Kalb's Q&A for Contractors By David Kalb, President of Capitol Services, Inc.
Real world problems can sometimes be easy to solve. At other times, the complex nature of the problem seems to require a ‘by the numbers’ approach if you expect to reach your goal successfully. A contractor looking at a new ‘venture’ shows everyone the route to ‘jointly’ profit-ing…
Q: I’m the president of our company and we’ve had a “C-39” (Roofing) License for four years. It will expire at the end of this month and my Responsible Managing Officer (RMO) is leaving the company. We don’t have another RMO. What will happen to the corporation?
A: Once the RMO disassociates, your company will have 90 days to replace him. Normally, during this time, the license would remain in good standing. However, you may have problems renewing the license until the new Qualifier is officially on board since the current RMO cannot sign the renewal application. Nevertheless, for a number of reasons I would suggest sending in the renewal prior to the end of the month.
Unless you have someone who already holds the “C-39” classification an Officer or supervising employee will need to sit for the exam. Upon passing the law and trade test, and meeting the Board’s other licensing requirements, this per-son would become the new Responsible Managing Officer or Employee (RMO/RME).
Q: Is it your understanding that an organization (likely an LLC) that contracts with a public entity for a lease-leaseback project needs to hold a contractors license?
A: Based on my understanding of a “lease-leaseback” ar-rangement with a public agency (such as a school district), the contractor would be required to hold a CA contractors license. By year’s end the rush will be on to obtain contrac-tor licensing for Limited Liability Companies or LLC’s in California. If you are considering this licensing avenue, get-ting in ‘line’ now is advised as a high volume of applications is expected. Capitol Services is already getting requests to help with this completely new application for LLC licensing.
Q: I have asked you several questions previously regarding my current company and our pursuit in securing a contrac-tors license. You and your staff have been very helpful and I thank you for all the assistance. A couple more questions have come up that I am hoping you can answer.
We are in preliminary talks with a couple firms for a Joint Venture (JV) arrangement on a pending project. One of the entities is not a licensed contractor. They are a manufacturer and equipment supplier but have done some contracting. My understanding is that all partners on a JV must be licensed contractors. Is that accurate even if one of the proposed team members would not be involved in the “construction” activities, but only manufacturing and equipment supply?
My second question with regard to the license -- is there any issue with applying for a JV license too soon after we secure our corporate license?
A: 1) You’re correct; all entities must have an active CA contractor’s license in good standing. 2) If the manufacturer were only a material supplier, they would not independently require a license. If a company were both a supplier and “contractor” a license would be necessary. Regardless, since the JV will be handling the actual construction their inclu-sion or exclusion as the “material supplier” is up to you. 3) Once your license # is issued, you can apply for the JV license the next day. This application can be prepared ahead of time for your review and signatures and be ready to sub-mit to the Contractors Board.
Finally, The Governor has lifted the CSLB hiring freeze so they can begin filling long-vacant positions in both Enforce-ment and Licensing Divisions. At a recent CSLB meeting the Board publicly thanked all those who may have played a part in securing this policy change. Good work.

Any tool powerful enough to slice through wood can do the same to human flesh, so chainsaw injuries are often serious. Before you operate a chainsaw, make sure you read and understand the operator’s manual and make sure you have the right chainsaw for the job. The instruction manual should describe the saw’s capabilities. If you rent a saw, be sure to get a demonstration of how it works, including its safety features. Then make sure your saw is sharp, properly tensioned, and in good condition.
When you’re going to use a chain saw, wear protective clothing which includes a hard hat, safety goggles, gloves to give you a good grip, hearing protection, steel-toed shoes with nonslip soles, and trim-fitting clothes that won’t get caught in the chain.
Start your chainsaw according to the manual’s direction. Clear the work area so the chain won’t touch anything but the wood you want to cut and place the saw on a level surface; never rest a saw on your leg or drop-start it. Stand to the side of the saw so you won’t follow the cut through into your leg and stand on the uphill side of your work so it won’t roll into you. Hold the saw parallel to the ground with your left arm straight for better control and to reduce the chance of the saw pushing into you if it kicks back.
Keep both hands on the saw while its running. Work slowly, don’t rush. Let the chainsaw do the work; never force it. Avoid cutting above mid-chest height. Never attempt to cut a tree with a diam-eter greater than the length of the chainsaw blade and watch for branches that may spring back as you cut. Always be aware of what is in the saw’s downward path after the cut. It’s a good idea to take frequent breaks from cutting so you don’t operate the saw when you’re tired.
Although some chainsaw injuries are caused by operator error, kickback is the greatest cause of chainsaw injuries. In kickback, the upper chain “grabs” in the wood or an obstruction and forces
the saw backward, causing operator to either lose control of the saw or lose balance, bringing the saw into contact with the body. Some chainsaws have chain brakes that are designed to instantly stop the saw after kickback. While these don’t prevent kickback, they can reduce the severity of injury from it.
Carry the saw below your waist, with the engine off and guide bar pointed to the rear, so if you trip the saw drops behind you.
If your saw is electric, make sure you use an extension cord that’s approved for outdoor use and don’t use the saw in a damp environment. Fuel gasoline-powered chainsaws outdoors, being careful not to overfill or spill the fuel. Never refuel a hot saw. Let it cool down first, and have a fire extinguisher nearby.
It’s dangerous to work alone with a chainsaw. Have a compan-ion within calling distance, but keep bystanders and helpers at a safe distance from operation so that they will not be injured by the saw, flying chips, sawdust or by what you’re working on.

Evite cortar a una altura superior a la parte media del pecho. No trate nunca de cortar un árbol que tenga un diámetro mayor que la longitud de la pala de la sierra y evite las ramas que puedan saltar a medida que corta. Dese cuenta siempre de lo que haya en la trayectoria descendente de la sierra después del corte. Se recomienda tomarse descansos frecuentes mientras corta para evitar usar la sierra estando cansado.
Aunque algunas lesiones de sierra de cadena son causadas por un error del usuario, el retroceso es la causa del mayor número de lesiones de sierra de cadena. En el retroceso, la cadena superior “se agarra” a la madera o a una obstrucción, y fuerza la sierra hacia atrás, haciendo que el usuario pierda el control de la sierra o pierda el equilibrio y provocando que la sierra toque el cuerpo. Algunas sierras de cadena tienen frenos diseñados para detener la sierra instantáneamente después del retroceso. Aunque los frenos no previenen el retroceso, pueden reducir la
gravedad de la lesión causada.
Lleve la sierra por debajo de la cintura, con el motor apagado y el brazo de la sierra en dirección hacia atrás, de modo que, si se tropieza, la sierra caiga detrás de usted.
Si la sierra es eléctrica, asegúrese de usar un cable de exten-sión aprobado para uso a la intemperie y no utilice la sierra en lugares húmedos. Llene las sierras de cadena que funcionan a gasolina al aire libre, cuidando de no llenarlas en exceso ni de derramar el combustible. Nunca reposte una sierra en caliente. Deje que se enfríe primero y tenga a mano un extinguidor de incendios.
Es peligroso trabajar en solitario con una sierra de cadena. Tenga a una persona a quien pueda llamar, pero mantenga a los espectadores y asistentes a una distancia segura, de modo que no sean lesionados por la sierra, trozos de madera que salgan despedidos, aserrín o el objeto que está cortando.
