    Menomonee Falls VillageManager Mark Fitzgerald providedthe most thorough explanation of thevillage's actions regarding the devel-opment of the Radisson Hotel during apresentation at the May 6 VillageBoard meeting.

    The village provided financing forthe construction of the hotel throughthe approval of $17.65 million in gen-eral obligation bonds in April 2010. To

    date, $1.2 million of that has beenpaid. The hotel opened in May 2011but went into receivership in November2011. The village is currently in litiga-tion against the remaining owner of theLodging Investors of Menomonee Fallsgroup. The village is seeking to fore-close on the property and force a sale.

    Fitzgerald emphasized that taxincrement, the value of the hotel andthe operating revenue there-on wouldsupport this hotel and it would neverbe burden or an impact to the generalproperty taxpayer through the generallevy. We said that, and we shouldhave been saying it every two weeks,frankly.

    The history

    Fitzgerald provided the history

    behind the development of the hotel,noting that he sought to avoid issuesrelated to ongoing litigation betweenthe village and the current ownershipgroup.

    Fitzgerald started by explainingthat when he started as village manag-er in March 2007, the Village Boardmade it clear to him that redevelop-

    Fitzgerald noted that a hotel that loses aational franchise loses 30 to 50 percent of

    value, which is what happened to the Fallsn by spring 2007.

    Those corridors, frankly, were ripe withight and disinvestment, Fitzgerald said.he vacancy levels were high and, frankly,r a community like Menomonee Falls, theea was in sorry shape.

    Fitzgerald believed the blight was chron- in those areas, which is why it was priori-to reclaim that area.

    While the village had an overall plan iteated in 2006, it later decided to focus ondeveloping the hotel and the grocery storee. In addition, the industrial properties

    orth of Roosevelt Drive were split off into aparate tax incremental finance district for

    evelopment.Fitzgerald explained that in April 2008

    e village entered into an agreement with ave-member hotel ownership group for theotel to renovate the site, and a tax incre-ental finance district was approved for theea.

    However, a nationwide banking crisis ine fall of 2008 made it difficult for the hotelwnership group to secure private financing.zgerald said the failure to secure financingas not based on the project or the villagele in it, it was really based on the recession

    nd the almost complete banking collapseat we remember very well.

    In the meantime, the hotel owners hadarted to deconstruct the hotel, so that is wasbeled by residents as the "Baghdad Hotel."

    It was an eyesore, it was an embarrass-ent, he said.

    Fitzgerald said the village was left with aeconstructed hotel and banks that werentnding during the worst banking crisis sincee Great Depression. By the fall of 2008, itecame clear that to village officials that pri-ate financing wasnt going to be provided.e village came to the conclusion after 16

    onths of working the hotel ownership groupattempting to seek financing.Fitzgerald said that discussions occurred

    thin the village regarding the next option.I will tell you this: The idea of the village

    eing the financial lender for the hotel was ast resort, not a first resort. That decision wasade perhaps, and all of you (the Villageoard) could answer this yourself, with asuch trepidation, as much concern, as muchnawing at the gut of probably any decisionat you made while you served as trustees ofe village, Fitzgerald said.

    Fitzgerald said that the board faced theospect that if the hotel property wasntdeveloped, the redevelopment of the rest ofe Main Street area wasnt likely to occur.dditionally, Fitzgerald said that there wasways the fallback that if the village did the

    an and for some reason things didnt workut quite the way it would, it could alwaysvert back to a tax increment finance dealnd be supported through that mechanism.

    Those factors are what prompted the vil-ge to issue general obligation notes for the

    onstruction of the hotel on behalf of a five-ember hotel group that had a certified netorth at the time of $25 million.

    Village President Randy Newman, relay-g a comment he has heard from people ine community, asked why the village didntecide to knock down the remaining hoteleleton.

    Fitzgerald said that government agenciesave to pay a highest and best use foroperties through the condemnation

    process.Public acquisition is sort of a last resort

    because we will pay more than what the mar-ket will bear because we have to pay, bystatutory authority, an appraised value that isbased on the highest and best use,Fitzgerald said.

    Fitzgerald said it would have cost $8 mil-lion to raze the remaining skeleton of the oldhotel with a $1 million deconstruction value.

    The numbers never worked. That nevermakes any sense, Fitzgerald said.

    Fitzgerald then added: We believe andstill believe, and the market study believes, Ithink the data takes us there: That can be asuccessful, long term hotel.

    Fitzgerald cited figures showing that theprevious hotel was valued at $1.8 million in2006 whereas the current facility is valuedjust under $9 million. The current facility isprojected to bring in $2,999,136 of taxincrement.

    The presentThe village and the ownership group

    agreed to enter into receivership byNovember 2011 to protect the value of thehotel. Since then, the village initiated actionagainst the hotel ownership group.Fitzgerald said the space in the story is due

    to litigation issues.Fitzgerald said the village is proceedingwith the foreclosure, but the owner can repaythe debt and retain ownership of the facility.

    The owners own it, they have a right topay off the debt, Fitzgerald said.

    During questioning, Fitzgerald addressedcomplaints by contractors and subcontractorsthat they have not been paid.

    Fitzgerald said there were 53 contractorsand subcontractors for the construction, andthey have been paid in varying amounts. Hesaid the Village Board has remained commit-ted to seeking a process through which thecontractors and subcontractor can be paid.

    That is not a simple issue, he said.Fitzgerald said the village attempted vol-

    untarily negotiations last summer which didnot result in a resolution. He said the Village

    Board, as a matter of policy, wants to see ifthere is a legal means possible to pay thesubcontractors in a way that also creates afull and free release to the ultimate sale of thehotel.

    Fitzgerald said the village controls theconstruction fund of the hotel, which wasdrawn down for proof of work. There are stillfunds in the account and it is the villagesplan to use the funds to pay liabilities of thehotel as necessary through the point of fore-closure and redemption. It is our strong beliefthere is enough funds to do that and neverhave this be a liability on the general levy ofthe general taxes of the village.

    When asked, Fitzgerald said that villagepayments for such things a payroll came fromthat account, which is segregated from othervillage accounts. He later said the village

    made a payment on the franchise fee to pro-tect the value of the hotel.Fitzgerald said that once the hotel is sold,

    the village will use principal reduction pay-ments, sale proceeds to pay off the hotel andtie down the debt.

    In response, Newman recalled what theMain Street area near Hwy. 41/45 lookedlike several years prior to the redevelopmentefforts.

    I dont think thats arguable, that thearea looks a lot better, and it has greaterprospects that it has had in the probably thelast 20 years, Newman said.

    During additional questioning, Fitzgeraldindicated that the village has been limited in

    its responses to comments about the issuesince there is ongoing litigation.

    I think we need to start shouting back,tonight maybe starts that shouting back,Fitzgerald said. I think we have been wrong-fully silent because of the litigation.

    Fitzgerald added when the day is donewe have a hotel that I believe is an asset.

    Not convincedSteve Welcenbach, president of the

    Menomonee Falls Taxpayers Association,was at the Village Board meeting for thepresentation. Afterward, Welcenbach wasless than convinced by the villagesapproach to redevelopment in the area.

    Youre saying theres no other way itcould have been done? Welcenbachasked. Im saying there could have been abetter way that would not have put (the vil-lage) at risk.

    Welcenbach said he would have pre-ferred if the village razed the old hotel andsold the property to a developer.

    A new fitness facility at the Colonial Plazain Menomonee Falls will be the first step in aredevelopment of the mall, according to infor-mation presented at the May 7 MenomoneeFalls Plan Commission meeting.

    The mall is located along AppletonAvenue just south of Roosevelt Drive.Somerstone LLC, which recently entered into a

    contract to purchase the mall, has requested aconditional use permit to allow for a 24-hourfitness facility at the mall.

    During the Plan Commission meeting,Director of Community Development MattCarran disclosed that a Planet Fitness is pro-posed for the space currently used by theSalvation Army store. The Salvation Armywould relocate to an adjacent space in themall.

    In addition to Planet Fitness, Somerstonehas indicated its intent to revamp the mall overa two-stage process, with the first step involvingthe new fitness center and the move of aSalvation Army to other space.
