I am writing again to add a few more worries we have about the above proposal.

We feel very worried about our quality of life being affected by such a development which is within a short distance of our property. We feel live or recorded music noise would affect our lives coming from a large wooden shed as proposed

Also the disturbance of noise from people leaving around midnight and from car doors banging and general merriment would unacceptable at that time of night.

In the past before the snack bar appeared we have had golf balls breaking glass in our greenhouse andunfortunately men urinating against our fence all we have had to put up with. We have several golf balls at thismoment that have appeared in our garden which we will put back over the fence.

Now, with this new proposal surely extra cars and buses going back and forth from this venue could cause noisedisruption and danger on Moss Side in the late hours.

We notice that the planning permission was not given for a "Footgolf" scheme which is now being carried out at Formby Golf centre. Also I see planning was given for the snack bar as an ancillary to the golf centre which has daily closing hours and not as proposed in this alcohol grant application for a midnight closure.

This is making all of Moss Side residents very worried that our quality of our lives will be affected by your decision to grant a liquor license. Please take into account the feelings of the residents.

I object to the above being granted an alcohol licence. The reasons being are – 1.The licence applied for is to sell alcohol between the hours of 8 am &12 midnight. This would mean supplying alcohol up to midnight & this would result in clients leaving at around 12.30 am or possibly even later. This would infringe on the peace & quiet of the immediate & close surrounding areas with excess unwanted noise from people talking & shouting plus car doors slamming. There would be motor vehicle noise from clients vehicles & taxis etc. Some of the clients leaving the licensed premises could be walking & again could be causing noise from talking, laughing & shouting etc. especially after drinking alcohol.

2.There is no need for licensed premises at the premises mentioned in the application. It is a golf driving range & the hours of opening are from 9.30 am until 8.30 pm.

3.The applicants are not even associated with the golf driving range other than renting the premises

4. My rear garden is only approx. twenty two feet away from the building in question & there is a patio/flagged area that is even closer.

5. I am led to believe that the applicants wish to have hen party & stag party nights plus other night time functions with live music & recorded music being played as well.

6. I am also led to believe there is going to be a cafe &/or a restaurant with 25 covers.

7. If clients of the licensed premises are outside on the patio drinking there is bound to be excessive noise coming from them & possibly bottles, glass’s etc. thrown over the fence into my garden.

8. There would be excessive noise interrupting the peace & tranquillity of this area/surrounding area that is semi rural. Greenwoods riding stables, that is in Southport old road just off the bypass which is directly in line with my property beyond the golf driving range being approx. a third of a mile away has functions mainly at weekends in the day & some occasionally go on until late at night & loud noises can be heard in my bungalow as it can be in other residential premises in Moss Side.

In my opinion to grant a licence on the terms requested by the applicants especially the opening hours is ludicrous when taking into account my objections & I am sure from neighbouring properties objections. Dear Sir, I wish to object to the above application for the following reasons:

I already suffer from the problem of people being dropped off/ collected from the corner of Little Hey Lane and Moss Side as they arrive and leave the driving range as this is the corner of my front garden. I have had damage to my garden and fence and litter is left and I have been threatened by 14yr old youths with golf clubs, all this without a 16 hour time slot for selling alcohol or playing

live/recorded music.

This same entrance has been recognised as a problem for over 100 years -rails where erected over the small Downholland Brook to help avoid accidents in 1905, if the alcohol licence is granted in full

this exit from the driving range will surely be used more frequently as a short cut to Maghull and Ormskirk even though it is a very uneven ,raised single track in some areas with a ditch either side

and no lighting.

The adverts for the Footgolf centre already say there is a licenced bar to open soon, this also says it is an ideal place for stag/hen and corporate days out. I live on a rural lane with mostly farm traffic. I do not wish to be deafened by the sound of music & other noise associated with these events from

8am till midnight 7 days a week.

Dear Sir, I wish to object to the above application for the following reasons:

Mr Mawdsley has planning permission for a snack bar - which I did not object to as I thought it was just relocating the existing coffee shop to another area of the driving range - but not a cafe. Cafes are usually associated with wine bar/cafe. The new snack bar has been built but looks empty. Permission was granted for this small timber building to be open from 9.30 am to 9.30 pm but it is already advertised as being open from 8.30am to 9.30 pm.

Noise associated with the selling of alcohol during this large time frame and the playing of live/recorded music would be totally unacceptable. My home is a bungalow and on the corner of Moss Side and Little Hey Lane which is the entrance to the driving range and snack bar. I already have problems with people being dropped off/collected from the driving range as they wait on the corner, there are issues with litter and damage to my garden and threats from 14yr olds with golf clubs and this is at 2pm on a Saturday afternoon.

On a lovely clear summer night I can hear the celebrations at Formby Hall due to the fact that sounds travels much easier in more rural areas, I dread to think how loud it would be in my bedroom which is 10m from Little Hey Lane and 20m from the main car park of the driving range if the license is granted - it would be unbearable.

Mr Mawdsley did not extend his parking allowance when he applied for the snack bar permission, which was for 29 cars but the adverts for the footgolf which is situated within the driving range premises advertises it is ideal for stag/hen parties and corporate events. They need coaches - some have already arrived - there has not been permission for coach parking - the turning from Moss Side into Little Hey Lane, which is classed as a bridle path, is small for the size of vehicles that will be entering it. I have already had part of my fence written off by delivery wagons .

I do not object to alcohol being sold if snacks are consumed whilst sitting at a table but the

timeframe of 16 hours per day is excessive.

When this application was made the no thought was given to the residents of Moss Side which is a small semi rural road regarding noise,litter,damage to property and loss of privacy.

15 August 2016 Planning Department Licensing Department Sefton Council Dear Sir Objection to the alcohol and entertainment licence application for Formby Golf Centre Cafe, Moss Side, Formby L37 0A. Formby Parish Council would like to express our concerns at the licence application for Formby Golf Centre Cafe, Moss Side, Formby L37 0A. Having been contacted by local residents, we share some of their concerns. Having searched Sefton’s online planning portal we have been unable to find planning approval for the main structure on this site to sell food for consumption on the premises? We question whether this building has been granted approval for class A3 usage? This being the case we conclude that the application relates to the small 6m by 8m single storey snack hut. It would seem that from the regulated activities applied for, sale of alcohol by retail, provision of late night refreshment, provision of regulated entertainment live music and recorded music, that the consumption of food will not be the primary purpose of the licensed area/building. In light of this we would question why the applicant has not applied for a change of use to a class A4 “Drinking Establishment”? We also note that as late as 2005 Planning application N/2005/1083 condition 4 states quite clearly that “the golf range shall not be open for business outside of the hours of 9:30am to 9:30pm daily”. Similarly Application DC/2014/00525 Erection of snack bar ancillary to Formby Golf Centre, states that the longest opening hours will be “from 8:30am to 9:30pm”.

We are concerned that the applicant may be asking for a licence for business and licensed activities for which the building does not have planning permission. We would strongly suggest that this building is not suitable to be used as a bar, is far too small for a live music venue, and this will lead to noise escaping from the venue and patrons spilling out onto the curtilage of the building directly behind properties on Moss Lane.

Although we understand that Licensing and Planning are two distinct processes within the Council we would not support a licensing application that is completely inconsistent with the previously determined planning conditions and terms of usage for the building.

The applicant is asking for a licence for the activities highlighted above until midnight when the premises only have planning permission to remain open, as far as we can ascertain, until 9:30pm. Given this we would suggest that if a licence was granted it would be inappropriate to do so beyond 9:30pm. Alcohol should not be consumed outside of the hut or on the building’s curtilage and the sale of alcohol and provision of entertainment must only be with a substantial meal rather than snack, in order for it to be consistent with an A3 usage.

Given that this business is also attractive to younger people, Formby Golf Centre should restrict the areas within which alcohol can be consumed and consider carefully or better still refrain from promotions relating to alcoholic drinks.

The Safety of patrons arriving and leaving on foot is of great concern. The mix of alcohol and the A565 Formby Bypass crossing is a recipe for tragedy. Although we would fully understand and support this establishment offering additional restaurant facilities which may include the sale of alcohol to patrons, who come primarily for the sporting facilities, we would be concerned if this became a late evening drinking and entertainment venue.

Dear Kevin,

Having being advised of the above application, I wish to inform you of our strong rejection to the grant being approved. Details as follows:-

You are probably well aware that ours is one of the private homes backing on to Formby Golf Range. The proximity is so close that even the golf balls arrive in our garden on regular occasions. However to have a constant evening noise pollution till midnight seven nights a week is an absolute outrage.

We have three bedrooms in our bungalow and all are north facing, therefore the sleeping quarters of the property are the nearest to the golf range.

If this approval goes ahead the property value will instantly depreciate.

The distance between our property and the proposed site is less than 70 metres. Therefore the sound level will be very pronounced to approve this application would be absurd. We back directly onto the Golf Range Café, which clearly will be the housing area for the licensed drinks.

We trust you will have a sensible, sympathetic and understanding approach to this application since most of the residents directly involved are maturing people who moved to this area for a quiet life.
