Congressman Jared Huffman presented the award to Ghilotti Bros. at San Rafael Chamber of Commerce event held in front of the company’s headquarters on 525 Jacoby St. San Rafael, CA 9490. Congressman Huffman spoke to Ghilotti Bros. continued work as good stewards in the community through consistent support of local charities and organizations, completing much needed road and construction work with integrity, and remaining a strong and good employer for Bay Area workers. Mayor Gary Phillips also honored the company at the event with a proclamation. Mayor Phillips cited the remarkable feet of a family business staying sustaining over three generations and for 100 year. He also remarked on Ghilotti Bros. having donated over $10 million dollars to charities and non-profit organizations in Marin County. Mayor Phillips proclaimed August 13, 2014 to be Ghilotti, Bros. Inc Day. Mike Ghilotti expressed gratitude for the recognition and pride in his company, “GBI is extremely proud to receive these proclamations on our 100th anniversary acknowledging our commitment to our founder’s philosophy of “doing good work, treating our employees with respect, and giving back to the community in which you live and work.” Photo Credit: Trevor Henley

Project Description:Work will include asphalt concrete resurfacing, asphalt concrete grinding, concrete sidewalk, concrete curbs, curb ramps, vegetation removal, raising utility covers, landscaping, irrigation, signage, lighting, and other park amenities on a multi-use pathway in southern Marin County. The work will also require construction of a temporary by-pass pathway, construction area signs, and fencing. Construction will take place during the daytime hours with traffic control of bicyclists and pedestrians.

The Engineer’s Estimate for the base bid for this project is $310,000.

The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.

Water damage sucks, but is a contractor’s license required to just vacuum it up? Our friends ‘in high places’ will appreciate another question and the answer that is ‘on the house’ as we also clarify rules on Nevada licensing in this edition…

Q: My client is a water damage restoration company. They only do extraction and drying (no alteration or repair work at all) specifically to avoid having to have a contractor’s license. Do you have any authority that explains that water damage restoration companies are not required to have a contractor’s license in CA under B&P code 7026?

A: Thank you for contacting Capitol Services. There is nothing in B & P Code 7026 that directly relates to water damage restoration companies. However, if your client is simply removing water and drying and not doing any further repairs or alterations, then a contractor’s license is not required. Some water restoration companies not only remove the water but they also then repair any damage (swelling, warping of floors, removal of mold or other hazardous materials, etc) as a result of the water damage, and in that case a contractor’s license would be required.

B & P Code section 7026 defines “contractor” as “any person who undertakes to or offers to undertake to, or purports to have the capacity to

undertake to, or submits a bid to, or does himself or herself or by or through others, construct, alter, repair, add to, subtract from, improve, move, wreck or demolish any building...”. This would not apply to a company that is simply using equipment to remove water from a structure and then dry the area.

Q: I have a roofing project that also includes mechanical work, electrical work (associated with the mechanical improvements), and structural work (also associated with the mechanical improvements). The mechanical costs are over 50% of the total project (when you take into account the “associated improvements”). At what point does this move from a “C-39” Roofing to a “B” General Building contractor? Is there a dollar amount cut off?

A: There is no dollar amount cut off, however if the majority of the project is mechanical work including electrical and structural then it would be more suited for a “B” contractor. A roofing contractor can only perform work that is incidental and supplemental to the overall roofing project. Basically, doing work in other classifications is only acceptable if it’s essential to accomplish the roofing project. However, the work in other classifications needs to be a small percentage of the overall roofing project. Again, there is no specified amount written in the statutes but in my opinion it sounds as if

the mechanical work you’ve described may be beyond your scope.

Q: You recently helped me obtain my Nevada General contractor’s license (“B-2”). I would like to have a “C-3” Carpentry license and also a “C-4” Painting license. Would I be required to take the trade exams? Also, do I need to take the Business/Management again?

A: Thank you for contacting us again. You would not have to take any exams! You already took the Business exam to obtain your “B-2” so that would not be required. Secondly, carpentry and painting are considered to be trades that are included in the “B-2” classification, and therefore you are considered pre-qualified for those classifications. This may be news to Nevada licensees, if so let us know how we can help you.

As part of a series on the role of the Safety Coach, this article focuses on laying the groundwork for the coaching process. Appropriate coaching is critical to behavior-based safety (BBS). Behavior-based safety is a systematic way to promote safety in the workplace. The goals of a behavior-based safety program:

• Creating a process that clearly defines a set of safe behaviors and work practices that reduce employees’ risks for injuries.

• Providing a way to consistently identify and reinforce safe work practices.

• Reducing at-risk behaviors to a near-zero level.

• Recognizing favorable behaviors.

• Correcting unfavorable behaviors when needed.

• Problem-solving to improve work practices. Create a coaching program:

Coaching is essential because maintaining the desired behaviors requires frequent, objective, and appropriate feedback.

Observations provide the objective data that makes coaching uniquely effective. Once observation checklists (as noted in a previous “Being a Safety Coach” training short) are finalized, make good use of them by developing your coaching program.

Identify the right coaches:

Considerations include:

• The availability of employees.

• How much training is required for the coaches to understand the applicable roles.

• Whether eligibility extends only to supervisors and leads.

Determine frequency of observations and coaching:

Daily or weekly coaching is the best way to support lasting behavior change. To decide the ideal frequency, first determine the risks associated with the jobs being observed. Provide training to coaches:

Be a Safety Coach (Part 3) – Coaching

Consider the existing skills and training needs of your possible coaches. For the Behavioral Safety process to be successful, coaches will need to be proficient in three areas. 1. Observation skill training:

Observation is foundational to evaluation; it is one of the most important skills a coach masters.

Does every coach see the same things? Look at the sentence in the box below; give yourself time to scan it well. Then, answer the question, “How many “F’s” are in the sentence?” The answer is located at the end of this document.*

How many “F’s” did you find? If your count is different than the “final answer”, look again.

Observation is not as simple as it seems. Many processes, pre-conceptions and beliefs can interfere. In the case of the exercise, the typical person doesn’t recognize the letter “F” in the word “of” because it registers as sounds like “ov.” We seem to have this pre-conceived notion that the letter “f” should sound like the “soft” “f” in the word finish. It’s a challenge. An effective coach takes into account similar kinds of challenges when observing. Coaches must be as objective as possible, observing what occurs with no preconceived notions, beliefs or judgments.

2. Observation-based coaching training:

Coaches must be able to:

• Give positive feedback.

• Have a constructive discussion about any observed safety concerns.

• Problem-solve regarding the safety concerns with the worker or workgroup. 3. Training for the role being observed:

Coaches need to understand the basic skills and roles of the employees performing the work tasks being observed.

*Answer to “How many F’s are there?”: Six!
