare programme, The Affordable CareAct. Better known as Obamacare, the scheme whichgives health insurance to uninsured, low-incomeAmericans, has been a bone of contention between theDemocrats and the Republicans, with the latter consider-ing it to be an unacceptable expansion of state power.Either way, the tussle over Obamacare is nothing new. Nor is the partisan confrontation over AppropriationBills that has become routine in recent years. Finally,members of Congress were well aware of the September 30 deadline — when the previous funding bill, passed earlier in May, expired. In other words, everybody onCapitol Hill knew that this was coming but their inabili-ty to prevent it points to collective irresponsibility.As of now, there seems to be no resolution in sight. Mr Obama has made it clear that he will not cower before acabal of far-Right legislators who refuse to pass astraightforward spending bill that pays for expenditure both Democrats and Republicans have already agreed upon. And so, on Tuesday, even as the federalGovernment went into shutdown mode, Senate Majorityleader Harry Reid rejected a proposal from the House toappoint negotiators. Previously, the Senate had rebuffed Republican plans for continued funding to services suchas maintaining national parks, veterans’ needs and theDistrict of Columbia. Now, the Republican Party hasclearly put its full weight behind a small, radical groupof Conservatives who are leading the fight againstObamacare, even though a majority of moderates withinthe party does not endorse such a hardline approach and agrees that the stance is deeply damaging the party's prospects. Caught between a rock and a hard place, theRepublicans have allowed the uproarious Tea Party to“hold hostage” the entire United States Government, asPresident Obama said on Tuesday — ironically, the firstday of enrolment in the regime’s pet Obamacare project.The situation is eerily similar to 1996 — the last timethe US Government shut down in this manner — whenMr Newt Gingrich as Speaker of the House took a simi-lar stand against President Bill Clinton. Seventeen yearslater, it is Mr Ted Cruz, a Senator from Texas and thedarling of the Tea Party, who has brought upon theavoidable crisis.The issue might worsen if Congressfails to pass the Bill that will increase the nation's bor-rowing limit. If that happens, the US will default on its payments for the first time ever. Needless to add, thefailure will send shock waves across the world market.

NEW DELHI, OCTOBER 4:Scrutiny of the tapped conversations of former corporate lobbyist Niira Radiawith influential people has revealed that they were not restricted to 2G spec-trum alone and “throw light on differ-ent” spheres including, recruitment of members in Railway Board, theSupreme Court said on Friday.The apex court, which perused the con-fidential reports of the 10-member committee, said the scrutiny of call

details of Ms. Radia with politicians,corporates and others reflect the issuesconcerning national security and appointments of members in RailwayBoard.Observing that “the recent issue con-cerning the Railway Board Member”also comes to light on scrutiny of theintercepted conversations of Ms. Radia,

a bench of justices G.S. Singhvi and V.Gopal Gowda said, “actually money is

 paid.”However, it cautioned that “thereshould not be one-sided view” and there should be a thorough probe sup-

 ported by material as the issues are“extremely serious.”“On the aspect of the security of thenation, the report is hazy but extremelyserious and needs thorough scrutiny of the call details. We would not like to

have it unless some substantial materi-al is found. They are throwing light ondifferent aspects. Our perception wasthat everything was related to spectrumetc but it is far more wide and differentaltogether. There is serious cloud onsome of the issues,” the benchobserved.“On national security, you (CBI) have

to be very cautious which we pointed out. Till something is found, it should not become a matter of speculation

 because it harms the national interest.The agencies involved must be givenenough time to completely look into

the matter,” the bench said.“We will give enough time to scrutinisethe entire tape either by same team or whatever team you choose or by theinitial team of the income tax depart-ment which intercepted Ms. Radia’sconversation,” the bench said.It decided to hear the matter again onTuesday to pass some orders on the ini-tial probe done by a specially constitut-ed team of investigators which wentthrough the call details and transcripts.Additional Solicitor General ParasKuhad said in some of the items whichcame under the investigation, the con-versations “reflect certain degree of criminality” and cases can be registered under the Prevention of Corruption Act.The bench asked Mr. Kuhad to sharethe report with another AdditionalSolicitor General L. Nageshwar Raowho was appearing for the Income TaxDepartment.Advocate Prashant Bhushan, appearingfor the NGO, Centre for Public InterestLitigation, which has sought making allthe recorded conversations public,alleged that CBI was on the verge of closing a case which has found a men-tion in the tapped talks.He said despite the fact that there is suf-

ficient evidence that the education of the daughter of a former Director General of Hydrocarbons was funded 

 by a corporate house, the probe agencywas trying to close the case.Mr. Bhushan said the investigation intothe case should be monitored by theapex court and the entire tapped con-versation, barring personal in nature,

should be put in public domain so that public spirited persons from civil soci-ety can see as to what could be done.The bench said it would also hear onOctober 22, the petition filed by former Tata Chief Ratan Tata seeking action

against those allegedly responsible for the leakage of the tape and his plea for right to privacy.The apex court on August 29 had con-ducted two-hour-long in-camera pro-ceedings in the case for knowing theCentre’s stand and perusing “topsecret” documents which formed the

 basis for interception of her calls.The apex court had decided on in-cam-era hearing after it found that manycontroversial and sensitive informationand names of people figure in the vari-ous reports disclosure of which in pub-lic domain could harm national interestand could tarnish the image of peopletill they were established.The conversations were recorded as

 part of surveillance of Radia’s phoneon a complaint to the Finance Minister on November 16, 2007 alleging thatwithin a span of nine years she had 

 built up a business empire worth Rs300 crore.The government had recorded 180 daysof Ms. Radia’s conversations — firstfrom August 20, 2008 onwards for 60days and then from October 19 for another 60 days. Later, on May 11,2009, her phone was again put on sur-veillance for another 60 days following

a fresh order given on May 8.The apex court had ordered setting upof a team of investigators to examinethe contents of the conversations.The court had perused the report and transcripts prepared by the special teamof investigators and said that “some of the items highlighted will become thesubject matter of investigation”.

KOCHI, OCTOBER 4: TheKerala High Court onThursday stayed further pro-ceedings against Transport

Commissioner Rishi RajSingh on the basis of recom-mendations of the StatePolice Complaint Authority(SPCA) to initiate discipli-nary action against him for not appearing before it inconnection with the hearingof a complaint.Justice P.R. RamachandraMenon stayed the proceed-ings for two months. The stayorder came on a petition filed 

 by the TransportCommissioner challengingthe recommendations made

 by the SPCA . The auth orityhad made the recommenda-tions against Mr. Singh to theChief Secretary for his failureto appear before it though he

had been issued many sum-mons. The complaint wasfiled by Welgate Video relat-ing to raids conducted for 

seizing pirated CDs in 2006.In his petition, Mr. Singh said the authority had never served any summons on him.It was unheard in civil

 jurisp rudence that penalaction was recommended in acivil matter for not respond-ing to the summons.In fact, the recommendationwas made by the Chairman.It was not a full quorum deci-sion or even a majority deci-sion, he said.He also contended that hewas protected by Section 113of the Kerala Police Act.As per the section, there wastotal prohibition against pros-ecution of a police officer for action taken in good faith.

Besides, the authority had made the recommendationswithout hearing him.The Transport Commissioner 

 pointed out that he had toencounter many difficult situ-ations when he started crack-ing down on sellers of pirated CDs through raids in 2006.

He had been removed fromthe post of nodal officer of the anti-piracy cell followinga raid on Riyan Optical Discowned by Anitha T.Thachankery in Kochi. Hewas restrained by the thenDGP from conducting further raids on the studio.

Minister Kamal Nath’s claim that theBharatiya Janata Party (BJP) had agreed to help pass the bill on dis-qualification of convicted legislators.In a detailed note, Mr. Jaitley assert-ed that on more than one occasion heand Leader of the Opposition in the

Lok Sabha Sushma Swaraj had madeit abundantly clear that a bill of suchnature would be unconstitutionalwithout a simultaneous amendmentof the Constitution.He said that he was opposed to a con-stitutional amendment as it would have conveyed to the people that law-makers could go to the extent of amending the Constitution to shield 

themselves. Accusing the govern-ment of indulging in a disinformationcampaign, Mr. Jaitley maintained the

 bill was never brought up during theall-party meeting.

 National spokesperson of the BJP,Prakash Javadekar, also questioned the so-called minutes of the meeting,which were flaunted by theParliamentary Affairs Minister, and challenged him to produce proof of when and where they were prepared.Mr. Jaitley suggested that the govern-ment’s managers were trying to cre-ate confusion by citing the agreementreached at the meeting, on passing a

 bill to nullify the Supreme Court judgment on barring candidates in police custody.The apex court, he said, had deliv-ered two separate judgments in quick succession — one on debarring can-didates in police custody and the

other on disqualification of convicted legislators.All the political parties, including theBJP, felt that debarring candidates in

 police custody would be prone tomisuse, thereby destroying democrat-ic process, Mr. Jaitley said.Following up on the all-party agree-ment, the law amending Section62(5) of The Representation of the

People Act was passed at the recentlyconcluded monsoon session of Parliament.On the apex court’s judgment on dis-qualification of convicted lawmak-ers, Mr. Jaitley said that the “impres-sion” conveyed was that the govern-ment would finalise a proposal and refer the matter to a StandingCommittee for formulation of opin-ion.Against this backdrop, the BJP, Mr.Jaitley said, had opposed the billwhen it was introduced in the RajyaSabha, and compelled the govern-ment to refer it a Parliamentarystanding committee.“We were shocked when theOrdinance was issued even though aBill was pending consideration

 before the Standing Committee. Weopposed the issuance of theOrdinance on several grounds.”

The Centre on Friday moved the SupremeCourt seeking modification of an earlier order, which said Aadhaar card is not manda-tory and no person should be deprived of anygovernment schemes for want it.A bench headed by Chief Justice P.Sathasivam said that the plea of the Centrewould be taken up for hearing on October 8.“We seek modification of the order, whichsaid that Aadhaar card is not mandatory,”Solicitor-General Mohan Parasaran, appear-ing for the Centre, said, adding that the order may come in the way of various welfareschemes. Earlier, the Supreme Court had said 

that the Aadhaar card, being issued by UniqueIdentification Authority of India (UIDAI),was not mandatory for availing any govern-ment services and nobody should be deprived of any such facilities for the want of the card.The Centre had also told the court that theAadhaar card was optional and that it has notmade it mandatory for the citizens.The apex court had passed the earlier order while hearing a batch of pleas against deci-sions of some States to make Aadhaar cardscompulsory for a range of activities includingsalary, PF disbursals and marriage and proper-ty registrations.

Jet-Etihad Airways deal. A bench comprising Chief Justice P. Sathasivam and Ranjan Gogoi said that it

would hear the petition on October 8.Mentioning the matter, Mr. Swamy said it required 

urgent hearing in view of the approval accorded tothe deal by the central government.

Mr. Swamy had in his PIL sought “a direction to setaside and revoke any action or decision or grant of 

any further approvals/permissions/ permits, etc. by

the respondent (govt) authorities, based upon, relying

BRUSSELS, OCTOBER 4:President Pranab Mukherjeehas sought to counter criti-cism against the economicstimulus provided when hewas the Finance Minister in2009 and maintained thateconomy under him regis-tered high growth rates.Seeking to debunk criticismthat the stimulus was respon-sible for high fiscal deficit and depreciation of rupee, he told Euronews “...like most other countries we provided stimu-lus package to ensure thatfastest sliding down of theGDP growth leading to unem-

 ployment could be arrested...In India we got temporaryrelief because in the year,from 9 per cent GDP growthwe had registered a 6.7 per cent (2007-08).”But, Mr. Mukherjee said, in

But againfrom the third year it started sliding down.India’s economic growth rateslipped to 6.2 per cent in2011-12 and to a decade’s lowof 5 per cent a year after. Inthe first quarter of the currentfinancial year it was 4.4 per cent. According to AsianDevelopment Bank’s latest

 projectio n the growth ratecould fall to 4.7 per cent in2013-14.Mr. Mukherjee said that when he took over asFinance Minister in January2009 the impact of the globalfinancial crisis was being felton India.Observing that hisimmediate task was to dealwith the ensuing economic

 problems, he said, “IndianGDP was growing at a fastrate of around 9 per cent plus.

But when I took over I found out that there was on a fort-

nightly basis sliding down of the GDP growth.”In order todeal with the global crisis of 2008, he said, the then U.S.President George Bush called the first G20 summit and therewas broad consensus that

countries should providestimulus to address the eco-

The government shutdown is bad enough, but failure to raise the debt ceil-ing would be far worse, and could veryseriously damage not only the US econo-my, but the entire global economy,” IMFManaging Director Christine Lagarde,said.“So it is “mission-critical” that this beresolved as soon as possible,’ Ms.Lagarde said in her address to the GeorgeWashington University. The United States, she said, needs to “slow down and hurry up,” she added.“That means replacing the sequester withmore back-loaded measures that do nothurt the recovery. At the same time, theUS needs to do more to make debt sus-tainable by containing the growth of enti-tlement spending and raising revenues,”Ms. Lagarde said.Japan, she said, also needs a credible

QUITO, OCTOBER 4: Ecuador’s National Assembly on Thursday gave thego-ahead to drill in the Yasuni NationalPark, after failing to secure international

compensation for leaving it untouched.President Rafael Correa asked the assem- bly in mid-August to allow the move,after a call went unanswered for devel-oped countries to pay Ecuador for notdrilling in the nature reserve.The Yasuni park in the east of the countryhas been declared a UNESCO biospherereserve for its exceptional biodiversity,and is home to several indigenous tribes.But in the six years since Ecuador launched the ITT-Initiative, named after the three oilfields of Ishpingo, Tiputiniand Tambococha under the park, pledgeshave only reached 13.3 million dollars, or 0.37 per cent of the target, promptingCorrea to abandon the project.The deposits are expected to yield profitsof 18.3 billion dollars, with extraction tostart in five years.Thursday’s legislation, passed by 108votes to 25, would allow drilling in 0.1

 per cent of the park’s surface, and excludes a large section in the middle of the area which is to be left untouched.The operation was in the national inter-

est, and would be carried out by a stateoil company, the assembly said.Proceeds should go to the developmentof communities in the area, and to sup-

SRINAGAR, OCT 04:Minister for Higher Education Mr. MohammadAkbar Lone on Friday saidthat Union Ministry of Human Resources hasannounced a SpecialScholarship Scheme (SSS)for the 12th class or equiva-lent passing-out students

 belonging to J&K State.The information was given

 by the Minister during thequestion hour while replyingto a clubbed question raised

 by Sheikh Ghulam Rasooland Ravinder Kumar Sharma.The question was initiallyreplied by Minister for RuralDevelopment, Ali

Mohammad Sagar.Mr. Lone said that thescheme launched in 2011-12

 provides 5000 fresh scholar-ships per annum (4500 for General Degree Courses,250 for Medical and 250 for Engineering) to the students

of J&K.He said an amount of Rs. 3lakh tuition fee and Rs. Ilakh hostel charges for Medical, Rs. 1.25 lakhtuition fee and Rs. 1 lakh ashostel charges for Engineering and Rs. 30,000tuition fee and Rs. 1 lakhhostel charges were been

 paid to the students gotadmission under the scheme,adding that as per the latestinformation provided by theUnion Government anamount of Rs. 31.9 crore has

 been released for grant of 2858 scholarships.The Minister stated that theJ&K State has no role in theimplementation of the

scheme and acts only as thefacilitator. He said thescheme has been started byMHRD and is being imple-mented through AICTE.The Minister said that theEducation department hastime and again notified that

no NGO or any other organ-ization has been authorizedfor sponsoring the scheme.The matter of certain NGOsmisleading the students has

 been viewed seriously andtaken up with the CID for investigation to inquire intothe role of NGOs who pre-sented themselves as thesponsors of the schemes tomislead the students.The Minister further informed the House thatafter receiving representa-tion made by various stu-dents stating that they havegot admission outside theState with the hope that theywill get benefit of scholar-ship but have not yet receive

scholarships so far, he took the matter with the UnionMinister of HRD to redressthe grievances of such stu-dents. Moreover, the Chief Minister has already takenup the matter with the PrimeMinister, he added.

The Excellence Award wasgiven on Friday at a symposium on "NewPublic Management" held at Indian Instituteof Foreign Trade (IIFT) New Delhi.Mr. Asif Hamid Khan, Additional ResidentCommissioner, J&K Government, New Delhireceived the "Excellence Award" on behalf of Chief Secretary Mr. Mohammad IqbalKhanday, from Dr. Prajapati Trivedi,Secretary (Performance Management), GOIand Chairman, National Authority ChemicalWeapons Convention, Cabinet Secretariat,

 New Delhi.Jammu and Kashmir State has already com-

 pleted the implementation of the first round of RFD in a record time and has the distinctionof achieving excellence in implementing var-ious specific and critical aspects of RFD poli-cy.The Cabinet Secretariat having recognized theexcellent performance of the State expresseddeep appreciation for the effective leadershipof the State Government particularly Chief Secretary Mr. Mohammad Iqbal Khanday inimplementing the RFD. The UnionGovernment presented a trophy to the StateGovernment in recognition of its contribution.At present, 80 departments of Government of 

India and 800 Responsibility Centers under these departments are covered by the RFD. In

addition, 17 States are at various stages of implementing the RFD. To recognize theachievements in this regard, the CabinetSecretariat decided to give the States an"Award for Excellence in Implementing RFDPolicy". Jammu and Kashmir was identifiedas one of the frontrunner States for this Awardof Excellence for the "most expeditiousimplementation of RFD at State level".Union Secretaries, senior officers of 80departments of the Government of India,members of Ad-hoc Task Force (ATF) and

HYDERABAD, OCT 04:Months before the first batchof 6000 engineers graduatefrom the Rajiv GandhiUniversity of KnowledgeTechnologies (RGUKT),dozens of public and privatesector companies are alreadyqueuing up for r ecruitment.The university will be thefirst technological institutein the state to have such alarge batch of engineeringgraduates from six streamssuch as electronics and com-

munication, computer sci-ence, civil, mechanical, met-allurgical and chemical engi-neering pass out in May2014.A total of 34 public and pri-vate sector companies havesigned up for the placementdrive, including TCS,Infosys, Mahindra Satyamand HCL.From the public sector, the

Defence Research andDevelopment Organisation(DRDO) have expressedinterest to recruit engineers,varsity officials said.The varsity was establishedin 2008 with three separateinstitutions functioningunder it at Nuzvid (Krishnadistrict), Idupulapaya(Kadapa) and Basar (Adilabad), to provideworld-class technical educa-tion to rural students.Although it had started out

with a total of 6,000 seats inall the three institutions, thenumber of seats were later reduced to 3,000 in 2010,due to lack of proper infra-structure facilities.While a majority of the stu-dents of the institute comefrom rural areas, RGUKThas been imparting specialEnglish training to bridge thelanguage gap.

English courses will contin-ue in the form of technicalwriting classes and similar modules, an official said."Students can match the softskills of those graduatingfrom premier institutions inthe country. Recruiters arelooking forward to hiringsuch talent," the vice-chan-cellor said. The varsityoffers a six-year course thatincludes a two-year pre-uni-versity schooling equivalentto Intermediate education.

Students from governmentschools, who topped SSCexams from each mandal inthe state, are eligible for admissions.Over 50 per cent of the stu-dents studying in the varsityare girls. The new recruit-ment drive will be a shot inthe arm to the institute whichhas not been getting govern-ment funding in recent years.

PUNE, OCT 02: Areas hav-ing a minimum of 200 Urdu-speaking population can nowhave Urdu-medium schools,

 provided at least 30 studentsfrom such pockets are willingto study in each school, astatement issued by the state

education department said.The government has recentlygiven a go-ahead to local self-government bodies like zilla

 parishads, municipal corpora-tions, municipal councils andcantonment boards in the stateto open Urdu-medium schools

as per the requirement. As per figures supplied by the stategovernment, Maharashtra has1.03 lakh primary and second-ary schools. It includes around4,785 Urdu-medium, 9,130English-medium and 87,120Marathi-medium schools. The

government's decision toallow local self-government

 bodies to open Urdu-mediumschools has come in the wakeof last month's move to clear aRs 10-crore package for 200of the 1,889 madarsas in thestate.
