4 . The F e d e r a l Bureau o f I n v e s t i g a t i o n ( FBI ) was a

f e d e r a l law e n f o r c e m e n t agency t h a t i n v e s t i g a t e d a l l e g a t i o n s o f

v i o l a t i o n s o f f e d e r a l c r i m i n a l laws, i n c l u d i n g t h o s e a l l e g e d l y

commit ted by employees o f l o c a l law enforcement a g e n c i e s such as

t h e LASD. Some o f t h e s e i n v e s t i g a t i o n s i n c l u d e d a l l e g a t i o n s o f :

(a) c i v i l r i g h t s abuses , such a s d e p u t i e s u s i n g exces s ive f o r c e

on inmates i n j a i l s ; and (b) p u b l i c c o r r u p t i o n o f f e n s e s , such a s

d e p u t i e s smuggl ing c o n t r a b a n d i n t o j a i l s i n exchange f o r b r i b e s .

The FBI o f t e n conduc ted i n v e s t i g a t i o n s i n a c o v e r t manner so

t h a t t h e s u b j e c t s o f t h e i n v e s t i g a t i o n s would be unaware o f t h e

e x i s t e n c e , manner, and e x t e n t o f t h e i n v e s t i g a t i o n s .

A d d i t i o n a l l y, t h e FBI o f t e n a c t e d a s an arm o f f e d e r a l grand

j u r i e s by, among o t h e r t h i n g s , s e r v i n g grand j u r y subpoenas ,

o b t a i n i n g e v i d e n c e t o be p r e s e n t e d t o t h e grand j u r y, and

26 i n t e r v i e w i n g w i t n e s s e s t o a l l e g e d c r i m e s b e i n g i n v e s t i g a t e d by

8 MCJ. A d d i t i o n a l l y, Inmate AB was p r o v i d i n g i n f o r m a t i o n abou t

9 a l l e g e d f e d e r a l c i v i l r i g h t s o f f e n s e s b e i n g commit ted by

10 employees o f t h e LASD work ing a t t h e MCJ who were a l l e g e d l y

11 a b u s i n g i n m a t e s .12 12. S p e c i a l Agent LM and S p e c i a l Agent DL were S p e c i a l

13 Agents w i t h t h e FBI. S p e c i a l Agent LM and S p e c i a l Agent DL were

14 among t h e FBI a g e n t s p a r t i c i p a t i n g i n t h e F e d e r a l I n v e s t i g a t i o n .

15 13 . As p a r t o f t h e F e d e r a l I n v e s t i g a t i o n , t h e FBI

16 conduc ted an u n d e r c o v e r o p e r a t i o n t o d e t e r m i n e whether Deputy

17 Michel would a c c e p t a b r i b e t o p r o v i d e Inmate AB w i t h a c e l l u l a r

18 phone. I n o r a b o u t l a t e J u l y 2011, Deputy Michel a c c e p t e d a

19 b r i b e and p r o v i d e d Inmate AB w i t h a c e l l u l a r phone. On o r abou t

20 August 8, 2011, t h e LASD d i s c o v e r e d t h a t Inmate AB had i n Inmate

21 AB's p o s s e s s i o n t h e c e l l u l a r phone t h a t Depu ty Michel had

22 smuggled i n t o t h e MCJ i n r e t u r n f o r a b r i b e .

23 14. By no l a t e r t h a n i n o r about August 2011, d e f e n d a n t s

24 THOMPSON LEAVINS SMITH MANZO SEXTON CRAIG and LONG were

25 aware t h a t t h e FBI and a f e d e r a l grand j u r y were c o n d u c t i n g an

26 i n v e s t i g a t i o n o f t h e LASD's employees w i t h i n t h e Los Angeles

27 County J a i l s and t h a t Inmate AB was an i n f o r m a n t a s s i s t i n g i n

28 t h e F e d e r a l I n v e s t i g a t i o n .

MANZO moved Inmate AB t o a c e l l i n t h e MCJ's medica l ward.
