It's over five years since we last met with PaulEdmonds of Insurance Claim Solutions and inthat time much has changed. The world hassuffered a major economic crisis, the property
market underwent massive change and only nowis seeing a recovery and we all live in a worldconscious of climate change, internationalterrorism and political upheaval. So what impacthas all this had on the world of insurance and oninsurance claims?
Back then, insurance companies were focusingon reducing payouts and investigating legitimateclaims. Not much changes, and that is still theirprime motivation – we still all believe that aninsurance company is focused on how not to payout on your claim.
So is that true, and how does one make aclaim? Latest Homes met again with PaulEdmonds to find out if things remain thesame or if the rules and attitudes havechanged.
“Property Insurance policies are as easy asever to purchase but most of us still do notunderstand that the real value comes whenyou need to claim,” says Paul. “It is at thatpoint you realise you are on your own.”
When you make an insurance claim, typicallyyour insurer will appoint a loss adjuster to act ontheir behalf and investigate the claim. Their fee ispaid by the insurer. The loss adjuster will look atthe causes of your claim and the circumstancessurrounding it and will consider the exclusions inyour policy together with how much you wereinsured for and the values you have submitted. Ifnecessary, they will engage the services offorensic scientists and other specialists.
“By appointing Insurance Claim Solutions toact on your behalf we will pro-actively deal withall insurance company negotiations,” says Paul.“This will protect your interests and maximiseyour entitlement.
“As loss assessors, we represent your interestsand act as you the claimant's professional. Theloss adjuster will aim to reduce the amount theinsurance company pays. To ensure you do notlose out, each claim is dealt with by anexperienced loss assessor. Our network ofprofessionally qualified surveyors, engineers andcontractors allows us to fully manage your claimfrom the outset.
“Our normal policy is to make a no charge visitto your home or premises to discuss yourrequirements and make an initial assessment ofthe claim and damage.” Insurance ClaimSolutions’ core team all come from a fullyqualified insurance background and areregulated by the Financial Conduct Authority.
Paul’s philosophy“I worked as a senior loss adjuster for ten years,”Paul says, about the philosophy behindInsurance Claim Solutions. “I was tired ofdeclining and adjusting claims, achieving feetargets and service standards. Typically, sevendays after I met a policy holder on a major fire orflood, I lost sight of their needs in a flurry of newclaims and visits.
“When the documentation did arrive, it was
clear that the policy holder had no idea whatthey could claim for, or how to present it. It wasalso clear that the limited advice I was able toprovide as a loss adjuster was not enough toenable them to structure and control the claim.They had lives to lead and businesses to run. Asmy full time job, this made it both easier andharder.
“I wanted to create a company that provided aservice to the policy holder and focused on theirneeds,” Paul continues. “As a loss adjuster I wasunable to do this as I was working for the otherside – on behalf of the insurance company. Iwanted to use my professional skills and
knowledge toensure policyholders’ interestswere protectedand their claimswere met.”
Small printInsurance companies are still extremely stricton the small print in the policy. Often, thepolicy holder’s notification of the claim will berecorded. It is important to appoint arepresentative who understands the correctpresentation of the claim, to secureacceptance of the claim and early interimpayments.
“Last year wesaw lots offlooding andtorrentialdownpours ofrain. At thattime, we
helped a lot of clients get the very best results.Many home owners affected by the seriousflooding were out of their homes for a year butwe were able to help some get back into theirhomes and lead a normal life again in sixmonths.”
Mutual respectInsurance Claim Solutions understand the detailsof an insurance policy and the techniques usedto avoid liability. It can be easy to criticise theloss adjusting profession and use this asjustification for the appointment of a lossassessor. By having it expertly represented andmaximising your entitlement it need not be acloud. “This is not about trying to submit aninflated or fraudulent claim,” Paul explains. “Thevalue of the policy is often contained in the smallprint, much of which is missed by the policyholder.

What happens if an employeecovertly records a meeting?
First of all, you should make itclear under your disciplinarypolicy that covert recording of ameeting of any nature by theemployee or by someoneaccompanying them isunacceptable and can lead todisciplinary action being taken.
You may wish to makearrangements for the meeting tobe recorded openly, however thiscan lead to time-consumingtranscription of the sound files ortapes of the meeting. Although acompromise could be to let theemployee have a copy of therecording and to make their owntranscription if necessary.
Employment Tribunals have awide discretion to decide whetherevidence is admissible andgenerally relevant evidence will
be. The courts have said that whilstthe practice of covert recordingmay be distasteful, this does notnecessarily render evidenceobtained in that way inadmissible.
In one case the EmploymentAppeal Tribunal held that whilst acovert recording of a disciplinaryhearing could be admitted on thegrounds of public policy, arecording of the disciplinary panel’sprivate deliberations could not. Inanother case the private part of therecording was allowed, as thecomments recorded were not partof the deliberations in relation tothe matters being considered at thehearing. It was then for the tribunalpanel hearing the case to assessthat evidence and the impact of itupon the issues which it had todetermine.

a future hearing. It is obviouslypreferable to avoid having to havethis sort of costly and time-consuming argument at a tribunalor court hearing.
There are obvious steps whichcan be taken to minimise the riskof any recordings being made. Askfor mobile phones to be switchedoff and left in view on a table –although the problem with this isthat there may be other secretrecording devices and it isprocedure which may causefriction and delay.
The most sensible solution is toretire to a different private roomfor deliberations or for any part ofthe process which you would notwant to be recorded. Alternatively,do not say anything that wouldembarrass you if it were repeatedlater on at an EmploymentTribunal. Another option is to askthe employee and theircompanion to leave the room andto take all of their belongings withthem. This should be a relativelysafe course of action, assumingthat there have been no JamesBond-style recording gadgets leftbehind to capture what is said.

1980s classics such as The Goonies andthe Indiana Jones trilogy created awhole generation longing to findhidden tunnels beneath concealed
entrances in the floor. I have often stared at the various grates on
the floor of St Michael & All Angels Church inBrighton and wondered what exists below.On my latest visit, Fr Mark Lyon and I liftedone.
The remains of the original warm-airheating
system were instantly recognisable. Largepipes, over one foot in diameter, oncetransported air around the building.Today, the old network serves as a conduitfor the hot water pipes that lead to thelarge iron radiators that now heat thebuilding.
A stone staircase at the rear of thebuilding leads down into the boiler room.Two large square holes, carved into thelintel above its door, were presumablyinlets for the original warm-air system.The cavernous room was clearly oncehome to a large coal stove that heated airfor the whole building. Two large gasboilers now heat water for the radiators.
An adjoining door provides access to aspiral staircase that leads to a flat roofoverlooking Powis Square. The staircase istopped by a circular turret, opposite theheating system’s disguised chimney. Adoor on the roof leads into a void abovethe north aisle with views across the nave.Lights in the north aisle can be lowered byrope from here so that bulbs can bechanged at ground level.
On the way out, I spotted a ladderbeneath one of the grates. Peeringthrough the holes, it was clear that theladder was about 12ft long and set amongst alien machinery – what I canonly assume are the windchests of the original organ. I’d love to explorefurther.
