Thornbury Township Board of Supervisors Meeting Wednesday, July 6, 2011

The Thornbury Township Board of Supervisors held a Public Meeting on Wednesday, July 6, 2011, at the Township Administration Building, 6 Township Drive, Cheyney, PA. Chairman Raith called the meeting to order at 7:00 p.m.

On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the General Fund check register in the amount of $57,719.05 for June 16, 2011 through July 6, 2011, was approved. Chairman Raith called for public comment. There was no public comment. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the Sewer Fund check register in the amount of $33,693.83 for June 16, 2011 through July 6, 2011, was approved. BOARDS AND COMMISSSIONS PARKS & RECREATION Joe Burke reported that they will not be having a meeting in July. Tickets to the Phillies Bus Trip sold out very quickly and everyone had a great time. The July 4th parade was a huge success and was attended by over a thousand people. Joe then expressed special thanks to Susan Daudert for all of her efforts. Vice Chairman Kelly thanked Joe for the great job Park & Rec did on both events. Sheri Perkins reiterated. HISTORIC COMMISSION Ric Miller was not present. Chairman Raith gave the Township Engineer permission to move forward with the Historic Commissions request. PLANNING COMMISSION Jim Bulkley was not present but Al McCann mentioned that they have been working on the comprehensive plan. SEWER COMMITTEE

Ted Jacquet reported that they had no meeting in June but mentioned that they have a schedule for Fox Lair and should be ready to go by August 2012.

Chairman Raith offered the support of the Board if any informational meetings needed to be held. ENVIRONMENTAL ADVISORY COUNCIL Al McCann reported that they will be holding another trail clearing this Saturday and will meet at the Cheyney Post Office at 9:00AM. He also thanked Lindsey Price and his crew for the trail clearing at Tall Trees. LIBRARY Patty Hunsecker reported on her executive summary and thanked Susan Daudert for her recent help. AGENDA ITEMS Resolution No. 2011-15, allowing the option to shut off water service or place liens on properties with unpaid sewer bills was tabled. Chairman Raith asked Mr. Anderman when it would be ready, and he replied by the next meeting. There was no public comment.

On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the Extension Request on the “Wills” Subdivision, extending the present action date 90 days, to October 5th, 2011 was approved. Chairman Raith called for public comment. There was no public comment. Chairman Raith explained that there was a health, safety and welfare hazard associated with the following contract: On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the contract from Builder Landscaping Services, Inc. for the emergency clean-up project, not to exceed a total of $5000.00 was approved. Chairman Raith called for public comment. There was no public comment.

The partial Escrow Release Request on the Blantyre Subdivision, from Megill Homebuilders, was tabled. Chairman Raith called for public comment. There was no public comment. PUBLIC COMMENT Therese Mallory of 272 Lansdowne Rd, Lansdowne, and Joseph Beaver of 2923 Joey Drive, Philadelphia, shared information about a proposed bill (HR 1489) reforming the commercial banking and securities business. Dewey Yesner asked about repairs to the Locksley Road Whistle Stop and Chairman Raith replied that the repair and clean-up would be in conjunction with the Historical Society. Ted Jacquet mentioned that it was also being considered as a Boy Scout project. STAFF REPORTS

TOWNSHIP MANAGER'S REPORT- Susan Daudert

The Township Manager’s Report was submitted and is attached. There was no comment on the manager’s report. TOWNSHIP ROADMASTER’S REPORT – Lindsey Price Lindsey Price was not present. Chairman Raith mentioned his recent procedure and wished him well. TOWNSHIP TREASURER’S REPORT – Peter Barsz, CPA Peter Barsz reported on the May accounts and will report on the June accounts at the next meeting. On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the May, 2011 Treasurer’s Report was accepted. Chairman Raith called for public comment. There was no public comment.

TOWNSHIP SOLICITOR’S REPORT – Robert P. Anderman, Esq.

The Township Solicitor’s Report was submitted and is attached. There was no comment on the solicitor’s report.

TOWNSHIP ENGINEER’S REPORT – Elizabeth Catania, PE The Township Engineer’s Report was submitted and is attached. Chairman Raith asked that the Engineer move forward carefully with the Orleans Dedication. TOWNSHIP SEWER ENGINEER - Justin Scarth,PE

The Township Sewer Engineer’s Report was submitted and is attached. There was no comment on the sewer engineer’s report.

MANAGER’S REPORT

1. (AGENDA ITEM) I am requesting that you approve the water shut off resolution

to better enable the collection of outstanding sewer bills.(MOTION)

2. (AGENDA ITEM) We received an extension request regarding the Wills Sub-

division and would recommend approval of that the request. (MOTION)

3. (AGENDA ITEM) We have crafted an agreement for the resident located at 15

Stony Hill and would recommend that the Board of Supervisors approve that

agreement. (MOTION)

4. (AGENDA ITEM) We received an Escrow release request from Megill

homebuilders and I am recommending partial release based on the engineers

review and approval of that release amount. (MOTION)

5. We went to settlement for the purchase of open space located at 754 Cheyney

Road on Wednesday June 28, 2011. We now own that parcel of ground.

6. I met with Lt Anthony Sivo on Wednesday 6-28-11. Lt Sivo is the new

commander at the media barracks. He replaces Lt Gustaitis. He is looking forward

to working with Thornbury Township.

7. Our first fourth Friday was postponed until Wednesday 6 29-11. The movie in the

park was well attended as was the science exhibit prior to the showing of the

movie.

8. We will be showing a movie and serving dinner for Senior residents on Saturday

July 9, 2011. Dinner will be served at 6:00 and the movie (Key Largo) will

follow.

9. Lisa Catania and I met with representatives of Orleans homebuilders to address

the outstanding issue of dedication. We agreed that the next step was for Catania

engineering to issue a “deficiencies list” and present that list to Orleans prior to

them doing final paving.

10. We received confirmation from our insurance carrier that the Colucci case has

been settled, and the Township has not been affected by the settlement.

11. We have created a new agreement to address payment of outstanding sewer use

fees and would appreciate the board’s consideration on this matter.

12. DELCORA contacted me and requested permission to clean aeration tank #4. I

approved that work and it will be completed by the end of the week.

13. We experienced a problem with the transfer switch at the Creek road West pump

station. Mardinly was contacted and the issue was resolved within several hours

of discovery.

14. We met with representatives of Fulton Bank to discuss possible banking

opportunities.

THORNBURY TOWNSHIP Public Works Department Report – Week Ending June 24, 2011

1. Routine maintenance performed throughout the Township, including mowing and maintenance at all Parks.

2. Time Line Project complete and was dedicated at the 4th of July event. 3. Mulched trees and beds and planted new plantings at Thornbury Park. 4. Performed maintenance on equipment. 5. Cleared inlets throughout the Township. 6. Opened up trail heads for EAC. 7. Cutback trails at Tall Trees. 8. Pothole repairs complete throughout Township– good job. 9. Continuing research on purchase of an enclosed trailer.

Solicitors Report

July 6, 2011 The Township Solicitor, Robert P. Anderman, Esquire, reports as follows: I. WEST SIDE SEWER DISTRICT – MORTGAGE RECORDING In this matter, the Solicitor has received another five (5) mortgages to record from the township staff. There are still a number of property owners who have not contacted the township which will require the filing of a lien against the property, which has been authorized by the Board of Supervisors. The township’s staff is presently working with a number of the property owners in order to resolve the matter. II. CANNON PROPERTY – OPEN SPACE

The Solicitor, together with the Township Manager, Jeffrey Seagraves, attended settlement at the offices of the title company, Land Services USA, Inc., in Media, Pennsylvania on June 29th and the settlement went very well. The Township is now the owner of the 13.065 acre lot.

III. COLLEGE HILL SEWER MAIN - THORNBURY TOWNSHIP, CHESTER

COUNTY In this matter, the Solicitor received a letter from the Solicitor of Thornbury Township, Chester County, requesting the approval by the Board of Supervisors of a resolution granting permission to Thornbury Township, Chester County to construct or install a proposed sewer main in the right-of-way of the state highway, however, in a small portion of Thornbury Township, Delaware County, This matter should be reviewed by the Township Sewer Engineer and staff then placed on the agenda for consideration.

W ork completed for the period:

Blantyre - The Developer has completed wearing course paving. I would anticipate a request fordedication of streets will be forthcoming.

Mill Creek - All work has been substantially completed. Completing periodic erosion and sedimentationinspections.

Grading and Encroachment Permits - W orking with the Township Licenses and Inspections on severalpermits.

Andover - Completing sedimentation and erosion control inspections. House construction is continuing.

Greenbriar - Dallett V - Met with representatives of Orleans Builders and the Township Manager. Anagreement as to the next action has been made.

Cheyney University - Final grading over the geothermal field has been completed. Stabilization will benecessary for the sediment basin to be removed.

Joseph Gricco - Received land development plans for a combined driveway for the Locksley Roadproperty. A waiver of the separate driveway requirement is being sought. The applicant has been askedto address this item.

Collins Subdivision - PaDOT comments must be addressed. No further action.

W ills - Plans have been received and reviewed. The Applicant has added a driveway onto Skyline Drive. No action taken.

Cherry Creek - Met with representatives of the three developers to discuss sidewalk conditions. Developers to prepare a response for the Boards consideration. The Solicitor has forwarded a letter torequest resolution of the matter. I am not aware of a resolution.

PaDOT Liquid Fuels - Reviewed PADOT street list for accuracy. A few streets have been added. TheSecretary is researching files for deeds of dedication.

Road Program - Contracts have been forwarded to the contractor by the Township. Awaiting informationfrom the contractor for submission to PaDOT for From 329 approval.. Expect work to be started in lateJuly.

Paaby subdivision - Plans for subdivision have been reviewed and signed for recording.

Guilday Subdivision - Received revised plan incorporating revisions of the Fire Marshall’s review.

W iddis Stormwater Complaint - Received a complaint of stormwater flowing over the property of 48 JudithLane. There is one inlet upstream of the cul de sac that has been cleared.

MS4 Permit - The individual permit has been forwarded for execution and submission to DEP. Year 8report has been submitted. As part of the comments received on years 7 & 8 indicate the need for anupdated storm sewer map.

Blackbell Farm - Reviewed open space legal description or closing. W ork is complete.

REGARDING WASTEWATER ISSUES June 15, 2011

EAST SIDE SEWERS The developer at Squire Cheyney Farm has changed contract operators for the pump station as of June 1, 2011. The current operator is Aqua Wastewater Management. Pennoni will coordinate with them to maintain copies of the operation logs as was done with the previous operator. The developer for Greenbrier Phase V has submitted copies of the video inspection of the sanitary sewers. We are in the process of reviewing them and will provide a response when complete. WEST SIDE SEWERS Pennoni has contacted the DEP and is preparing the Task Activity Report for Fox Lair Lane which will initialize the planning process and allow partial reimbursement from the Department for the Planning Process.

2011 TV SEWER INSPECTIONS Pipe Services Corporation completed the televised inspection of the off-road sewer lines in the easements between Cherry Farm and Brinton Lake Colony on Monday June 13, 2011. A copy of the report and the findings has been forwarded to the Manager for review.
