THE REPUBLIC OF INDONESIA

CONCERNING
PROVISION ON INDONESIAN TECHNICALLY SPECIFIED RUBBER (TSR)
TRADED OVERSEAS
BY THE GRACE OF GOD THE ALMIGHTY
THE MINISTER OF TRADE OF THE REPUBLIC OF INDONESIA,
Considering : a. whereas to maintain the quality and increase the
competitiveness, image of the Indonesian product, as
well as business certainty for Producers of Indonesian
Technically Specified Rubber (TSR), it is necessary to
re-stipulate the existing regulation;
b. whereas the existing regulations on Indonesian
Technically Specified Rubber (TSR) in its development
is no longer appropriate, thereby it is necessary to
revoke and re-stipulate it;
c. whereas in this respect, it is necessary to stipulate the
Regulation of the Minister of Trade;

Ministry of the Republic of Indonesia, as already
amended several times, recently by President
Regulation Number 17 of 2007;
11. President Regulation Number 11 of 2005 concerning
the Fifth Amendment to President Decree Number 103
of 2001 concerning Position, Task, Function,
Organization Composition, and Work System of Non-
Department Government Institutions;
12. Minister Decree Number 558/MPP/Kep/12/1998
concerning General Provisions on Export as already
amended several times, recently by the Regulation of
Minister of Trade Number 01/M-DAG/PER/1/2007;

DECIDES
To Stipulate : REGULATION OF THE MINISTER OF TRADE OF THE
REPUBLIC OF INDONESIA CONCERNING PROVISION
ON INDONESIAN TECHNICALLY SPECIFIED RUBBER
(TSR) TRADED OVERSEAS

Article I
In this Regulation of the Minister, by:
1. Indonesian National Standard, hereinafter referred to as
SNI, shall mean the standard stipulated by the National
Standardization Board and effective nationally.
2. Indonesian Technically Specified Rubber/TSR or Standard
Indonesian Rubber hereinafter referred to as SIR shall
mean the natural rubber gained from the processing of
latex and rubber processing material from Hevea
brasiliensis tree mechanically with or without chemicals, as
well as fulfilling SNI quality requirements.
3. Producer Identity Card, hereinafter referred to as TPP
shall mean an identity issued by the Ministry of Trade to
SIR Producer.
4. SIR Producer shall mean any individual, business entity or
legal entity carrying out SIR production activity whether
those already having certificate of product marked SNI
issued by the Conformance Assessment Agency or not.
5. Conformance Assessment Agency hereinafter referred to
as LPK shall mean the Product Certification Agency
issuing Certificate of Product Marked SNI or Testing
Laboratory issuing Test Result Certificate and already
accredited by the National Accreditation Committee with
work scope covering Technically Specified Rubber /SIR.
6. Certificate of Certificate of Product Marked SNI hereinafter
referred to as SPPT SNI shall mean the document issued
by the Product Certification Agency stating that the
business actor is eligible to produce the goods and or
service according to SNI requirement (through certification
type 5).
7. National Accreditation Committee, hereinafter referred to
as KAN shall mean Non Structural Institution established
based on the Decree of President having responsibility to
Regulation of the Minister of Trade of the Republic of Indonesia Number: 10/M-DAG/PER/4/2008

accredit the Conformance Assessment Agency.
8. Test Result Certificate shall mean the document issued by
the testing laboratory stating the result of testing to the
sample of goods already tested based on the specification,
test method and fulfilling SNI requirement.
9. SIR Testing Laboratory shall mean KAN accredited
laboratory conducting testing to SIR sample.
10. Notification on Goods Export hereinafter referred to as
PEB shall mean customs document used to notify the
implementation of goods export that can be in terms of
inscription on form or electronic media.
Article 2
(1) SIR traded overseas shall fulfill SNI 06-1903-2000 or
revision thereof.
(2) Fulfillment of obligation as referred to in paragraph (1)
shall be proven by existence of SPPT SNI or Test Result
Certificate.
Article 3
Every SIR Producer shall have Producer Identity Card (TPP).
Article 4
TPP shall be issued by the Director General of Foreign Trade
the Ministry of Trade c.q. Director for Goods Quality
Supervision and Control.
Article 5
To gain TPP:
a SIR Producer already having SPPT SNI for SIR shall
submit the application for TPP to the Director General of
Foreign Trade c.q. Director for Goods Quality Supervision
and Control by attaching:
1. Photocopy of Deed of Company establishment and
or amendment thereto;

2. Photocopy of Industrial Business Permit or
Permanent Business Permit;
3. Letter/document indicating that SIR Producer has
SIR Laboratory proven by list of equipment and
number of laboratory personnel that must be
employed according to the manufacturer’s
production capacity; as contained in Appendices I-a
and I-b hereto;
4. Certificate of member of Indonesian Rubber
Company Association (GAPKINDO); and
5. Photocopy of SPPT SNI from LPK accredited by
KAN for scope of SNI and registered with the
Ministry of Trade.
b. SIR Producer not yet having SPPT SNI for SIR shall
submit the application for TPP to the Director General of
Foreign Trade the Ministry of Trade c.q. Director for Goods
Quality Supervision and Control by attaching:
1. Photocopy of Deed of Company establishment and
or amendment thereto;
2. Photocopy of Industrial Business Permit or
Permanent Business Permit;
3. Technical recommendation from LPK in this case
SIR Testing Laboratory already accredited by KAN
with scope of SIR and registered with the Ministry of
Trade as well as have the expert/technician in SIR
field, covering:
3a. Letter/document indicating that SIR Producer
has SIR Laboratory proven by list of
equipment and number of laboratory personnel
that must be employed according to the
manufacturer’s production capacity; as
contained in Appendices I-a and I-b hereto;

3b. Testing result fulfilling requirement of SNI 06-
1903-2000 or revision thereof to at least 60
samples of SIR taken for 12 days
consecutively (at least 5 samples of SIR per
day); and
3c. Technical recommendation issued and signed
by person in charge of LPK in this case SIR
Testing Laboratory.
4. Certificate as member of GAPKINDO; and
5. Statement of preparedness of SIR Producer to
obtain SPPT SNI for SIR from LPK with scope of
SIR within maximum 2 (two) years as of issue of
TPP.
c. The model of application as referred to in items a and b
shall be that as referred to in Annex II hereto.
d. The model of statement of preparedness of SIR Producer
as referred to in item b point 5 shall be that as referred to
in Annex III hereto.
Article 6
(1) To ensure the truth of document submitted by the
applicant, the Directorate General of Foreign Trade c.q.
Director for Goods Quality Supervision and Control shall
examine the document.
(2) Director General of Foreign Trade c.q. Director for Goods
Quality Supervision and Control shall issue TPP if the
application fulfills the requirement or deny the application
of TPP within not later than 5 (five) business days
calculated as of the receipt of document in complete.
(3) The issue of TPP or denial as referred to in paragraph (2)
shall be submitted to SIR Producer with carbon copy to the
local Provincial and District/Municipal Agency responsible
in trade sector.

(4) The model of TPP and denial of application for TPP as
referred to in paragraph (2) shall be that as referred to in
Annex IV-a and Annex IV-b hereto.
Article 7
(1) TPP issued consists of three letters, with the first letter
denotes the Producer’s regional code, namely:
a. S for Sumatera region;
b. D for Java and Bali region;
c. K for Kalimantan region;
d. C for Sulawesi region;
e. M for Maluku and Nusa Tenggara regions; and
f. P for Papua region;
(2) The second and third letters denote the Producer’s identity
alphabetically according to the sequence of company
receiving TPP.
Article 8
The validity term of TPP ownership shall be as long as SIR
Producer still carries out production activity.
Article 9
(1) SIR Producer already obtaining TPP shall submit the
quarterly progress report to the Director General of
Foreign Trade c.q. Director for Goods Quality Supervision
and Control with carbon copy to the Executive Director of
GAPKINDO.
(2) The model of progress report as referred to in paragraph
(1) shall be that as referred to in Annex V hereto.
Article 10
(1) The Directorate General of Foreign Trade c.q. Director for
Goods Quality Supervision and Control shall carry out
evaluation to the production activity of SIR Producer by bi-
annually based on the progress report.

(2) In case of complaint about uncertainty in performance of
SIR Producer already obtaining TPP, the Directorate
General of Foreign Trade c.q. Director for Goods Quality
Supervision and Control together with Secretariat General
of the Ministry of Trade c.q Standardization Center and
GAPKINDO may carry out verification.
(3) The evaluation result as referred to in paragraph (1) and
verification result as referred to in paragraph (2) shall be
used as consideration material for the validity term of TPP
ownership.
Article 11
(1) In case of change of ownership, name of the company or
legal entity, the new SIR Producer may obtain TPP with
the existing identity by submitting the application to the
Directorate General of Foreign Trade c.q. Director for
Goods Quality Supervision and Control by attaching the
requirements as follows:
a. Photocopy of Deed of amendment to Company
establishment;
b. Photocopy of new Industrial Business Permit or
Permanent Business Permit;
c. Photocopy of valid SPPT SNI;
d. Photocopy of existing TPP;
e. Certificate as member of GAPKINDO; and
f. Technical recommendation from SIR Testing
Laboratory in case the new SIR Producer does not
yet have SPPT SNI as referred to in Article 5 item b.
(2) Model of application as referred to in paragraph (1) shall
be that as referred to in Annex II hereto.
Article 12
(1) TPP and Symbol of SIR can only be attached on the
product of SIR Producer already having TPP and fulfilling
the requirement of SNI 06-1903-2000 or revision thereof.

(2) The provision on letter and marking of TPP, SIR Symbol
and SIR Package shall comply with the provisions in SNI
06-1903-2000 or revision thereof.
Article 13
(1) SIR Producer already having TPP but its SPPT SNI is
cancelled by LPK or validity term thereof already expired,
shall re-gain SPPT SNI within 6 (six) months calculated as
of the cancellation date or expiry date of its validity term.
(2) If within term as referred to in paragraph (1), SIR Producer
does not yet obtain SPPT SNI, then its TPP shall be
cancelled.
(3) The model of cancellation of TPP as referred to in
paragraph (2) shall be that as referred to in Annex VI
hereto.
Article 14
(1) TPP already issued can be cancelled if SIR Producer:
a. breaching provision as referred to in Article 2;
b. failing to carry out production activity for 2 (two)
years consecutively;
c. using TPP for SIR Product not produced by the
relevant Producer;
d. assigning TPP to the other company leasing out its
processing/production facility;
e. failing to obtain SPPT SNI for 2 (two) years
calculated as the issue of TPP especially for SIR
Producer not yet having SPPT SNI;
f. failing to submit the progress report for 2 (two) years
consecutively; or
g. ceasing to become the member of GAPKINDO.
(2) The cancellation of TPP shall be made by the Director
General of Foreign Trade c.q. Director for Goods Quality
Supervision and Control with carbon copy to the local
Regulation of the Minister of Trade of the Republic of Indonesia Number: 10/M-DAG/PER/4/2008

Provincial/District/Municipal Agency responsible in trade
sector, and Director General of Customs.
(3) The model of cancellation of TPP as referred to in
paragraph (1) shall be that as referred to in Annex VI
hereto.
Article 15
In order to be able to carry out conformance assessment to SIR
Producer, LPK shall be accredited by KAN with scope of SIR
and registered with the Secretariat General of the Ministry of
Trade c.q Standardization Center.
Article 16
(1) The registration of LPK as referred to in Article 15 shall be
made by submitting the application for registration to the
Secretariat General of the Ministry of Trade c.q
Standardization Center by filling out the form of application
for registration.
(2) The form of application for registration shall be appended
with:
a. Photocopy of certificate of KAN accreditation with
scope of SIR; and
b. Statement of employing Expert/Technical expert
having competency in SIR field for testing laboratory.
(3) The model of form of application for registration of LPK as
referred to in paragraph (1) shall be that as referred to in
Annex VII hereto.
Article 17
(1) The Secretariat General of the Ministry of Trade c.q
Standardization Center shall issue the Decision on
Registration or denial to application for registration of LPK
within not later than 5 (five) business days as of receipt of
application in complete.
(2) The validity term of Decision on LPK Registration shall be
3 (three) years and can be extended.

(3) The model of Decision on LPK Registration of and Denial
to LPK Registration as referred to in paragraph (1) shall be
that as referred to in Annex VIII-a and Annex VIII-b hereto.
Article 18
(1) To renew the validity term of the Decision on LPK
Registration, the relevant LPK shall submit the application
to the Secretariat General of the Ministry of Trade c.q
Standardization Center by filling out the form of application
for re-registration and attaching the document as referred
to in Article 16 paragraph (2).
(2 The model of form of application for re-registration of LPK
as referred to in paragraph (1) shall be that as referred to
in Annex IX hereto.
Article 19
The registered LPK shall submit quarterly report to the
Secretariat General of the Ministry of Trade c.q Standardization
Center, by attaching:
a. Photocopy of Conformance Certificate issued,
postponement, extension or revocation of certification
status; and
b. Photocopy of result of periodical and incidental supervision
to SIR Producer already obtaining SPPT SNI.
Article 20
If there is complaint about performance of LPK already
obtaining Decision on Registration, the Secretariat General of
the Ministry of Trade c.q Standardization Center together with
KAN may carry out verification.
Article 21
(1) The Decision on LKP Registration can be cancelled if:
a. Accreditation status of LPK is revoked or not
renewed;

b. Verification result on LPK as referred to in Article 20
fails to fulfill requirement; or
c. LPK fails to submit the report together with the Annex
thereto as referred to in Article 19, for 1 (one) year
consecutively to Secretariat General of the Ministry
of Trade c.q Standardization Center.
(2) SPPT SNI issued by LPK shall be effective until expiry of
its validity term in case LPK issuing SPPT SNI canceling
the registration thereof and the supervision is then carried
out by the Secretariat General of the Ministry of Trade c.q
Standardization Center.
(3) Model of cancellation as referred to in paragraph (1) shall
be that as referred to in Annex X hereto.
Article 22
The supervision to SIR traded overseas shall be carried out by
the Directorate General of Foreign Trade c.q. Director for
Goods Quality Supervision and Control.
Article 23
SIR traded overseas, shall be from SIR Producer having TPP.
Article 24
In order to be able to trade SIR overseas, SIR Producer shall
have TPP and fulfill the following provisions:
a. SIR Producer already having SPPT SNI shall write the
number of SPPT SNI in PEB document for every goods
party exported;
b. SIR Producer not yet having SPPT SNI shall attach the
Test Result Certificate from SIR Testing Laboratory
fulfilling the requirement of SNI 06-1903-2000 or revision
thereof, for every goods party exported;
c. SIR Producer of which SPPT SNI is cancelled and in re-
certification process term as referred to in Article 13
paragraph (1) and will carry out export, before obtaining

new SPPT SNI, shall append the Test Result Certificate
from SIR Testing Laboratory and fulfill the requirement of
SNI 06-1903-2000 or revision thereof, for every goods
party exported;
d. SIR Procedure of which the validity term of SPPT SNI
expires and in re-certification process term, may use
existing SPPT SNI by attaching certificate from LPK.
Article 25
(1) Building to SIR Producer already having registered TPP
and LPK shall be carried out by the Directorate of Goods
Quality Supervision and Control Standardization Center
the Ministry of Trade and Provincial/District/Municipal
Agency responsible in trade sector.
(2) The building as referred to in paragraph (1) shall be in
terms of technical building, extension, training and
consultation.
Article 26
(1) SIR Producer already having TPP, before effectiveness
hereof, shall submit re-application to the Director General
of Foreign Trade c.q. Director for Goods Quality
Supervision and Control to obtain TPP with identity
according to its own TPP within not later than 1 (one) year
as of effectiveness hereof, by attaching:
a. Photocopy of existing TPP or Certificate from
GAPKINDO if its TPP is lost;
b. Photocopy of Industrial Business Permit or
Permanent Business Permit;
c. List of Laboratory Equipment and Laboratory
Personnel that is adequate according to the
manufacturer production capacity, minimum number
and type of equipment according to the production
capacity as referred to in Annex I hereto; and

d. Photocopy of SPPT SNI from LPK for SIR Producer
already obtaining SPPT SNI, or technical
recommendation from LPK (SIR Testing Laboratory)
furnished with the statement on preparedness of SIR
Producer to obtain SPPT SNI within not later than 2
(two) years as referred to in Article 5 item b point 5
for SIR Producer not yet having SPPT SNI.
(2) The model of application as referred to in paragraph (1)
shall be that as referred to in Annex II hereto.
Article 27
SIR Producer already having TPP before effectiveness hereof
and not submit the application for re-registration within not later
than 1 (one) year as referred to in Article 26 paragraph (1), its
TPP shall be declared null and void.
Article 28
By effectiveness hereof, then:
a. Minister of Trade Decree Number 143/Kp/VI/69
concerning Standard Indonesian Rubber/SIR;
b. Minister of Trade Decree Number 399/Kp/XI/1969
concerning Symbol of Standard Indonesian Rubber/SIR;
c. Minister of Trade Decree 389/KP/XII/1969 concerning
Implementing Regulation of Decree of the Minister of
Trade regarding SIR;
d. Minister of Trade Decree Number 45/KP/III/71 concerning
Supplement to State Gazette of the Republic of Indonesia
and Amendment to Decree of the Minister of Trade on SIR
(Decree of the Minister of Trade Number 143/KP/VI/69
and Number 389/KP/XII/69);
e. Minister of Trade Decree Number 365/KP/XI/71
concerning Revocation of SIR as One of Quality Types of
SIR;

j. Minister of Trade and Cooperatives Decree Number

concerning Change of SIR Scheme;
l. Minister of Trade Decree Number 184/Kp/VI/88
concerning Standard Indonesian Rubber/SIR;
m. Minister of Industry and Trade Decree Number
164/MPP/Kep/6/1996 concerning Obligatory Quality
Supervision for Certain Export Product; in the clause
relating to SIR;
shall be declared revoked and null and void.
Article 29
This regulation shall become effective for 6 (six) months as of
stipulation date.
For public cognizance, it is ordered to promulgate this
Government Regulation by publish the same in the State
Regulation of the Minister of Trade of the Republic of Indonesia Number: 10/M-DAG/PER/4/2008

Annex to Decision on LPK Registration

Provisions and Obligations of Conformance Assessment Agency
1. Conformance Assessment Agency:
a. Securing its accreditation status is maintained.
b. Securing that the product certification facility/test result is according to the prevailing
procedure, legislation and policy.
c. Reporting to the Standardization Center, every change of:
• legal, commercial, organization or accreditation status thereof;
• key personnel;
• address
• any matters affecting the maintenance of conformance with criteria or requirement
stipulated by the Standardization Center of the Ministry of Trade.
[2. The Registration as Conformance Assessment Agency shall be effective for 3 (three) years and
shall submit the application for re-registration 6 (six) months before expiry of the validity term.
3. Supervision after Registration
Standardization Center the Ministry of Trade will carry out supervision to Conformance
Assessment Agency to ensure the practice standard is maintained or to follow up the complaint
submitted to the Conformance Assessment Agency relating to the problem relating to its
registration.
4. Cancellation of Registration
(a) The Standardization Center shall cancel the registration if:
(i) Accreditation is cancelled;
(ii) Is proven failing to meet the criteria or requirement of this procedure or with the
requirement for which the authority is issued; or
(iii) Standardization Center the Ministry of Trade decides that there is strong reason to
revoke the registration.
(b) The Conformance Assessment Agency of which the registration has been cancelled shall
be desisted from List of Conformance Assessment Agency with Standardization Center the
Ministry of Trade, and shall be prohibited to carry out the Indonesian Technically Specified
Rubber (TSR) certification activity.
