the !ontempation of .egisators when the $!t was ena!ted)$nother aspe!t whi!h the Commission fee is %er( importantin the present s!enario is that when amendments are made tothe effe!t that women ha%e +een entited to inherit propert( from her parenta side as we as from hus+and/s side, itwoud +e 'uite justified if e'ua right is gi%en to her parentaheirs aong with her hus+and heirs to inherit her propert( if su!h a situation arise) It is in this !ontet, the Commissionproposed an amendment to se!tion 1" of the #indu

definite and uniform s!heme of su!!ession to the propert( of a

femae #indu who dies intestate) *here are aso rues set out

in Se!tion 1 of the #indu Su!!ession $!t whi!h ha%e to +e

an( issue then the propert( inherited +( her from her father or

fi%e entries as stated earier +ut upon the heirs of father) $nd

se!ond(, in respe!t of the propert( inherited +( her from her

introdu!ed in the Raj(a Sa+ha did not !ontain an( !ause

!orresponding to su+&se!tion 324 of Se!tion 1") It !ame to +e

in!orporated on the re!ommendations of the Joint Committee

of the two #ouses of @ariament) *he reason gi%en +( the Joint

Committee is found in Cause 17 of the Bi, whi!h reads as

foows&

Hhie re%ising the order of su!!ession among the heirs

to a #indu femae, the Joint Committee ha%e pro%ided,

properties inherited +( her from her father re%erts to the

fami( of the father in the a+sen!e of issue and simiar(

propert( inherited from her hus+and or father&in&awre%erts to the heirs of the hus+and in the a+sen!e of

issue) In the opinion of the Joint Committee su!h a

pro%ision woud pre%ent properties passing into the

hands of persons to whom justi!e woud demand the(

shoud not pass)E

<)? *he intent of the .egisature is !ear that the propert(, if

origina( +eonged to the parents of the de!eased femae,

shoud go to the ega heirs of the father) So aso under !ause

more preferred heirs to inherit her propert( if her !hidren et!)

and hus+and are not ai%e) She woud aso prefer that her

sister and +rother ha%e a +etter right to inherit her propert(

than her +rother&in&aw and sister&in&aw) $!!ording(, it is

urged that Se!tion 1"314 shoud +e modified to ensure that the

hus+and/s heirs a+o%e those who +eong to her nata fami(

ie her father and mother and thereafter her +rother and

sister) It is !ontended that when a man dies intestate, his

wife/s reati%es do not e%en figure in the order of su!!ession

despite the manner in whi!h he ma( ha%e a!'uired the

propert() In %iew of this, parit( is sought in the !ase of femae

+( app(ing the same rues as appi!a+e to mae/s propert()

$!!ording(, it is suggested that it woud +e +etter to amend

Se!tion 1"314 to spe!if( the genera rues of de%oution, whi!h

wi app( not on( to sef&a!'uired propert( +( a women +ut

aso to other propert( a!'uired through her fami(, gifts, et!)

*he on( pro%iso whi!h woud then +e needed woud +e to

propert( that a woman a!'uires from her hus+and/s fami()

from the hus+and fami( as we as the nata fami( in e'ua

share) *he fa!t remains that in spite of her !oseness to, and

dependen!e on, her nata fami(, her reations with her

hus+and/s fami( are not separated and uprooted in entiret()
