Thornbury Township Board of Supervisors Meeting Wednesday, June 1, 2011

The Thornbury Township Board of Supervisors held a Public Meeting on Wednesday, June 1, 2011, at the Township Administration Building, 6 Township Drive, Cheyney, PA. Chairman Raith called the meeting to order at 7:00 p.m.

Number of Attendees: 13 Chairman Raith announced that the Board previously held a brief Executive Session this evening regarding real estate matters. Sheri Perkins was in attendance but had to leave due to family matters before the regular meeting.

APPROVAL OF CHECK REGISTERS

On a motion by James Kelly, seconded by James Raith, and carried unanimously, the General Fund check register in the amount of $151,392.59 for May 19, 2011 through June 1, 2011, was approved. Chairman Raith called for public comment. There was no public comment. APPROVAL OF MINUTES

On a motion by James Kelly, seconded by James Raith, and carried

unanimously, the Wednesday, May 18, 2011 Work Session minutes were approved. Chairman Raith called for public comment. There was no public comment. PRE-EMPTIVE AGENDA ITEM On a motion by James Kelly, seconded by James Raith, and carried unanimously, the “Thorkild S. & Alleine A. Paaby, Final Minor Subdivision” at 32 & 34 Westtown Rd.,was approved as per the conditions to be met, set forth in the resolution. Chairman Raith called for public comment. Jessica Raymond asked how many lots? Jeff Seagraves explained the property lines. BOARDS AND COMMISSSIONS PARKS & RECREATION Joe Burke was not present. Chairman Raith mentioned the Take 25 event held at Thornbury Park and the upcoming July 4th celebration. HISTORIC COMMISSION Ric Miller reported that they met with Board Members from Cheyney University regarding the Squire Cheyney Farm and they are eager to support the joint effort. He asked direction from the Board regarding a Station Road Historic District. Chairman Raith responded that they will look into it. Mr. Miller then reported on the Timeline progress to be dedicated on July 4th. PLANNING COMMISSION Jim Bulkley reported that they approved The Paaby Subdivision and are presently reviewing a Draft Historic Sign Ordinance. They informed the Board that it would be a long process. They are tabling the accessory structure ordinance and are updating the new Comprehensive Plan. SEWER COMMITTEE

Ted Jacquet reported that at their May 26, 2011 meeting, there was a consensus to recommend to the Board of Supervisors, contract guidelines for residents installing sewer connections. The document was based on problems that other residents experienced when they went through contracting and installing a connection to the new sewer system, because certain items were not clear or were omitted in the documents. The Sewer Committee recommended that these guidelines be given to the residents when they apply for a sewer connection. Chairman Raith mentioned the Board does not get involved with

resident’s contract negotiations. Jeff Seagraves reiterated and added that there were 33 tie-ins in the West Side Sewer District. ENVIRONMENTAL ADVISORY COUNCIL Al McCann reported they had no quorum at their last meeting and their recent trail clearing was a success and their present plans for the next one will be in this Saturday. They also revised their present open space recommendation list. There was no public comment LIBRARY Patty Hunsecker reported on her executive summary. There was no public comment. REMAINING AGENDA ITEMS On a motion by James Kelly, seconded by James Raith, and carried unanimously, The Generator Maintenance Contract proposal from Mardinly Enterprises, LLC, of Broomall PA, in the amount of $3,591.00 for a one year contract was approved. Chairman Raith called for public comment. There was no public comment.

On a motion by James Kelly, seconded by James Raith, and carried unanimously, an Application for Special Event from Boy Scout troop 260, to hold a weekend camp-out, June 3rd through June 5th, at Martin Park, was approved. Chairman Raith called for public comment. There was no public comment. PUBLIC COMMENT Jim Bulkley thanked the board for appointing Herman Welsh to the Planning Commission. Patty Hunsecker was impressed with the Memorial Day service. Maureen McCann commented that Bethlehem United Methodist Church is having a Chicken Barbeque and Country Fair this Saturday and all are welcome. Gene Bonner expressed concerns at Bonner Park. He then presented photos of traffic problems and asked for signs to be posted. Chairman Raith reported that the signs have already been ordered and he also commented on invasive growth plants at that location. Manager Seagraves said that they were working on it as on going maintenance.

STAFF REPORTS

TOWNSHIP MANAGER'S REPORT- Jeffrey Seagraves

The Township Manager’s Report was submitted and is attached. There was no comment on the manager’s report. On a motion by James Kelly, seconded by James Raith, and carried unanimously, the contract for the Fourth Friday Night at the Park Movies with Richard J. Eisenacher Audio Visual Services, at a total cost of $3520.00, to be paid in four monthly installments, was approved. Chairman Raith called for public comment. There was no public comment Chairman Raith asked Jeff Seagraves if there was anything on Pennoni and if someone should attend the Concord meeting on the 13th. He also asked about the seniors projects. Mr. Seagraves agreed that someone should attend the meeting and then reported that on July 9th they will be having a Seniors movie night with dinner beginning at 6:00 PM. Chairman Raith stated that they were working on more senior events. Mr. Seagraves said they have named the events as Second Saturdays for Seniors. Maureen McCann suggested that glow-in-the-dark bracelets should be provided. TOWNSHIP ROADMASTER’S REPORT – Lindsey Price Lindsey Price was not present. Jeff Seagraves reported for the Roadmaster. TOWNSHIP SOLICITOR’S REPORT – Robert P. Anderman, Esq.

The Township Solicitor’s Report was submitted and is attached. There was no comment on the solicitor’s report.

TOWNSHIP ENGINEER’S REPORT – Elizabeth Catania, PE

The Township Engineer’s Report was submitted and is attached. There was no comment on the engineer’s report. TOWNSHIP SEWER ENGINEER - Justin Scarth,PE

MANAGER’S REPORT 6-1-11

1. We received several complaints regarding the traffic as a result of the road closure

on Brinton Lake Road. We have added some signs and also have contacted the State police to ensure that they are aware of the complaints.

2. We received a final proposal for the Generator Maintenance contract and would recommend that we accept the proposal from Mardinly Enterprises LLC of Broomall PA in the amount of $3,591.00 for a one year contract. (MOTION)

3. Just a reminder that we start resume summer hours on Monday June 6th. Our summer hours will be 7:30am to 5:00 PM Monday through Thursday.

4. We received the entrance rugs from Cintas; they are a pleasant addition to our entrance ways.

5. We held our Red Cross Blood donation drive on Thursday May 19 and had a pretty good turn out.

6. I attended a COG meeting on Tuesday May 23, 2011. The guest speakers were from the Delaware county Planning Department. The department is currently working on the county comprehensive plan. We have supplied them with some information, but they are seeking additional input which we will coordinate.

7. I met with Joe D’Orazio and Glen Myers regarding the Greenbriar HOA. They are looking for some direction on maintenance of their storm water basins. I am working with our engineer on developing some guidelines for them.

8. I met with representatives of the Brandywine conservancy at Bonner Park. They have a commitment to inspect the park annually as part of their conservation easement.

9. I sent a letter to CTSA requesting consideration for 11 EDU’s for the Fox Lair development.

10. Pennoni is in the process of completing the application for the Fox Lair development. They need direction on whether or not to apply for reimbursement. My recommendation would be to apply for the reimbursement.

11. Take 25 event was held on Wednesday May 25th. We are working on some ideas on how to improve attendance next year.

12. Plans are secure for the Fourth Fridays , which start on Friday June 24, 2011. We have a Movie as well as a Science show planned for that evening.

13. The Newsletter is at the Printers and should be mailed within the next week. 14. The Paaby sub-division has been recommended for approval by the Planning

commission and we would recommend that the Board of Supervisors approve. (MOTION)

THORNBURY TOWNSHIP Public Works Department Report – Week Ending May 27, 2011

1. Routine maintenance performed throughout the Township, including mowing and maintenance at all Parks and cleaning of inlets.

2. Performed maintenance on equipment. 3. Performed markings for PA One Calls for sewers. 4. Sign program remains ongoing. 5. Continued work on time-line project. 6. Prepared for Take 25 event and Memorial Day event.

Solicitors Report

June 1, 2011 The Township Solicitor, Robert P. Anderman, Esquire, reports as follows: I. WEST SIDE SEWER DISTRICT – MORTGAGE RECORDING The Solicitor has now recorded fifty-four (54) mortgages which represents all of the mortgages given to the Solicitor to record. There are still a number of property owners who have not contacted the Township which will require the filing of a lien against the property when properly authorized by the Board of Supervisors. The Township Staff is presently working with a number of the property owners in order to resolve the matter. This matter is still pending. II. CANNON PROPERTY – OPEN SPACE

The Solicitor scheduled settlement on this property for April 12, 2011, however, the seller was unable to clear title on all the objections listed by the Title Company and the settlement had to be postponed until the Title Company receives all of the proper documentation. This matter is still pending. III. COMMONWEALTH V. PERRY The Township has received a letter from the District Attorneys Office notifying that the above named defendant is being considered for possible release or parole. The Victims Rights Law gives the victim, in this case the Township, the right to express an opinion regarding the possible defendants release on parole. The Solicitor will give no opinion on this matter unless the Board of Supervisors desires it to be done.

REPORT OF THE ENGINEERJune MeetingJune 1, 2011

W ork completed for the period:

Blantyre - The Developer has been requested to complete restoration of several disturbed lots. Bill Camphas been advised the Developer will be seeking to pave and dedicate the roads. He has walked the sitewith the Developer to assist with the deficiencies of the right of way area for repair prior to paving.

Mill Creek - All work has been substantially completed. Completing periodic erosion and sedimentationinspections. Grading and Encroachment Permits - W orking with the Township Licenses and Inspections on severalpermits.

Andover - Completing sedimentation and erosion control inspections. House construction is continuing.

Greenbriar - Dallett V - Orleans has forwarded correspondence with reference to the dedication punch list. Met with the Solicitor and Manager to discuss status of work.

Cheyney University - Topsoil is being spread over the geothermal field and sediment basin will beremoved upon stabilization. Grading plan revision has been submitted and has been reviewed. No furtheraction.

Joseph Gricco - Received land development plans for a combined driveway for the Locksley Roadproperty. A waiver of the separate driveway requirement is being sought. The applicant has been askedto address this item.

Collins Subdivision - PaDOT comments must be addressed. No further action.

W ills - Plans have been received and reviewed. The Applicant has added a driveway onto Skyline Drive. No action taken.

Cherry Creek - Met with representatives of the three developers to discuss sidewalk conditions. Developers to prepare a response for the Boards consideration. The Solicitor has forwarded a letter torequest resolution of the matter. I am not aware of a resolution.

PaDOT Liquid Fuels - Reviewed PADOT street list for accuracy. A few streets have been added. TheSecretary is researching files for deeds of dedication.

Road Program - Contracts have been forwarded to the Solicitor for review and execution by the Board.

Paaby subdivision - Plans for subdivision have been received and reviewed. A conditional plan approvalis recommended.

Guilday Subdivision - Received revised plan incorporating revisions of the Fire Marshall’s review.

W iddis Stormwater Complaint - Received a complaint of stormwater flowing over the property of 48 JudithLane. There is one inlet upstream of the cul de sac that is need of repair. Currenlty research is requiredwith regard to the “swale” at the pipe outfall.

ENGINEER'S REPORT

REGARDING WASTEWATER ISSUES

June 1, 2011

WEST SIDE SEWERS

Fox Lair Lane

Pennoni is in the process of initiating the DEP planning process for the proposed Fox Lair Lane

low pressure sewer. The DEP has provisions for up to 50% reimbursement to municipalities for

expenses incurred for planning (however, it is our understanding that reimbursements have been

somewhat delayed due to budget constraints at the DEP). In order to be eligible for the

reimbursement, the Township must submit a Task-Activity Report for approval prior to

commencing the planning process. This could add a few months to the procurement of the

planning process, but Pennoni can prepare the report if the Township desires to pursue

reimbursement.

Brinton Lea & Thronhill LPS

The Record Drawings with the lateral locations for the low pressure sewer systems in Brinton

Lea and Thornhill have been completed and are in final review. Copies will be forwarded to the

Township once they have been finalized.

2011 TV SEWER INSPECTIONS

Pipe Services Corporation has completed the TV sewer inspections in the Cobblestone

Development. No significant deficiencies were found on the sewer lines inspected. Pennoni is

working with Pipe Services to coordinate the inspection of the off-road sewer line between

Cherry Farm and Brinton Lake Colony. It is anticipated that this inspection will be conducted

within the next two weeks.
