California’s State Legislature – Are We Finally on the Right Track for the Future?
Let me begin this year’s report on a note of optimism and hope for the future. The Capitol was a changed place for the better this year. Literally from January 3rd when I walked through the halls to begin the New Year, there was a very evident feel of optimism both in the air and in my introductory meetings with the myriad new legislators. And myriad they were indeed! The Assembly started the year with 38 new members (which will shortly grow to 41!). These “newbies” within the halls of the Capitol constituted the most freshmen since 1934! With a total population of 80 members in the Assembly, having almost half as new members IS significant.
In the Senate, things were a bit different in terms of numbers, but the feel of optimism was still evident. There were 10 new members starting this year, but 9 of the 10 “moved-up” from the Assembly, thus there was only 1 new member (which also has since changed with the election of another new freshman from the Central Valley and two additional moves from the Assembly). I should also add, since the Senate “only” has 40 members, this meant there was a 25% change of faces (which has now expanded to almost 33%).
So, what made for this feeling of optimism, particularly since both of the houses have a 2/3rds Democratic majority which in large part was due to “the help” provided by labor unions’ sizeable PACS? Simply, you can thank the voter-enacted reforms for the difference. To wit:
For the first time, California had an open primary system in which the top two candidates, regardless of party, advanced to November. Thus under the new "top two" open primary system, many runoff candidates last November were forced to compete for votes among a wider spectrum of the electorate. No longer could they depend on just the party core (whether it be liberal or conservative). Instead they had to appeal to independents and members of the other party – and that was particularly true of the 20 legislative contests in which two members of the same party had to run against each other. The result was CLEAR that more moderate candidates won in many more seats under this new primary system.
Candidates ran in districts drawn by a nonpartisan commission instead of by lawmakers protecting their own safe seats (called gerrymandering). Again, this was another factor that produced more moderation in who was elected.
Looser term limits. Allowed to serve 12 years in one house, new legislators aren't arriving in the Capitol searching for their next job.
Given the fact that suddenly these 38 freshmen didn’t have to start running for their next office beginning on January 3rd meant they could “smell the roses!” In other words, many told me in my introductory meetings that they had no interest in introducing bills in their first year! And, for many others, they explained that while they would introduce “some” bills, they too were

going to keep their “loads” to a minimum. While this may sound “sacrilegious” for elected officials to espouse, their reasoning was very valid thanks to the aforementioned voter-enacted changes. Why not “learn the ropes” for a year or so by being active in their respective committee assignments before even attempting to author bills?
There was also something else that was different that day which continued to play out throughout this year (and will hopefully carry on henceforth) – no budget deficit to battle over from day one. This can be credited to past cutting, a recovering economy and Gov. Jerry Brown's tax increase of last year for the elimination of this fight. Again, without this catalyst, “battle lines” were not drawn from the outset. So, what was the outcome of this year’s optimism and reduced load of bill introductions? Certainly there were “bad” bills introduced, but there weren’t nearly as many as years past and most didn’t even make it through the legislative process! And for the ones that did make it to the governor, he pared them down even more! What is particularly noteworthy was that while the labor unions’ hold on Sacramento is substantial, it was remarkable that the governor “held the line” as much as he did. While I will not include the bills that the governor vetoed, suffice to say there were many. Finally, while CEQA reform was attempted this year, it will be at least next year before we will see any meaningful reform. Following are highlights of key bills that were signed into law which affect YOUR business, sorted by topic:
Architects & Engineers
AB 630 (Holden) - Chapter 453, Statutes of 2013. - Architects. Current law defines what constitutes an architect’s professional services. This bill will provide that no person may use an architect's instruments of service without the consent of the architect in a written contract, written agreement, or written license specifically authorizing that use. The bill will prohibit an architect from unreasonably withholding consent to use his or her instruments of service from a person for whom the architect provided the services, except as specified. The bill will provide that this act is a clarification of existing law and does not take away any right otherwise granted by law. SB 679 (Berryhill) - Chapter 471, Statutes of 2013. – Professional Engineers & Land Surveyors: reporting requirements. Current law prohibits, in order to safeguard life, health, property, and public welfare, any person from practicing civil, electrical, or mechanical engineering, or land surveying unless appropriately licensed or specifically exempted from licensure, as specified. This bill will revise provisions to instead require a licensee to report to the Board for Professional Engineers and Land Surveyors the occurrence of any civil action settlement or administrative action resulting in a settlement against the licensee, as specified, if the amount or value of the settlement is greater

than $50,000, and any civil action judgment or binding arbitration award or administrative action resulting in a judgment or binding arbitration award against the licensee, as specified, if the amount or value is $25,000 or greater.
Building Standards
AB 56 (Weber) - Chapter 475, Statutes of 2013 - School facilities: carbon monoxide devices. Will require, by July 1, 2015, the State Fire Marshal to propose for adoption by the California Building Standards Commission, appropriate standards for the installation of carbon monoxide devices in public and private school buildings. AB 127 (Skinner) - Chapter 579, Statutes of 2013 - Fire safety: fire retardants: building insulation. Will require the State Fire Marshal, in consultation with the Bureau of Electronic and Appliance Repair, Home Furnishings, and Thermal Insulation, to review the flammability standards for building insulation materials, including whether the flammability standards for some insulation materials can only be met with the addition of chemical flame retardants. The bill will require, if deemed appropriate by the State Fire Marshal based on this review, the State Fire Marshal to, by July 1, 2015, propose for consideration by the commission updated insulation flammability standards that accomplish certain things, including maintaining overall building fire safety. AB 221 (Quirk-Silva) Chapter 154, Statutes of 2013. - Recycled concrete. Current law defines the term recycled concrete as including mix designs or aggregate gradations that are in accordance with certain specifications. This bill will revise the definition of recycled concrete for purposes of these provisions to additionally include, as one of those specifications, the California Green Building Standards Code. AB 341 (Dickinson) - Chapter 585, Statutes of 2013 - Green building standards. Will require the California Building Standards Commission and state agencies that propose green building standards to allow for input by other state agencies that have expertise in green building subject areas. The bill will require the process by which these other state agencies shall submit suggested changes for consideration to be adopted as administrative regulations that include certain elements. This bill contains other related provisions and other existing laws. AB 1092 (Levine) - Chapter 410, Statutes of 2013 - Building standards: electric vehicle charging infrastructure. Will require the California Building Standards Commission, commencing with the next triennial edition of the California Building Standards Code adopted after January 1, 2014, to adopt, approve, codify, and publish mandatory building standards for the installation of future electric vehicle charging infrastructure for parking spaces in multifamily dwellings and nonresidential development. The bill will require the Department of Housing and Community Development to propose mandatory building standards for the installation of future electric vehicle charging

infrastructure for parking spaces in multifamily dwellings and submit the proposed mandatory building standards to the commission for consideration.
Construction Defect
SB 652 (DeSaulnier) - Chapter 431, Statutes of 2013. - Real property disclosures: construction defect litigation. There is presently no statutory requirement that a homeowner notify a potential buyer of a construction defect within the home. For example, if a homeowner receives a cash settlement based on an alleged defect, the homeowner does not need to disclose the nature of the defect to the prospective purchaser or whether a repair was made. A potential buyer should be aware of this fact and know whether or not that defect has subsequently been repaired.
Contractors’ License Board/ Contractors AB 433 (Gordon) – Chapter 377, Statutes of 2013 – Plumbers Installing Residential Fire Sprinklers Authorizes licensed plumbing contractors to install residential fire protection systems for single- and two-family homes through January 1, 2017 AB 1057 (Medina) - Chapter 693, Statutes of 2013. - Professions and vocations: licenses: military service. Current law authorizes a licensee or registrant whose license expired while the licensee or registrant was on active duty as a member of the California National Guard or the United States Armed Forces to, upon application, reinstate his or her license without penalty and without examination, if certain requirements are satisfied, unless the licensing agency determines that the applicant has not actively engaged in the practice of his or her profession while on active duty, as specified. This bill will require each board (including CSLB), commencing January 1, 2015, to inquire in every application for licensure if the individual applying for licensure is serving in, or has previously served in, the military. AB 1236 (Hagman) - Chapter 114, Statutes of 2013 - Contractors: limited liability companies. One of the problems that contractors desiring to become licensed as a limited liability company have had is to obtain a $100,000 surety bond and a minimum $1 million general liability insurance policy for up to five employees, with an additional $100,000 of limited liability insurance coverage per additional employee not to exceed a total of $5 million. These policies had to be written by an insurer or insurers duly licensed by this state. This bill will additionally permit those policies to be written by an eligible surplus line insurer which should make the policies easier to obtain. SB 261 (Monning) – Chapter 163 of 2013 Statutes – Fraudulent Use of License This bill expands the Contractors’ License Board’s administrative authority to encompass additional instances when a licensed or unlicensed contractor has improperly or fraudulently

used a contractor’s license. This would permit the CSLB to punish the violation of general restrictions on license usage with warning letters, citations or fines, or even suspension or revocation of a contractor's license, without having to rely on local law enforcement. SB 262 /(Monning) – Chapter 180 of 2013 Statutes – RMO – Qualifying Individuals This bill requires the Responsible Managing Officer (RMO) qualifying on behalf of a firm to be responsible for exercising direct supervision and control as defined in CSLB regulations to secure compliance with the Contractors Law. It provides that a qualifier's failure to exercise direct supervision and control shall constitute a cause for disciplinary action and shall be punishable as a misdemeanor by imprisonment in a county jail not to exceed six months, by a fine of not less than $3,000, but not more than $5,000, or by both a fine and imprisonment.
Design/Build AB 195 (Hall) – Chapter 121, 2013 Statutes – Extension of Design/Build Authority This bill extends, from July 1, 2014 to July 1, 2016, the date on which the statutes authorizing counties to use the design-build contracting method expire.
Employer/Employee AB 10 (Alejo) - Chapter 351, Statutes of 2013 - Minimum wage: annual adjustment. This bill will increase the minimum wage, on and after July 1, 2014, to not less than $9 per hour. The bill would further increase the minimum wage, on and after January 1, 2016, to not less than $10 per hour. AB 263 (Hernández, Roger ) Chapter 732, Statutes of 2013 - Employment: retaliation: immigration-related practices. This bill will prohibit an employer from retaliating or taking adverse action against any employee or applicant for immigrant-related practices. The bill will provide that an employee who was retaliated against or otherwise was subjected to an adverse action is entitled to reinstatement and reimbursement for lost wages. The bill will subject a person who violates these provisions to a civil penalty of up to $10,000 per violation. AB 442 (Nazarian) – Chapter 735 Statutes of 2013 – Employee Wages This bill authorizes the Labor Commissioner to collect liquidated damages from an employer who pays an employee less than minimum wage. SB 288 (Lieu) – Chapter 756 of 2013 Statutes – Employment Protections: Time Off This bill provides that an employer may not discharge or in any manner discriminate or retaliate against an employee who is a victim for taking time off from work, upon the victim's request, to appear in court to be heard at any proceeding for the following offenses:
Vehicular manslaughter while intoxicated.

Felony child abuse likely to produce great bodily harm or a death. Assault resulting in the death of a child under eight years of age. Felony domestic violence. Felony physical abuse of an elder or dependent adult. Felony stalking. Solicitation for murder. A serious felony, such as kidnapping, rape, or assault. Hit and run causing death or injury. Felony driving under the influence causing injury.
For the purposes of this law, a proceeding includes any delinquency proceeding, involving a post-arrest release decision, plea, sentencing, post-conviction release decision, or any proceeding in which a right of the victim is at issue. It defines a victim as any person who suffers direct or threatened physical, psychological, or financial harm as a result of the commission or attempted commission of a crime or delinquent act. The term "victim" also includes the person’s spouse, parent, child, sibling, or guardian. SB 292 (Corbett) - Chapter 88, Statutes of 2013 - Employment: sexual harassment. Clarifies that, with respect to an employment-related sexual harassment claim made under the Fair Employment and Housing Act (FEHA), sexually harassing conduct need not be motivated by sexual desire. SB 390 (Wright) – Chapter 718 of 2013 Statutes – Failure to Remit Employee Wage Withholdings This bill provides that it is illegal for an employer to willfully or with the intent to defraud fail to remit withholdings from an employee's wages pursuant to local, state or federal law to the proper agency, and also provides that if an employer fails to remit $500 or more in wage withholdings, the employer's violation is a misdemeanor and shall be punishable by imprisonment in a county jail for a period of not more than one year, by a fine of not more than $1,000, or both. SB 435 (Padilla) – Chapter 719 of 2013 Statutes – Compensation: Meal and Rest or Heat Recovery Periods Sponsored by several unions, this measure will clarify how paid rest breaks and recovery periods (to comply with heat illness regulations) are to be compensated by employers when employees are paid on a piece-rate basis. Proponents argue that piece-rate workers, unlike their hourly or salaried counterparts, are often induced to work through their rest or recovery periods because they suffer a loss of income. They believe this bill is necessary to increase incentives for piece-rate workers to actually take their rest and heat stress recovery periods rather than "willingly" working through them to avoid losing money. SB 462 (Monning) – Chapter 142 of 2013 Statutes – Employment: Compensation Makes the award of attorney's fees and costs where the prevailing party is not an employee contingent on a finding by the court that the employee brought the court action in bad faith. SB 666 (Steinberg) – Chapter 577 of 2013 Statutes – Employment: Retaliation

This bill provides for a suspension or revocation of an employer’s business license for retaliation against employees and others on the basis of citizenship and immigration status, and establishes a civil penalty up to $10,000 per violation. SB 770 (Jackson) – Chapter 350 of 2013 Statutes – Paid Family Leave This bill expands the type of family members for whom an employee may seek wage replacement benefits under the Paid Family Leave (PFL) and does not place any new mandates on employers. This legislation will not go into effect until July 1, 2014.
Excavation
AB 811 (Lowenthal ) - Chapter 250, Statutes of 2013 - Excavations: regional notification center system: contractor certification. You may recall that the Public Utilities Commission and several legislators have been pushing legislation over the past two years that would significantly increase the fines for not calling Dig Alert before excavating. We were able to amend these efforts instead into AB 811 which is a data collection bill. Starting in January 0f 2014, utilities, excavators and other affected parties will be able to go online and file a report about an incident (for a contractor, he will have the opportunity to document that it was a utility’s fault due to mismarking or not marking in the first place). I will discuss this more in a future update when more information is available.
Land Use AB 116 (Bocanegra) - Chapter 62, Statutes of 2013 - Land use: subdivision maps: expiration dates. This bill will extend by 24 months the expiration date of any approved tentative map or vesting tentative map that was approved on or after January 1, 2000.
Public Works/Prevailing Wage AB 44 (Buchanan) - Chapter 258, Statutes of 2013 - Subletting and Subcontracting Fair Practices Act: bidding practices Starting on July 1, 2014 all contractors submitting bids to public agencies will have to list the contractor’s license number of all subcontractors whose bids are over ½ of 1%. If an error is found in the license number that is listed, a contractor will have 24 hours after the bid is due to correct the mistake. AB 164 (Wieckowski) – Chapter 94 Statutes of 2013 – Payment & Performance Bonds For P3 Projects Requires the use of payment and performance bonds in local government infrastructure projects that are financed through public-private partnerships (P3s). AB 1336 (Frazier) – Chapter 792 of 2013 Statutes - Prevailing wages: payroll records.

Existing law requires the Labor Commissioner, if the commissioner or his or her designee determines after an investigation that there has been a violation of the public works provisions, to issue a civil wage and penalty assessment to the contractor or subcontractor, or both. The assessment is required to be in writing, describe the nature of the violation and the amount of wages, penalties, and forfeitures due, and include the basis for the assessment. The assessment is required to be served not later than 180 days after the filing of a valid notice of completion in the office of the county recorder in each county in which the public work or some part thereof was performed, or not later than 180 days after acceptance of the public work, whichever occurs last. If the assessment is served after the expiration of the 180-day period, but before the expiration of an additional 180 days, and the awarding body has not yet made full payment to the contractor, the assessment is valid up to the amount of the funds retained. This bill will change the deadline for service of the assessment to not later than 18 months after the filing of a valid notice of completion in the office of the county recorder in each county in which the public work or some part thereof was performed, or not later than 18 months after acceptance of the public work, whichever occurs last. The bill will delete the provisions with regard to an assessment served after the expiration of the 180-day period. SB 54 (Hancock) - Chapter 795, Statutes of 2013 - Building Trades & Oil Refinery Work In a battle between the building trades and refinery workers’ union, the building trades won! This bill will extend prevailing wage requirements to private refinery construction, and also give union tradesmen first dibs on refinery jobs, elbowing aside members of the refinery workers union! SB 328 (Knight) – Chapter 517 of 2013 Statutes – Counties, public works contracts This bill, until January 1, 2018, allows a county, with the board of supervisors' approval, to use construction manager (CM) at-risk construction contracts for erecting, constructing, altering, repairing, or improving buildings owned or leased by the county. This bill provides that a county may use a CM at-risk construction contract only for projects in the county in excess of $1million, and allows a county to award the CM at-risk construction contract using either the lowest responsible bidder or best value method. Subcontractors are afforded the same protections they are provided in other provisions of the Public Contract Code. SB 377 (Lieu) – Chapter 780 of 2013 Statutes – Public Works – Project Determinations This bill requires the Director of the Department of Industrial Relations (DIR) to establish a new process to determine whether a project is a public work, upon the request of any party. It also provides that the period of service for assessments for prevailing wage violations shall be tolled for the period of time required by DIR to determine whether a project is a public work. The measure also provides that the period of service for assessments shall also be tolled for the period of time that a contractor or subcontractor fails to provide certified payroll records in a timely manner. It provides that these tolling provisions shall also apply to the period of time for commencing an action brought by a joint labor-management committee. It requires DIR to make

that determination within 60 days of receipt of the last notice of support or opposition from any interested party, but upon request for additional time can have an additional 60 days. SB 425 (DeSaulnier) – Chapter 252 of 2013 Statutes – Public Works Peer Review Act Allows a public agency that is principally charged with the administration, planning, development, and operation of a public works project (administering agency) to establish a peer review group of qualified persons to give expert advice on the scientific and technical aspects of the public works project. All peer review members will be required to provide a statement that authorizes a peer reviewer to conduct his or her duties under the charter impartially, without restriction or limitation, and in a manner the peer reviewer believes is necessary to appropriately review a proposed project; and, a statement that declares whether the members of the peer review group have signed a conflict of interest disclosure form that would identify real or perceived conflicts between a peer reviewer and the specified public works project. SB 776 (Corbett) – Chapter 169 of 2013 Statutes – Prevailing Wage Rates – Employer Payment Credits Establishes additional restrictions on credit granted against the obligation to pay prevailing wages for employer payments made to monitor and enforce public works laws. Specifically, it:
Prohibits credit from being granted for employer payments made to monitor and enforce law related to public works if those payments are not made to a program or committee established under the federal Labor Management Cooperation Act of 1978.
Provides that an employer may take credit for those specified employer payments, even if those payments are not made (or costs are not paid) during the same pay period for which credit is taken, if the employer regularly makes those payments on no less than a quarterly basis.
Tire Recycling
AB 513 (Frazier) - Chapter 499, Statutes of 2013. - Tire recycling program: rubberized asphalt. Will establish the Rubberized Asphalt Concrete Market Development Act and will require the Department of Resources Recycling and Recovery, in accordance with the tire recycling program, to award grants for certain public agency projects that utilize rubberized asphalt concrete.

Following is a brief description of each of our sponsored measures for 2013: AB 536 - (Wagner) – Two-Year Bill - The Prompt Pay statutes are turning into a mess of loopholes that prevent contractors from being paid what they are legitimately owed. They provide no relief to contractors against a sophisticated owner. Worse, they provide those owners with excuses for withholding more money due to a loophole within the existing statute. Section 7107 (e) of the Public Contract Code states: (e) The original contractor may withhold from a subcontractor its portion of the retention proceeds if a bona fide dispute exists between the subcontractor and the original contractor. The amount withheld from the retention payment shall not exceed 150 percent of the estimated value of the disputed amount. Unfortunately, "disputed amount" is not defined in the statute. How AB 536 Will Address the Problems AB 536 is intended to correct this major loophole in the current prompt pay statutes by defining three specific things which cannot be included in a disputed amount. This will ensure that the process is fair and equitable to all sides. The 3 specific things that the measure proposes are: 1). With respect to liquidated damages assessed by the owner, any amount in excess of the liquidated damages assessment. This provision addresses a problem construction attorneys have encountered in southern California: When a contractor protests against a liquidated damages assessment, some agencies have responded that the protest makes the amount of LDs a "disputed amount" for which the agency can withhold not just the amount of LDs, but 150% of the amount of LDs. The broad language of Martin Bros. appears to support this argument The first sentence in the pattern is designed to preclude such EXCESS withholding by saying that any withhold IN EXCESS OF the amount of LDs will NOT go into the safe harbor for protection against prompt payment penalties. Only the withhold for the actual amount of the LDs will go into the safe harbor. 2). With respect to mechanics liens and stop payment notices, any amount in excess of what the owner is permitted by law to withhold from the direct contractor on account of such mechanics lien or stop payment notices.

This provision addresses what amounts to an affirmative claim by a subcontractor - either by a mechanics lien or a stop payment notice. By other statutes, the owner can withhold 125% of the lien/stop payment notice claim from the prime contractor. The prime contractor is, of course, entitled to withhold that same amount from the subcontractor - and to have that withhold go into the safe harbor. However, under Martin Bros., if the prime contractor disputes the mechanics lien or stop payment notice amount, then that claim amount becomes a "disputed amount" for which the prime contractor can withhold from the subcontractor 150% x 125% = 187.5% of the amount of the lien/stop payment notice claim. This provision is designed to preclude such EXCESS withholding by saying that any withhold IN EXCESS OF the amount withheld by the owner on account of the lien/stop payment notice will NOT go into the safe harbor for protection against prompt payment penalties. Only the withhold for the amount withheld by the owner will go into the safe harbor.
None of ECA’s proposed language will preclude general contractors from withholding funds from subcontractors who fail to pay their suppliers, fail to pay their insurance premiums, fail to pay civil judgments, fail to rectify defective work, etc.
Nothing in AB 536 has ever sought to define what constitutes a "disputed amount" - it
only seeks to identify 3 things that are NOT disputed amounts under the broad language of the statute and Martin Bros.
3). The amount of any claim for additional compensation by the direct contractor against the owner. This provision addresses the affirmative claim discussed in Martin Bros. Construction, Inc. v. Thompson Pacific Construction, Inc. (2009) 179 Cal. App. 4th 1401, 102 Cal. Rptr. 3d 419. See page 2, lines 31 to 34; page 3, lines 26 to 28; page 4, lines 24 to 26; page 5, lines 10 to 13 and lines 37 to 39; page 8, lines 3 to 6; page 9, lines 7 to 10. To the extent that a subcontractor may breach a subcontract by making affirmative claims for additional compensation, AB 536 does prevent the prime contractor from withholding, from payments otherwise due, 150% of the amount of those affirmative claims for additional compensation. To the extent that a subcontractor may breach a subcontract by pursuing a mechanics lien or stop payment notice remedy, AB 536 limits the withholding from the subcontractor to just the amount the owner withholds from the prime Contractor on account of that mechanics lien or stop payment notice. To the extent that a subcontractor may breach a subcontract by causing the owner to assess LDs against the prime Contractor, AB 536 limits the withholding from the subcontractor to just the amount of LDs the owner is withholding from the prime Contractor. Nothing in AB 536 precludes the prime Contractor from making its own claim for delay damages - separate from the LDs pass-through - AND withholding that amount from the subcontractor AND having that withhold go into the safe harbor for protection against prompt payment penalties.

In conclusion, AB 536 will ensure that all parties in a dispute are protected without allowing for “gaming” of the system. AB 1212 - (Levine) – Two-Year Bill - Existing law encourages contractors and manufacturers bidding on public works contracts to submit a bid which utilizes an equal to or greater technique or product in lieu of that which has been specified in the original request for proposal by the public agency. Unfortunately, current law allows public agencies to require these “Or-equal” submittals prior to the actual bid day. This is a major disincentive to any contractor, because there is nothing preventing the agency from sharing the information with other competitors who in-turn can then underbid contractor’s innovation. Consequently, innovations and/or major cost savings that could be derived are often withheld by potential bidding contractors due to this requirement. In other words, what incentive does a prospective bidder have to provide a major cost savings or innovation to the public agency if it is going to be shared with his competitors prior to bid day? Indeed competition, which is driven both by price and by innovation, is truly the lifeblood of all public works contracts. This measure will serve to provide safeguards to prospective innovative bidders by simply stating: No data substantiating a request for a substitution of "an equal" item shall be disclosed to other potential bidders prior to the time when bids are received. AB 1353 - (Linder) – Two-Year Bill - This measure was introduced in an effort to define what a subcontractor is within the Public Contract Code. However, AB 44 (Buchanan) accomplished what we had intended. Hence, we will be amending this measure to fix another problem/issue in 2014 which hasn’t been decided as of this writing. SB 399 - (Wright) – VETOED - As background, John Malloy, a long time engineering contractor, was called by the LA Office of the California Department of General Services to perform an emergency sewer repair job at the State Building in LA back in the beginning of October, 2012. The problem was so bad that they had to close the building because of the unsanitary conditions!
It turned out that the lateral sewer line which traverses between the main trunk sewer line from the street into the building was broken. Fortunately, Mr. Malloy was able to successfully replace the broken pipe and sent the state a bill for the work when it was completed. Unfortunately, despite having enough urgency to have Mr. Malloy come out immediately to repair the sewer

problem, DGS totally ignored both his invoice and his phone calls inquiring about the money owed to him!!
I was contacted in early January, 2013 to see if I could “shake the money loose.” Even with my assistance and close working relationship with the executive offices of DGS, it took an additional 6 weeks before Mr. Malloy was finally paid!
SB 399 (Wright) would have narrowly expanded existing law. Simply, the legislation was written so that as long as state agencies did their jobs and made payments within the existing 45 day payment window, there absolutely would be no additional costs to the state resulting from SB 399. Once the contractor had provided all the required documentation (such as proof of workers’ compensation, general liability coverage, etc. that protects the interests of the state as well as the workers that were on the job), the prompt payment clock would start ticking. Once the 46th day had been reached and every day thereafter until the payment was made, contractors who performed work on an emergency basis would have qualified to receive interest under the existing provisions in the Government Code which certified small Businesses and others currently benefit from – namely an interest rate of 10 percent above the United States Prime Rate on June 30 of the prior fiscal year. This measure was not intended to enrich ANY contractor; rather, it was intended to serve as a bright light to state agency executives should they start to see interest penalty payments reflected in their accounting data. It would then be hoped (and expected), that remedies would be found quickly to ameliorate the problems. In (what we hope were) those rare instances that payment to a contractor exceeded 45 days , it was only appropriate that the contractor who successfully completed the project be fairly compensated, just as certified small businesses currently are under this section of the law. Our point to the governor was, “remember, despite not having received their payment from the state, contractors still have to keep their doors open which means ALL of their overhead costs (before ANY profits can be made!) must still be paid!”
Incredibly, despite passing through both Houses of the Legislature with a unanimous Aye vote, Governor Brown ignored the wisdom of the Legislature and instead listened to his bureaucrats in the Department of General Services and VETOED our sponsored bill! Following is Governor Brown’s veto message (which is in classic “bureaucratese” that could only be written by a bureaucrat for the governor to make “their” argument!

I am returning Senate Bill 399 without my signature. It is the policy of the state to provide for the timely payment of every state contract whether the work is completed on a standard or emergency basis. For the rare occasion when timely payment does not occur, current law provides specific safeguards. Recognizing the distinct struggles faced by small businesses and nonprofit organizations, increased safeguards are provided for these entities, including a higher late payment penalty. Extending the higher penalty rate to all contracts in a narrowly defined category regardless of the size of the contractor would be inconsistent with the state's policy of reserving this additional protection for those that need it most. 2014 Activities Besides the aforementioned two-year bills that are carry-overs into 2014, there will be several other bills we will be looking at, including:
Disgorgement - Over the past three years, we have introduced two separate bills to address the draconian problem known as disgorgement. Indeed, Business and Professions Code Section 7031 governs civil actions brought (1) by contractors to recover compensation payable for work performed, and (2) by property owners or prime contractors to force contractors or subcontractors to disgorge compensation received for work performed when the contractor/subcontractor was unlicensed. If a person performing work requiring a contractor's license is not duly licensed during the entire project, or contracts for or performs work outside of the person’s license classification, that person is prohibited by Section 7031 from bringing a civil action against the property owner or prime contractor to recover ANY amount due under the contract. Even if the person had been previously licensed and performed the work to everyone’s satisfaction, a lapse of license for a single day could bar the contractor from bringing a civil lawsuit against the owner or prime contractor to recoup amounts due for labor and materials. In 2013, we teamed-up with the Contractors’ License Board to sponsor SB 263 (Monning) in hopes of resolving this serious problem. Again due to the complexity of the issue, it became a two-year bill. I am hopeful that 2014 will be the year when we finally are able to effect some major changes to this draconian provision within existing law. Legislation to Require Competitive Bidding on Public Works Not Now Requiring It - Require all public entities that are not mandated to competitively bid all construction work over $2,500 to do so unless bound by its charter, ordinance or statute. Now more than ever, ALL public entities should be required to competitively bid ALL construction work over $2,500! This is one of the bills we are considering for introduction in 2014 Reduce the Disincentive to Vindicate the Competitive Bidding Laws By Alleviating Some of the Cost of a Successful Bid Protest. When a bidder proves in court that he was illegally denied a contract, AND (2) the job no longer exists (because it has been partially or completely performed under the illegal contract), then the public agency should have to pay the SUCCESSFUL bid protestor's attorney fees. Require Public Agencies to Provide Job Site Storage Yard – I have already begun working with local agencies to see if something can be done about agencies not providing job site storage yards. Allow Four Day, Ten Hour Work Week This is a matter of great importance to every contractor and his employees and is something I have been working on for more than a decade. The question is why shouldn’t employers allow employees to work four, ten hour days if both parties agree? Unfortunately when dealing with

public works, the California State Constitution prevents this from happening! Written into the constitution back in the 1800s, there are only two ways that we will ever be able to change this requirement: 1). Introduce a bill that ultimately obtains a two thirds vote of the Legislature which is then signed by the governor. Next, it would have to be placed on the general election ballot and approved by a majority (plurality) of the voters (50% plus 1). 2). Qualify a ballot initiative for the general election ballot. Again, it would have to be approved by a majority of the voters. I am committed to making this a priority issue once again in 2014. Please bear in mind however, the odds are very much against us because it will require union support - but they will only want a bill that addresses signatory contractors. Again, despite these potential obstacles, I am committed to trying to make this happen. Be Prepared to Introduce Legislation Quickly on an As-Needed Basis It seems that virtually every year there always is a last-minute need to have a bill introduced to address an unforeseen problem or issue. As always, I stand ready to meet the challenge again in 2014. Private Infrastructure Besides legislation, I am moving ever closer to FINALLY obtaining a 100% privately owned and financed infrastructure project. I feel strongly that if I can obtain one successful project, it will truly open the gates to many more in the future. I will hopefully have more news to report on in the near future! This also helps licensed contractors by exposing those unlicensed scam artists ‘un-leveling’ the playing field or driveway as the case may be…
Q: Real Estate offices in our town may knowingly refer out business to unlicensed contractors. Can they face penalties for doing this if reported? This is not a fair practice and undercuts the licensed contractor.
A: Thank you for contacting Capitol Services. While there is no way to know until the complaint is actually filed, it’s possible that the CSLB might consider that referral “aiding and abetting” and cause for a disciplinary action. B&P Code Section 7114 states “Aiding or abetting an unlicensed person to evade the provisions of this chapter or combining or conspiring with an unlicensed person, or allowing one’s license to be used by an unlicensed person with the intent to evade the provisions of this chapter constitutes a cause for disciplinary action.”
I agree that the agency is definitely out of line if they are referring work out they know amounts to over $500.00. You would need to provide
the CSLB with some sort of proof that the Real Estate agency is knowingly referring business to unlicensed contractors.
Q: I was given your name by my son, who said he found Capitol Services’ email on the Internet. He said you might be able to answer a question regarding hiring a contractor since this is what you deal with. Here’s my situation: A man came to my door saying he just happened to be in the neighborhood and had some left over materials. He told me he had just repaved a neighbor’s driveway and could also do mine for a “very low price”. After asking him some questions including the neighbor’s name, something sounded fishy so I sent him away.
However, my driveway does need repairs so what would you recommend to find someone to do this work. By the way, do you work for the State?
A: Thank you for the email. Just to be clear, we are not the State Contractors Board but from time to time receive calls and emails from people who think we are. In most cases my staff and I are happy to respond to these type of inquires if we can.
You were probably smart to send him away. Over the years, this type of door-to-door approach has been done by individuals who are unlicensed and do not carry the proper insurance and bonding. The best thing to do is contact at
least three contractors who have a valid State contractor’s license. By getting bids from several contractors you’ll be able to compare prices and likely get a better deal. Look for a contractor who holds a “C-12” (Earthwork and Paving) or “A” (General Engineering) classification. Ask neighbors and friends if they’ve needed this type of work or search the Internet for legitimate contractors.
To determine if a contractors license is in good standing, I recommend you visit the CSLB web site (http://www.cslb.ca.gov). For any construction project $500 or more a state license is required to legally do this type of work. Local police might also be interested in these types of ‘door to door’ contractors as previous victims come forward.

SMALL EMPLOYERS: HEALTHCARE REFORM UPDATE
The health insurance marketplaces created by the Affordable Care Act will open on Oct. 1. Most small employers—those with 50 or fewer full-time employees—are not required to offer health insurance coverage under the Affordable Care Act. Even businesses with more than 50 full-time employees have received a one-year reprieve from penalties if they don’t offer insurance. But all companies, regardless of size, are required to notify their employees about the Obamacare marketplaces.There’s also another feature of the law that was supposed to help small businesses: a tax credit to help the smallest ones buy health insurance. It has been around since 2010 on a smaller scale, but starting in 2014, they’ll be able to get a credit for up to 50 percent of their health care premium costs if they buy insurance through one of the SHOP exchanges.It’s only for really small businesses, though — those that have fewer than 25 employees (or their “equivalents,” again), pay less than $50,000 a year in average wages and pay for at least half of the premiums themselves. And they only get the full credit if they have 10 or fewer full-time workers and their average wages are less than $25,000 a year.Smaller companies with fewer than 50
employees, while not required to provide health insurance, need to inform employees about the law and make sure new healthcare plans (if they offer them) comply with Obamacare.
Make sure you’ve addressed the requirements that went into effect in 2012 or earlier:• Provide your employees with a Summary
of Benefits and Coverage from your insurer, clearly explaining what their plan covers and what it costs.
• Make sure any health accounts you have set up for your employees, such as flexible spending accounts (FSAs), health reimbursement accounts (HRAs) or health savings accounts (HSAs), comply with new rules:
1. They can no longer be used to buy over-the-counter drugs (except insulin) without a prescription.
2. ◦Employees are limited to contributing no more than $2,500 to FSAs.
3. ◦Employees will pay higher penalties (20%) for withdrawing HSA funds for nonmedical expenses.
Prepare to comply with these requirements in 2013 and beyond:• If you have not been providing insurance,
investigate your options now. If you have fewer than the full-time equivalent (FTE) of 50 employees, you don’t have to provide coverage. But you may want to see if you can afford it. Beginning in 2014, you can buy coverage through insurance marketplaces
(exchanges). If you have fewer than 25 employees, you also may be eligible for tax credits.

• By Oct. 1, notify your employees about the availability of health insurance marketplace (exchange) plans and that they may be eligible for subsidies to help pay for coverage. Here is the template of information required for employers who offer coverage. Further guidance, and templates for
employers who will not be offering coverage, are available from the Department of Labor.
• Inform your high-wage employees ($200,000 for individuals; $250,000 for joint filers) of new Medicare payroll and investment income taxes — effective in 2013 — and adjust your payroll system accordingly.
• Report to the federal government on whether you offer health coverage, the total number and names of those receiving coverage, and the cost of the plan. The first report is due in 2015 for the year 2014.
• Decide whether you want to offer expanded wellness incentives. Starting in 2014, businesses can offer discounts of up to 30% off insurance premiums to employees who take part in employer-sponsored wellness programs. This is an increase from the 20% discount previously allowed.

Construction Safety - Demolition 1
Required preparations prior to starting:
• Site study: Before beginning the actual work of demolition, a careful study should be made of the structure that is to be torn down, as well as its surroundings. A definite plan or procedure should then be mapped out, and thereafter followed as closely as possible. The following rules should be incorporated as part of this plan.
• Shoring of other buildings: This is often necessary, and plans should be made to carry out all operations of this kind promptly.
• Structures wrecked by fire, flood, explosion or other catastrophe: It may be necessary to shore up or brace some of the walls of the building that are to be taken down, before the wrecking operations can be safely started.
• Notify and protect the public: Before the wrecking operations begin, protection of the public against falling objects should be provided when the building stands close to a street or to a much frequented roadway of any kind. The entire sidewalk adjoining the building should be fenced off, and sidewalk sheds constructed where necessary. Sidewalk sheds should be capable of supporting a load of 150 pounds per square foot. If material is to be piled on the sheds, they should be able to support 300 pounds per square foot.
• Utilities: All gas, electricity and water should be shut off at the outset, and all windows, glass doors and other fragile fixtures removed before proceeding with any other work. The lath and plaster then should be stripped off throughout the entire building.
• Personal protective equipment: Employees should use hard hats, safety goggles, safety shoes and gloves are particularly recommended. All floor openings should be kept covered, except where in actual use for lowering materials. If this is not feasible, toe-boards and hand rails should be installed around the openings.
• Proceed systematically: Proceed story by story, and the work on the upper floors should be completed before any of the supporting members on the lower floors are disturbed.
• Material removal: Material should never be thrown to the ground. It should be lowered to the ground or to the top of the sidewalk shed by means of rope and suitable tackle. Debris should be removed by means of wooden or metal chutes.
• Projective nails: All projecting nails in boards, planks and timber should be carefully removed, hammered in or bent in a safe way. Good housekeeping is of extreme importance.

Seguridad en la construcción – Demolición 1
Preparaciones necesarias antes de comenzar:
• Estudio del lugar: Antes de comenzar la tarea específica de demolición, se debe realizar un estudio cuidadoso de la estructura que será demolida, así como también de sus alrededores. Luego se deberá establecer un plan o procedimiento definitivo, que deberá seguirse posteriormente intentando apegarse a él lo más posible. Las siguientes reglas se deben incorporar como parte del plan.
• Apuntalamiento de los demás edificios: Esto suele ser necesario, y se deben hacer planes para llevar a cabo rápidamente todas las operaciones de este tipo.
• Estructuras dañadas por fuego, inundación, explosión u otras catástrofes: Puede ser necesario apuntalar o reforzar algunas de las paredes del edificio que habrá de demolerse, antes de que puedan comenzar las operaciones de demolición de forma segura.
• Avise y proteja al público: Antes de comenzar las operaciones de demolición, se deberá brindar protección al público contra la caída de objetos, en caso de que el edificio se ubique cerca de una calle o en una vía de comunicación concurrida de cualquier tipo. Se deberá colocar una valla a lo largo de toda la acerca colindante al edificio y, si fuera necesario deberá de construirse un cobertizo sobre la misma. Esta protección deberá ser capaz de soportar 150 libras por pie cuadrado. Si se va a acumular material sobre los cobertizos, deberán soportar 300 libras por pie cuadrado.
• Servicios: Todos los servicios de gas, agua y electricidad deberán ser suspendidos antes de la demolición, y además deberán retirarse todas las ventanas y puertas así como otras instalaciones frágiles antes de proceder con cualquier otra tarea. Todas las tablas delgadas y placas de yeso deben retirarse del edificio.
• Equipamiento de protección personal: Los empleados deberán usar cascos, anteojos, calzado de seguridad y guantes, como recomendación especial. Cualquier abertura en los pisos deberá mantenerse cubierta, salvo cuando estén en uso para el descenso de materiales. Si esto no fuera posible, se deberán instalar zócalos y pasamanos alrededor de estas aberturas.
• Proceder de modo sistemático: Avance paso a paso, y el trabajo de los pisos superiores deberá terminarse antes de que cualquier integrante del equipo de apoyo en los pisos inferiores sea molestado.

On June 3, 2009, the Board of Education of the West Contra Costa Unified School District approved Resolution 90-0809. The resolution places the District under the Uniform Public Construction Cost Accounting Act. Under Section 22036/of the act, the District is inviting all licensed contractors to submit the name of their firm to the District for inclusion on its list of qualified bidders for the following calendar year (2014).
