I. NO ALABAMA COURT HAS SUBJECT-MATTER JURISDICTION

REGARDING ANY MATTER CONCERNING THE RE-ELECTION OF

PRESIDENT BARACK OBAMA.

I n November 2012, P r e s i d e n t B a r a c k Obama was r e - e l e c t e d

P r e s i d e n t o f th e U n i t e d S t a t e s o f A m e r i c a . As a c k n o w l e d g e d

b y M c l n n i s h and Goode, t h e e l e c t o r s d u l y v o t e d i n December

and, as t h e w o r l d knows. P r e s i d e n t Obama was i n a u g u r a t e d i n

J a n u a r y 2 013, Now, however, M c I n n i s h and Goode i n v i t e t h i s

C o u r t t o e x c e e d t h e s c o p e o f i t s j u r i s d i c t i o n b y a d d r e s s i n g

m a t t e r s c o n c e r n i n g t h e c o n d u c t o r r e s u l t s of th e November

2012 e l e c t i o n . T h i s C o u rt s h o u l d d e c l i n e t h e i n v i t a t i o n .

P r e s i d e n t Obama a p p e a r e d on the Alabama b a l l o t as t h e

nominee o f th e D e m o c r a t i c P a r t y . The e l e c t i o n was h e l d and

t h e r e s u l t s were c e r t i f i e d l o n g ago. A l t h o u g h a l l o f

Alabama's e l e c t o r a l v o t e s were c a s t , c o n s i s t e n t w i t h t h e

p o p u l a r v o t e , f o r t h e nominee of th e R e p u b l i c a n P a r t y , a

m a j o r i t y o f t h e n a t i o n ' s e l e c t o r a l v o t e s were c a s t f o r

P r e s i d e n t Obama and, t h u s , he was r e e l e c t e d . He has been

i n a u g u r a t e d a n d w i l l s e r v e as t h i s c o u n t r y ' s p r e s i d e n t

u n t i l J a n u a r y 2 017. T h e r e i s a b s o l u t e l y n o t h i n g t h a t any

Alabama c o u r t ca n do t o change t h i s r e a l i t y . Thus, any

a c t i o n a c o u r t m i g h t t a k e w o u l d be o f no meaning o r e f f e c t .

F i n a l l y , t h e o b j e c t o f M c l n n i s h a n d Goode's s c o r n ,

P r e s i d e n t Obama, c a n n o t be e l e c t e d a g a i n t o t h e o f f i c e o f

P r e s i d e n t . Amendment X X I I , S e c t i o n 1, of t h e U n i t e d S t a t e s
