    Re: Oakland Bay Marina/City of Shelton UGA; Port of Shelton Request for Annexation and Request for Comprehensive Plan Amendment Initiation

    Honorable County Commissioners and Mr. Goins:

    The Port of Shelton seeks to have its property and marina within Oakland Bay annexed into the City of Shelton. Presently, the marina facilities are located both in the County and in the City. This creates a number of administrative inefficiencies and inconsistencies for the Port as the property owner and the two current regulatory agencies, but for the tenants in the Oakland Bay Marina. Accordingly, the Port of Shelton requests that the City of Shelton annex all of the Harbor Area into the City of Shelton. The Port also requests that the Eagle Point area be annexed into the City of Shelton.

    In preparation for this request, the Port has examined the City of Shelton UGA in Oakland Bay. It is the Port's conclusion that the property owned and leased by the Pori in Oakland Bay is in the City for Shelton's UGA, and the 2006 City UGA line located at the Outer Harbor Line across Oakland Bay remains in effect. The Port does acknowledge that there may be a lack of clarity as to the location of the UGA in Oakland Bay. Please find the attached summary and maps detailing these issues.

    Accordingly, without conceding the issue of the location of the City of Shelton UGA boundary across Oakland Bay, the Port does request that both the County and the City initiate a Comprehensive Plan amendment that would re-establish and confirm, or establish the City of Shelton UGA line at the Outer Harbor Line across Oakland Bay. We would ask that these amendments be included as part of the 2015 annual comprehensive plan amendment docket,

  • but if not in that docket, then as part of the 2016 Comprehensive Plan update for both the City and the County.

    We believe that the County Board of Commissioners can take this action by motion at its earliest convenience in 2015.

    The City planning Department has requested this letter prior to the end of March. This letter is submitted for this purpose. The Port will provide a legal description and exhibit in the near future.

    If you concur that the existing City of Shelton UGA boundary is at the Outer Harbor Line as it crosses Oakland Bay, then this letter should be considered a request to the City of Shelton for annexation of the Harbor Area, which includes Port-owned and leased properties, in the City of Shelton's UGA.

    On February 10; 2015 Mason County released an advertisement for application for community members to join the County's Solid Waste Advisory Committee (SWAC).

    The SWAC is required (per RCW) to consist of community members from each of the Commissioner Districts as well as representatives from Tribes, industry and business to make recommendations to the Commissioners regarding solid waste and special waste management in Mason County.

    Five new applications have been received Eric Nelson to represent Commissioner District 1, Janet O'Conner to represent Commissioner District 2 and Rik Fredrickson, Delray Cox and Steve Gilmore to represent local industry and businesses involved in waste and recycling handling, collection and/or disposal.

    RECOMMENDED OR REQUESTED ACTION: Recommend the Board of County Commissioners, at the May 5, 2015 Cmr1mission Meeting, select and appoint applicants as a community representative to the Solid Waste Advisory Committee (SWAC).

The committee also has to make sure the plan addresses compliance with state and local regulations, permitting and enforcement. The committee makes recommendations to the county ccmmissioners for final aproval.

  • ITEM: Briefing for announcement of a special event to celebrate the 10th anniversary of the Mason County Historic Preservation Commission on May 16th.

    The Mason County HPC is holding a special event on Saturday May 16th to celebrate their 10th anniversary. The purpose of the event is to bring together the larger historic preservation community and the public at large to create more public awareness of the MCHPC and their mission. There will also be a special workshop on the Heritage Grant program.

    BUDGET IMPACTS: The HPC has budgeted $1 ,000 for this event.

  • The Mason County Historic Preservation Commission would like to invite the public to join us on May

    16th 2015 in celebration of Historic Preservation Month and the Commission's 10th anniversary.

    The event will take place at the Shelton Civic Center May 16th 2015 starting at 1:00 p.m. with a meet

    and greet and light refreshments followed by recognition of some Mason County supporters of historic

    preservation.

    Mr. Stan Graham will be our guest speaker. Stan was the founding Chair of the Mason County Historic

    Preservation Commission and always has a good story to teii where we are sure to learn something in a

    fun and interesting way.

    We have also invited our local historical groups to set up display tables so we can all learn about the

    great work they are doing in the community to preserve our history, tell our stories and educate us on

    the rich and interesting history of Mason County.

    Also included is a brief discussion on the mission of the Mason County Historic Preservation Commission

    and our past and present projects and programs.

    We will conclude the event with a workshop on the Commission's Heritage Grant Program. This is a

    great opportunity for non-profit organizations and government entities to learn about the goals, scope

    and application process for this great program.

    EXECUTIVE SUMMARY: (If applicable, please include available options and potential solutions) In the rural lands development standards for Mason County, motorized commercial outdoor recreation facilities are limited to only two zoning districts, and then only with an approved special use permit. Recent events have caused Staff to reconsider the complementary activities that can be associated with motorized recreational facilities. When a use is approved under the limitations of a special use permit, adjunct activities (civic events, spectator sports, etc.) or complementary businesses (retail stores, food establishments, etc) are often prohibited or severely restricted due to eitherthe permitting process or the scope of the original approved project. If a special use permit is granted for a specific proposal that is silent on, or uncertain of, future opportunities, expansion of the facility can be restricted and the landowner is forced to seek a revised special use permit. In an effort to remedy this, Staff is asking the Board of County Commissioners to consider language amending those portions of the Development Regulations that would add motorized commercial outdoor recreation as a permitted use on larger parcels of land.

    SUMMARY OF PROPOSAL: Staff is bringing forward a proposed amendment to the permitted uses currently applied in Rural Tourist and Rural Tourist Campground zoning districts. The amendment is a revision designed to address motorized commercial outdoor recreation uses that would allow them as a permitted use, without the necessity of a special use permit, on parcels 100 acres or greater in size.     BACKGROUND/DISCUSSION In the rural lands development standards for Mason County, motorized commercial outdoor recreation facilities are limited to only two zoning districts, and then only with an approved special use permit. Recent events have caused Staff to reconsider the complementary activities that can be associated with motorized recreational facilities.     STATE ENVIRONMENT PROTECTION ACT (SEP A) This proposed amendment is categorically exempt from SEPA review under WAC 197-11-800(19) "Procedural Actions".

    PUBLIC NOTIFICATION A list of interested parties has been maintained by staff to ensure that notifications of public meetings and comment periods are addressed specifically to those individuals. All public meeting notices will be mailed to all parties of interest and posted in accordance with MCC 15.07.030.

    PLANNING ADVISORY COMMISSION The Planning Advisory Commission held a public hearing on April 13, 2015 to consider Staffs Report together with public testimony on the proposed amendments. The Commissioner made a unanimous recommendation for approval to the Board of County Commissioners.

    SUMMARY AND RECOMMENDATION The Board of County Commissioners should consider this proposal favorably and Staff would recommend adoption of these amendments.

    Under RCW 36.70A.130(5)(b) Mason County is required to review and, if needed, revise its Comprehensive Plan and Development Regulations by June 30, 2016. To provide some assurance that local jurisdictions comply with this mandate, the Washington Department of Commerce awarded state grant funding to several counties, including ours. Mason County was awarded $48,ooo for one year, which represents the first half of the estimated total grant funding for the updatei it is anticipated that funds will be available for the second half in the amount of $48,ooo after July 1 1 2015. Provided with the grant award is a Statement of Work outlining the various goals and action items to be completed along with a timeline. There are three goals to be accomplished by June 30 of 2015. Goals 1 was to use the Periodic Checklist to review relevant comprehensive plan and development regulations, including critical areas ordinance, and determine if there are any sections that need revision. Goal 2 was to conduct a public hearing to review proposed comprehensive plan and development regulations updates as identified in Goal 1.0, and seek citizen's proposals for updating current comprehensive plan goals and policies. The last goal, Goal 31 is to update the comprehensive plan, the development regulations and the critical areas ordinance identified in Goal 2.0. Completion of all updates to the Comprehensive Plan and Development Regulations by June 30, 2015 is unlikely at this time. Staff has consulted with the Department of Commerce and will need to revise the original Grant to accommodate a different schedule of deliverables.

    The checklist was completed and provided to the Department of Commerce as scheduled. The results of the checklist were compiled and presented at a public hearing with the Planning Advisory Committee. The results of that hearing together with Staff's report are being provided to the Board of County Commissioners. Under Goal 21 a grant required deliverable was an outline the results of the public hearing summarized in a Scope of Work. Additionally, the Planning Advisory Commission requested that a formal Public Participation Plan also be drafted for the Board's review and approval together with the Scope of Work. A second public hearing was held with the Planning Advisory Commission to review and recommend a Public Participation Plan. The Plan and the Scope are the specific topic of this Briefing, and Staff is seeking to schedule these documents for adoption through a formal public process.

Examples of failure include: (a) Sewage on the smface of the ground; (b) Sewage backing up into a structure caused by slow soil absorption of septic tank effluent; ( c) Sewage leaking from a sewage tank or collection system; ( d) Cesspools or seepage pits where evidence of ground water or surface water

    degradation exists; (e) Inadequately treated effluent contaminating ground water or smface water; or (f) Noncompliance with standards stipulated on the permit.

    Maintenance and Monitoring: The actions necessary to keep the on-site sewage system components functioning as designed. Periodic or continuous checking of an on-site sewage system, which is performed by observations and measmements, to determine ifthe system is functioning as intended and if system maintenance is needed. Monitoring also includes maintaining accurate records that document monitoring activities.

    We have completed our annual review of the classification of Washington's shellfish growing areas. We have determined that part of the Hood Canal 6 and Pickering Passage growing areas fail the criteria for an Approved classification, which will result in a reclassification of a portion of the growing areas. The North Bay growing area is threatened with a downgrade in classification. In addition, we are concerned with water quality in other portions of the Hood Canal 6, North Bay, and Pickering Passage growing areas, as well as the Annas Bay, Hood Canal 9, Oakland Bay, and Skookum Inlet growing areas. The annual reports and water quality early warning system summary report for the threatened areas in your ounty are enclosed for your review. You can refer to the map in the annual report to determine what part

    of the area is threatened. Also enclosed is a map of classified commercial and recreational shellfish growing areas based on 2014 classification data. All of our annual reports and water quality early warning system summary reports are available on our website at www. doh. wa. gov I CommunityandEn vironment/Shellfish/ GrowingAreas/ AnnualReports .aspx.

    We call an area threatened when a water sampling station passes the water quality standards but shows bacteria levels that are near the limit of the stanqard, or when a shoreline survey identifies pollution sources. The threatened designation u~ually does not mean that the classification of the entire shellfish area is at risk.

    We are notifying the Tribes, shellfish growers, Conservation Districts, the Department of Ecology, and the Puget Sound Partnership. We want all affected parties to be aware of the threats and we want to· encourage work to identify and correct pollution problems before a downgrade is required.

    in improved marine water quality and safe shellfish harvesting.

    Shellfish Sanitation Program prescribes two methods to evaluate bacteria levels in harvesting areas: Systematic Random Sampling (SRS) and Adverse Pollution Conditions

    use a minimum of 30 samples. With the SRS method, the estimated 9Qth percentile cannot exceed 43 fc/l 00 ml. With the APC method, no more than 1 0% of the samples can exceed 43 fc/l 00 ml. If either of the predefined methods is exceeded, no shellfish can be

    - These marine water sampling stations do not meet the shellfish area water quality rds for safe harvesting. The classification of the shellfish harvesting area must be

    Pickering Passage was sampled six times using the Systematic Random Sampling method. The Department completed an evaluation of the southwest portion of Squaxin Island and classified the area as Approved.

    Analytical Results Of Water Samples

    Table 1 summarizes 30 of the most recent samples collected from each of the sampling stations. This summary shows that all but Station 57 pass the NSSP water quality standard.

    Station: 57 in McLane Cove is currently failing the NSSP water quality standard with an estimated 90t11

    percentile of 46.3 FC/1 OOmL. In addition to the failing station, Station 67 is Concerned status. Table 2 includes individual sample results for the failing station.

    Activities In The Growing Area in 2014

    The majority of the Hood Canal 6 growing area was sampled a minimum of six times in accordance with NSSP criteria for Systematic Random Sampling method. Exceptions include station 233, which was only sampied five times. Stations 212, 213, and 214 were monitored 12 times to help better assess the impacts of the Skokomish River to the Growing Area. Five new stations were added in the Hoodsport area based on a tribal request to evaluate the area. This area is currently classified as Prohibited. These new stations have only been monitored twice.

    A portion of the growing area was closed from Mayl st to September 30th due to boating activities at the Alderbrook dock. The area from Browns Point to Bald Point was closed 10 times for 140 days due to flooding on the Skokomish River. The Hood Canal Coordinating Council is receiving National Estuary Program funds to develop and implement the Hood Canal Regional Pollution Identification and Correction (HCRPIC) plan. Hoodsport and the shoreline near to Station 292/Big Bend Creek have been prioritized areas for Mason County pollution identification and corrective activities under the HCRPIC plan.

    Analytical Results Of Water Samples

    Table 1 summarizes the most recent 30 samples collected from each of the sampling stations. Station 292 fails to meet the NSSP water quality standard with an estimated 90th percentile of 43.4 FC/1 OOml. Station 292 appears to be impacted by rainfall events. All other stations meet NSSP standards for their respective classification.

    Station 309 has an estimated 90t11 percentile of 25 FC/100 ml and is classified as "Concern".

    1. Mason County Parks Advisory Board

    • Mason Parks Board meets first Wednesday of the month at 5:00 p.m

    • Very engaged and dedicated group - need assure support

    2. MCRA Park Field #6 and #7 Project

    • We have a $260,000+ RCO grant from RCO e Commission has pledged a match of $130,000

    • Community is tasked with matching $130,000

    3. Kiosk in Allyn on Street End next to Leonard K's

    4. Coulter Creek Park RCO grant • We likely will have two RCO grants, $1,000,000 each - both match one another

    • Might need 10% match. We plan to ask the seller for 10% discount

    5. Sheriff Evidence Facility Capital Request

    Monitor state capital budget to see if funds are allocated.

    6. Building 3 and 8 move

    23. Vance Creek Bridge Project

    • This project can happen and John offered to continue to facilitate. Green Diamond Resource Company is anxious to help. Vertigo Bungee potential partner, and a NOVA grant could be all that is needed to make it happen.
