February 13, 2012 MOBILE COUNTY COMMISSION The Mobile County Commission met in regular session in the Government Plaza Auditorium, in the City of Mobile, Alabama, on Monday, February 13, 2012, at 10:00 A. M. The following members of the Commission were present: PRESENT ABSENT Commission President Connie Hudson None Commissioner Merceria L. Ludgood Commissioner Mike Dean Commissioner Hudson acted as Chairman of the meeting, and John F. Pafenbach, County Administrator and Clerk of the Commission, acted as Clerk of the meeting. The Chairman stated that due notice of the time, place and purpose of the meeting having been given to all members of the Commission, and a quorum being present, the meeting was open for the transaction of business. __________________________________________________ INVOCATION The invocation was given by Pastor Arthur Barker of New Generation International Church, 2466 Dauphin Island Parkway, Mobile, Alabama 36605. __________________________________________________ President Hudson called for a moment of silent prayer for the family of Officer Steven Green, who was killed in the line of duty, February 3, 2012. __________________________________________________ Jamie Gayle, Mobile, Alabama, addressed the Commission and said she was speaking on behalf of her father, who was the seller of the property in the Madison Oaks Revised Subdivision, Agenda Item #51. She said the survey on the property was done by the buyer and not by her father, the seller, who has the original survey along with other property documents. Ms. Gayle said her father has not agreed to sell the property to the buyer and the buyer was trying to purchase the property which is in foreclosure in a wrongful manner. She requested the Commission to not approve Agenda Item #51. President Hudson asked Ms. Gayle if she had spoken with Commissioner Dean or the County legal staff? Ms. Gayle said no. Commissioner Dean said he would set up a meeting with Ms. Gayle, the Legal staff and Engineering Department, to discuss her concerns.

President Hudson called for a moment of silent prayer for the family of Officer Steven Green, who was killed in the line of duty, February 3, 2012.

__________________________________________________ Jamie Gayle, Mobile, Alabama, addressed the Commission and said she was speaking on behalf of her father, who was the seller of the property in the Madison Oaks Revised Subdivision, Agenda Item #51. __________________________________________________ Mayor Don Nelson, City of Creola, addressed the Commission and said he was speaking in support of Agenda Item #44. He said on behalf of the City of Creola, its City Council members and residents, they are strongly in favor for the Commission to approve the installation of a traffic control signal for public safety of citizens traveling across the intersection of Jackson Road at U. S. Highway 43. President Hudson thanked Mayor Nelson for expressing support for Agenda Item #44 on behalf of his community. She said the Commission agrees, public safety is a significant issue.

February 13, 2012 Commissioner Dean moved, seconded by Commissioner Ludgood, that the Board authorize a letter of support for the Gulf Coast Resource, Conservation & Development (RC&D) Council’s efforts to locate 2014 National Convention in Mobile and adopt the following resolution: WHEREAS, the Gulf Coast Research Conservation and Development Council (the Council), formed in 1993, is a volunteer organization made up of representatives of local government, local soil and conservation districts, and community leaders interested in carrying out plans, programs, and projects to improve the Gulf coast area; and WHEREAS, the Council’s purpose is to provide local leadership in developing and carrying out plans for the orderly conservation, improvement, development and wise use of natural resources, thereby improving economic development; and WHEREAS, the Council has been involved in numerous projects positively impacting life in Mobile County, most notably the development of the Semmes Library, the Mount Vernon Library & Technology Center, and the Alma Bryant High School Aquaculture Program; and WHEREAS, rhe National Association of Resource Conservation and Development Councils (NARC&DC) was established in 1988 to represent America's 375 local resource conservation and development councils; and WHEREAS, the NARC&DC serves as an advocate for local RC&D councils, including the Gulf Coast Research Conservation and Development Council; and WHEREAS, the Mobile County Commission appreciates the work and efforts of the Council and the NARC&DC and wishes to invite the NARC&DC and its member councils to visit Mobile for the 2014 national conference; NOW, THEREFORE, BE IT RESOLVED that the Mobile County Commission strongly supports and endorses the efforts of the Gulf Coast Research Conservation and Development Council to hold its 2014 annual conference in Mobile. The Chairman then stated that the Commission is charged pursuant to §40-7-42, Code of Alabama (1975), with the duty each year to levy the amount of general taxes required for the expenses of the County, the Mobile County Board of Health, the Board of School Commissioners of Mobile County, the Saraland City Board of Education, The Satsuma Board of Education, and for other uses associated with the maintenance of hospital care in Mobile County. The Chairman also stated that the proposed tax levy for the fiscal year beginning October 1, 2011, and ending September 30, 2012, maintained the same level of taxes levied during the preceding year and did not constitute an increase in taxes. Thereafter, the following resolution, order and levy were introduced in writing by Commissioner Hudson:

WHEREAS, after a most careful consideration into the

financial needs of the County, and in order to balance the budget for the fiscal year beginning October 1, 2011, and ending September 30, 2012, for general expenses and for special and specific purposes as hereinafter set out, upon motion made, duly seconded and unanimously carried, it is hereby RESOLVED that the following taxes for the tax year beginning October 1, 2011 and ending September 30, 2012 be, and they are hereby, levied: A. In order to collect the amount of general taxes required for general expenses provided for by Section 215 of the Constitution of Alabama of 1901 and authorized by §40-7-42, Code of Alabama (1975), a tax at the rate of six (6) mills on each dollar's worth of taxable property in said County be and the same is hereby levied on all taxable property in said County as assessed for revenues for the State, and shown by the book of assessments of the County for the said fiscal year. K. As provided by an amendment to the Constitution of Alabama of 1901 as proposed by Act 648 of the 1961 Regular Legislative Session for public hospital purposes, a tax at the rate of three and one-half (3 ½) mills on each dollar's worth of taxable property in said County as assessed for the revenue for the State and shown by the book of assessments after it has been corrected, be and the same is hereby levied on all taxable property in said County, for public hospital purposes in said County as defined in said constitutional amendment. L. For the carrying on of any business in Mobile County, Alabama, a license tax for the year beginning October 1, 2011, in the sum equal to fifty percent (50%) of the amount fixed by the Legislature of Alabama on all businesses required by the Legislature of Alabama to pay a license or privilege tax for the carrying on of any business in the State of Alabama. N. As authorized by Act No. 88-156 adopted in the 1988 Regular Session of the Alabama Legislature, and enacted by resolution adopted and last amended by the Mobile County Commission on April 14, 2003, a privilege or license tax on the gross receipts within the County of one percent (1%) against those selling tangible personal property, a tax of one percent (1%) on street deliveries made within the County, and a tax of two percent (2%) against those operating hotels, motels, or places of accommodations within the County, together with certain exemptions and different tax rates for certain businesses all of which is set out more fully and in detail in Resolution Number 12 adopted April 14, 2003, by the Mobile County Commission and any amendment thereto or successor resolution, which said resolution, amendment and/or successor resolution is adopted as part of this levy by reference. O. The provisions of this tax levy are severable. If any part of this tax levy is declared invalid or unconstitutional, said declaration shall not affect the part which remains. P. And further the Mobile County Commission orders and decrees that a certified copy of such levy be prepared and furnished to Marilyn E. Wood, Revenue Commissioner, Mobile County, Alabama, and that she be required to sign a receipt therefore hereon.

President Hudson asked if the approval should be contingent upon receipt of insurance? Jay Ross, County Attorney, said there is no separate written agreement, they only pay a fee to use the arena. Joe W. Ruffer, County Engineer, said it is handled in the same manner as when there is a request to use the fields at West Mobile County Park, they only pay a fee. President Hudson said she does not want the County to incur any liability. Mr. Ruffer said he would check on it. Mr. Ross said he would check to make sure the County is covered as a condition of the approval.

Commissioner Dean moved, seconded by Commissioner Ludgood, that the Board adopt the following resolution: WHEREAS, on October 3, 2011 the City of Bayou la Batre, Alabama, an Alabama municipal corporation (sometimes referred to as “the City”), by Ordinance No. 2011-006, annexed unincorporated territories which resulted in public streets or parts thereof which had been accepted by and controlled, managed, supervised, regulated, repaired, maintained and improved by the County being located outside the corporate limits of the City while at the same time bounded on both sides by the corporate limits of the City; and WHEREAS, Section 11-49-80(c), Code of Alabama (1975), as amended, requires that the County consent to the annexation of such public streets or parts thereof by the City; WHEREAS, Section 11-49-80(c) further provides that once such

Commissioner Dean said the University of South Alabama told him they are very close to an agreement with Mobile Infirmary. He asked Jay Ross, County Attorney, for a status update on the Indigent Care Board funds disbursements. Jay Ross, County Attorney, said their legal counsels promised he would receive a letter about an interim agreement, but he has not received it yet. He said he would like to have the parameters of what they are proposing in writing. Mr. Ross said an application appealing the case was still at the Alabama Supreme Court for a rehearing. He said he would check on the status for when their proposal would be forthcoming to him. Commissioner Dean asked President Hudson if she has had any discussions with the University of South Alabama or Mobile Infirmary? President Hudson said no.
