The wisdom of the Legislature cf USD

When It comes to a question of moraldifferences such as the Advertiser tetsforth there are several phases of thosubject that inn be discussed withoutgoliuc outside the nulms of the unlitloom.

ADVERTISER HONESTY.

"Pending the trial of this charge thispaper will not discuss lis nieiltsT"

This sentenco appealed In u state-ment signed by Lorrln A. Thurston andpuhllkhtd at tho head of the Advertisercolumns on Wednesday, .May 22. Thesigned statement goes on to say thatEditor Smith has been cited byGrand Jury for perjury, gives thonf tho charge, announces Its Intentionto withhold from discussion of tho caseand denies tho charge.

Tho statement made on May 21 Is

fully In keeping with editorial dignitynnd honesty.

Lorrln A. who owns thoAdvertiser signed tho statement. Onowould naturally expcit that the asser-

tion amounted to something.""A Packed Grand Jury' Is the title

'Tho prcbent alleged Grand Juiy la

the first sentenco of tho double columneditorial telatlng to tho Giifnd Jurythat made the chaige.

On motion of Mr. Ualdwln, the reportadopted and then Mr. C. Brow

renorted ns follows for the sceclal committee to whom were referred the Hems

The special committee to whom wasreferred the following Items In the SonAppropriation bill Pay of Police ofHawaii, $65,000; Pay of Police of Maul, Bam$40,000: Pay of Police of Kattnl. $15,-00- 0

beg leave to report as follows:Your committee obtained from the

Auditing Department a complete copythe Itemized payroll for each of the

above Islands for the month or Aprilpast, and also had the High She' iffappear with the estimates made byhim, and upon which estimates thoflguroB submitted by the Governor and

forth In the Appropriation bill ar'based. of

Upon the examination of tho Item-lie-

payroll. It appears especially InDistrict of South Hllo, Island of

Hawaii, and In Walluku, Island itMaul, that tho pay of police officer Is

nt all uniform. The committee B

recommends to the High Sheriff thatInstruct the sheriffs of each Islandmake the pay of the police ns uni-

form ns possible, taking Into conslde- --

ntlon the rcrvlces required nnd thecost of living in each particular district. This committee from tho Information obtained bv them cannot npprove of tho payroll for tho District

South Hllo, among the Items Is pavn humane officer as well as a health

offlcer, as also that of a night patrol. The payroll for the month of April u'-s- o

showed that there were In additiontho regular force of twenty-fou- r

members, sixteen special policementhnt district who were receiving

salaries rnnglng from three to sovonty-fiv- e

dollars n month. The pay of a humane and health off-

icer or n night patrol, especially thelatter, wnere the poiico nro on dutyduring the night, we believe should notuo paid ny tne police department.

The High Sheriff's estimates showthat tho sums asked for aro necessaryfor tho proper and efficient conduct otthis department of the government, and your committee' believes that, taking Into consideration the progressnnd Increase In population of the past, and believing that It will continue Intho snmu ratio during the next blcnnhlperiod, tho money asked for eachof the Islands named and the pav oftheir police is ns llttlo ns can bo donewith, nnd should nny decrease be

! "jl erlou.ly Interferewith nnd seriously tho efficiency of this department.

Your committee therefore recommend that tho Items pass as In thodim.

In a discussion of nollco Items Inconnection with tho report, Mr. Drowndeclared that tho committee had look-ed Into tho various police Items andadmitted thnt there wns considerabledifference maintained In the apportionment or pay. lie further stated thattho High Sheriff bad appeared before '

tho committee and announced his Intentlon of readjusting tho wages paidpolice, and thnt In futuro more uni-formity would bo employed. Tim ma-jority of tho commlttco did not li- t-novo it wise to make a reduction Inthe poiico appropriation owing to theincreased cost or living and steadyaccession of population to tho variousdistricts.

C. BROWN.J. T. BROWN,WM. WHITE,J. D. PARIS.

I agree with the aboe except that Ibellee the sums asked for are toelarge.

DAVID KANUHA.On motion of Mr. Kalauokalanl. the

following amendment to the report wnsinndo and the report ndopted. na amended:

"That tho High Sheriff Is hereby re-

quested to make such reductions In thepayment of tho superior officers of thepolice departments in the different Isl

Authority of Cooper

As Acting Governor

Attorney General n. P. Dole yesterdayrendered an opinion addressed; "ToIlls Excellency Henry E. Cooper, Act'Ing. Governor of the Territory of

Tho opening of tho documentreads thus:

"I have the honor, at your request,to submit the following opinion asto whether you are Acting Governorwill all the powers, for the time be-ing, of Governor of tho Territory ofHawaii.

"It often happens that questions ariseIn the administration of public affairswhich ate matters ot opinion. In whichreasons and legal authorities pro andcon must be considered and a decisionreached by neighing ono lino of reasoning and authority against another. In regard to this matter I seo absolutely no room for a difference of opinion or tor the slightest doubt.

"Your authority as Governor restsupon Section 70 of the Organic Act,which Is as follows: 'That in case ofthe death, removal, resignation, ordisability ot the governor, or his o

from the Territory, tho secretaryshall exercise all tho powers and perform all the duties or governor duringsuch vacancy, disability, or absence,or until anothr governor Is appointedand qualified;' and upon tho following letter from Sanford n. Dole, forthe time being of theTerritory:

" 'Expcutlve Chamber, Territory orHawaii. Honolulu. May 11th. 1901.

'"Honorable Henry E. Cooper. Sec-retary of the Territory of Hawaii, Honolulu, II. T.

"Sr: Finding that tho Htato ofm"y health docs not permit n satisfac-tory performance of my ofllclal du-

ties, and being advised by my physi-

cian that n change to a cooler localitywith n complete relief from work Isimperative for tho restoration of myhealth, I request you, as Acting Gov-ernor, to assume tho powers nnd du-

ties of my omdal position until suchtlmo as I nm able to rcsumo them.

I enclose for your Information, acopy or tho letter ot or. c. u. w 000.referred to.

" 'Very respectrully,(Signed) SANFORD R DOLE.' "Tho Attorney General then quotes

a New Jersey decision, relative 10 lining vacancies In the common councilof the city of Newark. In this It wnsheld that tho word "disability" was"oxtcnslvo enough to cover, and wasdesigned to cover, any cnuso wnicnprevented the commissioners from act-ing." Further, this nuthorltv holdsthat, where nn omrlal's resignationhas been accented, "There Is In such nraso n disability, which may bo law-full- v

supplied."Then n New Hampshire decision Is

cited, the svIlnbiiR of which says:"The rhalr of the governor Is vacantnlthln the moaning of the 49th articleof the constitution, when his perma-nent or temporary disability nnd thonecessities of tho public service

his omrlnl duties to lio perform-ed by n substitute In this case Gov-ernor Ooodoll wroto to Attorney Gen-eral Rnrnnrd. saving. "Please takesuch stops as von think necessnry tornitse the president of tho Senate toexerclso tho powers ot tho ofllco otthe governor during tho vacancy caus-ed by my Illness. I nm not nblo tnperform tho duties of tho ofllco, andtho public service should not sufferfrom mv innbllltv." Tho quoted re-

marks of tho Chief Justice, In render-ing tho opinion, show thnt under thoconstitution ot New Hampshire thopresident of tho Scnnto waB "In fact, though not In name," lieutenant-governo- r

ot the State. It Is held by thesnmo nutnnrlty that rules of construction should not bo npplled tn wordsIn a constitution which would glvothem a different mennlng to that Intho mind of the people when adoptingtho Instrument.

"Tho mischief designed to bo prevented." by tho article under reviewof the New Hampshire constitution,"wns the suspension of exccutlvo gov-ernment by the governor's death, ab- -

senco from tho State, or disability, says tho Chief Justlco. adding, "Thoproscribed remedy Is tho duty of nsubstitute to net In cases of necessity.Trio services of n substitute may bonecessary when tho governor's

or disability Is temporary, nswell ns when It Is permanent."

MORE CARE NEIiDUD.

I3dltor Evening Dullctln; The deathdf Patrolman Wuluers tho direct re-

sult of an effort on his part to stop a1 mm way on tho streets of this city, brings to mind tho fact that such run-aways nrc altogether too frequent for acity ot tho size of Honolulu.

Ono of tho most pote'it factors In thismatter of ninanayb is the character ofpersons to whom licenses tiro grnntcd.Whatever the courso of examinationprior to granting such liccnsrs may he,

the fact cannot be disputed that a majority of runaways are caused ly Ignor- -

anco anil incapacity on the part nfdrivers. Tho llcenBlug of per-

sons for this class of duties on thopublic highways should lio preceded bya rigid examination (not 11 coaching)by tho person authorized to grant li-

censes.Such examination should be conduct-

ed by soma ono other than tho HackInspector, for, with all duo respect totho Incumbent of that olllce, it 'is

with tho proper dlschnrgoof his duties as an Inspector that hoshould have the licensing power tocreate the very conditions his Inspec-

torship Is to regulate. Aside from thisfact, tho vast Increaso nf hacks and automobiles makes ample work In thodirect lino ot Inspections.

Tho next factor in the mako up nftho "runaway contingent" Is tho absurdand cilmlnnl practice ot soma fondparents and guardluns who think itlooks "smart" and "cute" to seo a childof tender years holding tho reins overnn animal's hack ulillo tho rest of thefolks go Into a store to do their shop-ping.

Tho third factor Is tho person whoneeds no ndvlco as to how to drive-kn- ows

It all In fact and capable (Intheir own minds) to ride or drive any-

thing from n Mexican mustang to 11

double team nf recently Importedblooded stock."The death of W'ullinrs merits Inqiiliy
