Reviewing Our

42 Years

The New York State DefendersAssociation (NYSDA) proudlypresents its Forty-secondAnnual Report to theMembership.

NYSDA is one of the firststatewide defenseorganizations establishedfollowing the U.S. SupremeCourt’s right to counseldecision in Gideon v.Wainwright. A Board ofDirectors composed ofprominent public defensepractitioners and leaders inthe statewide justicecommunity governs theAssociation. A list of thoseDirectors, along with theothers who constitute ourcollegial enterprise, begins atpage 11.

NYSDA has been providingsupport to New York’scriminal defense communitysince 1967. We also seek toincrease our support forpublic defense lawyers whorepresent adult respondents infamily court cases.

By assisting lawyers, we servetheir clients. NYSDArecognizes that clients and the

client community have astake, and must have a voice,in public defense provision.Unlike most other barassociations, our membershipincludes incarcerated persons,and our by-laws mandate aClient Advisory Board. Thatboard works directly with theExecutive Director andadvises the Association onissues of client relations andNYSDA’s communityprograms.

At forty-two, NYSDA providesmany people answers to manyquestions. Through its PublicDefense Backup Center,which began receiving statefunding in 1981, NYSDAassists lawyers, governmentalbodies, the client communityand the public. We developand sustain innovativeprograms and services inresponse to identified needs.Examples include ourCriminal DefenseImmigration Project,providing specializedinformation for lawyersrepresenting noncitizens incriminal matters, and ourPublic Defense CaseManagement System(PDCMS), software designedspecifically for public defenseprograms in New York State.

The Backup Center hasmaintained its many services,sometimes in more limitedforms, despite budget cuts andflat funding, for nearly threedecades. The survival of ourservices is due to:

• the willingness of anexperienced staff to dogood work for modestcompensation, adoptstreamlined methods andautomation to increaseproductivity, and take ona variety of roles;

• the availability of federalfunding;

• the invaluable support wehave received fromprivate foundations;

• the flexibility that ournon-profit status allows;and

• the help of public defenseprograms and countyofficials statewide who,along with our members,advocate for the BackupCenter when statefunding is threatened.

One attorney wrote this year:

I rely on the servicesprovided by the BackupCenter. On countlessoccasions over the past fewyears, I have relied ontheir well-trained,knowledgeable, patientand available attorneys toguide me throughchallenging situations andproblems. They havesuggested strategies, citedcases, and providedimportant feedback andguidance on difficultquestions of criminal andconstitutional law. Theabsence of the BackupCenter would significantlyhinder my work on behalfof indigent defendantsfacing jail.

Reviewing Our

42nd Year

This annual report detailshow NYSDA achieved short-term goals and moved towardlong-term ones during thepast year.

Backup Center staff workeddaily to improve the quality ofpublic defense services inindividual cases by respond-ing to requests for assistance

– 2,398 in the last fiscal year –from lawyers, clients, and oth-ers. These direct defenderservices helped individuallawyers provide the bestdefense possible, often underthe worst of circumstances, bymaking centralized resourcesavailable that county-baseddefense offices could notafford. Similarly, the NYSDAImmigrant Defense Project,which became a separate,independent office at the endof 2008, and the CriminalDefense Immigration Project,

our new initiative begun in2009, offered aid regardingissues at the interface ofimmigration and criminallaw. NYSDA’s Public DefenseBackup Center continues toprovide efficient, centralizedservices to local publicdefense offices and attorneys.

In every quarter of the year,NYSDA also sought toimprove the quality of publicdefense services bydistributing informationbeyond individuals requestingassistance. We used ournewsletter, website, and legaltrainings to accomplish this.Such training and informationallowed busy lawyers, manystruggling with excessivecaseloads, to learn quicklyabout new and potential

challenges toerroneous police andprosecution tacticsand evidence,ameliorativechanges insentencing laws, andmore. The technicalassistance we gaveoffices and theirlocal governmentsallowed them toprovide more cost-effective servicesand engage in more

informed policymaking.

Year round, NYSDAmet its contractualduty to review,assess, and analyzethe existing publicdefense system andrecommendimprovements. Wepublished ananalysis of theState’s primarypublic defensefunding mechanism,the Indigent Legal

Services Fund (ILSF). Weoffered testimony at hearings,and moved in other waystoward the long-term goal ofimproving public defenseservices statewide; includedin the latter efforts was ourwork with the Campaign foran Independent PublicDefense Commission.

More detailed descriptions ofthese long-term efforts andour daily work appear below.

The Public Defense

Backup Center

The Backup Center conductsregional and statewidetraining; publishes anewsletter; and maintains alarge, constantly updatedwebsite (www.nysda.org) andan in-house clearinghouse ofinformation about substantiveand procedural law (includinga case digest system), publicdefense services, and relatedmatters. With these resourcesas a foundation, the BackupCenter legal staff consultswith and sometimes conductsresearch for lawyers facingsudden or unusual legalissues. NYSDA staff also assistpublic defense programadministrators and localgovernment officials whoneed to know and understandcase law, statutes, rules, and

standards governing publicdefense services.

A Broad Range of Training

Beginning in Saratoga

The 41st Annual Meeting andConference in SaratogaSprings last July gave lawyersa full year’s worth ofmandatory Continuing LegalEducation (CLE) credits intopic areas relevant to publicdefense practitioners. Inaddition, the conferenceshowcased other NYSDAservices and, at the AwardsBanquet, achievements of thecommunities we serve.

Before the CLE sessions, theheads of public defense officesaround the state attended aChief Defender Convening.They discussed substantiveand procedural legaldevelopments regarding DWIcases and clients designatedviolent felons. They sharedadministrative concerns aboutpart-time public defenders’participation in the stateretirement system. Theylearned about theappointment of a New York

State Bar Task Force onWrongful Convictions, andaired opinions about reformissues including the progresstoward a state-run publicdefense system. And theyheard a presentation aboutthe effect of active militaryservice on individuals whobecome public defenseclients. NYSDA has continuedits efforts to secure funding tolaunch a Veterans andMilitary Defense Project;meanwhile, we strive toincrease awareness in thedefense community of theunique challenges andopportunities that may bepresent in these clients’ cases.

Beyond Saratoga

For those unable to come toSaratoga for two days, and forthose willing and able toadvance their skill andknowledge further, NYSDAoffered other training eventsthroughout the past year. Wepresented a large number ofCLE training events,including eight seminars onNew York’s new drug lawsand seven on immigrationconsequences of criminalcases. Some trainers were co-

sponsoredwith theFederalDefender forthe NorthernDistrict ofNew York, theAppellateDivision,FourthDepartment,the AssignedCounsel Planfor the SecondDepartment,The OntarioCountyDefendersAssociation,

the Cayuga County CriminalDefenders, and the NYUSchool of Law ImmigrantRights Clinic. NYSDA trainingoccurred across the state,often in local public defenseoffices. As in past years, ourtraining was praised byparticipants and defenderoffices for relevant, timelypresentations by some of themost experienced presentersin the state. At membershiprenewal time, one membermade a financial contributionin addition to paying the duesamount, saying “...in honor ofCharlie O’Brien & DianeGeary for outstanding 11/14/08Poughkeepsie program.”

In June 2009 NYSDA’sweeklong Defender InstituteBasic Trial Skills Program(BTSP) returned after a one-year hiatus. The breakresulted in an all-new caseproblem and a revisedsyllabus. Coached by triallawyers and communicationsexperts from around thenation, the defenders whoattended BTSP made greatstrides in skill and confidence.The use of carefully selectedand highly trained actors, the

participation of non-lawyerjurors, and experienced andsupport coaches made thisyear’s program among thevery best NYSDA hasconducted. The exercisesparticipating defenderscompleted involving technicallegal lessons, along with theclient-centered approach forwhich the Institute hasreceived national recognition,will improve therepresentation their clientsreceive.

In addition to CLEtraining, we held asecond Chief DefenderConvening on December11, 2008. At this meetingwe invited candidsuggestions forincreasing andimproving ourassistance to publicdefense lawyers andprograms representingadult respondents infamily court. Followingthat meeting we soughtadditional funding toincrease staff support inthis area; given theeconomic climate, such

funding has yet tomaterialize. We havecommitted to directingmore attention andresources to this areaof representation.

The Public DefenseBackup CenterREPORT

All NYSDA members –lawyers, prisoners, andother individuals whosupport the right tocounsel – receive aprinted copy of theAssociation’snewsletter, the PublicDefense Backup Center

REPORT. NYSDA also mailsthe REPORT to all publicdefense programs and allprison law libraries, and postsit on the Association’s website.Summaries of selectedcriminal law and family lawcourt decisions and newsitems regarding publicdefense, legal developments,and other topics of interestappear in every issue. TheREPORT also publishesperiodic in-depth practicetips, an annual summary ofrelevant legislation, and muchmore. A prisoner spoke formany when he wrote that,after having read the REPORTfor some time, he appreciatedand commended what NYSDAmade available to the legalcommunity and to prisonerssuch as himself.

Backup CenterClearinghouse

NYSDA’s vast in-housecollection contains newmaterials, primarily inelectronic form, and a largelegacy collection from theprint-only era. The BackupCenter’s Legal InformationServices staff continually

update the collection andprovide notices to the legalstaff about new information.Coupled with the institutionalmemory of NYSDA’s staff andInternet research capabilities,the Clearinghouse enableslegal staff to respond toinquiries about past practicesas well as cutting-edge issues.

The Backup Center’sInformation Systems staffhave the major task ofmaintaining the software andhardware necessary to thevirtual portions of theClearinghouse and the manyother functions of the BackupCenter. They do a tremendousjob enhancing and

maintaining the BackupCenter’s technology toimprove public defenseefficiency with an everdiminishing budget. They alsolabor tirelessly to keep ourcomputer systems secure andfree from viruses and spamattacks.

Over the past year, NYSDA hasbeen working closely with theMonroe County PublicDefender Office to produce anextraordinary full-textsearchable, remote accessiblebrief bank for that office.Containing thousands ofdocuments, many convertedfrom print to PDF, thisdatabase allows any publicdefender in the MonroeCounty office, via the Internet,

to search hearing and trialtranscripts, training materials,pretrial and post-convictionmotions and much more.Most notably, it will preserveand make available MonroeCounty’s institutionalknowledge in a completelynew way. While the databaseis not available for outsideuse, this project has offeredNYSDA significant insightsinto development of suchcollections.

The Association’s website,www.nysda.org, offers 24-hour access to some ofNYSDA’s clearinghouseholdings and provides links torelevant information on theInternet. From Breaking Newsand detailed informationunder Hot Topics toPublications and NYSDAResources, the site offerscurrent, enduring, andhistorical information.Lawyers, county officials,reporters, and others oftencan find everything they needabout a particular topic on thewebsite, or may contact theBackup Center foradditional assistance.

Juxtaposed against theavailable tools andresources that couldimprove representation fora particular client if alawyer downloads and usesit are recurring referencesto the ongoing crisis in thestate’s public defensesystem as a whole. InNYSDA publications, otherstate and national reports,and news items,descriptions ofunderfunding leading toexcessive caseloads andresulting problems with thequality of representation

repeatedly appear. Before andafter the 2006 final report ofnow-retired Chief JudgeJudith S. Kaye’s Commissionon the Future of IndigentDefense Services, studiesshow major problems in NewYork’s public defense system.This documented evidence ofsystemic failure underliesNYSDA’s commitment tosystemic reform.

The Advisory Board sectionunder “About NYSDA” on thewebsite includes “Client-Centered RepresentationStandards” developed andpromulgated by the AdvisoryBoard and approved by theAssociation’s Board ofDirectors in 2005. Thesestandards exemplify NYSDA’sefforts to develop expertise inmeasuring client satisfaction,a vital but often overlookedaspect of improving publicdefense services. The

Advisory Board section of thewebsite also provides basicinformation about obtaininglegal representation and otherinformation of interest toclients and the public.

Direct Defender Services

From providing the citationfor a new case that someone“just heard about” to doingextensive research on an issueof first impression, NYSDA’slegal staff provide a variety ofinformation to those whocontact the Backup Center.Recipients of direct defenderservices often express thevalue of the materials theyobtain. Some, particularlyattorneys in small,overworked public defenseoffices or in solo assignedcounsel practices, also findvalue in collegial discussionabout issues. In the words ofone, it is good to have NYSDA“because it’s nice to havesomeone to talk to aboutthese things.”

Technical Assistance

Whether daunted by theforms that must be filed forcounties to receive ILSFdistributions from the State orbesieged by the complexitiesof managing a public defenseoffice caseload, countyofficials and public defenseoffice personnel can turn tothe Backup Center. Through

email, the Backup Center hasa direct line of communicationto chief defenders across thestate. This year chiefsreceived timely informationabout the ILSF distribution,defender loan forgiveness, andRockefeller Drug reformlegislation among otherimportant topics.

Public Defense CaseManagement System

NYSDA designed and supportsa public defense casemanagement system(PDCMS) now operating in 35public defense offices in 28counties. From generatingrequired reports to flaggingconflicts of interest soon aftera case is assigned, the PDCMSallows offices to moreeffectively and efficientlyrespond to client needs.

Version 10 is ready and hasbeen installed in about halfthe offices currently using thesystem. Seeking to speedimplementation of thiscritically needed resource, theAssociation sought but has notreceived additional funding toboost PDCMS staff support.Meanwhile, existing staffcontinue the high-qualitywork that won the Best of

New York DemonstratedExcellence in IT Operations,Support and Service Awardthree years ago. Their effortsand the PDCMS itselfconstitute an example of howcentralized but flexibleservices can improve publicdefense services across thestate.

Collaborationwith Others onJustice Issues

Devoted to theprinciple thatthe defensefunction mustbe independentof improperinfluences andstand on equalfooting with theprosecution andjudicialfunctions,NYSDA brings a

defense perspective to avariety of collaborativeprojects. In the last year,NYSDA or its staff participatedin meetings, events, oractivities of the following:

• Office of CourtAdministration’sCommittee on theCriminal Procedure Law;

Members of NYSDA’s ClientAdvisory Board also meet,upon request, with chiefdefenders wishing to set uplocal advisory boards.

NYSDA welcomes and invitesopportunities to take part inpolicy discussions affectingthe justice system. In additionto the list above, we presentedtestimony before the

Assembly StandingCommittees on Judiciary andCodes at a hearing concerningJury Pool Diversity in NewYork City and took part indiscussions with the Divisionof Criminal Justice Servicesand others regardingimplementation of legislationconcerning the managementof sex offenders.

Such activities servedual purposes; inaddition to theirintrinsic value, theymodel for others theinclusion of publicdefense providers inpolicy discussions.NYSDA advocates forgreater publicdefense participation— or for somedefense participationwhere thisperspective has beenshut out completely– in relevant decision makingat every governmental level.

Availing itself of opportunitiesto exchange information withothers knowledgeable aboutstate public defense issuesand to learn about possiblenew avenues forimprovement, NYSDA tookpart in several national events

this past year.

The Director ofLegalInformationServicespresented“Databases, E-Discovery, andCriminal Law”(associated withthe publicationof an article onthe same topic)at the RichmondSchool of LawSecond Annual

E-Discovery Symposium inRichmond, VA, on April 21,2009. NYSDA representativesparticipated in the AmericanBar Association StandingCommittee on Legal Aid andIndigent Defendants 5thAnnual Indigent DefenseSummit in Boston and anACCD Advocacy Conferencein Washington, DC at which

public defenders from aroundthe country met withDepartment of Justice officialsand others to learn aboutfederal funding opportunitiesand to raise the visibility ofstate public defense issues atthe national level.

Advocacy for Change

In addition to participating inongoing committees andprojects relating to specificaspects of public defense andcriminal justice, to specificgeographic areas, and tonational trends, NYSDAcontinued to review, assess,and analyze New York’spublic defense system itself.In compliance with our statecontract we also maderecommendations forchange to solve the problemswe found.

Deficiencies in defenserepresentation are known tobe a cause of wrongfulconvictions. With that inmind, NYSDA presentedtestimony at a hearing of theNew York State BarAssociation’s Task Force onWrongful Convictions onFebruary 24, 2009. Wecommended the Task Force’squick and fine work reflectedin its Preliminary Report andthanked them forrecommending thatorganizations operating aresource center for publicdefense lawyers shouldreceive additional resourcesto aid defense attorneysstatewide. The Final Report ofthe Task Force, released inApril 2009, reiterated the StateBar’s support for the KayeCommission reforms.http://www.nysba.org/Content/NavigationMenu42/April42009HouseofDelegatesMeetingAgendaItems/FinalWrongfulConvictionsReport.pdf

Building on past studies andusing the most currentinformation, NYSDAcompleted an “Analysis of theIndigent Legal Services FundMaintenance of EffortProvisions” in March 2009.

This publicationdescribed thelack ofmeaningfuloversightthat hasaccompanieddistribution ofState funds tolocalitiesthrough theILSF since itsinception. Ourreport observed:“The existingILSF measuresintended toimprove the

quality of public defense inNew York State are brokenboth in principle and inpractice.” The analysis, sent toall members of the StateLegislature and the Governor,is posted on the NYSDAwebsite:http://www.nysda.org/MOE_Analysis_Mar09.pdf

The failure of the ILSF tobring about meaningfulimprovement in publicdefense statewide militates forsystemic reform. Wherecircumstances prevent theState’s acceptance of full fiscalresponsibility, the Stateshould at least take on fulladministrative responsibilityand cap localities’ financialobligation as toconstitutionally andstatutorily mandated legalservices. This position isdiscussed in greater detail inour ILSF analysis andelsewhere.

At a February 2009 hearingbefore the Assembly StandingCommittees on Codes,Judiciary, GovernmentalOperations, and Correction onthe “Impact of the StateBudget on Access to Justice,”NYSDA provided joint

testimony with the Campaignfor an Independent PublicDefense Commission(CIPDC). That testimonyrecounted the stagnation andeven deflation in variousprograms providing statefunds for public defense. Itpointed out the lack ofoversight to ensure effectiveuse of what state funds weredisbursed. Describing knownpublic defense problems thatare bound to intensify absentreform, our testimony thenstated:

Every further deprivationof funding for publicdefense services willincrease the likelihood thatinnocent people will beconvicted, that clientsentitled to competentassistance of counsel willget little or no assistanceat all, and that communitytrust in our justice system,already damaged, willplunge further.

We recommended that theLegislature make a modestinvestment from the ILSF toinstitute change by creatingthe Independent PublicDefense Commission. The

Commission would beempowered to carry outnecessary planning for theState to take overadministration of publicdefense services and cap theexpenses of counties andNew York City.

Members of NYSDA’s ClientAdvisory Board have beenactive in the Campaign for anIndependent Public DefenseCommission, which NYSDAhas endorsed. Advisory Boardmembers participated in theannual Black and PuertoRican Legislative Caucusweekend, the Somos El

Futuro conference, and theGideon Day observance in2009, raising legislative andpublic awareness of the crisisin public defense and theneed for statewide reform.

NYSDA will continueadvocating for statewidereform. Because every day, asBackup Center staff assistsome public defense lawyers,others face overwhelmingcaseloads and insufficientresources alone as they try torepresent their clients. Forevery public defense lawyerthat can take the time toattend NYSDA or other high-quality, relevant CLE training,many more will meet theirmandatory CLE requirementswith credits from coursesunrelated to public defensework. Without reform, inanother year, NYSDA’s reviewof the existing system will

show more of the sameproblems that have plaguedthe system for years.

At forty-two, NYSDA has theexperience, skill, andknowledge to provide answersto many questions. We hopethat our answer to “Whatshould New York State do tofix public defense?” – createan Independent PublicDefense Commission – issoon put to the test. �
