It is assumed that each carrier on the tower pays for their own utilities. LWDD is not aware of what utility payments are made between American Tower and its tenants. As the tenant leases will terminate upon LWDD takeover of the tower, it will be up to the awarded respondent to determine how to address this in the leases with the subtenants as part of their agreement with LWDD. Information on tangible personal property taxes for each carrier can be found on the Palm Beach County Property Appraisers website at https://www.pbcgov.org/papa/ and searching on Tangible Personal Property using the following Tangible Account numbers:

    There is a separate utility meter for each provider on the tower. It is assumed that each carrier on the tower pays for their own utilities.   • Answer: The District prefers to receive payments over a 20-year period. Each respondent may submit up to one alternate fiscal proposal provided that it has submitted a proposal that meets the requirements in Exhibit D. Submission of more than a total of two (2) fiscal proposals may disqualify respondent from further consideration. A strong preference will be given to respondents who provide payments over the 20-year period.

    3. Question: Page 8, first paragraph states, “Regardless of the proposal accepted,

    the District will retain ownership of the tower or the option to take ownership rights of the tower at termination of the contract.” Page 9, Section K states, “Upon expiration of termination of the contract term, vendor will be responsible for the removal of the tower.” Please indicate which is preferred by the District.

    Answer: If the District does not exercise its option to take ownership rights at termination of the contract, vendor will be responsible for removal of the tower.

    4. Question: Page 8, Section F states there is a Memorandum of Understanding

    with Palm Beach County. Will you please provide a copy of that document?

    Answer: A copy of the document is provided in the attached. 5. Question: Please provide the latest Structural Analysis of the tower.

    Answer: A copy of a Structural Analysis of the tower is provided in the attached. LWDD does not warrant that this is the most recent structural analysis that has been done on the tower- only that it is the most recent one in LWDD’s possession.

    6. Question: Have any tenants provided notice they are going to remove their

    equipment prior to the end of the current sublease?

    Answer: To date, the District has not received any notice from current vendors regarding removal of equipment.

    7. Question: Will LWDD entertain a one-time lump sum purchase for a single

    payment and a term length of 20 years? Company will still uphold the rest of the manage duties but instead of the multiple annual payments with 3% annual escalations for 20 years, just a lump sum buy out.

    Answer: The District prefers to receive payments over a 20-year period. Each respondent may submit up to one alternate fiscal proposal provided that it has submitted a proposal that meets the requirements in Exhibit D. Submission of more than a total of two (2) fiscal proposals may disqualify respondent from further consideration. A strong preference will be given to respondents who provide payments over the 20-year period as requested.

    8. Question: Has Sprint or T-Mobile sent any correspondence about the renewal or

    a potential termination of their lease since this merger has taken place?

  • Answer: To date, the District has not received any notice from Sprint or T-Mobile regarding termination of their leases.

    9. Question: Do you know if there were any upgrades to the sites/equipment that

    was made to either of the two tenants recently, and if so, what were those upgrades?

    Answer: The District was notified in 2019 through 2020 of the following modifications to tower installations:

    20200207 – Sprint Nextel - Request for Approval of Proposed Installation of Backhaul Fiber Equipment

    20190923 – T-Mobile - Modification of existing Wireless Installation (remove and install)

    20190912 – AT&T - Upgrade Equipment at Existing Wireless facility (remove and install)

    20180212 – Verizon - Proposed modification of Equipment (remove and install) 10. Question: Are there any other amendments or agreements between American

    Tower Company and the village after the subsequent merger between Verizon and AT&T?

    Answer: A copy of a consent to sublease letter from American Tower is provided in the attached.

    11. Question: Is there a mortgage on the property?

    Answer: There is no mortgage on the property. 12. Question: As our legal department is based in California can you please clarify

    when the final submission for questions is? (Eastern or Pacific time)

    Answer: Submission deadline is Tuesday, December 15 at 2:00 PM Eastern Time.

    The purpose of this report is to summarize results of a structural analysis performed on the 200 ft self supported tower to reflect the change in loading by Palm Beach County / LWDD.

    Analysis

    The tower was analyzed using American Tower Corporation’s tower analysis software. This program considers an elastic three-dimensional model and second-order effects per ANSI/TIA-222.

    All engineering services are performed on the basis that the information used is current and correct. This information may consist of, but is not necessary limited, to:

    -- Information supplied by the client regarding the structure itself, antenna, mounts and feed line loading on the structure and its components, or other relevant information.

    -- Information from drawings in the possession of American Tower Corporation, or generated by field inspections or measurements of the structure.

    It is the responsibility of the client to ensure that the information provided to ATC Tower Services LLC and used in the performance of our engineering services is correct and complete. In the absence of information to the contrary, we assume that all structures were constructed in accordance with the drawings and specifications and that their capacity has not significantly changed from the "as new" condition.

    Unless explicitly agreed by both the client and American Tower Corporation, all services will be performed in accordance with the current revision of ANSI/TIA -222. The design basic wind speed will be determined based on the minimum basic wind speed as prescribed in ANSI/TIA-222. Although every effort is taken to ensure that the loading considered is adequate to meet the requirements of all applicable regulatory entities, we can provide no assurance to meet any other local and state codes or requirements. If wind and ice loads or other relevant parameters are to be different from the minimum values recommended by the codes, the client shall specify the exact requirement.

    All services are performed, results obtained, and recommendations made in accordance with generally accepted engineering principles and practices. ATC Tower Services LLC is not responsible for the conclusions, opinions and recommendations made by others based on the information we supply.
