!ER!IEW"

The purpose of this course is to inculcate in students the philosophical aspectsrelatin to the inception of criminal law in our society and its !asic conceptions !efore students start studyin su!stanti"e pro"isions of PP#.

The system of criminal law may !e $ustified as a mechanism for the preser"ation

of social order. There was no criminal law in unci"ili%ed society& and the pre"alent

law was the principle of miht is riht. The system was entirely retri!uti"e& 'a

tooth for a tooth& an eye for an eye& a life for a life. radually& howe"er the

system of retri!ution was o"erta*en !y reha!ilitation and reformation. An

understandin& therefore& of the inredients of crime& case law de"eloped o"er the

years !y the $udiciary in Pa*istan& toether with comparati"e study of the +nlishcommon-law will !e the primary focus of learnin to ac,uire conceptual clarity of

the nature& inredients and mental element(s) re,uired for "arious criminal

offences.

The criminal law of Pa*istan has mainly !een codified in the Pa*istan Penal #ode&

/0 ('PP#) and the #riminal Procedure #ode& 1 ('#2P#). The PP# deals

primarily with "arious types of criminal offences and states what matters will

afford an e3cuse or a defence to a chare of an offence. The aim of this course is

also to introduce some of the common criminal offences under Pa*istani law and

to apprise the students of the rele"ant defences that may !e a"aila!le to each

offence.

LEARNIN# UTCMES

By the end of this course students must ha"e understood& the definition& nature and

scope of crime& criminal !eha"ior& theories of punishment and efficacy of "arious

punishment mechanisms and the comparison !etween 4estern and 5slamic

concept of punishment. 6urthermore& students must ha"e understood the physical

element of crime& the all important distinction !etween act and omission& the

mental element of crime as well as the distinction !etween "arious le"els of

culpa!ility. Also the students would !e e3pected to understand eneral defences to

criminal lia!ility and more specifically the riht to pri"ate defence of self and property.

5n the su!stanti"e study of PP# students !y the end of the course must ha"e

understood criminal prosecution in Pa*istan& concepts relatin to !urden and

standard of proof and the shiftin of !urden in certain circumstances& non-fatal

offences aainst the person& different types of 7urder and the de!ate on a!olition

of capital punishment& concepts relatin to se3ual offences8 issues of consent and

the pro!lem of e"idence in such matters& crimes aainst property and white collar

crime& specifically criminal fraud and dishonoured che,ues. 9tudents must also

ha"e understood reasons leadin to the enactment of 4omen Protection Act& thesu!stanti"e content of the act and its effect. 6inally students must ha"e rasped the

new law on cy!er crime& the act of :00 as well as the Leislation relatin to

;u"enile ;ustice in Pa*istan.
