CONFIRMATION OF PAYMENT OF SETTLEMENTPROCEEDS INTO COURT

NOW COME Defendants, Charter Township of Shelby, a Michigan municipal

corporation, and Robert L. Leman, by and through their attorneys, Seibert & Dloski, PLLC,

and pursuant to this Court’s March 30, 2011 Order (Document 31) state as follows:

1. On March 22, 2011, Defendants filed a Motion to Permit Deposit of

Settlement Into Court (Document 30).

2. On March 30, 2011, this Honorable Court entered its Order allowing

Defendants to pay $40,000.00 in settlement proceeds into Court (Document 31).

3. On March 19, 2011, Defendants’ counsel, Robert J. Seibert, hand-delivered

a settlement draft in the amount of $40,000.00 payable to the United States District Court -

Eastern District of Michigan to the Court Clerk. A copy of the Treasury Registry evidencing

payment is attached hereto, marked Exhibit “A”.

WHEREFORE, Defendants have satisfied the terms of this Court’s March 30, 2011

Order and request that an Order of Dismissal with Prejudice be entered by the Court.
