Republic Act No. 9262 Anti-Violence Against Women and their Children Act of

2004 

“Violence against women and the their children”

any act or series of acts by any person against

his:

•  wife, former wife, or with whom the person

has/had sexual or dating relationship, or with

whom he has a common child, or

•  against her child whether legitimate orillegitimate, within or without the family abode

which result in or is likely to result in physical,

sexual, psychological harm or suffering, or economic

abuse

Specific Acts of Violence

Penalized under the Law 

1. Sexual violence • Rape

• sexual harassment

• acts of lasciviousness

• treating a woman or her child as sex object

• making demeaning and sexually suggestive remarks

• physically attacking the sexual parts of the victim’s body

• forcing her/him to watch obscene publications and indecentshows or

• forcing the woman or her child to do indecent acts and/ormake films

• forcing the wife and mistress/lover to live in the conjugal homeor

• sleep together in the same room with the abuser;

 Acts causing or attempting to cause the victim to

engage in any sexual activity by force, threat offorce, physical or other harm or threat of physical

or other harm or coercion;

Prostituting the woman or her child.

acts or omissions causing or likely to causemental or emotional suffering of the victim such

as intimidation, harassment, stalking, damage to

property, public ridicule or humiliation, repeated

verbal abuse and marital infidelity.

Penalized under the Law 3. Economic abuse

That make or attempt to make a woman financially dependent

Withdrawal of financial support or preventing victim fromengaging in any legitimate profession, occupation,

business or activity, except in cases wherein the otherspouse/partner objects on valid, serious and moral groundsas defined in Article 73 of the Family Code;

Deprivation or threat of deprivation of financial sources andthe right to the use and enjoyment of the conjugal,community or property owned in common;

Destroying household property;

Controlling the victim’s own money or properties or solelycontrolling the conjugal money or properties.

4. Battering, assault, coercion, harassment orarbitrary

deprivation of liberty.

 Acts committed:

Causing physical harm to the woman or her child;

Threatening to cause the woman or her child physical

harm;

 Attempting to cause the woman or her child physical

harm;

Placing the woman or her child in fear of imminent

physical harm;

Penalized under the Law 

 Attempting to compel or compelling the woman

or her child to engage in conduct which they

have the right to desist from or to desist from

conduct which they have the right to engage in,or attempting to restrict or restricting their

freedom of movement or conduct by force, threat

of force, physical or other harm, threat thereof,

intimidation directed against the woman or child.

Inflicting of threatening to inflict physical harm on

oneself for the purpose of controlling her actions

or decisions;

Causing or attempting to cause woman or herchild to engage in any sexual activity not

constituting rape, by force or threat of force,

physical harm, or through intimidation directed

against the woman or her child or her/hisimmediate family;

conduct, personally or through another that

alarms or causes substantial emotional orpsychological distress.

Causing mental or emotional anguish, public

ridicule, and humiliation to the woman or her

Protective Policies under the Law 

 A petition for protection order may be filed by any of

the following:

the offended party;

parents or guardians of the offended party;

ascendants, descendants, collateral relatives

within the 4th civil degree of consanguinity or

affinity;

officers or social workers of the DSWD or of

Local Government units;

Police officers, preferably those in charge of

women and children’s desks; 

Punong Barangay or Barangay Kagawad;

Lawyer, counselor, therapist or healthcare

provider of petitioner;

 At least two concerned responsible citizens of

city/municipality where the offense is committedand who has personal knowledge of the offense

committed.

Battered Woman 

is one who is repeatedly subjected to any forceful

physical or psychological behavior by a man inorder to coerce her to do something he wants her

to do without concern for her rights.

Battered women

exhibit common personality traits:

• low self-esteem

• traditional beliefs about the home, the family andthe female sex role;

• emotional dependence upon the dominant male;

• the tendency to accept responsibility for thebatterer’s actions; and

• false hopes that the relationship will improve.
