Pursuant to Administrative and Financial Regulation 4(4), I hereby submit to the Administrative Council for its approval the Annual Report on the operation of the International Centre for Settlement of Invest- ment Disputes required by Article 6(l)(g) of the Convention on the Settlement of investment Disputes between States and Nationals of Other States. This Sixteenth Annual Report covers the fiscal year July 1, 1981 to June 30, 1982.

The report includes the audited financial statements of the Centre, presented pursuant to Administrative and Financial Regulation 18.

$ ~ ~ e ~ $ ~ ~ During the past fiscal year the Convention

was signed by Paraguay on July 27, 1981, by Costa Rica on September 29, 1981, by the United Arab Emirates on December 23, 1981, and by El Salvador on June 9,1982, bringing the number of signatories to 88. The United Arab Emirates deposited their instrument of ratification on December 23, 1981, bringing the number of Contracting States to 81.

In order to assist potential users of the Centre’s facilities, the Centre has published an entirely revised set of Model Clauses (ICSID/5/Rev.l). All the Centre’s publica- tions now appear in its three official lan- guages, English, French and Spanish.

On January 21, 1982, the Centre orga- nized, with the assistance of UNlDROlT and of the Italian Arbitration Association, a col- loquium held at UNIDROIT’s headquarters entitled “Foreign Investments and the Set- tlement of Disputes under the Convention of Washington of 1965.” The colloquium was attended by a large number of businessmen, judges, government officials and lawyers specialized in international arbitration. The discussion showed great familiarity on the part of the audience with the original fea- tures of the Centre. The papers presented at the colloquium and the proceedings of the discussion will be published in the near fu- ture in the Italian Arbitration Review.

A significantly increased number of ques- tions relating to practical issues arising in connection with the use of the Centre has been submitted to the Secretariat. This clearly shows a new interest in the Centre on the part of certain governments and investors.

On March 29, 1982, Mr. Isi Foighel (Dan- ish) appointed by the Respondent, accepts his appointment as arbitrator.

On March 30, 1982, Mr. Berthold Goldman (French), appointed by the Chairman of the Administrative Council, accepts his appoint- ment as arbitrator and his designation as President of the Tribunal.

On March 31, 1982, the parties are noti- fied of the constitution of the Tribunal.

On October 1, 1981, Me Dominique Schmidt (French), appointed by the Claim- ants, accepts his appointment as arbitrator.

On October 15,1981, Dr. Eduardo Jimenez de Arechaga (Uruguayan), appointed by agreement of the other two arbitrators, ac- cepts his appointment as arbitrator and his designation as President of the Tribunal.

On October 26, 1981, the parties are noti- fied of the constitution of the Tribunal and the commencement of proceedings.

On December 15, 1981, the Centre re- ceives the ad hoc designation of SOCAME under Art. 25(1) of the Convention and the government’s approval of SOCAME’s partici- pation in the proceeding.

On December 21, 1981, the Centre re- ceives the Claimants’ memorial and support- ing documentation.

On June 15, 1982, the Centre receives the Respondents’ counter-memorial and sup- porting documentation.

Finance The Financial Statements of the Centre for

Fiscal Year 1982 are set forth in Annex 6. The

expenditures of the Centre were again COY-

ered entirely by the services and facilities made available by the World Bank free of charge pursuant to the Memorandum of Ad- ministrative Arrangements concluded be- tween the Bank and the Centre in February 1967,2 and by income from the sale of pub- lications. Thus it was not necessary to assess any excess expenditures to the Con- tracting States pursuant to Article 17 of the Convention.

The Centre’s expenses which are attrib- utable to the pending arbitration proceed- ings are borne by the parties in accordance with the Centre’s Administrative and Finan- cial Regulations. In accordance with these Regulations, the Secretary-General calls on the parties from time to time to make ad- vance deposits to defray the expenses of the proceedings.

The Memorandum of Administrative Arrangements between the Centre and the Interna- tional Bank for Reconstruction and Development (the Bank) which became effective as of October 14, 1966, provides, inter alia, that, except to the extent that the Centre may be re- imbursed by the parties to proceedings for fees and expenses of members of Conciliation Commissions, Arbitral Tribunals or Committees of Arbitrators, the Bank shall provide the following services and facilities to the Centre:

(1) the services of staff members and consultants; and (2) other administrative services and facilities, such as travel, communications, office

accommodations, furniture, equipment, supplies and printing.

The Centre does not have resources of its own. The reported expenditures on behalf of the Centre represent the value of the services provided by the Bank and include only those amounts identified by the Bank as being directly related to the Centre, and, accord- ingly, do not include any indirect or overhead costs of the Bank. The reported contributions of $238,268 and $217,084 in 1982 and 1981, respectively, are equal to the value of services provided by the Bank, less reimbursements by the Centre from its sale of publications and registration fees.
