Decal Verification Project Judy & Tara’s 5th Annual Ice Cream Social
Gecko’s Grill & PubCelebrates 22 Years
The decal system that controls entrance to The Landings for residents through the North and South Gates and the residents’ lane at the Main Gate has been operational since 2008. Over that time, there have come to be a large number of decals that, while still active in the system, are presumably invalid because they: 1) Are on vehicles that are no longer owned by a resident (i.e., sold or traded in for a new vehicle) or 2) Have been issued to vehicles that are no longer registered to a resident of The Landings. Over the next year, the LMA and its security staff will verify the validity of all vehicle decals issued to Landings addresses, on an association-by-association basis.
The process will entail: • Sendinganoticevia e-mail or letter to eachownerwith a form tobefilledoutby theownerwith the vehicle description, license tag, color and the decal number (which is located under the bar code). This notice will state that all decals issued to that addresswill bedeactivatedon thefirstofthe next month following the notice. Vehicles with deactivated decals will be able to enter The Landings only through the visitor lane at the Main Gate. •Noticerecipientswillbeabletopreventtheirdeactivation by bringing the completed form and the vehicle to the Main Gate any time before the scheduled deactivation. The security staff will verify that the vehicle is registered to a Landings owner and that decal will not be deactivated. •Vehicledecalsthatarenotverifiedandthereforeremain deactivated will be denied access except through the visitor lane at the Main Gate. The
deactivation will be lifted when the owner completes theverificationprocess. Owners who will be gone for the month their decals are scheduled to be deactivated may go to the Main Gate before they leave to complete the verificationprocess.TheformwillbeavailableonThe Landings website: www.landingsofsarasota.com and from the Main Gate. The schedule of deactivations by association is shown below. Due to the number of owners in the LHA, deactivation (on the 1st of the month) will be by street, as shown.

LMAPresidentHenryRhodesopened this month’s meeting by complimenting the “Safety and Security” committee for addressing the speeding concerns at The Landings.
EMERGENCY PLAN SHAPING UP
Representat ives of At lasInsurance,DavidMcMahonandAnnieLaRivierebrieflypresenteda summary of al l the LMA EmergencyPlanmeetingsheldinthe last three months. The purpose of the meetings was to compile an emergency plan so that if a catastrophic event occurred, it could be dealt with as efficientlyaspossible. Theplanspecificallyaddressesall areas of The Landings that fall under the LMA’s responsibility. These include, Safety and Security, road access, and all LMA common areas. As a result of the meetings, the LMA now has a 300 page emergency plan binder. The intent
is to narrow the information from this binder to a one or two page action step plan to guide The Landings through a catastrophic event should one occur. Atlas is the insurance provider for the LMA as well as a few other Landings Associations. Over the years they have compiled custom-designed emergency plans for hundreds of associations.
FINANCE REPORT Finance committee chair,DonMcMurray reported that the month ofAprilreflectedasmalldeficit,butfor the year they are $36,603 under budget. McMurray encouraged all committee chairs to do a review of their annual budgets.
YEARLY ASSESSMENTS As of June 2, 2014, there were six residents who had not paid their yearly assessment and three residents with outstanding fees (penalties for not paying the assessment on time), for a total outstanding debt of approximately $8,905. McMurray wanted to remind all owners that a collection policy is being followed. Not paying the annual assessment can result in financial penalties,the placement of a lien on the property and possible foreclosure proceedings. A continued area of concern for thefinancecommitteearetheunknown expenses associatedwith the proposed lane change project at the north entrance of The Landings.
AESTHETICS Aesthetics committee chair, Truman Menefee reported on the progress of several items. • A parking notice is beingdesigned to be used to tag
automobiles that are illegally parkedonTheLandingsproperty. •UpgradesarestillbeingmadetotheSCurve. • TheWells Fargopalm treetrimming project is slow, but continuing. •Signpaintingcontinues. •TheNorthgateentrancearmwas reattached. •FPLwasnotifiedthatoneoftheir lights has burned out. • The street sign at KestralSouthandLandingsBlvd.isgoingto bemoved to make it morevisible.
ARCHIVES LMAPresidentHarryRhodesreadArchivesChairman,RobertManteiga’s report in his absence. AllofLMA’sfileshavenowbeenorganized.Theworktoeliminateunnecessary duplicates and amended versions continues. Manteiga will meet with Sara RhodesandDickBaylestoverifythe accuracy of information online as well as add to that information ifneeded.AllCommitteemembersareaskedtoprovidethearchivescommittee electronic copies of important documents so they can be archived.
DRAINAGE Committee chair, Jack Jostreported Florida Mangroves(Derek Sherman) has begun thesemi-annual cleanup of all major swalesthattakestormwatertothebay.Work shouldbe completedearlynextweek. ThePintailWayCreekneedsto be cleaned out as well. Jost will contact Nathan Overholt, who hascleanedouttheCreekforthelast couple of years, about doing it again.
GAZEBO T h e s e l e c t e d G a z e b o replacement contractor, FloridaShoreline, has discussed the idea of adding a fishing porch and handicapped access ramp to the Gazebowith Sarasota County.Anymodification to theoriginalplan would have to be re-approved bytheCountyCouncilandotheragencies. A review would delay the project at a minimum and couldendthepossibilityofalike-kindreplacement.Inlightofthis,theGazeboCommitteeinstructedthe contractor to proceed with the original plan. Preliminaryengineered drawings of the proposed facility are now in hand.
INTERSECTION CONGESTION
Now entering its fourth year, the intersection congestion issue at KestrelParkwayandUS41continuesto move along at a snail’s pace. The LMA lawyer has been askedtoresumediscussionswithPublixlawyerstodeterminetheircurrentposition.Withoutprogressin these negotiations, LMA will have to resume efforts to obtain a Declaratory Judgment or abandon plans to modify that intersection.

Commi t t ee cha i r , La r ryLawrence reported the editorial committeewill beworkingmoreclosely with The Landing’s website team to better serve the community. Lawrence reiterated the policy regarding photos appearing in The Landings Eagle. The policy states that in order for a photo to appear in the newspaper there must be an accompanying article depicting that event. Lawrence shared there
were a few situations where the photographers dedicated their time to takephotos of an event,but an accompanying article never materialized. He’s hopeful this has now been corrected. Once the LMA EmergencyPlanisinplaceandonthewebsiteThe Landings Eagle will print appropriate portions. Plansareintheworkstoplacenames and photos of Security PersonnelinafutureissueofThe Landings Eagle to enable residents togettoknowthem.
LAKES Lakes’ chair, Larry Lawrencereported all the dead trees and brush have been removed from the Starling Preserve area andthe mitigation area was treated with herbicide to eradicate the invasive weeds. A second treatment is necessary and will be done soon. Plantingthereplacementtreesandplants is expected to occur mid-June. After clearing that area, an unsightly stand of dead trees and other vegetation remained. Aquagenix, the contractor for the project, found this situation to be undesirable and thought it reflectedpoorlyonTheLandings.As a result, Aquagenix requested permission to remove this dead vegetation at no charge. LMA approved the request and the workwillbedonewhentheareais planted. Most of the algae blooms in all the lakes have been eliminatedby recent treatments. Futuretreatmentswillhelpkeepthealgaeblooms under control. A new product designed to eliminate cloudiness is going to be testedinthewaterofLake#2,theTreehouseLake.

The refurbishment of the FitnessCenterhas been completed. While there are some“glitches” that remain toberesolved,Ibelievethe changes have made it a greatly improved facility.WeusedLEDlightingandmotion-activatedtoreduceourongoingexpense.WealsoinstalledtheseswitchesinthePoolsideandLakesidebathrooms. IneedtothankRudyBlohmonceagainfor his splendid planning and procurement effort;itpermittedtheworktobecompletedwhile he was gone for his annual sojourn to Europe. The “glitches”mentioned earlierwereofmymaking.IhastentopointoutthatRudywassolelyresponsibleforbringingtheproject in at $13,000 under budget. As noted in last month’s article, Meg Loomis had moved out of The Landings andhadtoresignherseatonourBoardofDirectors. Iampleased thatCarolFurlonghas accepted the Board’s invitation andagreed to serve for the remainder of Meg’s term.

Day BBQwas a hugesucce s s . Rough ly140 people came out to celebrate the day including 27 military veterans.BobFernanderandJerryWelchledthepresentation where all of the veterans were
recognized. That was followed by a sing-a-long with all of the military service songs. ThankyoutoEdvinandGaryformanningthe grills and to volunteers Sam McGowan, MargaretKahnandTrumanMenefeeforalltheir help. An event of this size would be impossible without their assistance. The next social event on the calendar is theWimbledon&Whites tennis roundrobin. It takesplace themorningof July5th with a social round robin followed by strawberries and cream, scones and mimosas in the LakesideClubhouse. We plan tohave matches on the big screen live from Wimbledon. Thesign-upsheet ison Joe’sdeskintheProShop. Now that summer is here, it is time for the annual tennis court resurfacing project to get started. Since they have all been rebuilt in
thelastfiveyears,wewillonlyneedtodoa standard resurfacing. My plan is to begin a routine where four courts a year will get extra material and new lines. The other four willkeep theirexisting linesandreceiveasmaller amount of Har-Tru. As usual, we willtaketwocourtsoff-lineatatime.TheprojectwillbegininJulyandbefinishedbytheendofSeptember.Withtwocourtsdownfor maintenance for most of the summer, this willputatightersqueezeoncourttime.Eventhough there are fewer people around this timeofyear,Iencourageeveryonetocallinadvance for reservations regardless of what time you plan to play. Forsometimenow,TheLandingshashada very good reputation for the quality of our tenniscourts.I’dliketoaskforyourhelpinkeepingthemplayingwell. Ifyourmatchendsafter4:00PM,pleasebrush thecourtwhenyouarefinished.Thiswillhelpkeepthecourtsmoothandplayingwell.Foryourconvenience, there is always a brush hanging onthefenceforeverysetofcourts.Itonlytakesafewminutestohandbrushacourt.Thiswillmakeabigdifference inkeepingour courts nice for a longer period of time. Summer in Sarasota has definitely arrived! The positives include: less traffic;easy to obtain restaurant reservations;abilitytospendmore time with friends who were less accessible during season;easiertoobtaintenniscourtswhenyouwantthem;fewer out of town guests;moretimeforvacationsaway;catching up on unfinished projects and generally a slower time. All that said—we miss our snowbird friends and can’t wait for them to return!! To be fair and honest the weather has changed and is much hotter with more h u m i d i t y a n d l i m i t e d visibility while driving in the almost daily afternoon thunder storms. Growing up in the south we used to call them “gulley washers.” Plans are progressing onrebuilding the Gazebo which hopefullywillbefinishedbyearly fall. Boardmembers
willbespendingtimelookingbackover thepast year andlookingforwardto2015.Thisincludesidentificationofnewprojects and budget requests tobesubmittedtotheFinanceCommitteeinearlySeptemberand then they will go to the full board for approval no later than the November board meeting. President’s Column LHA Meeting Notes
Mr. Larson reviewed the tour of Peregrine PointWay taken byseveral board members and the Association’s drainage engineer. After discussing several proposed alternatives to theflooding situationon that road, the group concluded that the correct solution would be to require homeowners to restore the properties’ swales to the extent required to provide proper drainage. A draft letter to all owners in the Association was presented to the board for their review and further actionwill be taken atthe July board meeting following consultation with Association counsel. The board will contact a tenant onPeregrinePointCirEtorequestacleanup of the rear yard, visible from PeregrinePointDrive. Letters of violation were sent to the ownersofpropertiesonPineHarrierCircleandLandingsTerrace. The board reviewed and approved a proposed roof replacement for Landings Terrace and a landscaping planforLandingsWay.

ColdWaranniversariesand warnings of more to come are piling up. The most famous ColdWarcelebrates its launching 70 years ago (1945-2014). ItwasbetweentheU.S.andtheUSSR and cost us $4trillion (for the other side the cost was almost double that). The other , current ColdWar anniversarymarksthe struggle’s putative its termination in 1989, 25 years ago. An organization called “ColdWar Patriots” (CWP)based in Denver, alerts the public to the fall of the BerlinWall,which event it considers to be the symbolic end of theColdWar. CWP, its brochure says,“was founded in 2008 to honor and provide assistance to over 700,000 patriotic Americans who served our country, sometimes in secrecy, to fortify our nation’s defenses.” I’m not sure if during theColdWarmyandothers’work
fortheU.S.DepartmentofStatedoing classified research on the Soviets and writing scripts for Voice of America as well as performing other, hush-hush activities rate aspatrioticworkfor thenation’sdefense.But itsurekeptmeinformedastohowthreatening this Soviet menace wasfromtheendofWorldWarII to about 1985. It was thisexperience that led me to write my tenthbook,whichhas justcome out, titled Myths of the Cold War: Amending Historiographic Distortions. About that later, Idon’t mean here to “advertise” mybook.
Whenweusetheterm“coldwar,” I wonder if we realizereally what that struggle really is or how many cold wars there have been in history. Or if any of us dare imagine that any more such “cold-peaces” are on the way--say, another cold warwith post-Soviet Russia(as some observers are openly suggesting)orwithCommunistChina,whichthreatenstoexpandbeyond its borders far into the SouthChinaandtheEastChinaSeaswhilehavingthemakingsofbecoming a powerful, ambitious superpower by mid-century.

It issimply too hot to fish in the middleoftheday.Earlymorningwill be the most reliable time tofish, evenings are good too,but frequent thunderstorms can makeplanning a tripdifficult.Anglerswhodon’tmindfishingin the darkwill have successat night, and they will beat the summer heat! ActiononthedeepgrassflatsfromthenorthendofSiestaKeyshouldbeverygoodforspeckledtrout,alongwithbluefish,Spanishmackerel, ladyfish, pompano,and jacks. A high tide in themorning is favored for anglers to drifttheflatsandcastCoteejigs,Rapalaplugs, spoons, and liveshrimpunder a popping cork.Netting up a bunch of shiners andchummingthedeepflatswillusually result in non-stop action. TheflatsandoysterbarssouthofCB’s SaltwaterOutfitters at
StickneyPt.downtoBlackburnPt.willhold somenice trout inJuly, and that area gets very little pressure in the summertime. The keyiswatertemperature;ifitistoohigh thebait andgamefishwill not be there. Redfish andsnookwill also cruise the barsand shorelines in search of prey. Areasthatdropoffquicklyintothree or four feet will be the most productivespots.Ahandpickedshrimp is deadly fished early in the morning on a high tide. Anglerschoosingartificial lureswill score with topwater and shallow diving plugs, scented soft plastics, and weedless gold spoons. Redfishwill begin to schoolup in July and can be caught in very shallow water The largest trout also prefer shallow water, so don’t be surprised if a “gator” intercepts an offering meant for a redfish. Thesefishshouldbereleased unharmed, they are the femalebreedstockandarecrucialtoahealthytroutfishery.
Nightfishingwillbeexcitingand productive in July. Lighted docks andbridges attract glassminnows and shrimp, which in turn attracts the gamefish. Snookare abundant, but trout,reds,jacks,ladyfish,andsnapperwill also be caught at night. Live shrimpworks verywell freelined in the current with little or no weight. A 24” piece of 25 lb flourocarbon leader and a 1/0 live bait hook is the basic rig.Lures will also catch fish, but canbedifficult to cast atnight.Flyfishermanwill scorewithasmallwhitesnookflysuchastheGrassett’sSnookMinnowtiedona#4hook. Tarpon will still be plentiful in the Gulf of Mexico, although the anglers will not be. The large schoolswillhavebrokenup,andalthoughthefishdon’tshowaswell,theyeatbetter.Pinfishandcrabs drifted out 6 feet under a corkatfirstlightwillcatchtarponinJuly.PointofRocksonSiestaKeyisaprovenspottofish.

It is mostimportant to vaccinate early in life when the development of the immune system ismost active.Rabies, by law, cannotbeomitted.Youmaychoosetoskipsomeoftheothervaccineslaterinyourpet’slife.Itisagood idea to discuss this option with your vet however, as some breeds need more protection than others and skipping onvaccinations is not recommended. Location can also determine the necessity of certain vaccines,soaskyourvetforthelistofshotsrequired in your area. 2. I just moved to Florida from upstate New York. My pets (cats and dogs) love the outdoors – are there any potential risks for
them if I let them run loose in the yard? Florida–thelandoftheexoticandthisexoticlandincludesvenomoussnakes,suchasrattlersandcoralsnakes.Certainplants,suchasverypopularSagoPalms(MiniaturePalmTrees),arehighlytoxicandcancauseliver failureanddeath if ingested. Ifyoulive in the countryside, watch for boars and otherwildanimals. Inthecity, theworsethingsyourpetwillmostlikelyencounterare red ants, bees and wasps. The rest is history. Goldie, arguably aChowmixoraShibaInu(whoknowsfor sure?), soon to be nine years old, was afurryskeletontossedoutonthestreetwithbitemarksfromlargerdogsontopofherhead,anervouspup–oneroomfulof chewed up furniture, two bottom steps of our upstairs stairwell reshaped, andonepairof shreddedLand’sEndsandals later, is now the queen of the household.(Really,itisn’tme.)She is really smart, playful, and friendly, yet opinionated, especially when it comes to cats, squirrels, geckos, smallbirds, and even insects, all of whom she holds in extremely low esteem. She loves
totakelongwalks,somethingshehadnoopportunityforinNewYork,wherewehadadogruninthebackyardandthe weather was not often conducive to squeaky rubberducky. Jeff,whohadsaid, “Oh, no! No more dogs!” (she’s our fourth) dotes on her as a true doggie parent.

S a r a s o t a a t t r a c t s m a n y professionals, including lawyers. Did you know that there areapproximately 1,000 practicing lawyers inSarasotaCounty? InFlorida,theunlicensedpracticeoflawisacrime.Butwhatexactlyis considered “the practice of law”? The Florida SupremeCourtsays,“ifthegivingofsuchadvice and performance of such services affect important rights of a person under the law, and if the reasonable protection of the rights and property of those advised and served requires that the persons giving such advicepossess legal skill andaknowledgeofthelawgreaterthanthat possessed by the average citizen, then the giving of such advice and the performance of such services by one for another as a course of conduct constitute the practice of law.” As you can see, this definition leaves a lotto interpretation. Ithas causedsomedifficulty for community
associations and their managers when trying to determine if they have to call upon an attorney for an answer to a routine question ortoundertakecertaincollectionactivity. Accordingly, some of themore significant changes totheFloridaStatutes specificallyaddress the unlicensed practice of law by community association managers(“CAMS”).ThechangesallowCAMStoperformservicespreviously provided only by attorneys. The amendments also confirmthatCAMSareallowedto include provisions in their management contracts which protect them from liability for their own ordinary negligence. Interestingly, attorneys are notallowed to limit their liability in such a manner. Under thenew law (Chapter468,FloridaStatutes),CAMSwillbe able to determine the number of days required for statutory notice; calculate the numberof votes needed for quorums
and approvals; draftmeetingnoticesandagenda;negotiatetheperformance and monetary terms of contracts (subject to association approval); determine amountsduetheassociationandtakestepstocollect(beforealawsuitisfiled);prepare certificates of estoppeland assessment. Additionally, CAMSwillbeableto:(1)sendtherequirednoticeofintenttofilealienifassessmentsarenotpaid;(2) send notice that a lien has beenfiledandwillbeforeclosed;(3) file a satisfaction of lien. These latter activities require the use of forms that are also being added to Condominium andHomeowners’ Acts. I think someof the changesregardingwhatCAMScandoforassociations are appropriate and will be particularly welcomed by associations with limited budgets.Itshouldnottypicallyrequire an attorney to determine how many votes are necessary or how many days’ notice is
required for a meeting. (Ifthere is a discrepancy between the statute and the governing documents, then that is another matter and the association should consider calling an attorneyforadvice.)Idohavesome concerns regarding the collection of amounts due to an association. The amount that can be legally collected is not always easy to determine, particularly after a foreclosure sale. A wrong call can leave money on the table. A n o t h e r s i g n i f i c a n t amendment, this time to The CondominiumAct,willallowanassociation to enter, inspect, and repair abandoned condominium units.

Growth of mold in abandoned units, particularly when the air conditioning has been turned off, hasbeenasignificantprobleminsome complexes. The mold can spread to adjoining units and the common elements. Rodentand insect infestation is another issue. Repairs to abandonedunits can run into the tens of thousands of dollars. This law
will be welcomed, it is a shame it was not enacted a few years ago, at the height of the foreclosure meltdown. F i n a l l y , I n o t e T h eCondominium Act has beenamended to reflect the reality of our modern electronic age: directors are now officially allowed to use e-mail as a means of communication. They may not cast a vote on an association matter by e-mail, however. The Homeowners Act has been amended to allow email addresses and addi t iona l telephone numbers to be printed in the community directory with
the owner’s consent. The remaining land on which theyaskedtobuildisvaluedat$1,047,500 (2014 Tax records) Two months ago, the Sarasota CountyCommissioners againunanimously denied their request for aCoastal SetbackVariance allowing them to build on the lot. This is the third petition brought by the couple, with the previous two petitions of January 9, 2013 and April 23, 2014 unanimously denied. Land existing beyond the Gulf BeachSetbackLine(1979)withno prior history of building, is protected under CountyOrdinance from development. This lot on the northwest portion of Siesta Key Beachhas well documented history oferosionandflooding.
OnJune16,theAllen’sfileda request with the county for relieffromtheCommissioner’sdecision. A Magistrate hearing of their petition is scheduled for August 5 at 10am in CommissionChambers. The publicmayattend but not participate. A Magistrate Hearing is directed by Statute within the State of Florida EnvironmentalRegulations, Section51,LandUseandEnvironmentalDisputeResolutionAct. TheMagistrate works tomediatearesolutionormakearecommendation to the parties. This could include many outcomes such as; nofindingfor relief, recommendations for amodifiedvariancepetition,Countyfinancialcompensationto the owners, change in taxable designation, or review of the County land use ordinancerelevant to this situation. Cold War Anniversaries: Will There be More?By Dr. Albert L.Weeks History has seen some 20,000 major cold and hot wars with hundreds of millions of casualties. Given today’s environment of weapons of mass destruction (WMD),escalationofcoldwars,insistmanyqualifiedobservers,must be prevented, or at least “contained.” Examination ofcold and hot wars throughout history--i.e.,canvassingconflictsbetween ancient Athens and Persia,CarthageandRome,andfrom the Middle Ages to modern times—shows that not all such historic stand-offs needed to have escalated from their cold-war
phasesintoarmedconflicts.Giventoday’sWMDarsenalsinseveralstates in our competitive multi-polar world, the causes of present-day cold wars that resemble those ofpastconflictsneedtobestudiedso that effective means be found to contain modern cold wars lest they escalate to catastrophic proportions. Such a study shows that the causesof such conflictscoalesce around several basic causative factors. This brings me to my latest book.InMythsoftheColdWar.In it, I try to dispelmistakennotionsaboutthepastU.S.-Soviet
ColdWarandthusbetterprepareus in case another such struggle develops. Unbelievably, somebooksareouttherethesedaysthatfalsely allege that “it was America thatstartedtheColdWar.” However, the facts prove just the opposite.Mybook exposesthe calico-thin arguments that are used by such authors. Such booksmay be influencing ourcollege youth in the wrong direction. Myths of the Cold War provides the countervailing fact that demonstrate the falsity of the BlameAmerikaGame.

Itmaynotbethefirsttimeplans have been made to develop the prime property at thecornerofU.S.41andStickney Point Road, buttheBendersonDevelopmentCompanyisbettingthatthistime,theplanswillstick. Backin2005,apartnershipcalled Siesta 41 Associates, LLP purchased the PineShores Trailer Park andsurrounding parcels on StickneyPointRoadandU.S.41, where it intended to raze the trailerparkandconstructa$350million mixed-use project called SiestaPoint.Thevillagewastocontain up to six condominium towers and dozens of shops, and the partnership group consisted of CoganDevelopment LLC,BendersonDevelopment andPromenadePartners,whichwasacollaborationbetweenCoganand financiers Neil Malamud andRonShenkin. At the time, the hope was that construction would begin by mid-2006 on the 23.9 acres, but as so often happens with the best-laid plans, this one did not cometofruition.Eventually,in2009, the property was razed and prepared for building, and nowitfinallyappearsasthoughthat land is on the brink ofdevelopment. BendersonDevelopmentandSiesta 41 have unveiled their plans for SiestaPromenade, anew 250,000-square foot open air shopping and a 150-room hotel, with an estimated construction start of next Spring. Back in Januaryof 2011, thegroupmetwith theSiestaKeyAssociation and laid out their intentions for that very visible and valuable piece of land. At themeeting, PaulBlackketter,Benderson’s projectmanager,told the Association members that h is company would undergo an extensive due-diligence process to determine the best type of development for that site. As it turned out, the new proposed project is actually very similar to the idea originally floatedin2005.
But this time, the economyseems to be cooperating a little better. Requests for buildingpermits in Sarasota Countyhave been booming in the past year,whichisdefinitelyatellingeconomic sign. T h o u g h B e n d e r s o nDevelopment is one of America’s largest privately held real estate companies, and owns and manages over 700 properties in 38 states, its influence on the Suncoast is prevalent. The newMall at UniversityTown Center, a BendersonDevelopment project scheduled to be completed in less than four months, is expected to be one of the premier shopping destinations in the state. The primary concern for people who live around the UniversityDrive area and arerequired to use exit 213, the one by the new mall, on a daily basis,isthattrafficgoinginandout of themall couldmake itimpossible to navigate the roads around it. Some neighbors who live close to the proposed Siesta Promenade sitehave the sameworries. “It’s hard enough toget outonto Stickney Point Road asit is,” said Rebecca Pietras,who lives down one of the side streets betweenU.S. 41and theStickneyPointBridge.“Where thatmall is going inisaverybusyintersection.I’mjust wondering if they are going to do anything to alleviate that problem, because it’s only going to get worse when they open up that mall.” BendersonDevelopmenthada public meeting on June 26 to
address citizens’ concerns, but as of the time of this printing, the meeting had not yet happened. Although this parcel for development is not within the SiestaKeyOverlayDistrict(SKOD),itisexpectedtohavea great impact for the District, due to the increased density and intensity of use. The streets in the surrounding neighborhoods are two lanes withoutsidewalks,andthere
is currently no plan on record that includes implementing traffic signals or traffic management while the property is being developed. Curt Preisser, of SarasotaCountyCommunications, saidthatthePre-ApplicationMeetingRequestformthathadbeenfiledby Benderson Developmentand which laid out the bones of the project, did not include a TrafficImpactAnalysis.Suchadocument would have explained how the company planned to handle the expected increased trafficflowatthenewmallsite. “A Traffic Impact Analysisis only required with a full application,” he said. “This one was technically a pre-application, so they didn’t include it.” Pietras and other neighborswillhavetheopportunitytoaskquestions and offer suggestions at the neighborhood meetings, of which there will certainly bemore.And, as Blackkettertold theSiestaKeyAssociationwhenheinitiallyspokeabouttheSiestaPromenadetothembackin2011,BendersonDevelopmenthas no intentions of building anything until it has tenants signed and ready to move in once construction has been completed. “There is no way we are going to build an empty building,” he said.
