TERMS AND CONDITIONS

01. SCOPE OF WORK & SPECIFICATIONs:

The scope of this tender covers for “Design , supply & installation of 600 KLd ETP”

at M/S MITS MEGA FOOD PARK LTD. (MMFPL), SITE OFFICE AT BHUJABAL,

KOLONARA, RAYAGADA - 765017. The Technical Specification for procurement of

above mentioned item is enclosed to this BID as Annexure – I.

02. PRICE:

The prices to be quoted should include the cost of material and all other costs such as

(i) Transportation up to site MMFPL, RAYAGADA. (ii) All taxes and duties (iii)

Insurance etc. iv) Execution of work at site.

03. PAYMENT

60% payment shall be made against proforma / tax invoice of the entire supply of

components, next 30% will be paid after successful installation, final 10 % will be

paid in lieu of the performance bank guarantee as per clause 11.

In case of increase in any payments or advance the party has to submit advance

bank guarantee (The format of Advance Bank guarantee is enclosed to this BID as

Annexure - II) / Pledged FDR in favour of MITS Mega Food Park Limited of the

equivalent amount as per the format given by MMFPL .

Payment would be made after verification accepted by MMFPL.

04. COMPLETION PERIOD:

The Supply shall be completed within 45 (Forty Five) days from the date of issue of

the Purchase Order.

05. GUARANTEE:

The materials should be guaranteed for a trouble free operation for a period of 12

months from the date of commissioning or 18 months the date of supply.Any defects if

found during this period, the same shall be replaced/repaired by the supplier free of

cost.

06. VAT CLEARANCE CERTIFICATE ,GST & PAN

The bidder is required to submit attested copies of the latest valid VAT clearance

certificate and PAN along with the tender. They are also required to submit their TIN

No, GST No & PAN No.

07. VALIDITY:

The rates quoted should be valid for a period of 120 days from the date of opening.

08. If the work as scheduled is not completed at site within the completion period

mentioned above, penalty shall be imposed at the rate of ½% of the contract value for

each week delay subject to a maximum of 5% of the total contract price.

09. The authority reserves the right to accept / reject the package or change the quantity /

specification / layout / design of the supply tendered without assigning any reason

thereof.

10. The bidder should be registered with Sales TAX Authorities of ODISHA/other states

and should submit the registration number or TIN No.

11. Performance Guarantee:

A performance guarantee worth 10% of value of the contract price may be furnished

by the supplier in shape of Bank Guarantee/FDR Pledged in favour of “M/s MITS

Mega Food Park Ltd. “to this office after completion of the work. This Bank guarantee

will be executed on a non-judicial stamp paper worth Rs. 100/- (Rupees Hundred only)

from any Nationalised/Schedule Bank. This Bank Guarantee / Pledged FDR should

remain valid for the guarantee period mentioned above in as per point no.-5. The

format of Performance Bank guarantee is enclosed to this BID as Annexure - III.

12. EMD

A Bid Security worth 1% of the value of Contract Price should be furnished in shape of

Demand Draft Pledge in Favour of “M/s MITS Mega Food Park Ltd. “ to be

submitted along with the Bid Document.
