1. BACKGROUND(a) UNICEF is a specialized agency of the United Nations with a mandate to

advocate for the protection of children's rights, to help meet their basic needs and to expand their opportunities to reach their full potential.

(b) In support to its aid relief programmes and operations, UNICEF Bangladesh is planning to engage qualified Contractors for the execution of:

2. SCOPE OF WORK(a) The EOI is the first stage of a multi-stage procurement process. The

objective of the EOI process is to identify and prequalified Contractors that wish to be considered for UNICEF office construction at Dhaka and have suitable capacity, capability and experience.

(b) An Evaluation Committee comprising representatives of UNICEF will evaluate EOI applications on the basis of the evaluation criteria set out in Section 4 of this Request for Expressions of Interest (REOI).

(c) It is expected that prequalified Contractors will be invited to submit Invitations to Bid (ITBs) or Request for Proposals (RFPs) when need arise for project implementation purpose.

3. ELIGIBILITY REQUIREMENTS(a) This REOI for Prequalification is open to all Contractors regularly registered

and licensed to operate in Bangladesh. (b) To become eligible candidates shall demonstrate to have:

a. minimum of 5 (five) years of experience as a general contractor, and

b. successful completed at least 3 (three) contracts of a nature and complexity comparable to the construction works required above (Section 1.b).

(c) Companies doing business with the United Nations are required to register online with UN Global Market (www.ungm.org ) and accept and comply with the UN Contractor Code of Conduct (https://www.ungm.org/Public/CodeOfConduct ).

4. EVALUATION CRITERIA (a) Prequalification will be based on meeting the minimum criteria regarding

their general and construction experience, financial position, personnel and equipment capabilities, and other relevant information as demonstrated by the Contractor’s responses in the Submission Forms attached to this REOI.

(b) Contractors must have cumulated a minimum score of 60% to be prequalified.

(c) Incomplete or inadequate responses, lack of response or misrepresentation in responding to any questions will affect the evaluation.

(d) Submissions shall be evaluated in accordance with the following criteria:

that it has adequate sources of finance to meet the cash flow requirements on works currently in progress and for future contract commitments.

5. DISQUALIFICATION OF PRE-QUALIFICATION SUBMISSION (a) If a prequalification submission fails to comply in any respect with the

requirements set out in this REOI or is ambiguous, UNICEF shall be entitled at its absolute discretion, but shall not be obliged to one of the following:

I. To reject the prequalification submission as non-compliant; OR

II. Without prejudice to UNICEF’s right to reject the prequalification submission, to meet with, raise issues and/or seek clarification from the Contractor in respect of the relevant pre-qualification submission;

ORIII. Without prejudice to UNICEF’s right to reject the prequalification

submission, to request the Contractor to provide UNICEF with information or items which have not been provided or have been provided in an incorrect form; and/or to waive a requirement which, in the opinion of the UNICEF, is not material and/or is procedural.

(b) Any change in the Contractor after the Contractor has submitted its prequalification submission may lead to disqualification of the Contractor unless notified to UNICEF in writing. UNICEF reserves the right to withhold approval for any such changes and to disqualify the Contractor concerned from any further participation in the during any future procurement process.

6. PREQUALIFICATION PROCEDURE(a) The Prequalification and all subsequent bidding exercises will be

conducted in accordance with UNICEF procurement policies and procedures. (For more details lease visit the link below: https://www.unicef.org/supply/index_procurement_policies.html)

(b) UNICEF shall not be obliged to enter into any contract with any Contractor based on this Prequalification process.

(c) UNICEF reserves the right not to proceed further with this invitation and/or to change the Prequalification procedure and/or terminate discussions at any time.

(d) UNICEF reserves the right to amend this Prequalification REOI, its requirements and any information contained herein at any time up until the closing date of the submission. The Contractor will be informed of any amendments in writing.

(e) UNICEF reserves the right to request any additional information, which is considered relevant for the evaluation. Interviews and visits from UNICEF officials to the Contractor’s premises and executed projects might be established during the pre-qualification process.

(f) UNICEF will only contract with a single legal entity. Where companies wish to enter their bids as Joint Ventures they shall indicate the lead company that would enter into contract with UNICEF as a single legal entity; all other companies shall sub-contract to this entity.

(g) UNICEF reserve the right to approve or reject the sub-contracts entered into between the lead contractor and any such sub-contractors.

(h) Any conflict of interest or potential conflict of interest must be fully disclosed to UNICEF as soon as such conflict or potential conflict becomes apparent. In the event of any conflict or potential conflict of interest UNICEF shall, in its absolute discretion, decide on the appropriate course of action.

(i) This REOI and all information provided by UNICEF in relation to the Prequalification process shall be treated as private and confidential. Contractors shall not release any information other than on a confidential basis to those who have a legitimate need to know or to whom they need to consult for the purpose of preparing their submissions. Contractors shall not at any time release information concerning this REOI to any unrelated 3rd party or for publication in the press or on radio, television, screen or any other medium.

(j) No reliance shall be placed on any information or statements contained in these documents and no representation or warranty, express or implied, is, or will be, made in relation to such information. Contractors must make their own assessment of the adequacy, accuracy, and completeness of these documents.

(k) In no circumstances shall UNICEF, its advisers, consultants, servants and/or agents incur any liability or responsibility for the legality, validity, effectiveness, adequacy or enforceability of any documentation executed, or which may be executed, in relation to the contract entered into between the parties.

7. METHOD OF SUBMISSION AND DEADLINE:

(a) The Contractor shall provide adequate information to demonstrate clearly that he has the technical capability, capacity, experience, tools and resources to meet the requirements for the services to be required.

(b) The Submission Forms must be fully competed in English and signed where required, including the “Letter of Interested”. The order of the forms and their format must be preserved as presented. Pages should be numbered sequentially.

(c) The Contractor shall include a copy of the current registration with the local regulatory body and license to operate in Bangladesh.

(d) The Contractor shall submit all the Forms, including the “Letter of Interested”, in two (2) bound hard copies and return them to UNICEF as a sealed package by registered post, recorded delivery or delivered by hand, not later than:

Wednesday, 27 December 2017 before 11.00 hrs (e) At the address:

(f) On the sealed package should be only marked the following: “EOI [Insert Reference]”

(g) A receipt must be obtained on delivery. If a prequalification submission arrives after the date and time above or such later date and time as may be notified in writing, it will not be accepted and will be returned unopened. Responsibility for the arrival of the completed prequalification submission rests solely with the Contractor.

(h) Under no circumstance will a prequalification submission, made by fax or email, be accepted.

(i) Contractor will be assessed on the basis of the submitted information, and therefore the submissions and supporting documents must be complete and true.

8. AWARD NOTIFICATION(a) Any Contractor, participating successfully or not, will be notified about the

result in writing by UNICEF. UNICEF will not be obliged to provide explanations or reasons for its selection.

(b) The Prequalification of a Contractor does not extend to any associated, related and/or subsidiary companies owned or controlled by the Contractor unless included in the submission.

(a) Submission and acceptance of any Prequalification will not constitute a contract or part of a contract between UNICEF and the Contractor.
