More on Proposal to ‘Update’ California’s

Tax System

As I reported several weeks ago, Senator

Bob Hertzberg has introduced SB 8 with the

goal of addressing/reforming California’s tax

system. Several of my lobbyist colleagues

and I met with the senator yesterday

afternoon to discuss his proposal which is

summarized below.

The takeaway from the meeting, California

has transformed to become a ‘service

economy’. California business now generates

80% of its gross revenues through the myriad

services it provides. Senator Hertzberg

stressed that the current tax system has

become woefully inadequate because of its

method of relying on capital gains.

In recognition of this problem, he has

introduced SB 8 in order to begin the dialog.

He emphasized that “everything is on the

table” and that “nothing is set in stone” in

terms of his proposal. He understands that IF

changes are ultimately made to the existing

system, it will likely take several years to

achieve. Besides having to pass muster in

the Legislature and with the governor, the

proposal would also have to be approved by a

two thirds vote of the public.

In any event, following are the highlights

of the proposal followed by a summary.

Both were provided to us in yesterday’s

meeting. Bear in mind that all services, from

construction to third-party administrators

would be affected if this change in the tax

structure were to become law.

Highlights of SB 8 (Hertzberg) “The Upward Mobility Act”1. Expands the state portion of the

sales tax to all services; exempting

the following:

a. Health care services.

b. Education services.

c. Businesses with under $100,000 in

gross sales.

2. The bill anticipates raising $10 Billion in

new revenue to be allocated as follows:

a. $3 Billion to K – 14 education.

b. $2 Billion to UC and CSU evenly

split between the two systems.

c. $3 Billion to local government.

d. $2 Billion to a new earned income

tax credit.

3. The measure also proposes to evaluate

the corporate income tax, while at the

same time linking changes to a more

reasonable minimum wage.

4. The measure also proposes to examine

the impacts of lowering and simplifying

the Personal Income Tax. The bill states

that it is its goal to reduce the PIT for low

and middle class income households so

that families earning $100,000 pay only

$1,000. The bill goes on to state that the

PIT for top earners may also be reduced,

balancing fairness and mitigating

adverse impacts to state revenues and

competitiveness. Prop. 63 (Mental

Health Services Act) obligations on top

income earners would not be affected.

residents. Senate Bill 8 updates California’s

tax system to reflect modern economic

activities, including information and

services. SB 8 starts by broadening the sales

tax base to include services. The bill also

considers changes to corporate taxes that

enhance the business climate and incentivize

entrepreneurship; such changes would

be linked to providing a more reasonable

minimum wage. Finally, SB 8 reduces

personal income taxes (PIT) with an aim

toward equality and investment in the

future. Additional revenues would be used

for higher education, K-12 education, and

local infrastructure projects. The goal is to

move beyond short-term budget balancing

measures to a vision for California that

shapes its tax system.

ISSUEStrategic, long-term investments in

infrastructure and education from the 1950s

and 1960s paid off as California grew to

be the fifth largest economy in the world.

However, as state and local budgets became

intertwined, long-term investments receded.

The state’s financial commitment to K-12

waned and by 2011, ranked 43rd nationally in

per pupil spending. The state’s commitment

to higher education also receded, including

for California’s community colleges, the

largest provider of workforce training in the

nation.

The underlying problem is that, while

California’s economy evolved, its tax system

failed to keep up. Over the past 60 years,

California moved from an agriculture- and

manufacturing-based economy to a services-

based economy. State tax revenues thus

became more reliant on PIT, especially those

of its top earners, leading to dramatic revenue

swings.

As a result, services like health care and child

care for low-income families faced budget

cuts at a time when they were most needed

(during the recession). In addition, the state

cut billions of dollars to education, including

adult vocational and literacy education, which

could help low-income families recover from

the economic downturn.

Further, our inability to fund new

infrastructure and education investments has

diminished opportunities for Californians

and fuels the growing income inequality in

our state. A modern tax system that is based

on the 21st century economy is needed and

must ensure that new revenue is invested to

help all California residents.

SB 8 (HERTZBERG)

The Upward Mobility Act proposes three

broad changes to the tax code. SB 8 proposes

to broaden the tax base by imposing a tax

on services. SB 8 also examines the current

corporate tax structure to incentivize both

business investment and a more reasonable

minimum wage. Finally, SB 8 adjusts

personal income taxes in a way that balances

fairness with state revenues. These latter

provisions would be phased in only when it

is clear that new revenues from the service

taxes are sufficient to replace revenues lost

by changes to the PIT and corporate tax and

are sufficient to provide low-income workers

with an Earned Income Tax Credit.

Bill to Further Regulate and Penalize

Excavation Introduced

Over the years I have been working with

the utilities, the state regulatory agencies,

contractors and other excavation stakeholders

to address the serious issue of excavators

who do not call to have their sites properly

marked before excavating and myriad

other related matters, such as mis-marks

by utilities (or failure to mark despite being

requested through Dig Alert) and ensuring

that excavators are properly compensated for

lost time, damaged equipment and injured

employees, and on and on. So too, Cal

Trans has been exempt from the provisions

of the law up until now – why? Ditto with

homeowners – why???

These and so many more issues are now

formally contained in a bill that came into

print this morning, SB 119 (Hill). Below are

highlights of the bill and I have also attached

an actual copy of the bill with this update. I

is ‘on the table’ for discussion. There will be

many hours of meetings and hearings before

anything clears the Capitol. I should also

stress, that in meetings held on the proposal

at the Capitol yesterday, I was appointed to

three sub groups that will look at all aspects

of the proposed legislation and assist with

ensuring that the measure is fair and protects

all interests groups from unfair provisions.

Following are highlights of the bill:

• Existing law vests the Contractors’ State

License Board with all functions and

duties relating to the administration of

The Contractors’ State License Law.

Existing law authorizes the issuance of

licenses to applicants for contractors’

licenses by written examination under

rules and regulations adopted by the

board.

This bill would require the board to adopt a

program to enforce violations of provisions

relating to excavation. The bill would

authorize the board to require a contractor to

undergo training, levy a fine, and suspend a

contractor’s license for a violation.

• Existing law requires every operator

of a subsurface installation, except

the Department of Transportation, to

become a member of, participate in,

and share in the costs of, a regional

notification center.

• Existing law requires any person

who plans to conduct any excavation

to contact the appropriate regional

notification center before commencing

that excavation, as specified.

• Existing law defines a subsurface

installation as any underground

any underground pipeline, conduit,

duct, wire, or other structure, except

nonpressurized sewer lines, storm

drains, or other drain lines.

• Existing law requires an operator of a

subsurface installation, who receives

notification of proposed excavation

work, within 2 working days of that

notification, excluding weekends and

holidays, to mark the approximate

location and number of subsurface

installations that may be affected by

the excavation or to advise that no

subsurface installations operated by him

or her would be affected.

• Existing law requires an operator of a

subsurface installation that has failed to

comply with these provisions to be liable

to the excavator for damages, costs, and

expenses.

This bill would declare the need to clarify

and revise these provisions. The bill would

define and redefine various terms relating

to a regional notification center. The bill

would instead define a subsurface installation

as an underground or submerged duct,

pipeline, or structure. This bill would also

delete the exception for the Department of

Transportation. The bill would require an

excavator planning to conduct an excavation

to delineate the area to be excavated before

notifying the appropriate regional notification

center of the planned excavation, as provided.

The bill would require an operator to

maintain and preserve all plans and records

for any subsurface installation owned by that

operator as that information becomes known,

as specified.

This bill would prohibit an excavator that

damages a subsurface installation due to

an inaccurate field mark, as defined, by an

operator from being liable for damages,

replacement costs, or other expenses arising

from damage to the subsurface installation,

provided that the excavator complied with the

provisions described above. The bill would

also require, in any action for reimbursement

or indemnification for a claim arising from

damage to a subsurface installation in which

the court or arbitrator finds that the excavator

complied with those provisions, the excavator

to be awarded reasonable attorneys’ fees and

expenses.

The bill would delete the existing

exemptions pertaining to an owner of real

property and would instead exempt an

owner of residential real property who

only uses non-mechanized hand tools for

excavation work not requiring a permit

on his or her residential real property that

has no easement or right of way.

• Existing law authorizes the Occupational

Safety and Health Standards Board to

adopt and to publish occupational safety

and health standards.

This bill would require the board, on or

before January 1, 2017, to revise these

provisions to clarify best practices to be

used by excavators when excavating near

subsurface installations. The bill would also

require the board to convene an advisory

committee hearing to seek input from

operators, regional notification centers,

labor, and excavators on best practices to

be used for excavating in urban areas, the

appropriate frequency of potholing, and other

best practices developed by various industry

associations.

This bill would create the California

Underground Facilities Safe Excavation

Authority. The bill would require the

authority to enforce laws relating to the

protection of underground infrastructure

by hearing complaints and assessing civil

penalties for violations of these provisions.

The bill would also authorize the Public

Utilities Commission and the Office of the

State Fire Marshal to enforce the requirement

to locate and field mark subsurface

installations and lines against operators

of natural gas and electric underground

infrastructure and hazardous liquid pipelines,

unless these operators are municipal utilities.

The authority would be composed of 9

members who would serve 2-year terms.

The bill would authorize the authority to

use compliance audits and investigations in

enforcing these provisions and furthering

its purposes. The bill would require the

authority, on or before January 1, 2017, and

each year thereafter, to report to the Governor

and the Legislature on its activities and any

recommendations.

Contractors State License Board Issues 1,000,000th Contractor LicenseMilestone reached 85 years after first license

issued

The nation’s largest industry* reached a

milestone in California over the weekend as

the Contractors State License Board (CSLB)

issued its one-millionth contractor license.

License 1,000,000 was issued on Saturday,

January 10, 2015, to a tree service company

in Norwalk (Los Angeles County).

“This milestone says a lot about the

resiliency of the construction industry,”

said CSLB Registrar Cindi Christenson.

“Despite ups and downs in the marketplace,

this industry is a major reason the state has

thrived, especially during the past century,

and why California is the envy of many other

states and countries. Construction has helped

our state though a depression, economic

downturns, wars, natural disasters, and many

other challenges.”

CSLB was created on August 14, 1929,

with the support of the state’s construction

industry, so the public would be protected

from irresponsible contractors. CSLB began

as the Contractors’ License Bureau under the

Department of Professional and Vocational

Standards. The Department had complete

control over Bureau operations.

The Bureau changed into its current

Board format on September 15, 1935,

enabling appointed industry representatives

to have a say in the state’s construction

industry regulations. Today, CSLB is a

semi-autonomous board within the state

Department of Consumer Affairs.

The law that created the Board also

defined three contractor categories that

remain in effect today. They are “A”

General Engineering, “B” General Building,

and “C” Specialty contractors. In 1939,

those categories evolved into the original

license “classifications” and CSLB also

began to examine applicants on their trade

qualifications.

Beyond building homes and major

infrastructure and transportation systems,

California’s construction industry was

especially robust in the mid-1940’s after

the end of World War II, and produced

remarkable and iconic structures during

the 20th century that include the California

aqueduct; dozens of bridges, among them

the Golden Gate and Bay Bridges; multiple

Legislative Analyst’s Office Issues ‘Overview of Governor’s BudgetThe 2015-16 Budget: Overview of the

Governor’s Budget

In the Governor’s 2015-16 budget proposal,

the administration raises its revenue

estimates, and this results in a multibillion-

dollar influx of new funds for schools and

community colleges under the Proposition 98

minimum funding guarantee. The Governor’s

plan identifies cost pressures and budget

risks in health and human services programs,

and new program commitments outside of

Proposition 98 are limited. The Governor’s

proposal to pay off the state’s retiree health

liabilities over the next few decades would, if

funded, address the last of state government’s

large unaddressed liabilities.

We conclude the state likely will collect

more tax revenue in 2014-15 than the

administration now estimates. Barring a

sustained stock market drop, an additional

2014-15 revenue gain of $1 billion to $2

billion seems likely in addition to the

Governor’s budget projection. Even bigger

gains of a few billion dollars more are

possible in 2014-15. These additional 2014-15

revenues will go largely or entirely to schools

and community colleges and could result in

a few billion dollars of higher ongoing state

payments to schools. Whether tax revenues

grow further, stagnate, or, in the worst case,

decline in 2015-16 will depend in large

part on trends in volatile capital gains and

business income.

If you think the same thing as our Arizona

solar contractor about new TPT rules,

you could also be stuck between a ‘ROC

and a hard place.’ Sometimes vague

statutes written into law can be subject to

misinterpretation or implications never

intended. Time has run out for another

contractor, so don’t let this happen to you…

Q: We have several Home Improvement

Salespeople (HIS) registered on our license.

I am the Responsible Managing Employee

(RME) on the license and my boss recently

suggested that I should register as a Home

Improvement Salesperson since I sell and

negotiate products as well. Is this required even

though I’m the RME on the license?

A: No, you are not required to register as a

Home Improvement Salesperson. The official

personnel listed in the CSLB’s records for

the contractor’s license are exempt from the

requirement to be registered. This includes

individual contractors, Qualifying individuals,

Partners, Officers of a corporation, and

Responsible Managing Employees (RME’s).

Q: You helped us get our Arizona license last

year and I received a renewal form from the

AZ Department of Revenue for our Transaction

Privilege Tax (TPT) number and noticed that

there is a new rule for contractors effective

1/1/15. It states:

“If you are a contractor whose only business

is to enter into contracts with the owner of

real property for the maintenance, repair,

replacement or alteration of existing property,

beginning January 1, 2015, you do not need to

have a TPT license.”

We only do solar sales and installation, so does

that mean that we do not need to renew?

A: While the notice certainly implies that you

do not need to renew your TPT license, that

notice is misleading. The Arizona Registrar of

Contractors (ROC) still has a statute in place

that requires all applicants and licensees to

provide them with a TPT to obtain or renew a

contractor’s license. According to the ROC’s

website “the ROC has asked the legislature to

make these laws more consistent by removing

this TPT requirement. Until this change is

made, contractors should maintain their state

TPT license.”

Q: Our Qualifier left the company some time

ago and just recently notified the CSLB by

disassociating from the license. Because he left

over 90 days ago, our license was automatically

suspended.

We have an application in progress with a new

Qualifier but he hasn’t even been scheduled

for an exam yet. Is there any way to get

an extension? If yes, how do we go about

requesting that?

A: In many cases the CSLB will grant you

a one-time 90-day extension to replace your

Qualifier. However, it is unlikely that you

will be approved for this request due to the

fact that your license is already suspended. If,

for instance, you were within your initial 90

days and you submitted your new Qualifier

application along with a request for a 90-day

extension, the CSLB would likely approve it.

Q: We are making a company banner and

want to know if there is a size violation if the

contractor number is too small on the banner?

A: While the CSLB does have regulations

about font size when displaying your name and

license number on company vehicles, I am not

aware of any regulation for font size on banners.

Carbon Monoxide

Carbon monoxide is a deadly poison.

Carbon monoxide (CO) is a colorless, odorless gas produced whenever carbon burns. When breathed, CO takes oxygen from the bloodstream. Oxygen-deprivation is damaging to vital organs and often fatal. CO can build up enough in an enclosed space to kill a person within minutes. Victims of CO poisoning can survive if the symptoms are recognized early and immediate action is taken. If not detected promptly, irreversible damage can occur to the heart or brain; death is not an unlikely outcome if CO poisoning is not dealt with and treated promptly.

In order to protect yourself and others from poisoning, learn the risks for CO buildup and take preventative measures. Sources of CO:

Substances containing carbon give off CO when burned, such as:

• Gasoline • Natural gas • Oil • Propane • Coal • Wood A common source for CO is the exhaust of an internal combustion engine. Other sources that can generate CO include generators, stoves and lanterns. Workers who use gas-powered tools are at risk. Symptoms of poisoning: High levels of CO inhalation can cause loss of consciousness and death. Unless suspected, CO poisoning can be difficult to diagnose because the symptoms mimic symptoms of other illnesses.

• Dizziness • Headache • Drowsiness • Nausea or vomiting • Weakness • Confusion and paranoia • Difficulty breathing • Collapse

Preventative measures:

• Check your workplace and home for CO sources and potential sources.

• Monitor the air. − Conduct regular tests. − Use personal CO monitors when CO is a risk. These must be equipped with an

alarm to warn when CO levels have risen too high. − Levels must stay at or below 50 parts per million.

• Educate workers about CO poisoning. They should be alert for symptoms and know to immediately report them. They should also know the common sources, and the safe use of any CO-producing equipment.

• Do not operate internal combustion engines indoors. For example, do not leave your car running in a garage.

• If internal combustion engines are required indoors due to an emergency situation, everyone indoors must wear respirators.

• If you need to use a fuel-burning tool indoors: − Use equipment that can separate the CO producing unit from the tool. Put the

engine outdoors, away from any sources of ventilation into the building, and use the exhaust-free part of the tool indoors.

− If it is possible and safe for the task, substitute electric-powered tools for gas-powered tools.

• Ventilate the area. This requires more than simply opening windows or using a fan. Ventilation should be professionally installed.

• Any equipment producing CO should be well maintained. If poisoning is suspected:

• Turn off the equipment. • Move the affected people into fresh air. • Keep them warm. • Call 911. • If they are not breathing, administer

cardiopulmonary resuscitation (CPR). • No one with symptoms of CO poisoning should

drive. • If CO poisoning occurs inside a building, have the

CO levels checked before anyone returns. • Rescuers may be exposed to fatal levels of CO,

and should be fully trained and prepared for the situation.

In the event of an emergency, our first responders will be overwhelmed. It is critical for citizens to be prepared to take care of themselves, their neighbors, and their community for at least 3 days, and preferably 5-7.

ReadyMarin.org is Marin County’s website for information on emergency preparedness, whether you are just learning or an experienced emergency volunteer. For those of you who wish to step beyond preparing your home and reach out to help your community in an emergency, train to be a Community Emergency Response Team (CERT) member.

A well-established construction company based in San Rafael, family–owned and operated for 100 yearsis seeking a hard working, orientated Bid Administrator (BA).

The BA is a central part of the Estimating Team and is primarily responsible for acquiring, preparing and submitting bid documents. The BA is the liaison between Owners and the Estimators where bid documents and procedures are concerned as well as between Estimators and the Bid Runner on bid days. The BA is directly responsible for the preparation of, and the expeditious flow of, documents (pre-qualification packages, project advertising, bid database maintenance, bid documents, bid bonds, etc.) to ensure timely and complete bid submittalpackages. The BA is responsible for all initial and follow-up DBE outreach, and documentation of GBI’s Good Faith Efforts. The BA ensures all documents are prepared accurately, completely and neatly in accordance with bid solicitation requirements. This position reports to the VP of Estimating.

Qualifications:• Minimum 5+ years administrative experience with construction knowledge a plus• MS Office (Word, Excel, PowerPoint, Outlook)• Must be able to work under pressure and meet deadlines.• Excellent organizational and project coordination skills

Construction industry knowledge is preferred and Timberline/Sage300, HCSS and Viewpoint software use a major plus.

A well established construction company based in San Rafael, family–owned and operated for 100 years is seeking a hard working, orientated Bid Administrator (BA). The BA is a central part of the Estimating Team and is primarily responsible for acquiring, preparing and submitting bid documents. The BA is the liaison between Owners and the Estimators where bid documents and procedures are concerned as well as be-tween Estimators and the Bid Runner on bid days. The BA is directly responsible for the preparation of, and the expeditious flow of, documents (pre‐qualification packages, project advertising, bid database maintenance, bid documents, bid bonds, etc.) to ensure timely and complete bid submittal packages. The BA is responsible for all initial and follow-up DBE outreach, and documentation of GBI’s Good Faith Efforts. The BA ensures all documents are prepared accurately, completely and neatly in accordance with bid solicitation requirements. This position reports to the VP of Estimating.

QUALIFICATIONS:

• Minimum 5+ years administrative experience with con-struction knowledge a plus

• MS Office (Word, Excel, PowerPoint, Outlook)

• Must be able to work under pressure and meet deadlines.• Excellent organizational and project coordination skills

Project, Primavera P3 and Expedition.• Strong organizational skills, ability to prioritize work as-

Dutra is currently looking for an Estimating Administrator. This position supports the Estimating Department. Successful applicant will be re-sponsible for distributing, organizing and maintaining bidding documents such as plans, specifications, addenda and quotes. Will also work to support the Chief Estimator and Proposal and Contracts Manager in preparing estimates, proposals, Statement of Qualifications and marketing materials. Additionally, will assist the Contract Administrator with bonds, contracts and tracking SBE participation.

ESSENTIAL DUTIES AND RESPONSIBILITIES:• Distribute, organize and maintain bidding documents including printing, copying, filing and tracking distribution.• Assist in the preparation of estimates, proposals, SOQs and marketing materials.• Assist in the preparation of contract documents, bond requests and Small Business Enterprise (SBE) requirements and goals.• Keep accurate records of SBE participation.
