Fellow South Dakota automobile dealers, During this past month it was my delight to participate in a weekend gathering of our NextGen group. These young dealers and manag-ers came to the Deadwood Lodge from all over South Dakota for a

great weekend of networking and socializing. Those in attendance included -- Bryan Beck, Beck Motor Company; Travis Vesley, Courtesy Subaru, Inc.; Nick Simon, Groton Ford; Ryan Junek, Juneks’ Chrysler Dodge; Kendra Lamb-Macke, Lamb Chevrolet & Implement; Max Patnoe, Liberty Superstores; Karris McKie-Kaiser, McKie Ford Lincoln; Travis VanDam, Murdo Ford, Ltd.; Donny Stew-art, Vermillion Ford, Inc., Allison Stewart-Farrar, Vermillion Ford, Inc.; Bryan Boocock, Wegner Auto Company; and Matt Einspahr, Einspahr Auto Plaza.Dinner Friday evening was followed by Saturday morning breakfast. Our featured speaker was the ever delightful former Rapid City council-man, Malcomb Chapman. If you have ever been privileged to hear Mr. Chapman speak, he brings with him a delightful life, along with great wit and wisdom. I would suggest that any time we can invite Mr. Chap-man to be a speaker for our group, we avail ourselves of that opportu-nity. On Saturday afternoon, some of us golfed at the Tomahawk Country Club golf course south of Deadwood, while others chose to ride horse-back on local trails. It occurred to me that the last four times I ever rode a horse I nearly killed myself. Sticking with golf was definitely in my best interest. Next up on the SDADA calendar is the Washington conference, Septem-ber 28-30. I will report to you in the October issue as to this conference.Last, but certainly not least, I think the travails that the Volkswagen company is finding itself in can be a real cautionary tale for all manufac-turers and businesses alike. We live in such a competitive world, and so much is expected of us. To think that this great company, and its dealer body, will suffer long-term damaging effects because of a few poor deci-sions, is an awful loss. As always, only the lawyers will win.

The National Automobile Dealers Association (NADA) will be holding its 2015 Washington Conference on September 29th and 30th in Washington, D.C. We have an excellent delega-tion from the SDADA in cue to attend, including Mr. Doug Knust, Mr. Bruce Eide, Mr. Jim Burgess, Mr. Doug “Dutch” Van Santen and Mr. Nick Si-mon (NextGen Representative) and me. During our visit to the nation’s capitol, we have sched-uled meetings with with Senator John Thune, Senator Mike Rounds and Representative Kristi

Noem. As I am quite sure that we will already have returned from Washington by the time you read this column. However, several of us will be reporting what was accomplished in our columns next month.

As you review this publication, I am sure you enjoy pictures and stories about the dealerships in South Dakota. While I review press clippings from the South Dakota Newspaper Association, I still do not get all of the stories nor the pic-tures that should be published. I ask, in the interest of the dealer body, that you submit pictures and stories of some of the great things you are doing for your community. The SDADA Staff would love to include those articles and photos in future publications of the SDADA Report.

I recently had a call from a dealer regarding a loaner vehicle that was returned with damage. In order to clarify this issue for all of you, here is a copy of the pertaining South Dakota Law: 58-23-4. Primary and excess coverage on vehicle loaned by automobile service agency. When an automobile insurance policy is in force for anyone engaged in the business of selling, repairing, servicing, storing, or parking motor vehicles and the person or organization allows the use of a vehicle with or without consideration to any other person or organization and the vehicle is involved in an accident out of which bodily injury or property damage to third persons or damage to the insured vehicle arises, the follow-ing automobile insurance policies shall be applicable: (1) In the event no other automobile insurance policy is in force at the time of the accident for the person or organization using the vehicle, the coverage provided by the motor vehicle owner's automobile policy shall extend to the borrower in the event the owner's automobile insurance policy extends coverage to said borrower. (2) In the event that another automobile insurance policy is in force for the person or organiza-tion using the vehicle, any coverage provided by the motor vehicle owner's au-tomobile insurance policy shall be excess coverage only but limited by the terms of the owner's applicable automobile insurance policy. The coverages in the policy afforded the person or organization using the vehicle shall be primary.

In my visits to dealerships, I have found that some dealerships have chosen to continue to use the old Power of Attorney and Dealer Reassignment forms. Although, the state DMV is evidently still accepting the old forms, I suggest that it is not a good business practice to use old forms especially when those forms contain damage disclosure sections while those specific statutes have been repealed and removed from state law. Please contact your SDADA Office and get your obsolete forms replaced!

NADA Director’s MessageDo you remember Groundhog Day, the 1981 movie starring Bill Murray? Murray plays a television weatherman who, during an assignment covering the annual Groundhog Day event in Punx-sutawney, Pennsylvania, finds himself in a time loop, repeating the same day again and again. I feel that same sentiment each month when Michelle sends me the email asking for my monthly column.

I try to sit back and look at the issues that are most pressing in our industry and how our indus-try is dealing with them. But it has seemed like Groundhog Day for the last three years as the Consumer Finance Protection Bureau has taken dead aim at car dealers and lenders. The CFPB remains the preeminent threat to our industry and business model. And so it goes again this month...

I have written about transparency in the Consumer Finance Protection Bureau's processes in this space before, but evidence against this agency continues to mount. Investor's Business Daily recently wrote:

In a series of internal documents obtained by American Banker magazine, Consumer Financial Protection Bureau officials acknowledge that the "disparate impact" and "proxy" methodology used to investigate car lenders for racial bias hypes the evidence. Yet they say they prefer that to underestimating bias.

But recently uncovered documents show that the assumptions that Obama's race bullies make while sifting through the limited auto loan data are even wilder than the ones they make against mortgage lenders, which already have forked over $100 billion to the government.

In July, the House Financial Services Committee passed NADA-backed H.R. 1737 to rescind the CFPB's flawed auto finance guid-ance that would limit or eliminate a customer's ability to receive a discounted auto loan in the showroom. The bill, which passed by a bipartisan vote of 47-10, has increased momentum with 133 cosponsors (76 Republicans and 57 Democrats). H.R. 1737 will likely come up for a vote on the floor of the House of Representatives this fall and will likely be a priority at our Washington Conference.

Consumers Tell Their Stories of Saving on Finance at the Dealership: The stories of real consumers who saved money by fi-nancing new vehicle purchases through local dealerships are at the center of an initiative by NADA to showcase the true econom-ic value of dealer-assisted financing. Through video testimonials and a new website NADA is bringing the voices of consumers back into the debate over dealer-assisted financing. Dealers have been fighting to preserve the fiercely competitive, pro-consumer financing model ever since it came under threat from the CFPB in 2013.

NADA Announces Keynote Speakers for 2016 Convention: On Friday, April 1, comedian and entertainer Jeff Foxworthy and 2015 NADA Chairman Bill Fox will address the convention. On Saturday, April 2, Mike Allen, Politico's chief White House correspondent, will moderate a panel session with Karl Rove, former deputy chief of staff and senior advisor to President George W. Bush, and Howard Dean, former governor of Vermont and former chairman of the Democratic National Committee. Incoming NADA Chairman Jeff Carlson will also speak. On Sunday, April 3, Peyton Manning, quarterback for the Denver Broncos, will provide an inspirational address.

Dan Ja-cobsen, with the rally, said they had a great rally and that Mustang en-thusiasts in attendance came from each coast and all across the United States and Canada. Federated Insurance's "Claim of the Month"- Could it happen to you?

When the dealership's employees arrived at work one morning, they noticed five pickup trucks

were missing. During the subsequent investigation, police discovered an extra set of keys was

missing from an unlocked file cabinet. Although they couldn't prove it, the police suspected the

thieves got help from one of the dealership's employees. The trucks were never recovered.

Under GHG Plan, EPA Makers Say The new federal green-house-gas proposal for trucks includes a provision that could reduce the appeal of glider kits if the proposal be-comes final. Glider kits are new heavy-duty trucks without complete powertrains. They Jack an engine, a transmission, drive axles or some combination of the three. The kits usually are completed with either a remanufactured diesel engine or a diesel-natural gas, dual-fuel power plant making the finished vehicle a combination of new and old parts.

The Environmental Protection Agency "is proposing to amend our regulations to allow only engines that have been certified to meet current standards to be installed in new glider kits," the agency said in its rule. EPA would allow an exemption for small businesses, though, which could keep doing glider work at current rates. The Phase 2 greenhouse-gas rule from EPA and the National Highway Traffic Safety Administra-tion says the use of glider kits has increased by a factor of 10 since the early 2000s, to thousands per year from a

few hundred, but the agencies did not provide precise num-bers. Discovery of language on gliders within the massive proposal published June 19 Jed a Republican member of the U.S. House of Representatives to introduce an amendment that would ban the agencies from enforcing rule changes affecting glider kits. The amendment by Rep. Diane Black of Tennessee was attached to the fiscal 2016 appropriations bill to fund EPA and the Interior Department. The bill has been stalled and awaits a vote by the full House after pass-ing through the Appropriations Committee.

Much of bringing the glider provision to light came from American Truck Dealers, which sent an e-mail alert to the trade group's members. "Some of our dealer members do work in glider conversions and others don't " said Laura Per-rotta, an ATD lobbyist. Perrotta said she and other ATD per-sonnel still are analyzing the proposal and have not yet come to an official position.

What's Hot in Fire Prevention? Equipment Maintenance!

Fires continue to ravage businesses across the country. Spontaneous combustion, heating and electrical systems, smoking, poor housekeeping, storing flammables-all common causes of industrial fires. But, they are certainly not the only risks needing attention.

Fires Don't DiscriminateA number of fires related to mechanical equipment can be blamed on poor maintenance or improper use, andmany could have been prevented with regular upkeep and appropriate employee training.To help prevent fires, all machines, from hand-held power tools to complicated equipment, require closelymonitored maintenance, and operating procedures that don't deviate from the manufacturer's instructions andrecommendations.

Fires from mechanical failure can sometimes be predictable. Other fires may be harder to anticipate. Somecommonplace situations can become surprising sources of fire, such as:• Production machines-attended and unattended• Overheated light fixtures• Pinched wiring exposed to flammables, which heat up and ignite• Exhaust systems and fans• Forklifts catching fire hours after being shut off• Overloaded electrical panels

It is important to understand the fire potential that may be present from the equipment your business uses. Youcan help identify many fire hazards, both in and outside of your premises, through regularly completing fireprevention checklists. When hazards are discovered, you can monitor and help control them with a preventivemaintenance plan. Proper setup, scheduled maintenance, and following the manufacturer's use specificationsare vital to keeping equipment in safe working condition and preventing mechanical fires.

The second week of October is National Fire Prevention Week. It's an excellent opportunity to reinforce fireprevention at your business as part of a solid risk management program. Often when one of the agents of the DMV’s Dealer Licensing Program walks into a dealership the first question they are asked is “What did we do wrong?” Although we do occasionally visit a dealership for the purpose of an investigation, there is a much better chance that the agent is there to perform a compli-ance review. These inspections are routine and are designed to help the agent and the dealer have the same understanding of what is required to be compli-ant under South Dakota law.

Upon arrival the agent will select vehicles you are displaying to identify records to inspect. Once they have a list they will introduce themselves and let you know they intend to do an inspection today. The agent will ask to speak with a title clerk, controller, owner, or man-ager depending on how you have struc-tured your business and who has access to the files. This person will be asked to retrieve the files the Agent has selected. While those files are retrieved the agent will ask for access to records for vehi-cles that you have sold over the last five years. The agent will review a random selection of these files in order to confirm that you are maintaining the proper records for sold vehicles. These files should contain a copy of the front and back of every document neces-sary to transfer vehicle ownership that you provided the customer when you delivered the title to them as well as any other paperwork relating to the purchase or sale of the vehicle.

Once the inspection of records is complete the agent will sit down with the person you have delegated and complete a Dealer Inspection Report. The report verifies at a minimum that the dealer is compliant with physical location requirements, completeness of paperwork, recordkeeping, ownership, necessary franchise agreements, business hours, contact in-formation, permit and plate use, vehicle rental busi-ness records, and display of dealer license and bond. Once this information has been reviewed both parties will sign the inspection form and a copy is presented to the dealer. If any shortcomings are identified the agent will give the dealer thirty days to correct the deficiency and plan to follow up at that time to make

sure the problem has been corrected.

At any time during the process please do not hesitate to ask the agent any questions you may have about the in-spection or the state rules and regula-tions the DMV is enforcing. The in-spection process should not be painful; it should be a positive learning experi-

ence for both the dealer and the agent in which both parties come away with a better understanding of how dealer licensing regulation works.

NADA Guidance on Recall Issues

The following is a quick 60-second overview of dealing with safety recall issues from NADA:

Each year millions of vehicles become subject to safety recalls. A relatively small percentage of these recalls involve “stop operation” or “stop sale” notices. The following illustrates potential steps to take based on the safety recall at issue and the vehicles involved:

For new vehicles in inventory or in transit:

Once any notice of an outstanding safety recall is received, federal law prohibits the delivery of impacted new vehicles until the recall is remedied.

For used vehicles in service, in inventory, or coming into inventory that are of the same make as the dealer sells new:

Federal law neither imposes an obligation on dealerships to know the safety recall status of used vehicles, nor prohibits the resale of used vehicles with outstanding safety recalls. However, it is recommended that used vehicles of the same make a dealer sells new be checked for outstanding, unremedied recalls (safety or emissions) since the dealership is authorized to do service or repair work involved.

Important: If and when a dealership receives a recall notice indicating that certain used vehicles should not be operated and/or resold, they should not be operated or resold until the recall is rem-edied.

For used vehicles in for service, in inventory, or coming into inventory that are not of a make the dealer sells new:

Again, Federal law neither imposes an obligation on dealerships to know the safety recall status of used vehicles, not prohibits the resale of used vehicles with outstanding safety recalls. In addition, state law may impose additional obligations. For example, additonal obligations are likely to be im-posed if and when a dealership employee knows that a particular “off-brand” used vehicle is subject to an outstanding unremedied safety recall involving a notice stating that is should not be operated and/or resold. For clarification regarding state law obligations, dealerships should contact their legal advisor.
