Center Priority Development Area (PDA) and Station Area Plan. At the request of the City Council PDA Subcommittee, City staff has prepared responses to a variety of PDA-related questions posed by the community. The responses to the community questions will be presented to the City Council at this study session. in August 2012, the City Council accepted the Civic Center Station Area Plan, which encompassed the same geographic area of the Civic Center PDA (1/2- mile radius surrounding the planned Civic Center SMART station). The City Council will also review the recommendations of the Station Area Plan in the context of Plan Bay Area and Civic Center PDA. No decisions or actions will be taken at this meeting; however the Council can provide staff with direction. The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.

I have heard that ‘timing is everything’ in humor, but it is no joke when deciding on making changes in your contractor’s licensing as our first question illustrates. Timing is again the issue in our second question, but the answer goes well beyond his immediate need. Anyone with, or hoping to obtain, an LLC license will find good news in new legislation signed by the Governor…

Q: We currently have two licensed corporations that we will be selling the assets of. The buyer will form two new corporations and obtain new license numbers, however one of the conditions of the sale is that the Responsible Managing Officer (RMO) stay on as his Qualifier for the first few years of business. I was reading that an RMO can be on up three licenses at a time as long as there is some common ownership (which there is). Once the sale is final we will cancel the existing corporations’ licenses, so he will no longer be listed as the RMO on those two licenses. I just wanted to be sure that there will be no issues with transferring him over to the two new corporations. Thank you for your expert advice.

A: You are correct that when the ownership requirement is met an RMO can be on up to three active licenses at a time, but if you read

that regulation further it states that an RMO can be up on three active licenses at a time within a one-year period. Your Qualifier is currently on two active licenses, so the CSLB would allow him to qualify one of the new entity’s licenses, but it’s unlikely that they will allow him to qualify both. In order to qualify the “fourth” entity, he would need to wait one year from the time he is removed from the current corporation’s license.

Q: I am the RMO on my brother’s corporation’s license. He recently went to work for another company so he inactivated his corporate license. Since he’s not using the license, I would like to remove myself from the license to be released of any potential liability but I don’t want his license to go suspended as a result. I assume he will have 90 days to replace me once I disassociate?

A: Actually, Inactive licenses are not required to have an RME/RMO. Likewise, Inactive licenses are not required to have Bonds or Worker’s Compensation on record with the CSLB. If and when your brother decides to activate the license in the future he will be required to list a new RMO/RME as well as comply with bond and insurance requirements.

LLC Licensing note: AB 1236 was signed by Governor Brown, which will authorize contractors licensed as LLC’s to obtain liability insurance from a surplus line insurer. Current law requires that licensed LLC’s maintain a certain level of liability insurance, and it is to be written by an insurance company admitted to underwrite insurance in California. Many times LLC contractors are unable to obtain a contractor’s license due to the fact that they cannot obtain the required liability insurance because such coverage is unavailable from any California admitted insurer. Many contractors in California that operate as corporations use a surplus lines carrier for their liability insurance. The new legislation will allow those corporations to apply for LLC status without changing insurance carriers.

This new legislation authorizing LLC’s to obtain the required liability insurance from a surplus line insurer will go in to effect on January 1, 2014.

Although several provisions of the Affordable Care Act (ACA) have been in effect since 2010, the majority of the regulations that affect employers will take effect in the fall of 2013 and 2014. One new requirement that may have slipped past you and where the clock is quickly ticking down in order to comply is Section 1512. This requirement applies whether your business is large or small, already provides health benefits to employees or not, or falls under the employer mandate or not.

The ACA, per section 1512, amended the Fair Labor Standards Act (FLSA) requiring employers to provide a written notice describing certain elements of the Health Insurance Exchange and subsidy eligibility to all current and future employees, and do so no later than October 1, 2013 (a date moved back from the original of March 1, 2013). The deadline is intended to correspond to the open enrollment period beginning October 1 for coverage through the marketplace beginning January 1, 2014.

Technically, the notice requirement applies only to employers subject to the FLSA—those engaging in, or producing goods for, interstate commerce and whose annual sales total $500,000 or more. However, that is a very large category that is essentially most private-sector employers and certain governmental entities, such as schools, hospitals, nursing homes, institutions of higher learning and federal, state and local government agencies. Additionally, because this requirement also falls under the Labor Management Relations Act, it applies regardless of whether or not the employer is considered “large” (with at least 50 full-time equivalent employees) and therefore subject to the employer mandate provisions of the ACA.

The notice must be delivered to every employee, full-time and part-time,

and whether or not they have health plan coverage. As an employer, you are not required to give any notice to dependents or other individuals who are or may become eligible for coverage under the plan but who are not employees.

Luckily, the Department of Labor has provided two models of such a notice: one for employers that do not offer a health plan and another for employers that do offer health benefits to some or all employees. Employers may use one of these models, as applicable, or a customized version, provided the notice meets the content requirements:

• First it must give basic information on Covered California (the health insurance exchange/marketplace here in California): that it exists, a description of its services and contact information.

• Secondly, an explanation that an employee may be eligible for a tax credit on premiums if they purchase coverage through the marketplace. In cases where said employee already receives benefits via their employer, they might be eligible if the employer plan covers less than 60% of allowable claims (thus not providing minimum value).

• Thirdly, it should note that any employer contribution to a health benefits plan may be lost if the employee chooses to purchase coverage through the marketplace, and that the employer contribution may have been excludable from federal income tax.

The model notices, however, are not just boilerplate language that can be photocopied and dispersed to current employees and new hires or posted to a bulletin board. There are a few details you as an employer will need to fill in.

Both forms, regardless of whether coverage is provided or not, require employer identifying and contact information. However, the form for

employers with group health insurance coverage also requires:

• Information on to whom health coverage is offered and the eligibility requirement and whether dependents may obtain coverage and the rules for their eligibility

• A checkbox to indicate whether the coverage is affordable and meets the minimum value standard (under the affordable coverage requirement, the employee’s share of the premium may not exceed 9.5% of annual household income, and to meet minimum value requirements, the plan’s share of the cost of coverage must be at least 60%)

• The name and contact information for someone with more information about employer-sponsored coverage, which may include a human resources contact or even a broker or third party administrator.

Given the money and effort Covered California is soon going to expend

to advertise the availability of insurance through the Exchanges, most employees probably will be aware of its existence. But mandate or no mandate and October 1st deadline or not, you as an employer have the opportunity to ensure that you are your employees’ trusted source of ACA information and options.

Are You Practicing Scaffolding Safety?The majority of scaffold accidents on the construction site are caused by falls, slipping or being struck by an object from above. All of these accidents can be prevented by taking the proper precautions. Here’s how. General Safety Tips

• To prevent slipping hazards, conduct a daily routine inspection to ensure all walking and working surfaces are free from potential hazards. If you spot a hazard, remove it.

• Never move, dismantle or alter a scaffold unless under the supervision of a qualified person while doing such activities.

• Never move a scaffold with workers still on it.

• keep scaffold loads below maximum capacity and remove your equipment when the scaffold is not in use.

• Be alert for bad weather. high winds and driving rain and snow can be dangerous when working at high levels.

Protection for Those Below

Always hoist up heavy tools, equipment and supplies, rather than carry them up by hand.

There must be a 3½"-high toe board to prevent things falling off a scaffold. If things on the scaffold are taller than 3½" (above the toeboard) other

systems, like debris nets, must be used to catch falling tools or materials.

Always wear a hard hat when working on and around a scaffold.

Never walk under or near the scaffold if roped off when work is being performed above.

Fall Protection Basics To help protect you against potentially deadly falls, fall protection is needed when working 6 feet or more above a lower level, and consists of either a personal fall-arrest system or guardrail systems, depending on the job. If using a fall arrest system, keep the following in mind:

• Always attach your lanyard to a vertical lifeline, horizontal lifeline or scaffold structural member.

• If you are using a vertical lifeline, make sure that you are fastened to a fixed safe point of anchorage, independent of the scaffold. This includes structural members of buildings, but not standpipes, vents, electrical conduit, etc. They may give way under the force of a fall.

• Clean and test your gear regularly, and never tamper with your fall protection system.

When working on scaffolding, your safety is our top priority. Make it yours, too!

When working on or around scaffolding, following some simple safety tips goes a long way in preventing injuries from slips, falls and being struck by falling objects.

• Para evitar peligros de resbalones, realice una inspección diaria de rutina para verificar que en todas las superficies de trabajo y por donde se camina no haya posibles riesgos. Si divisa un riesgo, elimínelo.

• Nunca mueva, desmonte o altere un andamio a menos que se encuentre bajo la supervisión de una persona capacitada mientras realiza tales actividades.

• Nunca mueva un andamio con trabajadores que todavía se encuentren sobre él.

• Mantenga las cargas de andamio por debajo de la capacidad máxima y quite su equipo cuando el andamio no esté en uso.

• Esté atento al mal clima. Los vientos fuertes y la nieve y lluvia intensa pueden ser peligrosos cuando trabaja en niveles altos.

Protección para los de abajo

Our company is a professional organization that has been providing all types of excavation services in the San Fran-

cisco Bay Area for over 15 years. We specialize in shoring, drilling, grading and site preparation needs. Our projects are wide and varied from excavating large hillsides and creating

lakes to digging swimming pools.

We are seeking an Estimator for our growing company. Estimator must be proficient in estimating public work for excavation, demolition, shoring and pipe work.

• Interpret architectural and structural drawings, specifica-tions, and bid documents

• Perform take offs and write RFPs, and RFIs• Review Job site conditions to determine scope, costs and

project timeline• Compile detailed scope of work inclusions, exclusions, &

clarifications for estimates• Attention to detail, strong organizational and time man-

agement skills

Job Requirements

• Previous experience with computer estimating using Dodge Pro and similar sites a plus

• Project Manager experience is a plus but Estimating is the priority

• Experience in Earthwork is also a plus• Work independently as well as part of a team and accept

feedback constructively• Ability to communicate efficiently with the owner, follow

directions and have own transportation• Local references are a prerequisite of the position
