TermsandConditionsfortheTotalCare11DEFINITIONS:

1.1Thecoverisfortheboiler&systemattheaddressbelow.

1.2PRIORITYATTENTION:Wewillendeavour,subjecttoworkloadandavailability,tocallthesamedayinresponsetoanyfailureofthecentralheatingSystemcoveredbythecontract.

1.3CHARGESFORLABOURANDPARTS:Nochargewillbemadeforanycalloutandannualservicing.Thecontracthasamonthlyfeeof£13.50collectedbymonthlyDirectDebit

2PERIODOFSERVICECONTRACT:

2.1Thiscontractisaminimumperiodof1yearfromthedateonwhichtheagreementwasinitiallymadebetweenAquilaHeating&PlumbingLtdandyou,thecustomer.NOTE:Servicingwillideallybecarriedoutbetween1stMayand31stSeptemberandMUSTbecarriedoutonceayeartomaintainvalidityofthiscontractandyourmanufacturerswarranty.

2.2Thisservicecontractremainsvalidaslongaspaymentiscontinuedandremainsorsubjecttoa30-daywrittenterminationnoticefromyouorAquilaHeating&PlumbingLtdbeforetheanniversaryofthecontract.

2.3AquilaHeating&PlumbingLtdattheirdiscretion,mayrefusetoofferrenewalofanyservicecontractormayofferareducedlevelofcover.

2.4Intheeventofanydefaultinpaymentbyyou,theremainderofthisagreementbecomesimmediatelypayable.Norefundwillbemadefortheunexpiredpartofanyservicecontract.

3PROVISIONOFSPAREPARTS:

3.1AquilaHeating&PlumbingLtdmaysupplyandfitadequatereplacementpartsorcomponentswhicharenotthesamepartsbeingreplaced.

3.2AquilaHeating&PlumbingLtdshallnotbeheldresponsibleforanydelayintheprovisionofsparepartsbysuppliers.

4REPLACEMENTOFCENTRALHEATING:

4.1Thisservicecontractdoesnotincludethereplacementofcentralheating,appliance[s]intheeventofsparepartsorcomponentsnotbeingreasonablyavailable.

5CONDITIONSofTHECENTRALHEATING:

5.1Acceptanceofacentralheating,appliancesorsystemcomponentsontoaservicecontractdoesnotimplythatitisinstalledsatisfactorilyortotheprevailingstandardsofAquilaHeating&PlumbingLtd.AquilaHeating&PlumbingLtdwillnotacceptresponsibilityforanyinadequacyattributabletotheoriginaldesignandmakesnowarrantyastofitnessforpurposeorcondition.

5.2Anyremedialwork,whichisconsideredessentialforsafetyreasons,maybesubjecttoafurthercharge.

6LIMITATIONofOBLIGATION:

6.1AquilaHeating&PlumbingLtdshallnotbeliableifitisunabletocarryoutitsobligationsundertheservicecontractduetoindustrialdisputesorforcemajeure

7EXCLUSIONS:

7.1Thereplacementofdecorativeparts.

7.2Anydefectorinadequacyattributabletotheoriginaldesignofthegascentralheatingsystem/appliances.

7.3Thefabricofthebuildingorpipeworkandfluepipeworkburiedinit.

7.4Anydefectcausedthroughmaliciousorwillfulaction,negligence,misuse,orthirdpartyinterference.

7.5Anydefectordamagecausedbyfire,lightning,explosion,floodstorm,tempest,impactorthirdpartyinterference.

7.6Consequentialdamageorlossarisingasaresultofadefectoccurringinthecentralheatingappliance,systemorthegasapplianceunlesssuchadefect,damageorlossisattributabletothenegligenceofAquilaHeating&PlumbingLtd.

7.7Anydefectordamageoccurringfromafailureofthepublicelectricity,gasorwatersupply.

7.8Descalingandanyworkarisingfromhardwaterscaledepositsorfromdamagecausedbyaggressivewaterorrustorcorrosionandsludgebuildup.

Alsonotcoveredbythiscontract:a)Clearingairlocks,blockedpipesarisingfromincorrectlyinstalledinstallationsb)Unventedwatercylindersc)Condensingheatexchangersd)Powerflushinge)Cylindersandtanksf)Gasleaksg)Repairingorreplacingappliancefluesthataren'tpartofyourboilerh)Movingyourboilerfromthewalltocarryoutarepair.Ifthishastobedone,therewillbeachargeof£250.00i)Thirdpartycharges–egparkingfeesandcongestioncharges.Thesebewillbechargedatcost.
