Minutes of the Open sessions of the North Carolina Medical Board Meeting held March 18-20, 2009. The March 18-20, 2009, meeting of the North Carolina Medical Board was held at the Board's Office, 1203 Front Street, Raleigh, NC 27609. The meeting was called to order at 8:05 a.m., Wednesday, March 18, 2009, by George L. Saunders, III, MD, President. Board members in attendance were: Janelle A. Rhyne, MD, Past President; Donald E. Jablonski, DO, President-Elect; Janice E. Huff, MD, Secretary/Treasurer; Ms. Pamela Blizzard; Thomas R. Hill, MD; Ms. Thelma Lennon; John B. Lewis, Jr., LLB; Peggy R. Robinson, PA-C; William A. Walker, MD; Paul S. Camnitz, MD and William W. Foster, MD. Also attending were R. David Henderson, Executive Director and Thom Mansfield, Board Attorney.

Presidential Remarks Dr. Saunders commenced the meeting by reading from State Government Ethics Act, “ethics awareness and conflict of interest reminder.” No conflicts were reported.

Minute Approval Motion: A motion passed that the January 2009 Board Minutes are approved as presented. Executive Director’s Announcements Ms. Judie Clark acknowledged Ms. Carol Puryear’s five year anniversary with the NCMB. Ms. Joy Cooke acknowledged Ms. Jane Paige as a new employee in the Licensing Department. Mr. Henderson noted the NCMB 150th Anniversary Celebration would be Thursday evening. ATTORNEY'S REPORT A motion passed to close the session pursuant to Section 143-318.11(a) of the North Carolina General Statutes to prevent the disclosure of information that is confidential pursuant to Sections 90-8, 90-14, 90-16, 90-21.22 of the North Carolina General Statutes and not considered a public record within the meaning of Chapter 132 of the General Statutes and/or to preserve attorney/client privilege.

3/2009 BOARD ACTION: Accept proposed Consent Order EXECUTIVE COMMITTEE REPORT The Executive Committee of the North Carolina Medical Board was called to order at 10:35 am, Wednesday, March 18, 2009, at the offices of the Board. Members present were: George L. Saunders, MD, Chair; Janelle A. Rhyne, MD; Donald E. Jablonski, DO; Janice E. Huff, MD; and John B. Lewis, Jr. Also present were R. David Henderson (Executive Director), Hari Gupta (Director of Operations), and Peter T. Celentano, CPA (Comptroller). Financial Statements Monthly Accounting January 2009: Mr. Celentano, CPA, presented the January 2009 compiled financial statements. January is the end of the first three months of fiscal year 2009. Dr. Jablonski made a motion to accept the financial statements as reported. Dr. Rhyne seconded the motion and the motion was approved unanimously. Mr. Celentano reviewed with the Committee the annual accounting of the Review Panel for 2008. Old Business

New Business

Proposed change to the Controlled Substances Reporting System: Members of the Executive Committee, including our Legislative Liaison, Thomas Mansfield, discussed concerns raised by Dr. Diane Alligood in a letter dated February 23, 2009.

Dr. Alligood is frustrated with the CSRS Act which seems to prevent her from reporting information acquired via the CSRS to colleagues who are also “treating” patients who are abusing and/or diverting narcotics.

After discussion, Dr. Rhyne made a motion to allow Mr. Mansfield to move forward with identifying and meeting with the parties who originally drafted G.S. 90-113.74 and discuss the possibility of amending the confidentiality provision. Dr. Jablonski seconded the motion and the motion passed unanimously.

Termination of Consent Orders: After the January 2009 meeting, the Board, via the

Disciplinary Committee, asked the Executive Committee to recommend protocols for handling requests by licensees to terminate Consent Orders. Mr. Henderson discussed with the Committee the two types of orders, remediation and disciplinary. Mr. Henderson made the following recommendations: 1) Grant, as appropriate, requests to terminate completed requirements of a remediation order. 2) Deny requests to terminate disciplinary orders. 3) Instruct staff to be sure orders are accurately captioned and public documents are properly described to avoid confusion. Dr. Rhyne made a motion to accept the recommendations made by the staff in regards to termination of consent orders. Dr. Jablonski seconded the motion and the motion passed unanimously.

Investigative Matter: A motion passed to close the session pursuant to Section 143-318.11(a) of the North Carolina General Statutes to prevent the disclosure of information that is confidential pursuant to Sections 90-8, 90-14, 90-16, and/or 90-21.22 of the North Carolina General Statutes and not considered a public record within the meaning of Chapter 132 of the General Statutes.

Incorrect Information on Web Site: Staff would like direction from the Board when incorrect information is found on the Board’s Web site. Dr. Rhyne made a motion to direct staff to submit proposed protocols when incorrect information is found on the website. Dr. Jablonski seconded the motion and the motion passed unanimously

RETENTION OF MEDICAL RECORDS

Physicians have both a legal and ethical obligation to retain patient records. The Board, therefore, recognizes the necessity and importance of a licensee’s proper maintenance, retention, and disposition of medical records. The following guidelines are offered to assist licensees in meeting their ethical and legal obligations:

• State and federal laws require that records be kept for a minimum length of time including but not limited to:1 o Medicare and Medicaid Investigations (up to 7 years); o HIPAA (up to 6 years); o Medical Malpractice (varies depending on the case but should be measured

from the date of the last professional contact with the patient)—physicians should check with their medical malpractice insurer);

o North Carolina has no statute relating specifically to the retention of medical records;

o Immunization records always must be kept. • In addition to existing state and federal laws, medical considerations may also

provide the basis for deciding how long to retain medical records. Patients

The times stated may fall below the community standard for retention in their communities and practice settings and for the specific needs. Physicians are encouraged (may want to) seek advice from private counsel and/or their malpractice insurance carrier.

should be notified regarding how long the physician will retain medical records.

• In deciding whether to keep certain parts of the record, an appropriate criterion is whether a physician would want the information if he or she were seeing the patient for the first time. The Board, therefore, recognizes that the retention policies of physicians giving one-time, brief episodic care may differ from those of physicians providing continuing care for patients.

• In order to preserve confidentiality when discarding old records, all records should be destroyed, including both paper and electronic medical records.

• Those licensees providing episodic care should attempt to provide a copy of the patient’s record to the patient, the patient’s primary care provider, or, if applicable, the referring physician.

• If it is feasible, patients should be given an opportunity to claim the records or have them sent to another physician before old records are discarded.

• The physician should respond in a timely manner to requests from patients for copies of their medical records or to access to their medical records.

• Physicians should notify patients of the amount, and under what circumstances, the physician will charge for copies of a patient’s medical record, keeping in mind that N.C. Gen. Stat. § 90-411 provides limits on the fee a physician can charge for copying of medical records.

MEDICAL RECORD DOCUMENTATION

The North Carolina Medical Board takes the position that an accurate, current and complete medical record is an essential component of patient care. Licensees should maintain a medical record for each patient to whom they provide care. The medical record should contain an appropriate history and physical examination, results of ancillary studies, diagnoses, and any plan for treatment. The medical record should be legible. When the care giver does not handwrite legibly, notes should be dictated, transcribed, reviewed, and signed within a reasonable time. The Board recognizes and encourages the trend towards the use of electronic medical records (“EMR”). However, the Board cautions against relying upon software that pre-populates particular fields in the EMR without updating those fields in order to create a medical record that accurately reflects the elements delineated in this Position Statement.

The medical record is a chronological document that:

• records pertinent facts about an individual's health and wellness; • enables the treating care provider to plan and evaluate treatments or

interventions; • enhances communication between professionals, assuring the patient optimum

continuity of care; • assists both patient and physician to communicate to third party participants; • allows the physician to develop an ongoing quality assurance program; • provides a legal document to verify the delivery of care; and • is available as a source of clinical data for research and education.

The following required elements should be present in all medical records:

1. The record reflects the purpose of each patient encounter and appropriate information about the patient’s history and examination, and the care and treatment provided are described.

2. The patient’s past medical history is easily identified and includes serious accidents, operations, significant illnesses and other appropriate information.

3. Medication and other significant allergies, or a statement of their absence, are prominently noted in the record.

4. When appropriate, informed consent obtained from the patient is clearly documented.

5. All entries are dated.

The following additional elements reflect commonly accepted standards for medical record documentation.

1. Each page in the medical record contains the patient’s name or ID number. 2. Personal biographical information such as home address, employer, marital

status, and all telephone numbers, including home, work, and mobile phone numbers.

3. All entries in the medical record contain the author’s identification. Author identification may be a handwritten signature, initials, or a unique electronic identifier.

4. All drug therapies are listed, including dosage instructions and, when appropriate, indication of refill limits. Prescriptions refilled by phone should be recorded.

5. Encounter notes should include appropriate arrangements and specified times for follow-up care.

6. All consultation, laboratory and imaging reports should be entered into the patient’s record, reviewed, and the review documented by the practitioner who ordered them. Abnormal reports should be noted in the record, along with corresponding follow-up plans and actions taken.

7. An appropriate immunization record is evident and kept up to date. 8. Appropriate preventive screening and services are offered in accordance with the

accepted practice guidelines.

REVIEW OF POSITION STATEMENT:

Departure from or Closing of Medical Practices

Issue: Review Committee referred this issue to Policy Committee to determine if the current position statement should be amended to cover nurse practitioners physician assistants.

5/2008 – It was pointed out that not all physician extenders work in the same circumstances. Many physician extenders are at-will employees; others work in practice environments in which they are the owner and/or the sole practitioner. The statement should cover both extremes. It was suggested that the layout of the statement could be similar to the Physician Supervision position statement, which

lists circumstances to be considered on a case by case basis. Additionally, it was stated that continuity of care for patients must be the ultimate concern.

BOARD CERTIFICATION DISTINCTION

Issue: How North Carolina-licensed physicians may advertise their Board certification status to the general public?

• Mr. Brosius will attempt to develop language to add to the advertising and publicity position statement to be presented at this meeting for consideration.

5/2008 BOARD ACTION: Accept the proposed Position Statement with the following change. Do not delete the following sentence: “If patient photographs are used, they should be of the physician’s own patients and demonstrate realistic outcomes.” This Position Statement is to be published in the Forum for comments.

7/2008 BOARD ACTION: Submit the following proposed position statement with the amendment to the last sentence of the third paragraph. 9/17/2008: The Committee discussed the fact that the proposed changes to the current Position Statement would not be consistent with the information currently being provided on the Board’s website. Additionally, a representative from the Medical Society recommended that the position statement should include PAs and NPs. 9/2008 COMMITTEE RECOMMENDATION: (Walker/Lennon) Add the following language to the position statement “To avoid misleading the public, the Board strongly encourages that the use of the term “Board Certified” only be used in advertisements when it refers to certification derived from a specialty board recognized by the American Board of Medical Specialties or the American Osteopathic Association.” 9/2008 BOARD ACTION: Policy Committee to continue to address issue 11/2008 BOARD ACTION: Policy Committee to continue to address issue. Consideration to be given to making sure that physicians should only advertise board certification if that certification is in the specialty for which they are advertising. Dr. Saunders will attend January Policy Committee.

1/2009 BOARD ACTION: In an effort to have the strongest Position Statement possible, Todd will research the issue of disclosure and also survey other states regarding the issue. This information will be reported at the March 2009 Committee meeting. 3/2009 COMMITTEE DISCUSSION: Todd reported that after research of this issue he concluded that the Board can restrict the use of the term “board certified”. The issue posed then to the Committee was whether to revise the Advertising and Publicity Position Statement or set out the requirements for physicians to advertise themselves as board certified through rulemaking. 3/2009 COMMITTEE RECOMMENDATION: Todd will draft proposed rules based on similar rules in North Carolina and other jurisdictions. Todd will then check on viability of the Board adopting such regulations.

CONTINUED COMPETENCE COMMITTEE REPORT The Continued Competence Committee of the North Carolina Medical Board was called to order at 10:30 a.m., Wednesday, March 18, 2009, at the office of the Medical Board. Members present were: Peggy Robinson, PA-C, Chair; William Walker, MD and Paul Camnitz, MD. Also attending were: Michael Sheppa, MD, Medical Director; Christina Apperson, Board Attorney and Maureen Bedell, Recorder.

January Minutes Motion to approve the amended January minutes was approved.

OLD BUSINESS

I. Dr. Sheppa gave a Reentry Agreement Update. He explained how the agreement has been revised and updated by our legal department. Ms. Apperson discussed the changes from a legal stand point and how it affects the mentor and mentee relationship. It was asked how many reentry applications the NCMB receive yearly. Dr. Sheppa said it is about 20/year. I. Dr. Sheppa reviewed the PLAS workshop he attended last month. The purpose of the workshop was to assist PLAS with services it might develop and offer.

II. Dr. Sheppa reviewed the Physician Competence Meeting he attended last month. Topics of discussion included: the Good Medical Practice document; items in common to maintenance of certification and maintenance of licensure, promoting conceptual shifts in different areas of medicine, and sustaining the work that this group has begun.

It has been suggested that the rule also include modification to limit the number of attempts for COMLEX (the osteopathic licensing examination). BOARD ACTION: Modify the rule to include parallel language for limiting the number of attempts for passing COMLEX to 3 attempts per level. Modification to application question Summary: It has been suggested that the Board consider including in the application questions an inquiry that addresses Leave of Absence, other than maternity leave. BOARD ACTION: Do not modify questions. Staff will use chronological history to look for leave of absences. New Interview Protocol BOARD ACTION: BOARD ACTION: Graduates of a medical college approved by the Liaison Commission on Medical Education, The Committee for the Accreditation of Canadian Medical Schools, or an osteopathic college approved by the American Osteopathic Association who have a “non-pristine” application and less than 2 years of postgraduate training should be reviewed by the Senior Staff Review Committee and appear for a split-Board interview. Statutory Requirement for Postgraduate Training BOARD ACTION: A motion was passed for staff to investigate the feasibility of changing NCGS 90-9.1(a)(2)a to require completion of more than 1 year of postgraduate education for graduates of a medical college approved by the Liaison Commission on Medical Education, The Committee for the Accreditation of Canadian Medical Schools, or an osteopathic college approved by the American Osteopathic Association after graduation from medical school. NC Emergency Medical Services Rehab for impaired EMS personnel Dr. Kanof has reported Secretary Lanier has approved the rehab program for impaired EMS personnel on the department’s legislative wish list. They are optimistic that it will pass since EMS is not asking for state funding. Once the Bill is introduced, she will supply details of the Bill. As far as she knows nothing has been written yet. Open Session Nurse Practitioners ASA Letter to NBME Summary: The American Society of Anesthesiologists sent a letter to the National Board of Medical Examiners (NBME) regarding the Doctor of Nurse Practice (DNP) exam equating to Step 3 of the USMLE exam for physicians. Board Action: Invite Duke’s DNP program director to explain to the Board what the program entails & the future of the program. Also invite NC Board of Nursing and the NC Medical Society.
