    1.0 Summary The Peninsula Corridor Joint Powers Board (JPB) which operates the San Francisco Bay Area’s Caltrain passenger rail service proposes to replace the two-track railroad bridge that crosses Los Gatos Creek, in the City of San Jose, Santa Clara County, California. The Proposed Action is needed to address the structural deficiencies and safety issues of the Caltrain Los Gatos Creek railroad bridge to be consistent with the standards of safety and reliability required for public transit, to ensure that the bridge will continue to safely carry commuter rail service well into the future, and to improve operations at nearby San Jose Diridon Station and along the Caltrain rail line. This report documents the evaluation of potential hazardous materials issues related to the Los Gatos Creek Bridge Replacement/South Terminal Phase III Project to inform the environmental review processes under California Environmental Quality Act (CEQA) and the National Environmental Policy Act (NEPA). The efforts documented in this report include a review of previous environmental site investigations of the project (which have included soil sampling and testing of bridge materials for lead-based paint), an updated environmental database search to identify potential sources of contamination in the vicinity of the project, an updated site visit, and identification of standard hazardous materials management commitments appropriate to minimize potential impacts. This report concludes that in the long-term, the proposed project would have no impact on hazardous materials exposure. Temporarily during construction, there is the potential for encountering contaminated soil, creosote-treated wood, and lead-based paints on the existing bridge. These types of materials are routinely addressed in JPB construction projects through standard best management practices in accordance with federal and state regulations. With incorporation of these best management practices, the impact of the project on hazardous materials would be less than significant under CEQA.

    2.0 Introduction The Peninsula Corridor Joint Powers Board (JPB) proposes to replace the two-track railroad bridge that crosses Los Gatos Creek, in the City of San Jose, Santa Clara County, California (see Figure 1). The purpose of this report is to document the evaluation of potential hazardous materials issues related to the project, including review of existing potential sources of contaminated materials, assessment of impacts related to contaminated materials during construction of the project, and identification of standard hazardous materials management commitments appropriate to minimize potential for impacts. 2.1 Project Location The Peninsula Corridor Joint Powers Board (JPB) which operates the San Francisco Bay Area’s Caltrain passenger rail service proposes to replace the two-track railroad bridge that crosses Los Gatos Creek, in the City of San Jose, Santa Clara County, California. As shown in Figure 1, the proposed project area, generally bounded by Caltrain’s San Jose Diridon Station to the north, Interstate 280 (I-280) to the south, Sunol Street to the west, and Royal Avenue on the east, occupies the width of the right-of-way (ROW) owned by JPB and extends a distance of approximately 0.4 mile. Two tracks, Main Tracks 1 and 2 (MT-1 and MT-2), run parallel through the entire project area. MT-1 is owned by the Union Pacific Railroad (UPRR) for freight service and MT-2 is owned by the JPB for Caltrain service. Both tracks connect with San Jose Diridon Station Tracks 1 through 9 immediately south of the Park Avenue Overpass. From the Park Avenue Overpass, the double-track alignment continues southward for approximately 800 feet before passing beneath the West San Carlos Avenue vehicular bridge. Immediately south of the West San Carlos Avenue vehicular bridge, the two tracks turn in a southeasterly direction and extend approximately 200 feet across the Los Gatos Creek railroad bridge. The JPB owns and maintains the Los Gatos Creek railroad bridge. Both tracks continue southeast for approximately 500 feet before crossing Auzerais Avenue at grade. South of Auzerais Avenue, the double-track alignment continues for approximately 400 feet before reaching the project area's southern boundary immediately north of the I-280 overpass. Beyond I-280, the alignment continues south to Caltrain’s Gilroy Station.

    2.2 Purpose and Need of the Proposed Project The proposed project is needed to address the structural deficiencies and safety issues of the Caltrain Los Gatos Creek railroad bridge to be consistent with the standards of safety and reliability required for public transit, to ensure that the bridge will continue to safely carry commuter rail service well into the future, and to improve operations at nearby San Jose Diridon Station and along the Caltrain rail line. These project needs are discussed below.

    Existing Safety Concerns 2.2.1 The existing Los Gatos Creek Bridge measures 174 feet in length and 35 feet in width and is approximately 100 years old. The bridge is made up of two bridge types, steel girders on concrete piers and timber trestle on wooden pile bents (piers). There are a combined nine piers and bents in the creek including the abutments. Second-hand steel girders (now much older than 100 years) were used during the original construction of the bridge and contribute an additional risk for the structural failure of the bridge. The existing bridge was inspected in 2005 and 2012 as part of the on-going JPB Bridge Program and many elements were found to not meet current load requirements. Although the steel spans are in good condition, the southerly timber trestle approach spans have been damaged by fire and have experienced moderate section loss. The bridge was evaluated per current industry requirements for the inspected condition and was found to rate below the current and projected service loads as well as the JPB design criteria for live load capacity (Cooper E80) for new bridges. The bridge was also analyzed for seismic capacity and found to be vulnerable during significant magnitude earthquakes. Figure 2 shows two photographs from the most recent bridge inspection in 2012.     The bridge has reached and exceeded the 75-year useful life for which it was designed. Due to its increasing age, the compromised condition of the southerly trestle approach spans, failure of some bridge elements to meet current and projected service loads, and vulnerability in the event of a significant earthquake, the Los Gatos Creek Bridge needs to be replaced with a new structure.

    Need for a Tail Track 2.2.2 Caltrain currently operates 46 northbound and 46 southbound trains per weekday (for a total of 92 trains per day). Thirty-four of these trains originate and terminate at Tamien Station, located approximately 1.3 miles south of the Los Gatos Creek Bridge. All Caltrain service to Tamien Station and further south utilizes only one of the two tracks through the project area, MT-2. The San Jose Diridon Station has recently completed an expansion program that included four new platform faces with extended platform lengths. The expansion allows for more trains to serve the San Jose Diridon Station and more passengers to access the Caltrain trains. In addition to Caltrain, Altamont Corridor Express (ACE), Capitol Corridor, and Amtrak also serve San Jose Diridon Station. ACE currently operates three weekday trains to San Jose during the morning peak period and three weekday trains departing San Jose in the evening peak period. Capitol Corridor operates seven weekday trains originating and departing from San Jose Diridon Station (for a total of 14 trains per day). Amtrak Long Distance currently operates the Coast Starlight which serves San Jose Diridon Station with two trains per day (one northbound and one southbound). While ACE and Capitol Corridor trains terminate passenger service at San Jose Diridon Station, one Capitol Corridor train and three ACE trains use Tamien Station and the Tamien yard for layovers. These trains utilize MT-1 through the project area from San Jose Diridon Station to Tamien Station. Since MT-1 is owned by UPRR, freight service has priority use for the track. Currently, the two tracks are sufficient to provide service through this rail corridor. However, several trains a day pass through the project area just to access the layover area at Tamien Station. There is no siding along this stretch of the Caltrain corridor; therefore non-revenue, non-passenger trains are traveling the full length between San Jose Diridon and Tamien Stations just to turn around. Moreover, other trains that terminate at San Jose Diridon Station have limited rail yard space to efficiently maneuver and change directions. A tail track extending south from San Jose Diridon Station would improve operations at San Jose Diridon Station and would be able to accommodate the trains otherwise laying over and changing direction at Tamien Station. In addition, if there is a delay in one of the rail services, or if a train breaks down, the lack of any siding along this alignment creates a delay along the entire route. The tail track in the project area would also serve as a temporary, emergency layover area for a passenger train.

    Purpose of the Proposed Project 2.2.3 The purpose of the proposed project is to replace the structurally deficient Los Gatos Creek railroad bridge and provide a tail track south of San Jose Diridon Station in order to:

    Ensure safe rail travel for Caltrain passengers and other users of the Los Gatos Creek railroad bridge;

    Improve operations at the San Jose Diridon Station and provide an efficient way for trains to change directions; and,

    Minimize system-wide delays by providing a temporary, emergency layover area. Without the proposed project, the replacement of the Los Gatos Creek railroad bridge would not be completed and the bridge would continue to present an increasing safety hazard to all users. In addition, operations at nearby San Jose Diridon Station would not be improved and system-wide delays would be likely to occur. 2.3 Project Description The following sections describe design elements and construction phasing plan for the proposed project. The proposed project consists of replacing the existing Los Gatos Creek Bridge while maintaining rail services across the bridge. The new bridge will consist of a two-track alignment over Los Gatos Creek with the addition of a tail track extending south from San Jose Diridon Station. The addition of the tail track comprises Phase III of the South Terminal Project, which includes a variety of improvements at and near the San Jose Diridon Station to improve Caltrain operations along this corridor. 2.4 Project Elements Figure 3 illustrates the elements of the proposed project. The existing bridge consists of a north abutment, three piers in the creek area, and a series of timber bent segments on the south end; the new bridge would have a north abutment, two piers within the creek area, and a south abutment. The two tracks that currently utilize this bridge are MT1 (owned by UPRR and on the east side of the bridge) and MT2 (owned by the JPB). The new bridge would be wider than the existing bridge, with the expansion occurring on the west side to accommodate the tail track to improve operations at the San Jose Diridon Station just to the north of the project area. The tail track and several temporary tracks, known as shoofly tracks, will be used to route trains around the area under construction in order to maintain active rail service across the bridge at all times. The ultimate alignments of MT1 and MT2 over the new bridge would be generally unaltered from their current configuration. The limits of the tail track are from approximately 300 feet north of West San Carlos Street 300 feet south of Auzerais Avenue, where it ties back into MT2 before the alignment crosses over I-280, the southern limit of the project area. Due to spacing requirements between adjacent tracks, minor right-of-way acquisitions from two parcels on the west side of the tracks would be required. Rock slope and scour protection (riprap) would be installed on the north bank of the creek.

    Caltrain operates, and is required to operate, rail service on two tracks across the Los Gatos Creek Bridge at all times. In order to maintain continuous rail operations on both tracks, the construction of the replacement span must take place in three sections. Before work can start on any section, the channel flow must be diverted via a pipe and out of the way of the work. Only after the channel is diverted can the first section be constructed. Piles, piers, superstructure, and finally the track itself will be constructed only after the channel diversion is complete. However, during the winter months, when no work is taking place in the channel, the channel shall be returned to its original condition. Therefore, in order to construct the new piers and bridge superstructure, Los Gatos Creek would be realigned via a diversion channel or pipe three times during construction. Proposed staging and laydown areas have been identified on the west side of the existing bridge. A portion of the staging area lies on private property and temporary construction easements would be needed for this area. 2.5 Construction Staging Replacement of the Los Gatos Creek railroad bridge is estimated to last approximately 24 months starting in 2015. Work within the creek will be limited to only the time between June 15th and October 15th in order to accommodate sensitive environmental resources. As a result of the environmentally constrained window for work within the creek, the in-creek construction elements will be completed in two consecutive summer seasons. The construction stages and major work elements are outlined in Table 1.

    3.0 Review of Previous Hazardous Materials Studies A Limited Phase I Environmental Site Assessment (ESA) Report dated July 2, 2008 was prepared for the Los Gatos Creek Bridge Site by Environmental Resources Management (ERM). Review of historical documents by ERM as part of the 2008 ESA indicated that the area surrounding the project site appeared to be occupied by commercial and residential buildings in all historical aerial photographs reviewed. The existing railroad bridge was constructed on the site in 1935.1 No nearby properties were identified with the potential to have affected the project site with hazardous materials. ERM identified no environmental concerns during a site visit in 2008. ERM did not identify recognized environmental conditions (RECs) associated with the project site, but concluded that based on the historic and present use of the bridge for rail operations, the potential exists that chemicals (such as petroleum hydrocarbons and metals) may have impacted the project site. ERM also identified the possibility that lead-based paint was used in the construction of the Los Gatos Creek Bridge based on its age. Based on the findings of the Limited Phase I Assessment, ERM collected soil samples for laboratory analysis to determine if soil contamination was present at the Site. ERM also collected paint samples from the bridge for lead analysis. The results of both soil sampling programs were provided in a letter report dated August 25, 2008. Based on the findings of this sampling and analysis, the following conclusions were made: Relatively insignificant impacts to soil were detected in the limited sampling

    conducted. Total petroleum hydrocarbons (TPH) as motor oil was the only contaminant consistently detected above the San Francisco Regional Water Quality Board Environmental Screening Levels. Reuse of any soil generated during the bridge reconstruction would be governed by the Caltrain North and South CTX Soil Management Plan (SMP) prepared by ERM in 2003. The SMP allows reuse of soil in the railroad ROW with up to 1,000 milligrams per kilogram of TPH as motor oil. ERM recommended that soil in the affected areas (near sample points LG-7 and LG-8 immediately west of the current Orchard Supply Hardware property) be stockpiled and sampled for TPH prior to reuse in the project area. Any soils that would require disposal off-site would require chemical profiling prior to disposal. Additional identified affected soils encountered during construction may require further characterization and determination of soil handling procedures.

    Lead-based and lead-containing paint was identified on the bridge structure. ERM recommended that any contractor performing demolition activities on the bridge structure comply with the California Division of Occupational Safety and Health (Cal/OSHA) Lead in Construction Standard for protection of workers, and properly control and contain paint dust and debris resulting from the demolition operation. The resulting paint chips, dust and debris should be properly contained and disposed of.

    4.0 Review of Environmental Databases The 2008 Limited Phase I Assessment included a database search for regulatory agency records regarding the project site and nearby properties. The 2008 ESA did not identify any properties that are considered RECs and at which releases or potential releases of oil or hazardous materials have occurred that have the potential to affect soil or groundwater quality at the project site. Although the 2008 report indicated that there are regulated properties in the vicinity of the project site, these nearby sites are not expected to have adversely impacted the project site because either (1) the case has been closed, (2) the sites are located downgradient or crossgradient from the project site, and/or (3) the sites are sufficiently distant from the project site. In order to update the 2008 findings, a search of federal and state databases was conducted by Environmental Data Resources, Inc. (EDR) in March 2013 (Appendix A). The various databases discussed further below in this section were reviewed for information regarding documented and/or suspected releases of regulated hazardous substances and/or petroleum products on or near the project site. The following federal databases (publication date in parentheses), identified by ASTM Standard E1527, were reviewed. The standard search radii specified in the ASTM were used for all databases.

    This EnviroStor web page allows one to search for properties regulated by DTSC where extensive investigation and/or cleanup actions are planned or have been completed at permitted facilities and cleanup sites.

    GeoTracker (State Water Resources Control Board, (http://geotracker.waterboards.ca.gov/).

    Geotracker is a database and geographic information system that provides online access to environmental data. It tracks regulatory data about leaking underground storage tanks (USTs), Department of Defense, Spills-Leaks-Investigations-Cleanups (SLIC) and Landfill sites. The database also contains information about public drinking water wells. Geotracker uses commercially available software to allow users to access data over the Internet.

    The unmappable (also referred to as “non-geocoded”) listings within the database report were also reviewed, cross-referencing available address information and facility names. Unmappable sites are listings that cannot be plotted with confidence, but are located within the general area of the Subject Property based on the partial street address, city name, or zip code. In general, a listing cannot be mapped due to inaccurate or incomplete address information in the database supplied by the corresponding regulatory agency. The criteria used to evaluate the potential for impact to the project site included:

    Distance from the project site; Expected depth and direction of groundwater and surface water (including

    stormwater) flow; The presence of documented releases of oil or hazardous materials at the

    identified sites; and The potential for impacts to the project site given past or present site activities.

    The identification of a site as potentially upgradient or downgradient is based on the regional topography with a general hydraulic gradient in the area of the project site expected to be northeasterly, toward the Guadalupe River and San Francisco Bay. Sections 4.1 through 4.5 provide a summary of sites from the database reviews that have the potential to affect the project site based on their distance and location with respect to the project site and/or the nature of hazardous materials releases on the sites. 4.1 RCRAInfo Inclusion on the EPA’s RCRA information system is not necessarily indicative of contamination; rather, it indicates the presence of potential sources of contamination. The database includes selective information on sites which generate, transport, store, treat and/or dispose of hazardous waste as defined by RCRA. Conditionally exempt small quantity generators (SQGs) generate less than 100 kilograms (kg) of hazardous waste, or less than one kg of acutely hazardous waste per month. Small quantity generators generate between 100 kg and 1,000 kg of hazardous waste per month. Large quantity generators (LQGs) generate over 1,000 kg of hazardous waste, or over 1 kg of acutely hazardous waste per month. Transporters are individuals or entities that move hazardous waste from the generator off-site to a facility that can recycle, treat, store, or dispose of the waste. Treatment, Storage or Disposal Facilities (TSDFs) treat, store, or dispose of the waste. The following RCRA generators were identified within one-half mile and upgradient from the project site in the environmental database report:

    Site Location Distance/Direction Orchard Supply Hardware 720 W San Carlos St. adjacent to southeast Tony’s Auto Repair 696 Auzerais Ave. 0.15 mile SE Apex Marble, Inc. 806 West Home St. 0.29 mile SSW All of these RCRA sites are SQGs. 4.2 EnviroStor The State of California maintains an inventory of the known contaminated sites (SHWS) in California, listed on the EnviroStor. These sites may or may not already be listed on the federal CERCLIS List. According to the EDR Report (Appendix A), there are two SHWS located within one-mile of the project site: Site Location Distance/Direction Reed & Graham, Inc. 609 Sunol St. 0.44 mile SSW Former West Coast Rebar 1131 Auzerais Ave. 0.49 mile WSW The Reed & Graham site is listed as “inactive – needs evaluation” in the EDR report. The former West Coast Rebar site is labeled as “Certified O&M, land use restrictions only.” Based on the distance of these sites from the project site, releases of hazardous materials on these properties are not expected to affect the project site. 4.3 Leaking Storage Tanks The LUST Incident Reports contain an inventory of reported leaking UST incidents. The EDR report indicated there are 112 LUST sites identified within approximately 0.75 mile of the project site, 40 of which are at equal or higher elevation. The closest of these listed LUST sites is the adjacent Orchard Supply Hardware to the southeast. The EDR report indicates the case for the leaking tank incident at the Orchard Supply Hardware store is now closed. 4.4 Spills-Leaks-Investigations-Cleanups The SLIC List, prepared by the California Regional Water Quality Control Board indicated that there are 16 SLIC sites within approximately 0.75 mile of the project site, 3 of which are at equal or higher elevation. The EDR report indicates that the spill cases for these 3 incidents are now closed. 4.5 Voluntary Cleanup Sites The former West Coast Rebar site at 1131 Auzerais Ave, about one-half mile west-southwest of the project site appears on the VCP list. As previously stated, this property is identified in the EDR report as “Certified O&M, land use restrictions only,” and based on its status and distance from the project site, releases of hazardous materials on this properties are not expected to affect the project site.

    5.0 Site Reconnaissance An environmental scientist conducted an updated site inspection along accessible portions of the project site on March 23, 2013. Photographs taken during the site reconnaissance are provided in Appendix B. The site reconnaissance recorded surficial and visible conditions only. Such a review cannot be expected to reveal all hazardous materials or conditions that might be present on-site; the possibility exists that some hazardous materials or conditions might exist and not be detected. The weather was sunny with a temperature of about 60° Fahrenheit (F) at the time of the site reconnaissance. Accessible portions of the project site were viewed by walking along the right-of-way, Los Gatos Creek, and public streets transecting the project corridor. The Los Gatos Creek Bridge itself was not directly accessed due to its location entirely within the active right-of-way; however, it could be readily viewed from adjacent properties. The project site consists of the Los Gatos Creek Bridge and a corridor of railroad right-of-way adjacent to residential and commercial properties near downtown San Jose, including a paint store (Kelly Moore Paints), an auto repair business (Ross Tire), a cleaning/restoration service (Service Master Clean), and a hardware and garden supply store (Orchard Supply Hardware). Los Gatos Creek transects a portion of the project site and the Los Gatos Creek Trail recreational trail parallels a portion of the project site. A former Del Monte Foods site, now converted into the Monte Vista townhome complex, is located adjacent to this trail. At the eastern end of the project site are rail yards adjacent to the Caltrain San Jose Diridon Station and the San Jose Fire Department Training Facility. During the site visit, evidence of dumping (furniture, tires, and other litter) was observed along the banks of Los Gatos Creek and in the creek itself, and evidence of homeless person encampments was observed. Several full 5-gallon buckets and other plastic containers of apparent automotive fluids were observed discarded along the right-of-way immediately south of Auzerais Avenue. Oily staining was observed on the ground surface beneath these containers.

    6.0 Impacts and Mitigation

    In the long-term, the replacement of an existing active rail bridge and provision of a tail track would not result in impacts related to hazardous materials. With respect to creosote-treated wood and lead-based paints, the project would have a long-term beneficial impact because these hazardous materials would be removed, eliminating the potential for impact the Los Gatos Creek from leaching (creosote) or falling paint chips (lead-based paint). These materials would not be used in the new replacement bridge.

    Temporarily during construction, it is possible that contaminated materials common to railroad environments could be encountered and would need to be addressed with standard best management practices in accordance with federal and state regulations. Based on the data obtained during the site inspection, regulatory records review, and reports for previous investigations on the project site and its history, the following RECs have the potential to impact the project site:

    Adjacent and nearby properties have had documented releases of oil or hazardous materials that have the potential to migrate via groundwater toward the project site. Although there is no known evidence that contamination from nearby properties has migrated to the project site the presence of the project site within an urban corridor with multiple documented releases of oil and hazardous materials represents a REC.

    Evidence of dumping observed on the project site included several full 5-gallon buckets and other plastic containers of apparent automotive fluids long the right-of-way immediately south of Auzerais Avenue. Oily staining was observed on the ground surface beneath these containers. This dumping and apparent spill of petroleum products represents a REC and may require remediation in accordance with State and local regulations.

    Based on the historic and present use of the project site for rail operations, the potential exists that chemicals commonly found along rail corridors including petroleum hydrocarbons and metals may have affected the project site. This current and historic use represents a REC. As is common with rail bridges, the wooden components of the existing bridge contain the wood preservative creosote, a complex mixture of chemicals. The primary substance of concern in creosote-treated wood is polycyclic aromatic hydrocarbons (PAHs). Creosote can leach into the environment gradually over time as wood is exposed to sunlight.2

    The following mitigation measures/best management practices will be implemented to minimize any potential for workers or the public to be exposed to hazardous materials temporarily during construction:

    Reuse of any soil generated during the bridge reconstruction will be governed by the Caltrain North and South CTX Soil Management Plan (SMP) (ERM, 2003). Soil should be stockpiled and sampled for TPH prior to reuse in the project area. Any soils that would require disposal off-site would require chemical profiling prior to disposal.

    The construction specifications and health and safety plan for the proposed construction will contain emergency response and contingency procedures for encountering unknown wastes and hazardous materials.

    The contractor performing demolition activities on the bridge structure will comply

    with the Cal/OSHA Lead in Construction Standard for protection of workers; properly control and contain paint dust and debris resulting from the demolition operation; and properly contain and dispose of the resulting paint chips, dust and debris.

    The contractor will be required be handle, store and dispose of creosote-treated wood according to California Department of Toxic Substances Control's Alternative Management Standards for treated wood waste. The standards are an alternative to the full hazardous waste regulations and allow for treated wood waste to be disposed of at approved solid waste landfills (as opposed to special hazardous materials disposal facilities). Wood waste would not be stored near the Los Gatos Creek.

    During final design, the contractor will be required to prepare a plan for minimizing environmental exposure to creosote during demolition activities, including pile removal. If found feasible, vibratory extraction will likely be the preferred method of pile removal because studies of this issue have concluded it results in less suspension of sediments than vertical pulling.3 The plan will also need to provide containment procedures for minimizing the risk of wood debris entering the creek and associated riparian habitat.

    7.0 CEQA Analysis Table 2 summarizes the hazardous materials analysis conclusions in terms of the CEQA significance thresholds. With the incorporation of mitigation measures for temporary construction impacts as described in Section 6, no significant adverse impacts would occur.

    Less than Significant Impact. Temporarily during construction, there is the potential for encountering contaminated soil, as well as lead‐based paints and creosote‐treated wood on the existing bridge. These type of materials are routinely addressed in JPB construction projects through standard best management practices in accordance with federal and state regulations and do not pose a “significant hazard” to the public or environment.  In addition, Removal of the existing old creosote‐treated piers will occur in the dry portions of the construction area during the June‐October work window, thus preventing creosote debris from entering the waterway.  In the long‐term, the replacement of an existing active rail bridge and provision of a tail track would not create a significant hazard to the public or environment related to hazardous materials.  Hazardous materials may be transported through the project area by UPRR freight rail operations, but the project would not increase hazards related to freight rail. In fact, the project would reduce such freight‐related hazards by replacing a deteriorating bridge that has exceeded its useful life.  

    b) Create a significant hazard to the public or the environment through reasonably foreseeable upset and accident conditions involving the release of hazardous materials into the environment? 

    Less than Significant Impact. Small quantities of potentially toxic substances (such as petroleum and other chemicals used to operate and maintain construction equipment) would be used in the project area and transported to and from the area temporarily during construction. Handling of these materials and any accidental spills would be addressed in accordance with federal, state and local requirements.   The replacement bridge would provide for safe railroad operations. The existing deteriorating bridge that has exceeded its useful life would be removed.  Therefore, the project would not create conditions that would create a significant hazard due to accidents and there would be no impact in the long‐term.

    No Impact. There are no existing or proposed schools within one‐quarter mile of the project site.  

    d) Be located on a site which is included on a list of hazardous materials sites compiled pursuant to Government Code Section 65962.5 and, as a result, would it create a significant hazard to the public or the environment? 

    No Impact‐ The project site is not included on a list of hazardous material sites compiled pursuant to Government Code Section 65962.5. 

    e) For a project located within an airport land use plan or, where such a plan has not been adopted, within two miles of a public airport or public use airport, would the project result in a safety hazard for people residing or working in the project area? 

    No Impact‐ The project site is located more than two miles southeast of the Mineta San Jose International Airport and is not within the land use plan or safety zone for the airport. 

    f) For a project within the vicinity of a private airstrip, would the project result in a safety hazard for people residing or working in the project area? 

    No Impact. The nearest private airstrip is located more than five miles northwest of the project site, in Mountain View, CA.  The project is not within in any airport land use or safety zone. 

    g) Impair implementation of or physically interfere with an adopted emergency response plan or emergency evacuation plan?

    Less than significant impact. During construction, emergency access to and in the vicinity of the project site could temporarily be affected by lane closures, detours, and construction‐related traffic. As noted in the Traffic Technical Report, a Traffic Management Plan would be implemented to ensure there is no interference with emergency vehicles/services or response/evacuation plans. The project would have no impact on emergency response or evacuation in the long‐term.  

    h) Expose people or structures to a significant risk of loss, injury or death involving wildland fires, including where wildlands are adjacent to urbanized areas or where residences are intermixed with wildlands?

    No Impact. According to the CDFFP San Jose fire map (California Department of Forestry and Fire Protection 2000) the proposed project site is not located in a fire hazard region. Therefore, there would be no impact associated with wildland fires.
