1. Restrictions to the application of Waiver of Fees and Charges

• The approval of a Waiver for a Fee and Charge is governed by the Instrument of Delegation, and

specifically Delegation 12, Write off of debts. The exercise of powers and the discharge of duties

under section 6.12 of the Local Government Act 1995 to warve or grant concessions (excluding

rate concessions) and to write off debts not exceeding $3,000. In cases where the request for

Fee Waivers exceed $3,000 a report needs to be submitted to an Ordinary Council Meeting for

Council's consideration and approval.

• Where a Fee and/or Charge is due to the Shire as an Australian Tax under Australian law in

respect of a service. then the Shire will not consider any application to waive that Fee and/or

Charge.

The Shire may at its own discretion determine an individual application on its merits and give

consideration to natural disasters.

A maximum of 50% of the Fee and Charge will be considered for Waiver as listed In the annual

Schedule of Fees and Charges adopted by Council (with the exception of National celebrations,

State or Federal functions and visits by Parliamentarians to the Shire).

The activity, event, competition, project or celebration must be offered within the Shire of

Augusta-Margaret River local government boundaries.

• The Community Organisation Is not to have already received funding from the Shire by way of a

Sponsorship, Donation, Community Development Grant or Council Contribution or received

financial assistance from the Shire under any existing written agreement during the current

financial year.

Where an activity, event, competition, project or celebration occurs on a regular basis within a

financial year July to June, then application for financial assistance shall be based on the full

financial year.

One application per financial year (July to J1:1ne} may be submitted at any time during the year for

Financial Assistance as listed in Table 1 -of the F112 Financial Assistance Policy.

• Applicatiqns are to be lodged on the Shire's official application form and retrospective

applications will not be considered where they are submitted after the activity, event, competition,

project or celebration.

Once the Delegated Shire Officer has determined that the application for financial assistance be

approved, a Tax Invoice' for 50% of the total Fee or Charge will be Issued for payment with the

due date for payment within 14 days as per the Shire's trading terms.

To be eligible for a Waiver of Fees and Charges the applicant must meet the following criteria :

• Operate in the Shire of Augusta-Margaret River;

• Community Organisation which is an Incorporated body;

• Not-for-profit organisation;

• Educationallnstitution.

Waiver of Fees and charges will be considered for:

Shire Fees and Charges that are not due to the Shire as ari Australian Tax under Australian taw

in respect of a service;

• Events that occur as a result of natural disasters;

• National celebrations;

Waiver of Fees and charges will not be considered for:

• Individual persons;

• State or Federal Government bodies;

Commercial Organisations or Businesses;

• Fees and Charges levied and collected by the Shire under any written law;

• Support for organisational or general operating costs;

• Activities that will financially benefit the Community Organisation (i.e. entry charge);

• Activities that are already covered by an existing service agreement with the Shire of Augusta­

Margaret River;

Community Organisations that have received funding from the Shire of Augusta-Margaret River

by way of Sponsorship, Donation, Community Development Grant or Council Contribution in the

current ·financial year.

3. Timeframes for Application

An application for a Waiver of Fees and Charges may be submitted at any time during the year.

4. Registration of Applications

Upon receipt of the Waiver of Fees and Charges application form together with supporting

documentation, incoming documents will be registered by the Records Team to file No FJN/130 and

assigned as an outstanding record to the following Officers:

o The Personal Assistant (PA) of the Director Corporate Community Services (DCCS).

o Environmental Health Technician for Event Fees.

o Governance Officer for Permits on Shire reserves.

o Infrastructure services for Banner Fees.

• The PA Is to print the application form and supporting documentation and pass to the DCCS

for review.

5. Determination of the Application

The DCCS is to assess the application against the restrictions on funding as set out in point 1 and

eligibility criteria as set out in point 2.

• The DCCS may liaise and forward the application onto the Manager of the relevant

Business Unit for their comment and recommendation.

• If the Manager is satisfied and re.commends approval, they are to provide reasons in support of

the application, sign, stamp and date the application form and return to the DCCS as

authorised officer under Delegation 12 Write off debts.

o Where applications are received for financial assistance over $3,000.00 the DCCS is to

prepare a report to Council.

• If the DCCS is satisfied that the restrictions do not apply to the applicant and that they meet the

eligibility criteria they are to sign, stamp and date the application form and return to the PA for

finalisation.

6. Notification of Outcome and Recording of Documents

Successful

• The PA will scan and photocopy the signed approved application form.

• The PA will inform the applicant in writing that the request has been successful and advise that

funds will be released by the Shire within 21 days.

• The Outgoing correspondence is to be cross referenced with the Incoming Records Document

No and the approved application form attached.

• The foilowing Officers are to be added as internal correspondents:

o Revenue Coordinator to all applications.

o Environmental Health Technician for applications in relation to Events.

• The record is to be marked as 'Final' by the PA and original documents returned to the Records

Team.

Unsuccessfu 1:

• The PA will scan the signed declined application form.

• The applicant will be informed in writing that the application has been unsuccessful and for what

reason.

• The Outgoing correspondence is to be cross referenced to the Incoming Records Document No

with application form attached.

• The record is to be marl<ed as 'Final' by the PA and original documents returned to the Records

Team.

7. Tax Invoice for Fee Payment

• The PA is to complete an on-line Debtors Invoice Request for the amount of the total Fee and

Charge less 50%.

• · GST Treatment is as follows:

o If the amount of the Fee and Charge includes GST then the amount is GST code 'C'.

o If the amount of the Fee and Charges is NOT subject to GST then the amount is GST code

'N'.

o The 'Tax Invoice' will be processed by the Revenue Team and issued for payment within 14

days.

Budget Revenue is to be allocated from the relevant Business Unit and corresponding Chart of

Account or Job No as detailed on the Application Form.

8. Financial Reporting

o The Revenue Team is to update the Financial Assistance listing located on the Shire's Intranet.

o The amount recorded shall be the 50% Fee amount waived.

• Financial implications will be included in the Monthly Financial Management Report provided to

Council and detail both a year to date and quarterly figure.

Application

Financial assistance for Waiver of Fees and Charges Is to be administered by Council and the

Directorate Corporate Community Services.

Terminology

In this procedure, unless the context requires otherwise- Community Organisation means a group of

people that come together to pursue a common cause or interest for the benefit of the Community and

may include an Association, Centre, Club, Committee, Group, Incorporated Body or Society.

development. This procedure provides the guidelin~s of eligibility timeframes for applications,

1. Restrictions to Community Development Grants

• One application per financial year (July to June) is to be submitted by the closing date as

advertised annually by the Shire of Augusta-Margaret River, applications received after the

closing date will not be considered.

Funding will not be provided for maintenance or works to any buildings or for development of any

assets, either Shire owned or Organisation owned.

• Applications are to be lodged on the Shire's official application form and retrospective

applications will not be considered after the advertised closing date.

• Where an application for a Community Development Grant has been approved by the Director of

Corporate and Community Services (DCCS), the recipient is to complete a 'Community

Development Grant Acquittal Form'.

• The 'Community Development Grant Acquittal Form' is to be completed and submitted 1 month

after the project completion date and is to provide proof of expenditure of the funds. This may

include copies of invoices, receipts for purchase of materials, costs of promotion or any other

costs incurred during the project or event.

The Shire will not consider applications where Community Organisations have previously

received funding from the Shire but have not acquitted the funding.

The Shire will issue a Tax Invoice to recoup funds that have not been expended or acquitted by

30 June of the following financial year.

To be eligible for a Community Development Grant the applicant must meet the following criteria:

Be a Community Organisation within the Shire of Augusta-Margaret River;

Be an Incorporated community-based volunteer and not-for-profit organisation functioning in the

Shire of Augusta-Margaret River;

• Note: Organisations not incorporated will need to be sponsored by a not-for-profit

organisation that is incorporated to whom funds can be paid and agreements can be

made. A letter from the sponsoring organisation must be provided with your application

confirming they agree to accept the funds on your group's behalf.

Community Development Grant funding will be considered for projects that: 2

Contribute to the wellbeing and quality of life of the local Community (i.e. Men's sheds,

shared community equipment);

• Assist the Community Organisation to attract more members or benefit the wider Community

(i.e. Events);

• Enhance the functioning of the Organisation (i.e. purchase of small equipment);

Increase the involvement in arts and culture by the Community resulting in significant cultural

and or economic impacts in the Shire (i.e. community arts projects);

• Strengthen our Community by, providing initiatives for the development of volunteers (such

as training and or workshops); and

Improve Community wellbeing by ensuring that opportunities to engage in activities are

accessible to all members of the community including those that are culturally and

linguistically diverse as well as people living with a disability.

Community Development Grants will not be provided to or considered for:

• Educational Institutions

• Capital or ongoing maintenance works:

• Community Organisations who have made application for funding assistance from the Shire

under any other financial assistance category in the last 12 months;

• Community Organisations that have applied for multiple Community Development Grants;

Sporting Associations and Groups requiring equipment or uniforms;

• Deficit funding for organisations experiencing a shortfall In cash, revenue or anticipated revenue;

• Recurrent events;

Commercial Organisations or Business to assist with salaries or recurrent operational costs;

• Proposals where alternative sources of funding are available;

Projects or activities that are already covered by an existing service agreement with the Shire of

Augusta-Margaret River.

• Community Organisations who have not acquitted previous Grant funding.

3. Timeframes for Applications

In line with the adoption of the annual budget the Shire will call for applications for Community

Development Grants and inform applicants through local media, via the Shire's web-site and the

Community Connect portal:

• Each financial year, the Community Development Administration Officer (CDAO) is to promote

through local media advising Community Organisations that the Shire is now accepting

applications.

The advertising period for Community Developmen\ Grant applications shall remain open for a

period of 42 days (6 weeks).

• The CDAO is to liaise with the Records Team notifying them of the responsible officer and

request amendments to the Volume number of records file FIN/191 prior to registering

applications for the current year and inform them of the closing date.

4. Acknowledgement of Financial Assistance

Successful applicants are required to acknowledge the Shire of Augusta-Margaret River's support

by participating in media and marketing opportunities as directed by the Shire. The applicant must

be willing to sign a media release form permitting the Shire to use their image for promotional

purposes and display a logo on relevant promotional material or during the Project or Event where

possible. Applicants must consent to being contacted by the Shire 's Marketing and Event Officer .

. 5. Registration an~ compilation of Applications

• Upon receipt of the Community Development Grant Application . Form and supporting

documentation, the incoming documents will be registered by the Records Team to file No

FIN/191 and assigned as an outstanding record to the CDAO.

The CDAO will send an acknowledgement letter to the applicants.

After the advertised closing date the CDAO will compile the applications received and enter the

relevant details into the Comparative Assessment Grid to include the applicants name, amount of

assistance and reasons for financial assistance.

6. Determination of the Application

• The comparative assessment will be reviewed by a panel of Shire Officers including:

• Manager Community Development and Safety (MCDS);

Community Development Administration Officer;

• Community Development Officer;

• Upon the completion and assessment by the panel, a Memo detailing the recommendations

together with the original application forms are to be forwarded to the DCCS.

• The DCCS will review the recommendations put forward and make the final determination to

either approve or decline the applications received.

• If the DCCS is satisfied that the restrictions do not apply to the applicant and that they meet the

eligibility criteria they are to sign, stamp and date the application forms and return to the CDAO

for finalisation.

7. Notification of Council Recommendation and Recording 'Of Documents

Successful:

• The CDAO will scan and photocopy the signed approved application form.

• . The CDAO wiU inform the applicant in writing that the request has been successful and

provide the following information:

• Media release form for completion and return.

• · Funds will be released by the Shire within 21 days.

• The Outgoing correspondence is to be cross referenced with the Incoming Records

Document No and the approved application form attached.

• The record is to be marked as Final by the CDAO.

• The Revenue Coordinator is to be added as an internal correspondent with action status of

outstanding.

• The CDAO is to liaise with the Marketing and Events Officer t6 advertise the successful

applicants in the Shire's Community Update and also list the applicants on the Shire's

website.

Unsuccessful:

The CDAO will scan the signed declined application form.

The CDAO will inform the applicant in writing that the application has been unsuccessful to

contact the CDAO for assessment feedback.

• The Outgoing correspondence Is to be cross referenced to the Incoming Records Document

No with application form attached.

• The record is to be marked as Final by the CDAO and the original documentation returned to

the Records Team.

8. Release of Funds

• The CDAO is to complete a Creditors 'Request for Payment' form and attach the signed

photocopy of the approved Community Grant Application form duly signed by the DCCS.

• GST Treatment is as follows:

If the applicant is registered for GST then the amount is plus 10% GST 'C'.

If the applicant is NOT registered for GST then the amount is GST 'N'

• The 'Request for Payment' form is given to Accounts Payable for processing.

• Budget Expenditure is to be allocated to the DCCS Business Unit DC39.44.

9. Acquittal of Funding

• One mi)nth after the Project completion date the CDAO will liaise with the successful applicants

where a Grant Acquittal Form has not been lodged.

• When acquittal documents are received CDAO to check all reporting is complete and provide a

memo to MCDS for acquittal sign off.

• Where acquittal forms have been received within the Project Finish date, the CDAO Officer will

·send a thank you letter to the applicant to finalise the Grant Funding Process.

10. Financial Reporting

e The Revenue Team is to update the Financial Assistance listing located on the Shire's

internal intranet.

• Financial implications will be included in the Financial Management Monthly Report provided

to Council and detail both a year to date and quarterly figure.

Application

1. Restrictions to the application of Council Contributions

Funding will not be provided for improvements to Shire facilities that are Capital in nature;

Projects for structural renovations or permanent improvements to items considered to be fixed to

a structure erected on Council owned or controlled land;

Purchase of plant or vehicle operating costs;

Major repairs that require a Licensed contractor (i.e. plumber, electrician, vermin or pest control);

Equipment purchases where there is not supporting evidence that such equipment is vital to the

ongoing management or maintenance of the facility.

Community Organisations that already receive funding under an existing agreement with the

Shire of Augusta-Margaret River.

Community Organisations are to provide an income and expenditure statement to June 30 of the

previous financial year which has been audited by a Certified Practising Accountant.

• The Shire will take into consideration any amount of surplus revenue as detailed in the audited

statement before providing financial assistance to the Community Organisation.

Applications are to be lodged on the Shire's official application form and retrospective

applications will not be considered after the advertised closing date.

Where applicable the Shire will issue a Tax Invoice for funds that have not been expended by' 30

June of the following financial year.

2. Eligibility

To be eligible for a Council Contribution the applicant must meet all of the following criteria:

• A Community Organisation within the Shire of Augusta-Margaret River that makes available its

membership to the general community;

• Be an Incorporated community-based volunteer and not-for-profit organisation functioning in the

Shire of Augusta-Margaret River;

Council Contributions will be considered for:

• General care and management of Shire facilities including, maintenance (l.e. painting, cleaning of

facilities, rubbish disposal, utility costs (i.e. gas, water, phone, power) and purchase of minor

equipment (i.e. kitchen utensils):

• Ground maintenance (i.e. gardening, mowing lawns):

• Core staff and administration costs for the management of Shire facilities (i.e. honorariums,

stationery).

• Minor events that are held by Community Organisations that have a significant cultural and

economic impact in the Shire;

• Cultural events resulting in significant benefits to the local community, Its members and are open

to the general public (i.e. Festivals, markets);

• Programs and activities that strengthen our community and improve community

well-being;

Council funds will not be considered for:

• Improvements to Shire facilities that are capital in nature:

4. Sources of Funding

Annually the Shire will provide budget funding up to a maximum amount of $100,000.

The amount of the contribution will be assessed on each proposal received with consideration given

to:

• The amount of funds being allocated towards the proposal by the organisation;

• Whether external grant funding opportunities have been or will be applied for;

• Other funding sources for the proposal.

5. Acknowledgement of Shire Assistance

Successful applicants are required to acknowledge the Shire of Augusta-Margaret River's support

by participating in media and marketing opportunities as directed by the Shire. The applicant must

be willing to sign a media release form permitting the Shire to use their image for promotional

purposes and display a logo on relevant promotional material or during the Project or Event where

possible. Applicants must consent to being contacted by the Shire's Marketing and Event Officer.

6. Registration and compilation of Applications

Upon receipt of the Council Contribution Form and supporting documentation:

• The incoming documents will be registered by the Records Team to file No COR/ and assigned

as an outstanding record to the PA of the DCCS.

• The PA will send an acknowledgement letter to the applicants.

• After the closing date the PA will compile the applications received and enter the relevant details

into a summary sheet to include the applicants name, amount of assistance and reasons for

financial assistance.

7. Determination of the Application

• The DCCS will review the summary of applications against the restrictions on funding as set out

in point 1 and eligibility criteria as set out in point 2.

• The DCCS will include the approved applications in the annual budget for adoption by Council.

• The DCCS is to complete the application form and sign, stamp and date the application form and

return to the PA.

.8. Notification of Council Recommendation and Recording of Documents

Suc;cessful

• The PA will scan and photocopy the signed approved application form and update the

summary sheet.

• The PA will inform the applicant In writing that the request has been successful and provide

the following informaiion:

o Media release form for completion and return.

o That the funds will be released by the Shire within 21 days.

The Outgoing correspondence Is to be cross-referenced to the Incoming Records

Document No and application attached.

• The record is to be marked as Final by the PA.

• The Revenue Coordinator Is to be added as an internal correspondent with aciion status of

outstanding.

Unsuccessful:

• The PA will scan the signed declined application form and update the summary sheet.

• The applicant will be informed in writing that the application has been unsuccessful and for

what reason.

• The Outgoing correspondence is to be cross referenced to the Incoming Records Document

No with application attached.

• The record is to be marked as 'Final' by the PA and original documents returned to the

Records Team.

9. Release of Funds

• The PA is to complete a Creditors 'Request for Payment' form and attach the signed photocopy

of the approved Council Contribution Form duly signed by the DCCS.

GST Treatment is as follows:

o If the applicant is regil!tered for GST then the amount is plus 10% GST code 'C'.

o If the applicant is NOT registered for GST then the amount is GST code 'N'.

10. Acquittal of Funding

Where funding has been provided for Cultural and minor events, the applicant is required to

lodge an acquittal form to the Shire within one (1) month of the completion of the event.

If an acquittal form has not been lodged within One (1) month after the event date the PA will

liaise with the successful applicant to reaffirm their requirements.

• Where acquittal forms have been received within one ( 1) month of the event date, the PA will

11. Financial Reporting

The PA will enter the Council contributions into the Application and Summary Results and

forward to the Revenue Team.

Objectives

The purpose of this procedure is to consider requests from Community Organisations for interest free

loan funding to ensure the Shire contributes to and supports the development of infrastructure within

the Shire for the benefit of the local Community. Set guidelines for applicants requesting Interest Free

Loan funding and to assist Shire Officers in the administrative management of applications.

Procedure

This procedure sets out:

1. Restrictions to the application of Interest free Loans

One application per financial year (July to June) is to be submitted by the closing date as

advertised annually by the Shire of Avgusta Margaret River, applications received after the

closing date will not be considered.

• The location of the facility shall be on land owned by or vested within the Shire of Augusta

Margaret River local government boundaries.

• The duration of the repayment of the loan is not to exceed a repayment period of more than five

(5) years.

• Applicants are required to have made an application for funding for the project from other funding

sources to the satisfaction of Council. ln. relation to this application, the Council may commit to

provide a certain level of funding providing the project proceeds. The rationale for this is to

maximise funding received from the other funding sources.

Community Organisations are to demonstrate a financial capacity to service loan repayments and

will be required to provide audited annual income and expenditure statements for the past two (2)

years.

• Documentation is to be provided being a copy of the Certificate of Incorporation issued by the

Department of Fair Trading and evidence of that the organisation is registered for an Australian

Business Number (ABN).

• If successful the Community organisation will be required to nominate two {2) persons who will

guarantee the repayment of the loan in full if the organisation falls to meet all or any of the

repayments when due.

Sporting Associations or Clubs require written support from the Sport and Recreation Advisory

Committee, which is to accompany the application.

All approved applications will require the Community Organisation to enter into a written

agreement with the Shire.

• It is at the discretion of Council if funding is to be provided in a financial year with relation to the

balance of the wmmunity loan reserve.

• The Community Organisation will be required to complete a Direct Debit Authorisation Form for

the Shire to process Loan Repayments on the date due as per the loan schedule . .

• Applications for an interest free loan will be determined by the Counci l.

2. Eligibility

To be eligible for an Interest Free Loan the applicant must meet the following criteria :

• Community Organisation within the Shire of Augusta-Margaret River that is under a current lease

agreement;

o Community Organisations that makes available its membership to the general community;

• Be an Incorporated community-based volunteer and not-for-profit organisation functioning in the

Shire of Augusta-Margaret River.

Interest Free Loan funds will be considered for:

• Establishment of new facilities preferably multi-purpose to allow for Community Organisations to

expand its operations and or services which as a result will have significant benefits to the

Community and its members;

o Capital improvements to Shire facilities open and used for attendance by the local Community

which encourage participation (ie: Sporting Associations or Clubs);

• Projects for permanent improvements or items considered to be fixed to a structure erected on

Council owned or controlled land;

• Structural renovations or improvements of a fixed nature.

Interest Free Loan funding will not be considered for:

• Improvements to Shire facilities that are not Capital in nature;

General maintenance, minor repairs or moveable items;

• Purchase of Plant;

• Community Organisations that already receive funding under an existing service agreement with

the Shire of Augusta Margaret River in the current financial year.

3. Tlmeframes for Applications

Each year the Shire will call for applications for loan funding and inform applicants through local

media, via the Shire's web-site and the Community Connect porta l:

Each financial year, the Personal Assistant (PA) to the Director Corporate and Community

Services (DCCS) is to request the Shire records team create a new IFU file.

• The PA is to tiaise with the Shire's Marketing and Events coordinator to promote through local

mediate that the Shire is now accepting applications for an Interest Free Loan.

The advertising period shall rema1n open for a period of 42 days (6 weeks).

The PAis to liaise with the Records Team notifying them of the responsible officer and File No for

registering applications and inform them of the closing date.

4. Sources of Funding

Annually the Shire will provide budget funding up to a maximum amount of $50,000. The Shire may

also give consideration to the balance of the community loan reserve.

The amount of the loan will be assessed on each proposal received with consideration given to:

• The amount of funds being allocated towards the proposal by the organisation;

• Whether external grant funding opportunities have been or will be applied for;

• Other funding sources for the proposal.

5. Registration of Applications

Upon receipt of the application for an Interest Free Loan and supporting documentation:

• Incoming applications will be registered by the Records Business Unit to the IFL file and assign

the application as an outstanding record to the PA of the DCCS.

• The PA Is to print the application form and supporting documentation and pass to the DCCS for

review.

6. Determination of the Application

• The DCCS is to assess the application against the restrictions on funding as set out in point 1

and eligibility criteria as set out in point 2.

• The DCCS is to prepare and submit a report to an Ordinary Meeting of Council.

• On decision oi Council the DCCS is to complete the application form (sign, stamp and date) then

return to the PA.

7. Notification of Council Recommendation and Recording of Documents

Successful:

• The PA will scan and photocopy the signed approved application form.

• The PA will inform the applicant in writing that:

o The request has been successful.

o Provide details of the process for completion of the written agreement between parties.

o Attach the Shire's Direct Debit authorisation form for completion and return.

o Costs associated with preparing and executing the legal documents are to be mel by

the applicant.

o The funds will be released by the Shire within 21 days.

The Outgoing correspondence is to be cross-referenced to the Incoming Records

Document No and application attached.

The record is to be marked as Final by the PA.

• The Revenue Coordinator is to be added as an internal correspondent with action status of

outstanding.

Unsuccessful:

• The PA will scan the signed declined application form.

The applicant will be informed in writing that the application has been unsuccessful and for

what reason.

• The Outgoing correspondence is to be cross referenced to the Incoming Records Document

No with application attached.

• The record is to be marked as 'Final' by the PA and original documents returned to the

Records Business Unit.

8. Loan Documentation

• The PA is to make arrangements for the Loan.Documentation to be drafted and signed by both

parties.

The signed loan agreement between both parties is to be scanned and registered to the

corresponding IFU File created by records.

• The Revenue Coordinator Is to be added as an internal correspondent with action status of

outstanding.

• The Record is to be marked as 'Final' by the PA and as the loan agreement is a vital record, the

original document is to be returned to the Records Business Unit.

9. Release of Funds

• The PA will liaise with the Accountant to setup an expenditure Chart of Account for the release of

loan funding, then also determine the Income Chart of Account for the revenue allocation.

• The PA will proceed to complete a Creditors 'Request for Payment' form with GST code of 'N'

and attach a photocopy of the approved signed application form by Director CCS.

• The 'Request for Payment' form is given to Accounts Payable for processing.

• Budget Expenditure is to be allocated to the General Finance Business Unit, Chart of Account as

advised by the Accountant.

10. Loan Repayments

The Revenue Team will load the bank details against the Debtors record, and update the debtors

'Monthly invoices' excel spreadsheet.

Within 7 days after the due date as shown on the loan repayment the Revenue Team will ra ise a

Tax Invoice for the repayment, GST free. The Debtors charge type will be GF71 .

• Revenue will process the payment by Direct Debit, stamp the invoice as paid and post to the

Debtor.

Default on Repayments

• If an organisation fails to honour two consecutive loan repayments that exceed 30 days of the

due date it will be deemed to have defaulted on the loan. 6

• In the event of a default, the Council will require the organisation to demonstrate that it has the

capacity to continue to meet the repayments required. If this cannot be demonstrated the Council

will commence proceedings to recover the outstanding monies.

• An organisation that defaults on its loan will be ineligible for further financial assistance by way of

Waiver of Fees and Charges, Community Development Grants, Council Contribution and Interest

Free loan for a period of three (3) years.

11. Acquittal of Funding

• One month after the Project completion date the PA will liaise with the successful applicants

where a Grant Acquittal Form has not been lodged.

• Where acquittal forms have been received within the Project Finish date, the PA will send a thank

you letter to the applicant to finalise the Funding Process.

7.0 GENERAL BUSINESS

7.1 Presentation from RPS, Sunset Events & Strategen consultants: Proposal to establish Lot 22 Caves Rd as an event venue for the holding of major music festivals (see Attach 1 & 2). • Mark Hunt, RPS Planning outlined Sunset Events' proposal to establish Lot 22

Caves Rd as an event venue for the holding of major music festivals. RPS has been appointed by Sunset Events to coordinate their development application.

• So far there has been in principle support to their proposal. A number of discussions have been initiated with surrounding land owners to resolve any issues. Mark explained that the point of the briefing today was to focus on the approach Sunset Events take to emergency management, including traffic management, fire management and communication. They are also hoping for feedback on issues the committee thinks are important to consider from an emergency management perspective.

• David Chitty, Managing Director Sunset Events explained their emergency management approach, emphasising that the safety of the event and their patrons was critical to the success of their business. David discussed their commitments as outlined on the powerpoint (Slide 4, Attach 2).

• Sunset Events would be using similar systems that are currently effectively used at their events. Detailed emergency plans and evacuation plans will be submitted prior to events being held.

• Traffic Management - The proposed site is much more isolated than the current Bussell Hwy Southbound site. It is also close to the beach, with a good road system. There are 3 entrance points to the site and with the 293 acre size cars can be brought onto the property for processing before going into the event, this will assist with traffic hold ups. Chapman Road will be used solely for local traffic. The speed limit on Bussell Hwy should remain unimpeded.

• Communications- Sunset Events have been working closely with all stakeholders. The Sunset Events representative talked through the Communications chart (Slide 12, Attach 2).

• First Aid - This will be self-resourced; with resources brought down from Perth, therefore there will be no impact on local services. This includes 24hr first aid, access to defibrillator, oxygen, ambulance and doctors onsite. This is in line with their current model which is to deal with as much as they can onsite then if need be escalate to a local facility. e.g. Sunbury Hospital.

• Fire management planning - The water licence has been approved. They will be putting in a bore, irrigation and turf. This will also help with the issue of dust.

• Roger Banks, Strategen Environmental Management Consultant discussed the context of fire management and proposed actions (see Slides 18- 22, Attach 2). Some of the Fire management actions include a 20m buffer adjacent to the National Park, adequate water and fire fighting resources and 3 access points provided onsite. They have drafted a fire management plan. The aim is to keep the site self-protecting.

• Committee representative for DCP voiced concerns over the 20m buffer and the temptation for festival goers to enter into the bush and light a fire. It was explained that there will be a security fence that is manned along the western boundary. This is a solid fence that can't easily be scaled over. The other side of the fence will be all lit and security patrols on quad or motor bike. This is in line with other Sunset Events such as the Falls Festival at Lorne which has been running for 20 years (also within a bush setting).

• Concerns were also raised over the impact of rubbish on the beach at Hamelin Bay with patrons being bussed to the beach over the 2 day festival. David explained that their teams stay onsite 7 days after the event to clean up.

• Committee representative for the Water Corporation raised concerns over the number of tourists and locals that will be around the coastal area at the same time. David explained that not all festival goers go to the beach at the same time; buses are spread intermittently all day. There is also 16km of beach so there should be enough room for all. The current model in Busselton is similar, these figures have been analysed and show that not everyone goes down to the beach at the same time.

• It was suggested that locals and non-Southbound traffic use Chapman Road to access Hamelin Bay.

• DEC raised the query that as their site is surrounded by National Park on 3 sides is there going to be a push from Sunset Events for DEC to do something about the 45 tonne of fuel loading i.e. will there be any added pressures on DEC as a result of this proposal? Sunset Events' fire management plan will focus solely on their self-contained site. There will be no push from them, however it was discussed that DEC will have to deal with this area in their long term fuel reduction plans regardless of the event.

• The committees concerns were acknowledged, and it was mentioned that RPS/Sunset Events feel all these concerns are legitimate however they too have thought about them and will address them in detail in the paperwork.

• It was asked what the next steps are for this proposal. The development application will be lodged; there will then be an advertising and submission period where key stakeholders are invited to make a submission towards the proposal. Feedback will go to Planning Officers. RPS will then provide additional information towards their application addressing any concerns.

• ACTION: If any committee members have any queries or comments please email Katie who can forward onto Mark, RPS Planning.

• It was reiterated that today was really a preliminary update and that the formal application will provide more detail and the opportunity to look at detailed plans. Tonight's purpose was to get as much local feedback as possible and try to address them before the application is submitted. They will be compil ing the submission in the next few weeks.

8.0 SHIRE OFFICERS AND DELEGATE REPORTS

8.1 Shire of Augusta Margaret River- Vicky Small • We have recently reached the formal end of recovery, with WANDRRA funding for

the recovery positions ceasing and the $40,000 Premier's donation having been spent/ allocated. The recovery team has held an official end event with a 14km hike from Ellensbrook to Gnarabup finishing with a sundowner at the Gnarabar. The Reco~ery Working Group has also wrapped up with only a couple of art projects carrying over.

• Moving on, the Red Cross has received funding through the Natural Disaster Resilience Program for a Community Engagement Officer to work on community preparedness for the next 9 months. Katie Taylor from the Shire has been appointed into this position to follow on from recent work around bushfire recovery.

8.2 Department for Child Protection & Family Support- Pamela Adams • Nothing much to report, still providing some counseling within bushfire recovery.

8.3 Water Corporation- Gary Yates • Nothing to report. • On another matter, Gary mentioned that he has some bridge beams at home that

could be useful for the bridge work that needs to be undertaken due to recent · storms. Katie will let Dave Nicholson know (completed) .

8.4 Department of Parks & Wildlife- Jere.my Friend • DEC has recently had a name change to Deptof Parks and Wildlife. Operationally

there is no difference. In the coming months DoPW will be undertaking some community consultation around the area ·in regards to burn offs. There will be no bushfire burning this year, aiming to start back up in autumn of 2014.

8.5 WA Police Augusta- Rik Lok • Nothing to report.

8.6 Margaret River Volunteer Fire & Rescue Service- Jeff Bush by • Margaret River VFRS had some officer changes/ shuffles at their AGM. Capt Jeff

Bushby, Lieutenant Leith Jones, Apparatus Officer Shaun Toye, Secretary Alison Scott, Treasurer Lester George, Fuel Hazard Reduction Coordinator Garth Baxter.

• Total of 18 emergency calls since last LEMC meeting 14 May 2013. 5 MVA's, 6 DBA's, 1 rubbish fire, 1 structure fire, 1 car fire, 2 ambo assist's, 2 special service calls.

• Had issues with Woolworth's customers parking in front of the Fire Station appliance bays. This issue has now become less frequent.

• New 3.4 Urban Tanker fire appliance is currently being built which · will allow the brigade to assist with more bushfire operations. Problem will be . housing the appliance; this issue is currently being investigated. Our new fire station is scheduled for approximately 2015.

• We will be participating in the 2013 Leavers "Crash Rescue" demQ at MRSHS this Friday being the 16th August 2013.

8.7 Margaret River Ambulance- Dave Hendry • Nothing significant to report. . • Margaret River has received some grant funding for a 2nd road ambulance. Within

the region more funding has been received for an emergency backup radio system, to enable more self-sufficiency. This system should be up and running before leavers.

8.8 WA Police- Margaret River/Local Emergency Coordinator- Paul Daly • In the recent storms the Shire, SES and Police got together and conducted a quick

table top discussion to ensure they had all measures in place including correct

phone numbers in the case of an emergency. Preparedness is what it's all about. The storms resulted in 3 wash away roads and numerous road closures. To be able to speak directly with the Shire during this time was really good . Paul suggests that if at any time people want to call toget~er a small sub-committee, and have a chat about the situation then they should. The assumed lead agency could also put forward a planned incident management team and bring them together early to ensure every agency has teams in place to be able to assist if it comes to that.

• MR Police now have a full complement of staff in place.

8.9 State Emergency Service- Lewis Hawkins • At the last AGM Rob Lewis stood down, his ongoing contribution over the years

8.10 Margaret River Volunteer Marine Rescue- Mark Ivers • MRVMR has been pretty quiet, with few incidents. • There has been one recent search involving Marine Rescue and St Johns with

someone falling off the rocks near Merchant Rock. Mark said that they can be communicated via 253 on a WAERN radio. WAERN access early would be good for St Johns.

• A list of VMR contacts has been provided to key agencies. • The Assistant Commissioner DFES is coming down this weekend for a visit. • The Anaconda is coming up. It'll be the same operation as last year, There will be

stakeholder meetings before then.

8.11 Shire President, AMRSC - Ray Colyer • An update was provided on the Augusta small boat harbour. Stage 1 is on track

with 80% of the build to be completed (i.e. operational) by September 2014. Funds have now been secured· for Stage 2 which involves a larger carpark and landscaping. The new jetty will be useful as a launching point for major sea rescues.

• Haven't heard yet from WANDRRA whether the Shire will receive flood rel ief to assist with rebuilding the roads/bridges affected by recent storms. Works can't start until after the peak rain season finishes.

Sunset Events provided an outline of its objectives with respect to utilising Lot 22 Caves Road as a venue for the relocation of the "Southbound" event from Busselton for the new year event in January 2015.

• Patronage is expected to be in the order of 10,000-12,000 people.

• The property enables camping to be accommodated consistent with current activity at the Southbound event.

• There will be three (3) proposed access points. One may be off Cosy Corner Road. The main access point for the public will be the northern off Caves Road. Access proposals will be confirmed through the DA process.

• Perimeter fencing will be installed around the immediate concert venue which is located in the western margins of the site.

• A Traffic Management Plan will be implemented as per normal process for the current event.

• A Security Management Plan is also to be prepared.

• A bus system will be provided to convey patrons to beaches during the event breaks. Other experiences such as the Caves, Blackwood River etc will be able to be undertaken through local tour operators.

• There will be no built facilities on the site until the success of the event can be

Various points raised by participants included the following:

The Local Emergency Management Group would like an opportunity to review the proposal at its forthcom ing meeting to be held on 14 August 2013.

All participants acknowledged that the event needs to be self sufficient in terms of security, emergency response, first aid, etc.

Communications in the area need to be considered. Mobile phone coverage experiences black spots.

DEC note that the time of the event increases a hazard for fire. Sunset Events advised that there is no possibility of adjusting the timing of the event as it forms part of a National series of music festivals held in the December to January period.

Traffic management on the event days will obviously be critical. Some entry points to the property may have inadequate sight lines along Caves Road. This will be developed and settled through the DA process. Participants were aware of the traffic management that is implemented with the current event at Busselton.

In order to avoid National Park impact, Department of Parks and Wildlife ( DPaW) sought a 1OOm setback from the boundary. Sunset explained that they were not opposed to the principle of a setback but 1OOm would be excessive in some areas ... for example it would compromise the ability to utilise shade trees that exist in proximity to some portions of the boundary. Preference is for a 1.8m I 2.0m high link mesh fence to be installed along the National Park boundary. Event organisers will be undertaking litt.er control, preclude camp fires, provided fire equipment on site, etc.

With respect the boundary lighting, National Park representatives considered that canopied lights' to minimise light spill into the Park would be beneficial. Sunset Events intend to light the boundary between the National Park and the festival area to ensure security is at the highest level.

DPaW reps also raised the issue of noise impacts on wildlife in the Park. Sunset advised that the layout of the festival area was still to be confirmed and considered that existing topography would most probably provide sufficient buffer for noise that would otherwise enter the Park.

Planning processes will be subject to further consideration by Shire staff. RPS and the Shire staff will discuss the approval penod but at this stage Sunset would be seeking a minimum of 5 years to enable. sufficient certainty for the event pre-establishment components.
