Conditions Générales de Location de MobilierConditions for Equipment and Furniture Rental

Toute location vaut acceptation sans réserve par le client desprésentes conditions générales de location à l’exclusion de toutautre document émanant du client même si CAMERUS en a euconnaissance.Any rental signifies the client’s full agreement to the present generalrental conditions and nullifies any document originating with theclient even if CAMERUS has been made aware of it.

Article 1Commande OrderingLe client doit passer sa commande par écrit en indiquant la quantitéet les références du mobilier loué, le prix convenu, la période etle lieu de location. La commande ne deviendra définitive qu’aprèsla signature par le client de la confirmation de commande ou dudevis émis par CAMERUS accompagné des conditions générales delocation. Il en sera de même pour toute demande de modificationet / ou de commande complémentaire. Le règlement de la totalitéde la commande, incluant la participation à l’assurance devra êtrejoint à la commande. Toute commande non accompagnée de sonrèglement ne pourra être honorée.Toute première commande d’un nouveau client doit être accompa-gnée de ses références commerciales et bancaires afin de permettreune ouverture de compte. A défaut, elle pourra ne pas être prise encompte par CAMERUS.The client must place the order in writing indicating the quantityand the reference numbers of the furniture or equipment rented,the agreed price, the dates, and the rental location. The order becomesfinal once the client has signed the order confirmation or theestimate drawn up by CAMERUS with the general rental conditionsattached.The same will be true for any request for modification and/or additionalorder. Payment for the entire order, including insurance charges,must accompany the order. Any order which does not include paymentcannot be honored.All first-time orders from a new client must also include its businessand banking information in order to establish its account. If not, theorder cannot be accepted by CAMERUS.

Article 2Modification · Annulation Changes · CancellationEn raison des contraintes liées à la disponibilité des stocks et auxdélais de réalisation de la prestation, CAMERUS pourra être conduità fournir, en lieu et place du mobilier commandé, un mobilier dequalité identique. Le client sera réputé l’accepter en l’absenced’un refus de ce mobilier de remplacement dès réception de laconfirmation de commande.Toute annulation de commande même partielle restera à lacharge du client et sera intégralement facturée.À titre dérogatoire, CAMERUS pourra accepter par écrit l’annulationqui entraînera en tout état de cause l’émission d’une facture d’indemnitéde dédit correspondant à 20% TTC du montant total de la commande.Après livraison conforme à la confirmation de commande, en casd’annulation totale ou partielle du mobilier, ou de changementde matériel, aucune déduction ne sera appliquée.Circumstances such as problems arising from availability of inventoryand fabrication turn-around time may sometimes lead CAMERUSto substitute furniture and equipment of quality identical to that ordered.The client is considered to have accepted it unless this replacementmaterial has been refused at the time of receipt of the order confirmation.The client will remain liable for any order cancelled, even partially,and will be billed for the entire amount. By special arrangement,CAMERUS may accept a cancellation in writing, which will, in anycase, give rise to the billing of a withdrawal penalty equivalent to20% of the total amount of the order, including tax.No deductions shall be applied for all fully or partially cancelledequipment or for any change in furniture.

Article 3Tarif PricingTous les prix indiqués par CAMERUS, y compris ceux indiqués surson site de commerce électronique, s’entendent en Euros, horstaxes, sans escompte et pour une durée inférieure à 10 jours. Letransport n’est inclus que pour les foires et salons se déroulantdans un rayon de 40 km de notre dépôt et dont Camerus est unfournisseur officiel. Les frais de main d’oeuvre sont inclus dansle cas d’un accès véhicules sans contraintes, d’une livraison enrez-de-chaussée ou par monte-charge. Les livraisons sans accèsvéhicules, par escalier ou à des horaires non conventionnels(entre 22h et 6h00) feront l’objet de frais spécifiques. Pour leslivraisons effectuées après l’ouverture officielle de la manifestation,des frais de transport complémentaires seront facturés.All prices listed by CAMERUS, including those listed on its electronicsales site, are understood to be in Euros, not including taxes ordiscounts, and for a duration of less than 10 days.Transportation is included only for fairs and trade shows taking placewithin a radius of 40 km of our warehouse and for which Camerusis an official supplier. Labor costs are subject to a free access forthe trucks, a delivery on the ground floor or through goods. Non-standard deliveries (by stair cases, unconventional hours, with li-mited parking access …) will be subject to extra charges. Extratransport / labor costs will also apply on orders placed after the of-ficial start of the celebration.

Article 4Intérêts de retard Flate feesEn cas de retard de paiement, le client sera redevable de pleindroit, sans mise en demeure, d’un intérêt de retard égal à deuxfois le taux d’intérêt légal en vigueur à la date d’échéance.À défaut de paiement d’une seule facture à l’échéance, les autresfactures échues ou non échues deviendront immédiatementexigibles sans mise en demeure ou autre formalité.In cases of payment past due, the client will automatically be assessed,without notification, a late fee equivalent to two times the legalinterest rate in effect on the due date. If one bill payment is missed,all other bills due or not yet due become immediately payable withoutnotification or further procedure.

Article 5Livraison · Reprise Delivery · ReturnLa livraison du mobilier loué est effectuée par CAMERUS selon lesconditions indiquées dans la confirmation de commande transmiseau client. Le client est responsable du mobilier loué de la livraisonà sa reprise. Le mobilier loué en bon état devra être utilisé confor-mément à sa destination et le client s’engage à ne rien faire oulaisser faire qui puisse le détériorer. Le client est responsable detoute détérioration, perte ou vol éventuel du mobilier. Le clientprendra toute disposition en vue de se garantir contre cesrisques et d’une manière générale tout sinistre dont il sera tenuresponsable. En cas de détérioration, le client sera tenu de réglerles frais de remise en état ou la valeur neuve du mobilier en casd’impossibilité de procéder à sa réparation. Le mobilier doit êtrelaissé à la disposition de CAMERUS vide de son contenu dès lafermeture de la manifestation.CAMERUS ne saurait en aucun cas être rendu responsable de ladisparition ou de la détérioration d’objets n’ayant pas été retirés dumobilier loué. Le matériel reste la propriété exclusive de CAMERUSet ne pourra faire l’objet d’aucun déplacement ou cession, prêtquelconque. Toute contestation sur la qualité ou la quantité dumobilier loué doit être adressée par lettre recommandée avecaccusé de réception dans un délai de 24 heures après la livraison,passé ce délai aucune contestation ne sera admise.En cas de refus du matériel par le destinataire final, pour quelquecause que ce soit, l’intégralité du prix de la facture établie resteraexigible auprès de la société facturée.Delivery of the equipment rented is performed by CAMERUS underthe conditions set forth in the order confirmation forwarded to theclient. The client is responsible for the equipment rented from the timeof its delivery until its return.Equipment rented in good condition must be used as intended andthe client promises not to treat it or let it be treated in a way whichmay damage it. The client is liable for any damage, loss, or theft of theequipment which may occur. The client must make all arrangementsnecessary to insure against these risks, and generally speaking,against any damage for which he or she will be held responsible. Incase of damage, the client will be liable for paying the cost of repairor replacement of the items if they cannot be repaired. The equipmentor furniture must be restored to CAMERUS empty of all contents asof the close of the event. CAMERUS will in no case become liable forthe loss or damage to objects which were not removed from the furniturerented.The equipment or furniture remains the exclusive propertyof CAMERUS and may not be moved, transferred, or lent in any way.If the recipient refuses partial or full delivery, for any reason what-soever, the principal shall still be liable to the obligation of a 100%settlement of the Camerus invoice.

Elles sont réputées être sous l’unique responsabilité dulocataire, de la livraison à la reprise. Article 7Clause pénale Penalty clauseSi la carence du client rend nécessaire un recouvrement judiciaire,le client s’engage à régler, en sus du principal, des frais, dépens etémolument ordinairement et légalement à sa charge, une indemnitéfixée à 20% du montant en principal TTC de la créance.If the client’s insolvency makes a judicial collection necessary,the client promises to pay, in addition to the principal amount, costs,expenses, and fees ordinarily and legally owed by the client,damages set at 20% of the principal amount including taxes.

Article 8Loi applicable et attribution de juridictionApplicable law and assignment of jurisdictionLes contrats conclus par CAMERUS sont régis par la loi française.En cas de difficultés d’interprétation ou d’exécution des présentes,même en cas d’appel en garantie ou de pluralité de défendeurs, leTribunal de Commerce de Paris est seul compétent.Contracts entered into by CAMERUS are subject to French law. In casesof problems of interpretation or execution of the present document,even in cases of appeal concerning guarantee or plurality of defen-dants, the Paris Tribunal of Commerce has sole jurisdiction.

Article 9Données personnelles Data collectionA/Collecte de données, Finalité de Traitement et Identité duResponsable de TraitementLa société prestataire procède à la collecte et au traitement desdonnées et des informations à caractère personnel de son client etde ses représentants pour les finalités suivantes (Ci-après dési-gnées ensemble en tant que “Finalité de Traitement“) :• Effectuer les opérations relatives à la gestion des clients, des

affaires, et au suivi de la relation commerciale,• Effectuer les opérations relatives à la satisfaction client• Gérer les demandes de droit d’accès, de rectification et

d’opposition,• Gérer les impayés et le contentieux.La société prestataire a la qualité de Responsable de traitementau sens de la loi et réglementation applicables.Les données collectées par la société prestataire sont traitées demanière licite, loyale et transparente.Les données collectées sont adéquates, pertinentes et limitéesà ce qui est strictement nécessaire au regard de la Finalité deTraitement.

B/Données collectées et consentementLe client et ses représentants sont désignés comme le Client dansle présent document.Le Client reconnaît être informé qu’il a le droit de retirer sonconsentement à tout moment. Celui-ci accepte expressément et de manière non équivoque detransmettre à la société prestataire, ses noms, prénoms, adressepostale, adresse mail, numéro de téléphone, numéro de cartebancaire, et ce dans le cadre des Finalités de Traitement ci-dessusexposées.

C/Informations et accès aux données à caractère personnelConformément aux dispositions du Règlement général sur laprotection des données UE 2016/679 et à la loi relative àl’informatique et aux libertés modifiée du 06 janvier 1978, lasociété prestataire qui a la qualité de Responsable de Traitementinforme le Client des points suivants :

a) Le Client accepte que les données personnelles le concernantrecueillies par la société prestataire dans le cadre des pré-sentes soient transmises aux sous-traitants avec lesquelscelle-ci est en relation contractuelle aux seules fins d’exécutiondu contrat, sous réserve que ces tiers destinataires des donnéesa caractère personnel soient soumis a une règlementationgarantissant un niveau de protection approprié et adapté telque défini au Règlement UE 2016/679.Ces informations sont conservées par lui ou toute sociétémandatée a cet effet, dans les conditions légales et règlementaires. Le Client sera informe préalablement à tout transfert de sesdonnées personnelles en dehors de l’Union Européenne. Enpareille hypothèse, la société prestataire s’engage à respecterla règlementation en vigueur et a mettre en place toute mesurenécessaire afin de garantir la sécurité et la confidentialitédes données ainsi transférées.

b) La société prestataire conservera les informations etdonnées à caractère personnel pendant la durée maximalelégale ou règlementaire applicable en fonction de la Finalitéde Traitement.

c) Le Client dispose d’un droit d’accès, de rectification,d’effacement, de limitation, de portabilité et d’oppositiondes données collectées le concernant.

Ainsi, les données collectées par la société prestataire dans lecadre des présentes peuvent donner lieu à l’exercice du droitd’accès et de rectification dans les conditions prévues par leRèglement UE 2016/679. Tout Client peut à tout moment ob-tenir une copie des informations le concernant sur simple de-mande adressée à la société prestataire et les transmettre àun autre responsable de traitement. Le Client peut solliciter al’adresse ci-dessous, une suppression ou une rectification deces informations par écrit. Il peut à tout moment s’opposerà la réception de sollicitations commerciales, faire modifier sescoordonnées, s’opposer a leur communication en adressantune notification par courrier recommandée ou courriel suivied’un accusé de réception à l’adresse suivante : [email protected]

d) Le Client dispose du droit d'introduire une réclamation auprèsd'une autorité nationale de contrôle.

e) L’exigence de fourniture des données à caractère personneltelles que définies au paragraphe B conditionne l’acceptationdes présentes CGV. Le client est tenu de fournir les Donnéessusvisées.

Purpose of treatment and identity of the data treatment managerThe service provider collects and processes the data and personalinformation of its client and representatives for the followingpurposes (hereinafter collectively referred to as "Purpose ofProcessing"):• Performing the operations related to the management of the

business relation,• Performing the operations related to customer satisfaction• Managing requests related to rights for access, rectification and

opposition,• Managing unpaid bills and litigation.The service provider is responsible for collecting and managing thedata in accordance with applicable law and regulations. The data collected is adequate, relevant and limited towhat is strictly necessary with regard to the Purpose of Processing.

Data collected and consentThe customer and its representatives are referred as “the Customer”in this document.The Customer acknowledges being informed that he has the rightto withdraw his consent at any time. He expressly and unequivocallyagrees to provide the service provider with his name, surname, postaladdress, e-mail address, telephone number and credit card number,for the “Purposes of processing” as set out above.

Information and access to personal dataIn accordance with the General Data Protection Regulation EU2016/679 and the Data Protection Act of January 6th 1978, the serviceprovider who is responsible of data management, informs that:

a)The Customer agrees that his personal data collected by theservice provider can be forwarded to subcontractors withwhom the service provider is in contractual relation; this will bedone for the sole purpose of executing the contract, and providedthat these third parties are subject to regulation ensuring anappropriate level of protection as defined in EU Regulation2016/679 regarding personal data.This information is kept by him or any company mandated for thispurpose, under the legal and regulatory conditions.The Customer will be informed prior to any transfer of his personaldata outside the European Union. In such a case, the serviceprovider undertakes to comply with the regulations in forceand to take all necessary measures to ensure the security andconfidentiality of the data thus transferred.

b ) The service provider will keep the information and personaldata for the maximum legal or regulatory duration applicable ac-cording to the “Purpose of Processing”.

c) The Customer has a right of access, rectification, deletion,limitation, portability and opposition of collected data concerningthe Customer.

Thus, the Customer has a right of access and rectification regardingthat collected data under the conditions provided by the EURegulation 2016/679.The Customer can at any time obtain a copy of its personalinformation against request addressed to the company provider.The Customer may request a deletion or correction of this infor-mation in writing to the below mentioned address. He may at anytime refuse any commercial solicitations, modify his contact details,oppose their communication by sending a notification by regis-tered mail or email followed by an acknowledgment of receipt tothe following address: [email protected]

d) The Customer has the right to complain to the nationalsupervisory authority.

e) The requirement of personal data as defined in §B determinesthe acceptance of these Terms of sales . The Customer is obligedto provide the aforementioned data.
