941.349.0194 | ISLAND VISITOR PUBLISHING, LLC www.THELANDINGSOFSARASOTA.com © MAY 2016 A lender has filed a foreclosure lawsuit against the Delaware-based company that owns the majority of the property within the Landings Shopping Center. According to the lis pendens suit filed in December, 2015 in the Circuit Court of the 12th Judicial Circuit, the Plaintiff, U.S. Bank, National Association, as trustee for Morgan Stanley Capital Inc., has instituted the foreclosure filing against the owner, Landings of Sarasota Florida LLC. A total of at least three parcels — filling about 93,000 square feet of indoor space — within the Landings Shopping Center are included in the foreclosure suit. However, the free-standing buildings near the shopping center — including Sweet Tomatoes and Olive Garden — are separately owned and not impacted by the foreclosure proceedings. In addition, the parcel that houses the Publix grocery space, 4840 S. Tamiami Trail, is also separately owned, by Publix Super Markets Inc., and thus is not impacted by the proceedings. The plaza, at 4800 S. Tamiami Trail, was built in 1988, according to Sarasota County Property Records. Centrally located on Tamiami Trail, the shopping center is one of the largest in the county, but has been hit with a spate of vacant storefronts, including Office Depot, which recently left the center. Starting in 2014, the national office retailer began closing hundreds of stores nationally. According to the foreclosure suit, the original mortgage for the property was recorded Oct. 5,2005. The shopping center is located on U.S. 41 just outside The Landings, and neither the plaza nor its owner Landing of Sarasota Florida LLC is affiliated with The Landings or LMA in any way. There is a total of ten parcels within the center. Commercial Realtor Ron Flynn said commercial foreclosure proceedings could span a lengthy range of time, up to several years, to resolve. If the bank does take possession of the center, at that time the bank could opt to either get a broker to list the commercial property on the market or auction it off, Flynn said. An auction sale would likely result in a lower sale price, a scenario which could allow a new owner to come in and rent the retail spaces at lower rates that could be viewed by retailers as more competitive with other, nearby commercial rents. Either method of sale could attract potential investors drawn to the shopping center’s central location on U.S. 41 between Bee Ridge Road and Clark Road. According to real-estate leasing information advertised online, more than 50,000 daily drivers pass the plaza. Landings residents Bill Hitchcock, Eric Greenstein, Beverly Smith, and Ginny Hitchcock kept up-to-date on Landings news on the steps of Ernest Hemmingway’s house outside Havana. They were part of the Educational

and Cultural Trip to Cuba sponsored by the Sarasota World Affairs Council. Cuba trip coordinator and SWAC board member Jorge Fernandez is at top right. Arriving the week after President Obama’s historic trip to Cuba, the

group spent five days exploring the many sites and museums in Havana and eating wonderful Cuban food at restaurants and paladars

(restaurants in private homes). “The trip was amazing, and we had a wonderful group, “ recounted Ginny Hitchcock. “If at all possible, you should plan to visit Havana ASAP before Cuba becomes Cancun. There have been Canadian and European tourists to

Cuba for some time, but they tend to cluster at the beach resorts. Havana had its share of tourists, but now it is still manageable and not crowded.”

With all due respect toMr. Kilmer, some Siesta Keyresidentsmightaddthiscaveatto that sentiment: It depends on the tree. Despite generally positivereviews from those attendingopeningceremoniesearlier thisyearfortherecentlycompletedSiesta Beach improvementproject, at least some Keyresidents have questioned thecounty’s landscaping choicesforthepark’smakeover. Of the project’s $21 millionbudget, $850,000 was spenton trees, shrubs and otherlandscaping improvements, according to Brad Gaubatz, the county’s pointman for theproject. “Thereare40 royalpalmsatthemainentrance,12liveoaksinphaseonenearthemaintenancebuilding,94greenbuttonwoodsnear theplaygroundforshade,62 sea grapes and 1041 sabalpalms in the parking lot,”Gaubatz explained in a phoneinterviewrecently. All told, more than 1600native trees were included inthepark’s landscapingplan,asdesignedbytheconsultingfirmKimley-HornandAssociates. But some residents havequestionedwhy somany treeswereplantedintheparkinglotand along the new esplanade, blocking views of the project’sfocal point: the beach beyond.TheissuewasraisedataSiestaKey Association meeting inFebruary. In a follow-up e-mail to theSKA after that meeting, laterforwarded to the county, JaneMcIntire, president of theBeachway Condo Associationboard of directors, pointed outthatpriortotherenovation“theonlyplaceonSiestaKeywhereyoucoulddrivedowntheroadand see the number one beachwasat themainbeachparkinglot. Thanks to all theimprovements, youreallycan’tseethebeachanymore.”

Butasitturnsout, preservingthe view of the beach fromacross the parking area wasnever an option due to rulesthat now govern parking lotdesignandconstruction. Back in the 1950s when thebeach was first developedordinances and zoningrequirements did not mandatethe planting of trees to softenthe view and provide shadeacrosslargeexpansesofasphalt.Such requirements are inplacetodayexplainedGaubatz. It’ssimilartothesituationnowfacedamile or so to the southattheExcelsiorCondominiumswhere repairs planned for thebuildings damaged by thetornado that swept throughthe complex in January mustmeet today’s stricter buildingcodes, not those inplacewhenthe buildings were originallyconstructedbackin1980. Another issue being raisedconcernsthechoiceofsomanycabbage palms, also known assabalpalms, fortheparkinglot.Theyhappentobethestatetreeof Florida, but some considerthem ‘dirty’ trees, requiringconsiderable maintenance tolooktheirbest.Oneoftherapsagainst Australian Pines haslong been their own status as‘dirty,’ a reputation earnedfor the prodigious amount ofneedles and cones they shedwhichaccumulatebeneaththeircanopies. (Some of the exoticpines were removed from thepark for just that very reasonas part of the improvementproject, though some remaindue to public input receivedin the project’s early planningstages). Some point to the cabbagepalms as being equally messy, droppingtheirdeadfrondsandseed pods several times eachyear. But Kimley-Horn projectManagerBillWaddillexplainedinarecentphoneinterviewthatgiventhechoicesavailable, andthetradeoffbetweenshadeand

visibility, the cabbage palmswerethebestalternative. “Thereisnoperfecttreethatworks in every case,” he said.“Thecabbagepalmisnative toFlorida. It is hardy and well-suited to the winds and saltsprayofacoastalenvironment.” But the final decision wasin large measure sealed bySheriff Department concernsabout the same issue of clearsight lines raised by McIntireat that February SKA meetingmentionedearlier. “The Sheriff Departmentwanted to be able to monitoras much of the parking lotas possible from their newcommand center and otherspots near the beach,” saidWaddill. “Oaks or other treeswithlargecanopieswouldhaveblockedmuchmoreofthatviewthanthepalms.” In fact, in order to addressSheriff Department concerns,a variance to the original codehadtobeadoptedbythecountyto allow for less shade in thelot thanwould have otherwisebeenrequired. The sabal palms adhere tothe county’s ‘best practices’policy for using native specieswhenever possible, both forthe hardiness Waddill pointsto and their low maintenancerequirements. Indeed, sabalpalms are often described as‘self-pruning’ since their deadgrowth eventually falls to thegroundonitsown. But their ‘dirty-petticoat’ ofyellow and brown fronds canremainhanginginthetreesformonths before gravity finallyprevails. That’s why mostprivate resorts, homeownersandeventownslikeFortMyersBeachandNaplesroutinelycutthedeadgrowthofftheirpalmsseveral times a year, often atconsiderableexpense. So will the county take thatapproach here or choose to letthemgo‘au-naturale?’ Siesta Sand got a mixedresponseonthatscore.

Gaubatzpointedtotheirself-pruning quality, adding thatover-pruning can actually bebadforpalms.“Itcanmakethetrunks narrow at the top andeventually hurt the tree,” hesaid. But Siesta Beach is ashowcase. After all, that’swhythe improvement project wasproposed in the first placeshortly after Dr. StephenLeatherman (a.k.a. Dr. Beach)named Siesta the nation’s bestbeachin2011. Askedabouttheaestheticsofup to a thousand ‘dirty-palm-frondpetticoats’swayinginthewind togreetvisitors,Gaubatzreferred us to Beach ParksManagerGeorgeTatge. He agreed with Gaubatz’scomments about too muchpruning,saying,“thehealthiestcabbagepalmisonenotpruned.Theylosemicro-nutrientsifyouovercutthem.” Butheaddedthatthecountywill have to work out itsongoingmaintenanceapproachovertime.“They’reallnewandlook great now. But the palmsin public areas will likely geta higher level of maintenancethan those less visible onestuckedawaybythedunes.” Another possible concern:disease. By planting so manyexamples of one tree, aninfestation of cabbage palmdisease could be devastatingto the county’s investment.Manyformerlygrandcanopied

avenues and boulevardsin northern cities were leftexposedandbarrenafterDutchElmDiseasewipedoutvirtuallyevery example of that speciesstartinginthelate1960s.Manymunicipalities came to regretthedecisionofearliercityparkadministration to use Elmsalmost exclusively along somanypublicthoroughfares. While not dismissing thepossibilityofadiseaseoutbreakWaddill said that cabbagepalmshavedone‘verywell’onSiesta Key. “Am I concernedaboutalimitedpalette?Yes.Butthere’sanissuewithalmostanytree.Nothing’sperfect.They’relivingthings.” Inanycase, thetropical lookof all those palms at SiestaBeach is certainly in keepingwith the expectations mostvisitors have for an exotic, tropicalplayground.AccordingtoGaubatz, theyhelpdefinetheparkinglanesandworktofocusattentiontowardthebeachevenas they work to obscure it forresidentsacrossBeachRoad. Inabitofironythough, treesnowoutnumberparkingspacesin the lot, despite the needfor additional parking spacesbeing cited early and often asperhaps the most importantimprovement needed for thepark. Thefinal tallyon that score?140newparkingspotsforatotalof980.Numberofnewcabbagepalms:1041.

Donate to Keep Fireworks on Siesta Key In 2015, we celebrated the25th year of having fireworksonSiestaKeyforthe4thofJuly.According to Mike Simmons,Project Manager at ZambelliFireworks, this display wasthe largest private show inSarasotaCountyandoneofthelargestinthestateofFlorida. Because all funding forthe annual fireworks comescompletelyfromsponsorships/donations, the group ofvolunteers that serve on thefireworkscommitteetookonachallenge when we agreed toraiseextrafundstobeef-uptheshowfromprioryears. Wesawthevalueinworkinga bit harder because 25 yearsof fireworks made possiblesolely by the generosity oflocal businesses and residentsistrulysomethingtobeproudof and to celebrate. Wewerealsostartingtoseeachangeinthe atmosphere at the publicbeach andwith the additionalchallenges that were put inthepathofproducing theVIPparty. Weknewthatthemodelwe

had used for so many yearswouldhave to changemovingforward. Forthosewhodonotknow,we’vealwaysheldaVIPpartyon the 4th of July and thedonations and ticket sales forthat party directly funded thefireworks and costs associatedwithputtingonthecommunityevent. When we first startedusing this model, there wasan old ball field that we usedfor parking for those whopurchasedticketsfortheparty.Fast forward to 2016, the ballfieldisnolongerthereandthebeach renovation project hasbeen completed. What doesthis mean to the fireworkscommittee?Well,wenolongerhave250parkingspotstoofferthe VIP party ticket holdersand we would have to raisean additional $8,000 just tohave the party. We realizedit just didn’t make financialsenseanymoresowemadethedecisiontoeliminatetheparty. Aside from the convenienceof having the fireworks onthe island for the residents,

why is it important to donateto keep them here? In oneword: Tourism. Being in theaccommodations business, Ican tell you if the fireworksdid not happen on Siesta, there would be a lot of upsetand disappointed guestswhich would be devastatingto the area. Thefireworksareextremely important to thepeople staying in our resorts -they shop, eat out, rent boats, etc. We need the people,we need the fireworks. Youcan help. We are countingon community groups, localbusinesses and residents tokeep our fireworks show thebest inthecounty! Let’sshowoff our newly renovated #1beach!!! Partnershipsandsponsorshipsare available. Pizza Burn From time to time we see patients with mouth discomfort caused by eating and/or foods. We see burns, lacerations, scrapes and swellings which can interfere with eating, swallowing and talking. They can even break teeth and fillings/crowns, etc. Usually these discomforts are diagnosed with examination and a careful history. The things we consume can be too cold or hot, too sharp and poky, or too hard. Very occasionally they can be allergenic. The top three offenders are ‘Pizza Burn’ (also from hot liquids), ‘Triscuit Trauma’ and ‘Chewing Gum’ crowns. The big healers here are ‘tincture of time’ or repair the broken, loose or fractured area. Any injury lasting more than two weeks needs immediate observation. Avoid pizza burn? Cut up the first few bites until it’s cool enough to chow down. Almost all of these problems are preventable and avoidable. It’s up to you!

Shampoo and towel dry.... and you’re done! The style is in the cut, not the blow-

dry, so you don’t have to fuss with your hair to look good... even with fine, limp hair... and my new steam color process creates richer brunettes and spectacular blondes. The colors go deeper and last

In January, Abel’s Ice Cream store founders Bill and Norma Abel retired after nearly five years in business and passed the ownership baton to Jerry and Jill Williams to carry on the legacy of award-winning tastes and superb customer service. Throughout the past months, the Williams have had multiple conversations with longtime customers about Bill and Norma, which prompted them to create a memory board (pictured), where a note of well wishes could be jotted for the Abels. When they were presented with the framed piece, both Norma and Bill were deeply moved. “Norma and I would like to express our sincere appreciation for the very touching gift from you and the customers,” Bill said. “It will be treasured for the balance of our lives.” Jerry and Jill hail from the Midwest, and are now permanent Sarasota residents. The couple have thoroughly enjoyed their welcome to the community and the wonderful legacy that Bill and Norma created.

“Bill and Norma are such wonderful people, and they really teed it up for us,” Jerry said. “From the ice cream, fine chocolates, and gourmet food, to the cleanliness and service, we couldn’t have created a better business model. We hope the only change the customers notice is a couple of faces. We feel blessed to have this opportunity.” Speaking of wonderful people, Mother’s Day is just around the corner! If you’re looking for a gift that will have Mom smiling from ear to ear, Abel’s Ice Cream has you covered. All-natural, handmade chocolates from Sweet Shop USA are ready to go, or can be customized if you prefer. Stonewall Kitchen’s famous jellies, jams and chutneys are also on hand. And, of course, you can’t go wrong with fantastic pints and quarts of mom’s favorite ice cream, or a gift card so she can treat herself. Featured flavors in May are a

nod to Jerry and Jill’s own mothers, so make sure to enjoy Black Cherry (Deep black cherry ice cream exploding with Bordeaux cherries), and Mint Chip (Mint flavored ice cream with large chocolate chips). Abel’s Ice Cream is located at 1886 Stickney Point Road, 921-5700. Learn more about Abel’s Ice Cream online at www.abelsicecream.com and connect with them on Facebook and Twitter.

Landings Gazebo Fishing Record By Karl Maggard

Bob Mantiega and I participated in what we are declaring as a new “World’s (at least Landings) Record”.We had five grandchildren and six poles fishing off the gazebo.

As I told the kids: “that’s why we call it fishing and not catching!”
